ROUTINE ORGANIZATION In the absence of the Chairman and Vice Chainnan, Co~issioner Norton was appointed Chairman p~o tom. The meeting was called to order by Chairman Norton at 7:35 P. M, A. ROLL CALL Present: Connnissioners Cowley, Crisp, Glenn, Kellum, and Norton. (Com- missioner Webster arrived at approximately 9:45 P. M.) Absent: Commissioners Johnson and Webster. B. MINII~ES Commissioner Glenn moveds seconded by Commissioner Crisp, that the reading of the minutes of November 26, 1963, be waived and that the minutes be approved subject to the following modification: Page 5...paragraph 2 under C-63...subsection 6)***insert 'as far as pos- sible' between ~roperty" and "and". l~tion carried unanimously. II. PUBLIC HEARINGS ~e Chairman declared public hearings open for the evening at 7:37 P. M. A. UP-55 - Brookside Club of Saratogas Cox Avenue - Use Permit for Additional Parking and Modification of Existing Use Permit - Continued from November 26~ .19~3 Messrs. Held and Oustezman ~ere present to represent the applicant. UP-55 - B,rookside Club of Saratoga Since there was no one present who wished to comment with regard to this applications Conunissioner Glenn moved, seconded by Con~nissioner Kellums that the public hearing on UP-55 be closed. Dbtion carried unanimously and the Chairman declared the hearing closed at ?|46 P. M. Commissioner Crisp moved that the Subdivision Committee Report of Decem- ber 9, 1963, relative to UP-55 be approved and that this Use Permit be granted subject to the terms and conditions outlined in the report, Com- missioner Kellum seconded the motion which carried unanimously. B. 9762 - Warren D. Porter, Jr., Fifth Street - Change of Zoning from R-M-3,000" (Multiple Residential) to "C-C" (Community Commercial) - Continued from November 26w 1963 The applicant was not present. The Secretary advised that to date the applicant had been unable to meet with the Subdivision Committee as requested so suggested that this matter be continued to allow further time for this meeting. There was no one present who vished to cement with regard to this appli- cation for change of zoning. On the basis of the Secretaryms suggestion, Chairman Norton directed C-62 continued until the meeting on December'23, 1963. C. C-63 - Crest Development Company, Prospect Avenue - Change of Zoning from "C-S" (Commercial St=vice) to "C-N" (Neighborhood Con~nercial) - Co__ntinued frog November 26~ 1963 The Secretary briefly reviewed this application and read a connnunlcation from Mr. end Mrs. R. Greene opposing this proposed change of zoning. Chairman Norton read the Subdivision Conunities Report of December 9, 1963, pertaining to this matter. Mr. Schaffer was present to represent the applicant and advised that it was not their intention to duplicate stores already established in Sara- toga buts instead, to bring in branches of some of the larger stores. ~e further advised that they had not made contact with these firms since they had nothir~ to offer until the zoning was changed. C_-6__3 - C_rest Development Company After further discussions Commissioner Glenn moved, seconded by Coumis- sioner Crisp, that the public hearing on C-63 be closed. Motion carried unanimously and the hearing was closed at 8:03 ~. M. Commissioner Glenn moved that the Subdivision Committee Report of Dacem= be= 9, 1963, relative to C-63 be adopted and transmitted to the City Council with a recommendation that the application be denied on the basis thatthe proposed change of zoning was inconsistent with the objectives of the Zoning Ordinance and the General Plan. Commissioner Cowlay seconded the motion which carried unanimously. Commissioner Crisp stated that he felt that the entire Commercial Service Zone should be given further thought, so suggested that the Secretary be directed to place this item on the agenda for the General Plan Review next year. After discussion, Chairman Norton so di=ected. D. ~-64 - Virgil R. Herring, Big Basin Way - Change of Zoning from '~-A" (Professional-Administrative) to "C-C" (Community Commercial) - Continued from November 26. 19~3 The Secretary briefly reviewed this application and read a letter addressed to Mr. Herring giving him notice of eviction as of January 1, 1964. Commissioner Crisp read the Subdivision Committee Report of December 9J 1963, relative to C-64. Commissioner Glenn suggested that Item 4J as of the report be revised to read as follows: '~roperty shall be limited in use to that of ~Antique Shop and Art Galleryw and suitable off-street parhing shall be provided on the property." The Subdivision Committee concurred with this suggest:ion and the report was modified accordingly. Since there was no one present who wished to comment with regard to this matter, Commissioner Kellummovnd, seconded by Commissioner ~lenn, that the public heari~lg on C-64 be closed. Herring Commissioner Kellummoved, seconded by Commissioner Crisp, that the Sub- division Committee Report of December 9, 1963, relative to C-64 be adopted and transmitted to the City Council as the recon=aendation of the Commis- sion; motion carried unanimously. E. V-233 - Dr. Richard A. Wallace, Juniper Lane - Variance to allow 10~ Side Yard Setback in lieu of the required 15' - Continued from Novem- ber 26? 