ZAT40N Tan meeting was callea to order by Vice Chairman Johnson at 7:00 A. ROLL CALL Present: Cuu~uissioners Cowlay, Crisp, Glenn, Johnson, Kellum and Norton. (Cv~lssioner Webster arrived at approxi- mately 7:05 P. Absent: Commissioner Webster. B. MINUTES Cou~nissioner Glenn moved, seconded by C~mnissioner Cowley~ that the reading of the minutes of June 10, 1963, be waived and the minutes be approved as sub~i~ted; motion ca~.~ied unan~-~usly, PUBLIC H~.ARINGS The Chairman declared public hearings open for the evening at P. M. C-57 - Virgil R. Herring, Big Basin ~4ay - Change of Zoning from '~ro- fessional-Administrative" to "Community Cv~ercial" - Continued from June 10, .1~963 ...... The Secretary advised that a revised Notice of Hearing had been pub- lished and there were several written communications on file. He read 1) letter from the applicant explaining the revised application 2) letter from Mrs. Rosalie M. West requesting tha~ her name be with- dr~wn from the application 3) letter from =he Saratoga Merchants Association favorin~ the subject change of zoning 4), 5) and 6) let- ters from Mrs. Alma L. Loze, Artus 14etzger and Mrs. Barbara Caldwell protesting the proposed change of zoning and 7) petition favoring the subject application with signatures of 42 Saratoga residents. -1- Pl.~nin~ Commission Hinu~as - June 10~ 1963 ~ Continued II. Q:57 - Vi~Kil R. Herrin~ Commissioner Webster arrived and, a~ the request of Vice Chairman Johnson, assumed the Chair. JACK EOP~A~, representin~ the applicant, 1) discussed the revised application with the Commission 2) explained that there was little property available for small business firms and 3) advised that 12 of the 15 property owners in the area had signed the application. ROBERT IDEALS stated that he felt the rezoning of this section of Big Basin Way was inevitable, that only the time element was in question, He observed that Saratoga could well be proud of the shop recently opened by Mrs, Ann Perker Valk, and that Hrs. Barbara RcKenziess pro- posed new shop would be another asset to the City, He advised that only four or five houses in the area in question were being main- rained as one-family residences and he would like to see the Commis- sion give this application favorable consideration. In answer to a question from Corsnissioner Norton, Mr. Neale advised that not more than 5Z of the Antique Shop customers were residents o£ Saratoga. Commissioner Norton then referred the Commission to Sec- tion 1.1 of Ordinance NS-3, Co~snissioner Crisp advised 1) to approve the subject application in its present form~ould constitute spot zonin~ 2) non-conforming uses would be created with regard to the existing residences and 3) taxes ~ould be raised for tl~se people retaining homes in the area. Commissioner Glenn suaEesCed gha~ ~his matter be deferred until after the General Plan metin~ on July 1, 1963. Commissioner Crisp and the Planning Director concurred with Connnis- signer Glenn, and further augSeated that the matter be referred to a Comittae for study and a report. leS, BAKBABA CALD~LL stated that the Tax Office had advised that there would be an appreciable tax increase if the proposed change of zoning was approved. MRS, RUTH OldEN questioned the possibility of all the older homes in the area being converted to Antique Shops and Design Studios within the next ten years, Planning Commission M~nutes - June 10, 1963 - Continued IT. Hezrin~ Chairman WebSter, with concurrence of the Con~lSSion, referred this matter to the Subdivision Committee for further study and a report, then directed C-57 continued until the meeting on July 8, 1963. The Chairman declared public hearings closed for the evening at 7:45 P. DL III. SUBD.IVISIONS AND BUILD.ING .S. ITES SDR-424 - Earl J. Peter, ,tune Way - Building Site Approval - 3 Lots - Reinstated . . ~le applicant was present end expressed satisfaction with the proposed conditions of approval. Conmlissioner Crisp moved, seconded by Commissioner Glenn, that the tentative map for SDR-424 (Exhibit "A", filed May 1, 1963) be approved subject to the conditions outlined in the Building Site Coum,ittee Report of June 24, 1963l motion carried unaD4mnusly. IV. DESIGN .REVI~4 A. A-111 - Dr. Max Robbing, Medical Village (Lot 8) - Preliminary DesiRn Re~.iew - Office Buildin~ Commissioner Cowley advised that the Design Review Commmittee had reviewed this application and felt 1) the plans were acceptable 2) there should be no fences alonE SaratoEs Avenue for the entire frontaEe of this development and 3) screens should be allowed close to the buildings where needed. The Cuu~uission discussed the desirability of e fence to prevent access from Saratoga Avenue. The Secretary advised that a decorative fence was one of the con- ditions of approval of the tentative map. Chairman Webster stated that he~ personal!y~ ~;ould prefer not to have fences if parkinE along SaratoEs Avenues as well as access from Saratoga Avenue, could be prevented. He also stated that he felt the City Council miEht chan~e the condition requirin~ a decorative fence on the basis of a recommendation from the Plan- ning Commission. A-111 - Dr. Max ,R. obbi..n.s After further discussion, Commissioner Cowley moved, seconded by Commissioner Johnson, that preliminary design approval be granted A-Ill, Dr. Max Robbins, for the proposed office building, but that this approval exclude the fences, pathways, etc. shown on the exhibits; motion carried unanimously. B. SS-31. - Marshall S. Ward, Fruitvale Avenue - Design Review - Tem- porary Subdi. v. ision SiMn for Montecito Glen In answer to a question from Commissioner Cowley, the Secretary advised thst the proposed sign was intended as a single face sign. Connnissioner Cowley roared, seconded by Commissioner Johnson, that design approval be granted 88-31, Marshall S. Wards for a single face sign as indicated on Exhibits "A" and "C"; motion carried unanimous ly. V. NEW BUSINESS Chairman Webster acknowledged, with pleasure, the presence of Mrs. Ruth Owen, Good Government Group representative. T.:e CILair. imn called attention to the meeting on July 1, 1963, to dis- cuss possible revision of the G~neral Plan. VI, OLD BUSINESS A. SDR.-4.11 - Desmo.nd Johnson, quito Road - Requ..est for Clarification The Secretary read a report from the Subdivision Commit~ee with regard to the applicant's request for clarification of Condition II, C. Commissioner Crisp moved, seconded by Comissioner Johnson, that the report of the Subdivision Cvah,~Lttee with regard to the modifi- cation of Condition II, C, be adopted by the Commission and trans- mitted to the C,ty Council as the recommendation of the Commission; motion carried unanimously. B. SDR-397 - John P. Maltbys Woodbank Way - Request for Modification The Secretary advised that a request had been received in connec- tion with Condition II, E. Plannin~ Cou.~lssion Minutes - June 10~ 1963 - Continu.ed VI. B. SD~-397 - John P. Maltby Coz~issioner Crisp briefly explained that the applicant had been unable to sell this lot because of Condition II, E~ andhad quested that the Commission establish the necessary steps rect this situation so that this condition could be omitted. He further stated that the City Engineer would submit a report in the near future for the Commission's consideration. VII. MICATION8 A. WRITTEN SD-347 - Dr. Isaac N. Abrams, Saratoga Avenue - Request for Modification The Secretary read a letter fremDr. Warren Sturla requesting that the Co~mission approve a modification of the tentative map for SD~347. Chairman Webster referred this matter to the Subdivision Commit- tee for study and a report at the meeting on ~uXy 8, 196S, than directed the matter continued unti~ that time. B.
