M. by Chairman Webster. A, ROLL CALL Present: Cuua,issioners Anderson, Cowley, Crisp, Glenn, Kellum and Webster. Absent: Commissioner Johnson. B0 I~IN~TES C~u=ai~sioner Glenn moved, seconded by Commissiorer Crisp, that the readin~ of the minutes of the meeting of December 26, 1962, be waived and that the minutes be approved as prepared and submitted to the C~mnission; motion carried unanimously. C. ELECTION OF OFFICERS Chairman Webster opened nominations for officers for the coming year. Commissioner Crisp nominated Commissioner Webster as Chairman of the Plan- ning Commission for 1963. Commissioner Glenn moved, seconded by Comia- sicnet Anderson, that nominations be closed; motion carried unanimously. Commissioner Cowley moved, seconded by Con~nissionar Kellum, tha~ the Secre- tary be directed to record a unanimous ballot for Cu~.issioner Webster as Chairman of the Commission; motion carried unanimously. Commissioner Crisp nominated Commissioner Johnson as Vice-Chairman. nilere was a motion by Commissioner Glenn, seconded by Commissioner Cowley, that nominations be closed; motion carried unanimously. Cou~nissioner Kelhmn moved, seconded by Commissioner Crisp, thac the Secretary be directed to record a unanimous ballot for Commissioner Johnson as Vice-Chairman of the Commission; motion carried unanimously. -1- ~anrdx~ C~,,lsaion Minutes - January 14, 1963 - Conti~ued C, Cuu~issioner Anderson nominated Stanley Walker, Planning Director, as Secretary of the Con~nissiono Co~nlssioner Crisp moved, seconded by Com- missioner Cowley, that nominations be closed; motion carried unardmously, There was a motion by Commissioner Glenns seconded by Commissioner Ander- son, that the Secretary be directed to record a unanimous ballot. for Stan- ley Walker as Se.-Tetary of the Co~mtssionZ motion carried unanhn6usly, Cotmniss~oner Crisp moved tha~ the Commission recognize and express ciation for the faithful and effective services of the Plannlng Department Secretary, Evelyn Voges, Cornmfssioner Anderson seconded the carried unanhnously, Chairman Webster stated that Commissioner Anderson was sitting fd~ the last time as a member of the Saratoga Planning Commission,.,that he was one of the three remaining original members of the Counnission (the other two being Co~umissioners Crisp and Webster),,,that Cotnmissioner Anderson h~d contributed more, not only to the Planning C~u~uission but to the City of Saratoga, than any other man who had been a member of the Commission,,, that the Mayor had requested that he accept another term but he (Chairman Jqebster) respected Cou~nfssioner Anderson*s decision, for the benefit his health, to take a rest, Chairman Webster expressed personal apprecia- tion for services rendered, far beyond the nell of duty, and extended the sincere respec~ and gratitude of the City of Saratoga. Commissioner Crisp expressed wholehearted concurrence with Chairman ster/s statements, Conunfss~oner Anderson expressed apprecfa~ion ~o the Commissioners for their con~ents and stated that he had been genuinely interested in the Cit7 since its incosporation,,,bad enjoyed working with the members of both the Planning Co~m~ission and the City Council,,,that the years he had spent as a member of the Commission hnd been a pleasure and he regret- ted that it was necessary for hhn to leave at the end of his term (Janu- ary 21, 1963), The Coxmnission Joined Chairman Webster in a standing tribute to sicnet Anderson, PUBLIC HEARINGS Chairmen Webster declared public hearings open for the evening at 7:21 P, A, C-52 - Mason Crocker Corporation, Westover Drive - Change of Zoning from ~" to ~R-1-15~000 P-D" - Continued from December 1Or 1962 .. Mr. Mtttelmanwas present, together with his engineer, Bill Ka-,~u,~rling, t9 discuss this matter further with the Commission. They explained that Title Report descriptions were not always accurate, especially when the survey was made as far back as 1884, so desired the P-D zoning (even ~hough the tentative map indicated that all lots met the minimum require- monte for '~-1-15,000" zoning) to cover any discrepancies. It was the consensus of the Cur~uission that 1) discrepancies in the Title Report description would be minimal 2) '~-1-15,000" zoning would be more compatible with the surrounding area and 3) discrepancies in the tenta- tive map would not provide a valid basis for P-D zoning. Cvu~lssioner Crisp moved; seconded by Connntssioner Kellum, that the public hearing on 8~52 be closed; motion carried unanimously and Chairman Webster declared the hearing closed at 7:40 P. H. There was a motion by Con~nissioner Anderson, seconded by Comm{sCioner Crisp, that the Flaming Commission recon~nend to the C~ty Council that the parcel of land covered by ~pplication C-52, l~ason Crocker Corporation, be razened from ~" to '~-1-15,000". Roll call vote: Ayes= Conmmissioners Anderson, Cowley, Crisp, Clenn, Kellum, and Webster. Noes: None, AbSent: Commissioner Johnson. Plotion carried unanimously. B. tvP-45 - Our Lady of Fatima Villa, Saratoga-Los C, etos Road - Use Permit for Convent and Mltnis~ratton Building The public hearing on UP-45 was opened by Chaimn ~ebster at 7:43 F. The Secretary advised that notices of hearing had been mailed and there' was one (~) written con~unication on file. He briefly reviewed this plication~ then read the written conununication from Hrs. Laura Bertelson and a Staff Report pertaining to this nmtter. Fred Houseling, architect for the applicant, was present to discuss this application with the Commission. He explained that the new Convent and Administration Building would replace the existing building, and that this would complete the building prograd for Our Lady of Fatima Villa. In answer to a question from Commissioner Coylays the Secretary advised that he knew of no existing violations on the subject property. After discussion, Counissioner Crisp moved, seconded by Cvuauissioner Glenn, that the public hearing in connectionwith UP-45 be continued until the meeting on January 28, 1963, subject to appointment of a Com- mittee to study this matter and submit a report aC that meeting; marion carried ueanimeuslyo Chairman Webster referred this matter to the Design Review Co.