1963 After the Secretary briefly reviewed this matter, Commissioner Kellum stated 1) the Variance Committee had visited the site 2) it was the consensus of the Couunittee that the findings required by law for the granting of a Variance could not be made and 3) it was the reco=menda- tion of the Variance Committee, therefore, that this application be denied. Ihere was no one present who wished to comment further with regard to this matter. Commissioner Crisp moved, seconded by Commissioner Cowley, that the public hearing on V-233 be closed. Motion carried unanimously and the hearing was closed at 8:21Po M. Commissioner Crisp moved that V-233, Dr. Richard A. Wallace, be denied since the findings required by law for the granting of a Variance could not be made, Coran~issioner Glenn seconded the motion which carried unanimously. F. V-~34 - Moser end Long, Marion Road - Variance to allow 90' Site Width in lieu of the required 1001' The hearing on V-234 was opened at 8:24 P. M. The Secretary advised that Notices of HearinE had been mailed and there were no written communica- tions on file, He briefly reviewed this application and advised that it had been filed in conjunction with a Building Site Approval application. Mr. Stanley Hopper was present to represent the applicant and explained that without a Variance Mr. Creek would be deprived of this lot since the access road shown on the tentative map for SDR-450 made this a corner lot requiring 100 feet width. He further explained that the subject lot contained the required area for a corner lot so was non-conforming in width only. Plannin~ gornui@s~on Ninutes r. December 9w. 1963 - Continued II. F. V-234 - Moser and Lon~ Counissioner Kellum stated 1) after careful study of this situations the Variance Committee felt that there was a definite physical hardship involved since 2) the property lies between an existing residence and an access road and there is no possible way to alter the lot lines so that this lot will conram. On the basis of these findings, it was the recouuuendation of the Variance Committee that this application be granted. There was no one present who wished to comment with regard to this matter. Couuissioner Crisp moved, seconded by Comnissioner Glenn, that the public hearing on V-234 be closed. Motion carried unanimously and the hearing was closed at 8:34 Y. M. Comissiouer Kellum moved, seconded by Commissioner Crisp, [hat V-234, Noser and Longs be granted since the findings required by Section 17.6 of Ordinance NS-3 could be made; mo~iou carried unanimously. G. V-235 - Richard Cornelius, Via Real Drive - Variance to allow 5' Side Yard Setback in lieu of the required 1q' The public hearing on V-235 was opened at 8:39 P. M. The Secretary advised that Notices of Hearing had been mailed and there were no w~itten comuuicatiens on file'. He then reviewed this application. Gene Kale was present to represent the applicant and explained that the existing 15' P.U.E. through the property created the need for the Variance. Cemmiesioner Kellum advised that, based on ~he tuformation available, the Variance Co~mnittee felt that the required findlugs could uot be made. Commissioner Crisp stated that he felt the pool could be designed to better advantage for the available space. The Commission concurred with this s~atement and Mr. Ka~e agreed to redssign the pool in an to make it conform. On ~he basis of the foregoing, Chairman Norton directed this matter con- tinued until the meetin~ on December 23, 1963. SU~D!V~SIONS AND BUILDING SI~ES A. ~DK~450 - Jerry Kocir, Marion Road - Building Site Approval - 3 Lots - ~~ - Continued from November.26~ 1963 Commissioner Crisp moved, seconded by Commissioner Kellum, that the revised tentative map for SDR-450 (Exhibit '~-2", filed October 30, 1963) be approved subject to the conditions outlined in the BuildinE Site Com~ mittee Report of October 14, 1963; motion carried unanimously. B. ~DR-453 - Multi-Building and Development Corporation, Ambric Knolls - BulldinE Si~e Approval -. 1 Lot - Continued from November 26, Commissioner Crisp advised tha: the applicant was trying to work out a problem relative to a septic tank permit, so suggested ~hat this matter be continued until the next regular meeting. BT~atar, Sobey Reed - Buildin~ Site Approval - 2 L~ts ~ Continued from November 26~ 1963 Mr. Bywater was present and expressed satisfaction with the proposed conditions of approval. Con~nissioner Crisp moved, seconded by Commissioner Kellum, that the Building Site Committee Report of December 9, 1963, relative to SDR-460 be adopted and thst the tentative map (Exhibit "A", filed November 13, 1963) be approved in accordance with the site development plan (Exhibit "B", filed December 9, 1963~ subject to the conditions outlined in the Building Site Committee Report; motion carried unanimously. D. SDR-462 - A. Thoma~..Barrie. Pierce Road - Building Site Approval - ~ Lot Co~sissioner Crisp advised that the Building Site Committee had