M. A, ROLL CALL Preaent: Con~issioners Cowley, Crisp, Glenn, Johnson and Webster. (Com- missioner Webster arrived at approx~n~tely 7:03 P. M.) Absent: Commissioner Kellmn. Upon completion of roll call, Vice-Chai~man Johnson requested that Co~mis- sioner Webster ass,r,~- the Chair. C~issioner Glenn moved, seconded by Commissioner Crisp, that the readin~ of the minutes of the meeting of January 14, 1963, be waived and that the minutes be approved as prepared and submitted to the Co~ission; motion carried uuanimously. IIo PUBLIC HEARINGS Chairman Webster declared public hearings open for the evening at 7:05 P. M. UP-45 - Our Lady of Pat{-~ Villa, Saratoga-Los Gates Road - Use Permit for Convent and Ad~in_._!!tration Buildin~ - Continued from Januat7 14~ 1963 Co~nissioner Glenn advised that the Planning Director and Chief Building specter had inspected the site, and read their Staff Report pertaining to this matter. He further advised that the Design Revie~ C~,ittee had later visited the site and had learned that the matter of the continuous footings (referred to in the Staff Report) vould be corrected when the present construction was completed. He stated that it was the recommendatio~ of the Design Revie~ C~.~...~ttee that this Use Permit (UP-45) be granted. -1- Planning Conanission Minutes -.January 28, 1963 - Continued UP-45 - Our Lady of Fatqm~ Villa Cun~nlssioner Crisp brought to the attention of the Commission the t~o (2) con- ditions reconmended in the Staff Report submitted at the meeting on January 14, 1963. There was no one else present who wished to comeut with regard to this matter, Con~nissioner Glenn moved, seconded by Cormuissioner Johnson, that the public hearing on UP-45, Our Lady of Fatima Villa, be closed and thac the Use Permit be granted subject to the following conditions: l) Design Review Approval. 2) The City of Saratoga Plannin~ tomlesion shall retain continuin~ Jurisdic- tion over the Use Petenit herein granted and expressly reserves the right to, from time to time, modify, delete or make additions to any or all of the conditions thereof or to terminate or extend the Use Permit, either on its o~n motion or on the application of the applicant, in order to pre- serve a substantial right of the applicant or to preserve the health, safety, morals, convenience or welfare of persons residing or working in surrounding areas, or to preserve existing or prospective values or pro- perty and improvements, or to prevent a public nuisance. l~otion carried unanimously. Chairman Webster declared public hearings closed for the evening at 7~10 SUBDIVISIONS AND BUILDING SITES A. SDR-38~ - Robert Morgan, June Way - Building Site Approval - 3 Lots - Con- tinued from January 14p 1963 Co~hnissioner Crisp advised that the additional information requested from the applicant had not been submitted, so recommended that this matter be continued until the next regular meetin8. The Secretary read a letter from HermanMager, attorney for the applicant, requestir~ that this application be continued to a date beyond the meeting of February 11, 1963, since he ~ould be out of to~n until February 1963. SDR-381 - Robert Morgan On the basis of the foregoin~, Chairman Webster directed that SDR-381 be continued until the meeting on February 25, 1963. B. SDR~38~ - Cocciardi Corporation, Pierce Road - Building Site Approval - 4 Lots - Continued f~om January.~4~ 1963 lit. Cocciardi and Mr. Tobin were present and, after discussion, expressed satisfaction with the proposed conditions of approval. Comaissioner Crisp moved, seconded by Conmissioner Glenn, that the tenta- tive map for SDR-385 (Exhibit '~-3', filed January 14, 1963) be approved subject to the conditions contained in the Building Site Committee Report of January 28, 1963, as modified by adding ~%rlthin the subdivision" at the end of Conditions 2 and 3; motion carried unanimously. C. SDR-393 - George Somps, Saratoga Hills Road - Buildin~ Site Approval - ~.~ots - Continued from January 14~ 1963 Dir. Somps was present and expressed satisfaction with the proposed coedi- tions of approval. Commissioner Crisp move4,, seconded by Co~uissioner Glenn, that the tenta- tive map for SDR-393 (Exhibit 'Aol'. filed January 17. 1963) be approved subject to the conditions contained in the Buildin~ Site Comnittae Report dated January 28, 1963, as modified by substituting "and obtain approval of City Engineer" ~or "for approval of City Engineer" in Condition 1I, D; motion carried unanimously. D. BDR-396 - I4m. K. Brown, Pierce Road - Buildin~ Bite Approve1 - 1 Lot - Continu..ed from qanusry 14~ 1963 Comissioner Crisp advised that, since the applicant planned to sell th~ property, it was decided that the site development plan previously reques- ted from Nr. Brown should be submitted by the new owner prior to applying for a Building Permit. Commissioner Crisp moved, seconded by Commissioner' Johnson, that the ten- ~ative map for BDR-396 (Exhtbi~ '~', filed December 14, 1962) be approved subject to the conditions contained in the Building Site Cormnittee Report of January 28, 1963, as modified by substituting "and obtain approval of the City Engineer" for "for approval of City Engineer" in Condition lI, C; motion carried unavtmously. -3- PlanninE C~ission Minutes - January 28~ 1963 - Continued E. SDR-401 - Arthur Strametz~ Sobey Road - Buildin~ Site Approval - 1 Lot Mr. Stremetz was not present. After discussion, Conwnissioner Crisp moved, seconded by Commissioner Glenn, that the tentative map for SDR-401 (Exhibit .