~s~'..ittee, with the suggestion that they check the files for pertinent information from previous hearings, then request that the Building Inspector accompany them for an on-site inspection. On the basis of the foregoing, Chairman Webster directed SDR-381 continued until the meeting on January 28, 1963. B. SDR-384 - Fenton E. Silvey, Norton Road - Building Site Approval - 1 Lot - Continued from December 26e 1962 Connnissioner Anderson advised chat the site development plan requested by the City Engineer had not been submitted, so suggested that this matter be continued. The Secretary s~aced that he doubted that the applicant would have the site plan completed in time for the next meeting. Commissioner Anderson moved, seaended by Cv~Mssioner Crisp, that the ten- tatire map for 8D-388 (Exhibit 'A-I', filed January 4, 1963), Mason Crocker Corporation, be approved subject to the ten (10) conditions con- tained in the Subdivision Counnittee Report dated January 14, 1963; motion carried unan4-~uely. ~EN 14INURE RECESS E. .S. Sen~s, Saratoga Hills Road - Building Site Approval - 2 Lots - Continued from December 26~ 1962 The Secretary advised that the applicant had requested that this matter be continued until the moetin~ on January 28, 1963. Laflin, Allendale Avenue - Building Site Approval - _1 Lot The Secretary read a Staff Report explaining that the applicant had sub- mitted proof that the subject parcel was a lngal lot (having been estab- lished when the area was zoned for 10,000 square foot lots), and advised that the City Attorney had reconnended that the Comntsston reinstate the application (SDR-395) on their own motion and approve same. In view of this information, Cc~issioner Crisp moved, seconded by Com- missioner Anderson, that SDR-395, James H. hafltn, be reinstated; motion carried unanimously° lit. The Secretary advised that the site development plan requested by the City Engineer had not been submitted. On the basis o6 this ineot~nation, Commissioner Anderson recomnended that this matter be continued until the next regular meeting. M~. BroJm'was present and stated that it was his understanding that his engineer, Rod Weeteal1, had submitted the requested site development ~lan. After discussing this application, Connnisaioner Anderson moved, seconded by Commissioner C~isp, that the tentative map ~or SDR-397 (Exhibit 6fled December 19~ 1962), John P. Naltbys be approved subject to the con- ditions contained in the Building Site Coh~lttee Report of January 1963, as modified by substituting 6or Condition No. lI, E, the following: '~mer shall submit a properly si~ned and acknowledged indemnification agreement in a form acceptable to the City Attorney, acknowledging that the parcel is subject to 61oodin~ and that the ditch he has constructed will aSfect the 61ow into the culvert, and agreeing to indenmiSy the City o6 Saratoga, the County o6 Santa Clara and the County Flood Control Dis- trict against all liability for maintenance o6 the ditch and for flooding or water dmm~ge on the premises and on other lands occasioned by condi- tions on the premises. The indemnification agreement shall state that it is a covenant running with the land." Stutzman, Piedmont Road - Building Site Approval - 1 Lot Commissioner Anderson moved, seconded by Commissioner Glenn, that the ten- tatire map for SDR-399 (Exhibit '~", filed January 7, 1963) be approved subject to the conditions contained in the Building Site C~wmittee Report of January 14, 1963; motion carried unanimously, K. SDR-400 - Wm. MeK~nnon~ Pierce Read - Buildin~ Site A~proval - 4 Lots Mr. McKinconwas present and expressed satisfaction with the proposed cOn- ditions of approval. There was a motion by C~m~issioner Anderson, seconded by Connnissioner CriSp, that the tentative map for SDR-400 (Lots ~", '~"; '~" and "H" as shol~n on Exhibit '~", filed January 4, 1963) be approved subject to the conditions contained in the Building Site Ct~ittae Report dated January 14, 1963; motion carried unanimously. DESIGN REVIEW A. A-96 - Blue Hills Shopping Center, Saratoga-Sunnyvale Road - Design Appro- val - St~n - Continued from December 26s 1962 Mel Peterson was present (on behalf of the applicant) to discuss this matter with the Commission. The Design Review G~.~,~tttee advised that while they agreed that the Shop- ping Center was entitled to its identification sign, they did not feel that they wanted ~o reconnnend approval of the proposed sign because of the small, individual identification signs included, Mr. Paterson submitted an alternate sketch which did not include the in- dividual identifinstion signs for the various uses in the Center. The sign sho~nx on the alternate sketch was favorably received by ,the Com- mission, but the applicant was requested to re-submit the draving giving the additional data required by the Ordinance and which had appeared on the original drawing. Chairman Webster directed this matter continued until the next regular meeting to allow the applicant adequate time to re-submi~ the drawing. J. Fo Ross, applicant's representative, discussed this matter further with the Connission, Counissioner Glenn moved, seconded by Conmnissionar Cowley, that final architectural approval be granted A-88, Standard Ofl Company~ for a ser- vice station as sho%m on Exhibits "A-I" through '~)", consistixlg of detailed plans and color sketch, subject to the following conditions: 1)Fence height shall be as designated by the Design Review not less than 3 feet nor more than 6 feet, 2)Standing sign shall be the same size as the one at the Argonaut pir~ Center, Motion carried unaD4~usly, V, NEW BUSINESS Chairman Webster welcumed Councilman Fred Ritchie and Good Cove:~ment Group Representative Charles Smith to the meeting.