requested that the applicant submit a revised map, so recommended that the matter be continued to allow the applicant sufficient time to comply with this request. The Secret~.ry read a petition with signatures of 12 residents of the Paramount Drive area which had been filed in opposition to the subject application. Thomas Barri~ Chairman Norton explained, with reference to the petition, that Mr. Barriers property was located in the '~-1-12,500" ZoninE District and the Comm~ission had no authority to change it. He suggested that they discuss this matter ~gith the City Council if they ~ished to pursue it further. The Chairman then directed SDR-462 continued until the meetins on Decem- ber 23, 1963. E. SDR-463 - Francis Minshall, Saratoga Avenue - Building Site Approval - 2 Lots The Secretary advised that the applicant had been present earlier in the eveninE and had expressed satisfaction with the proposed conditions of approval. Cor~issioner Crisp moved, seconded by Co~nission Kellum, that the Buildin~ Site Committee Report of December 9, 1963, relative to SDR.-463 be adopted and that the tentative map (Exhibit "A" filed November 29, 1963) be approved subject to the conditions outlined in the BuildinE Site Committee Report; motion carried unanimously. IV. DE.__S. IG~REVI~4 ~127 - First Valley Ban~s BiN Basin Iqay - Design Review - Sign The Secretary read a Staff Report stating that the proposed sign met all requirements of the ordinance, but that because of the size of the proposed sign it would be necessary to remove the existina signs when the new one was installed. After discussion, Commissioner Cowley moved that A-127, First Valley Bank, be approved subject to removal of all existin~ exterior signs. Commissioner Glenn seconded the motion which carried unanimously. V. CITY ~OUNCIL REPORT Commissioner Glenn gave a brief report on action taken at the City Council meeting on December 4, 1963. VI. NEW BUSINESS Off-Site D. irectional Si~ns re Points of Publi.c lnterest The Secretary displayed a design proposed by the Ferro-Enamelin~ Company for off-site directional signs for points of public interest. -7- PlanninR Commission Minutes - December 9~ 1D63 - Continued VIo Off-Site Directlone! Sin~ He explained that the size of the proposed design was slightly larger than the standard approved by the Commission since their letters would not fit the adopted standard. The consensus of the Commission was that no increase in the size of the sign would be acceptable. Therefore, the Chairman directed that the Secretary return the sign and request that it be redesigned in accordance with the approved standard. VII. OLD BUSIE~SS VIII., COb=4UNICATIONS A. WRITTEN 1. SpR-45.8. - Paul Swanson, Farwell Avenue - Request for Reconsideratip,.n. The Secretary read a Staff Report pertaining to this request for reconsideration. After discussion, the recommended revision of Condition II, C, was modified to read as follows: "Dedicate and improve Farwell Avenue to provide for a 25 foot half-street (25 foot half-street right-of-way with 13 foot half--street improvements), improvements to be made on north side of existing paving, along the entire frontage of the property (a distance of approximately 475 feet) as per requirements of the City Engineer." Co~mmissioner Crisp moved, seconded by Commissioner Kellum, that the Staff Report of December 9, 1963, relative to SDR-458 be adopted as modified and transmitted to the City Council as the recon~nendation of the Commission; motion carried unanimously. Commissioner Webster arrived during the discussion of Mr. Swanson's request for reconsideration. 2. UP-42 - United Presbyterian Church, Saratoga-Sunnyvale Road - Request for Extension The Secretary read a letter from Reese M. UP-~2 - United Presbyterian Church Commissioner Crisp moved, seconded by Commissioner Kellum, that the one (1) year extension in connection with UP-42 be granted as requested; motion carried unanimously. 3. UP-44 - St. Andrews Episcopal Church, Saratoga Avenue - Request for E~tension The Secretary read a letter requesting an extension in connection with UP-44. Commissioner Kellummoved, seconded by Commissioner Gtenn~ that an extension of one (1) year from date of expiration be granted in con- nection with UP-44; motion carried unanimously. 4. C-54 - Robert Neale~ Saratoga Avenue - Request for Removal of Restriction on.'t-C" Zon~n~ The Secretary read a letter from Robert Neale and John Ostrowski requesting removal of the use restriction placed on Mr. Neale's pro- perty under C-54. Mr. Neale and Mr. Ostrowski were present to discuss this matter with the Commisslon~ and advised that Mr. Ostrowski had bought the pro- perty and desired to use the building as a Real Estate Office. After discussion~ Chairman Norton directed this matter continued until the meeting on December 23, 1963, and referred same to the Subdivision Committee for study and a report at that time. B. ORAL IX. ADJOURNmeNT Commissioner Glenn moved, seconded by Commissioner Cowley, that the meeting adjourn; motion carried unanimously and the Chairman declared the meeting adjourned at 10:10 P. M.