~s,, filed January 17, 1963), Arthur Strametz, 1 lot on Sobey Road, be approved subject to the conditions contained in the Building Site Conrmittee Report of January 28, 1963; motion carried unanimously. F. SDR-402 - Alex Swanson, Saratoga Hills Road - Building Site Approval - 1 Lot Mr. Swanson was present and expressed satisfaction with the proposed con- ditions of approval. There vasa motion by Connissioner Crisp, seconded by Commissioner Glenn, that the tentative map for SDR-402 (Exhibit "A", filed January 18, 1963) be approved subject to Conditions I and II, 'A' through ~'~, of the Building Site Coawaittee Report of January 28, 1963; motion carried unanimously. G. SDR-403 - Frank Xsidorow Canyon V~ev ~rive - Buildin~ Site Approval - i Lot Mr. Isidoro was present and expressed satisfaction with the proposed con- ditions of approval. Conm~isstoner Crisp moved, seconded by Commiss~oner Glenn, that the tenta- tive map for SDR-403 (Exhibit "A", filed January 18, 1963) be approved subject to Conditions I and II, s~. through s},,, of Building Site Counittee Report of January 28, 1963; motion carried unanimously. DESIGN REVIEW A. A~96 - Blue Hills Shopping Center, Saratoga-Surmyvale Road - Design Appro- val - Sign - Continued from January. 14~ 1963 Mr. Richardson was present to represent the applicant and discussed this matter further ~ith the Commission. There was a motion by C~,tssioner Glenn, seconded by Cv~tsstoner Johnson, that A-96, Blue Hills Shopping Center Sign, be approved as shown on Exhibit "A-I", subject to the following conditions: -4- PlanninR Couauission Minutes - January 28~ 1963 - Continued IV, A, A-96 = Blue Hills Shoppin~ Center 1) Illumination to be restricted to 430 milli~eres, 2) Location and size of sign to be approved by City Planning Department for compliance with existing ordinance. 3) Existin~ sign to be removed, Motion carried unanimously, B, A-97 - Ann Parker Valk, Big Basin Way - Design Approval - Shop for Acces- sories..~nd Interior Design Services Mr, Winston and Mrs, Valk were present to discuss this matter with the Commission. The Design Review Cummittee advised that unless further arrangements were made for parking, they would be unable to recommend approval of this ap- plication. It ~as suggested that the applicanC discuss the poasibilitits for additional parking ~ith the Plannin~ Director. Commissioner Glenn further advised that the Design Review Cormnittee would like to meet with the applicant when adequate parking arrangements had been made. On the basis of the foregoing. Chairman Webster directed A-97, Ann Parker Valk, continued until the meeting on February 11.. 1963, to allow the ap- plicant adequate time to work out the parking plan. C. A-98 - Thelma Duri~hello. Prospect Avenue - Design Approval - Beauty Salon ~e Secretary briefly reviewed this application, Commissioner Glenn advised that the Design Review Committee could not recommend approval of this application as shown, since all requirements of the ordinance had not been met. After discussion, Chairman Webster directed A-98.. Thelma Durighello, con- tinued until tile meeting on February Ii. !963, end instructed the Planning Director to contact the applicant a~ request a revised drawing showing parking and other items required by the ordinance. X~. Kauffmann and his engineer, Mo Lo Splitstone, were present to discuss this matter with ~he Commission. They explained that the existing model homes would be used for development of the enti~e subdivision and they ~mre requesting the encroachment permit (for el~nation of paving and temporary use of prorestive planting on a portion of the bulb of Ingrid Court) for the period of time that the model homes were being used. After discussion, Chnix'r.r~U Webster moved, seconded by C~issioner Johnsons that the Planning C.'~p.~.tssion approve the encroachment of the planted circle in ~he cul-deosac at Ing:id Court subject to such bond as might be set by ~he Directo~ of Public Works to ~eure r~..-.val at the expiration date of the permit for the existing model homes; mo~on ear- tied ,,n~nimously, After discussion ~ega~ding the request for revision of Condition No. 9 of SD-327s H~, Kauffmann withdrew his request, He stated that he had misinterpreted the intent of this condition, and although the roses and grapes had already been plated along the fence, he would be happy to plant t-~ro (2) tncees within each of the lots along P~ospect Avenue. After discussion, Cu~.issioner Glenn moved, seconded by C~u~issioner Johnson, that design approval be granted for the subject fence as sh~n on the sketch submitted (Exhibit '~"), subject to compliance with O~di- eance NS-3; motion p~_~ried unanimously. Hinest Sobe. y ..Road - Reque..st .for Ex~ension The Secretary read a letter from lifo Hines stating reasons for needing the extension previously requested. After discussion, Cu~issioner Crisp moved, seconded by C~mnissione= Glenn, that a ~o~al of one (1) year extension be granted in conn~c~ion with SDR-293, ~-king the new expiration date January 8, 1964; motion carried unanimously, 2. The Secretary read a copy of a letter to the Santa Clara County Plan- ning C~auission, signed by approx~m-tely 25 residents of Saratoga, opposing the rumored riding academy abutting Saratoga in the Bohlmann Road area° ~he Secretary advised that he had contacted County Planning and no wgplication had been filed in connection with this matter. He further advised that if an application was filed in the future he felt sure that the Saratoga Planning Department would be advised, since the County always notified the City of Saratoga of any such application. At the suRestion of Co-~t ssioner Glenn, Chairman Web,toT requested that the Secretary obtain all available information pertaining to this matter for a report to the Commission at the next regular meeting, and be prepared to make a recu.~endation as to what action should be taken by the Co~Assion, if any.
