M., Monday, January 27,. 1964 PLACE: Saratoga High School, Herriman Avenues Saratoga, California TYPE: Regular Meeting I. ROUTINE ORGANIZATION The meeting was called to order at. 7:30 P. Mo by Chairman Norton. A. ROLL CALL Present: Commissioners Cowley', Crisp, Glenn, Kellum and Norton' Absent: None. B° MINUTES : Commissioner Crisp moved, seconded by Commissioner Cowley, that the reading of the minutes of January 135 i964 be waived and that the minutes be approved as submitted; motion carried unanimously. Chairman Norton stated that no changes would be made in the various com- mittees at the present time since the Council had not yet appointed the two new Commissioners. He designated Commissioner Kellum Acting Chair- man of the Variance Committee until permancn~ appointments were made. The Chairman stated that he was aware that a number of people in the audience had artended because of an interest in UP-60, application of Mrs° Clara Andersen, Pierce Road, for a Use Permit for a maximum of three lodgers or boarders. For the convenience of the interested parties, he then explained that there wouldbe no discussion in connection with this application since it had been'withdrawn prior to the meeting. At the request of the Chairman, the Secretary read the letter of withdrawal, ADRIEN L° ANDERSON, Craigen Circle, questioned abatement of the existing violation since Mrs, Andersen had one boarder at this time. Chairman Norton advised that the City was aware of the violation and it would be dealt with through regular channelS° A show of hands among the inter- ested parties indicated that thosepresent had a~tended to oppose the application, in support of the petitions filed in protest. II° PUBLIC HEARINGS A, C-62 - Warren D. Port.er, Jr. Fifth Street - Change of Zoning from "R-M-3,000" (Multiple Residential) to "C-C" (Community Commercial) - Continued~ from January 13~ 1964 The Secretary briefly reviewed this application then read a Staff Report pertaining to same, Plannin~ Commission Minutes - Januar7 27, 1964 - Continued IX. A. C-62 - Warren D. Porter~ dr. Mr. Porter was present and expressed willingness to have the use of the property restricted to the uses listed in the Staff Report. There was no one else present who wished to comment with regard to this matter° Commissioner Crisp~ on behalf Ofnthe Subdivision Committee, explained 1) the subject property is located in back of the Saratoga Carpet Shop 2) approximately one-third of the lot lies within the "C-C" Zoning District 3) the Commit]tee felt that it would be undesirable to open this property to certain uses permitted in the "C-C" Zone 4) through discussions with the applicant the Committee had arrived at the list included in the staff Report and 5) it was the recom- mendation of the Committee that the Commission recommend "Conditional C-C" zoning for the subject property, restricting use of the property to those uses listed in the Staff Report. Commissioner Crisp moved, seconded by Commissioner Cowley, that the hearing on C-62 be closed° Motion carried unanimously and the hear- ing was closed at 7:44 P. M. Commissioner Crisp moved~ seconded by Commissioner Cowley, that the Staff Report of January 27, 1964 relative to C-62 be adopted and transmitted to the City Council as the recommendation of the Com- mission; motion carried unanimously. Commissioner Kellum explained to those present that conditional zoning was usually restricted to one use but that in this instance, the Commission felt that any of the uses on the list would be appropriate for the subject property. B. UP-59 - Sto Andrews Episcopal Church, Saratoga Avenue - Use Permit for Portable Classroom for Educational Use The public hearing on UP-59 was opened at 7:48 P. M. The Secretary advised that Notices of Hearing had been mailed and there were no written communications on file. He then read a Staff Report per- taining to this matter° There was no one present to represent the Church, but the Secretary advised that representatives had planned to attend and would no doubt be present later in the evening. UP-59 - Sto Andrews Episcopal ChurCh Commissioner Cowley moved~ seconded by Commissioner' Kellums that the public hearing on UP-59 be closed. Motion carried unanimously and the hearing was closed at 7:53 P. M. After'further discussions Commissioner Cowley requested that the Design Review application filed by the Church be considered together with the Use Permit application. Commissioner Kellum concurred that it would be desirable to discuss the two applications simul~ taneously but suggested that further discussion be deferred until the Church representatives arrived. Commissioner COWley moved~ seconded by Commissioner Kellums that the hearing on UP-59 be re-opened. Motion carried unanimously and the hearing was re-opened at 7~57 P. M. Chairman Nortons with concurrence of the Commissions directed UP-59 continued until later in the evening. C. UP-60 - Mrs. Clara Andersens Pierce Road - Use Permit for Maximum of three,Lod~ers or Boarders WITHDRAWN .... See ROUTINE ORGANIZATION D. V-238 - Helen K. Rayburn, Big Basin Way - Variance to allow uncovered Parking Spaces for Residence in lieu of Carport or Garage and to allow Parking Spaces for both Residence and Antique Shop to. be nine feet in.width in lieu of the required ten feet. The pubiic hearing on V-238 wasZopened at 7:58 P. M. The Secretary advised that Notices of Hearing.had been mailed and there were no written communications on file. He then reviewed this application and read a Staff Report pertaining to same. Dwight Caswell was present. to r&present the applicant and stated 1) the existing buildings ~ould be removed from the property and new buildings constructed 2) to provide better traffic circulations the applicant had made arrangements to use the exit on the adjacent property and 3) because of the.shape of the property, it was felt that the apartment should be located on the back of the propertys leaving the second story of the'building in fren= for commercial'use. SAM HERNANDEZs Big Basin Ways stated that he was opposed to the granting of the subject Variance since he felt that the site was too small for the proposed development. Motion carried unanimously 'and the hearing was closed at 8:08 After further discussions Commissioner Crisp suggested that the hearing on V-238 be re-opened and that this matter be referred to the Variance Colmmittee for study and a report at the next regular meeting. Commissioner Crisp moved, seconded by Commissioner Kellum, that the hearing on V-238 be re-opened.. Motion carried unanimously and the hearing was re-opened at 8:10 P. M. Chairman Norton~ with concurrence of the Commission~ directed V-238 continued until the meeting on February 10s 1964~ and referred this application to the Variance Committee for study and a report at that time. E~ V-239 - Clarence Neale~ Saratoga-Sunnyvale Road - Variance to allow Accessory Structure in required rear yard to be 20 feet in heiSht in lieu of the permitted 14 feet The public hearing on V-o239 was: opened at 8:11 P. M~ The Secretary advised'that Notices of Hearing' had been mailed and there were no written communications on file. The applicant was present and read a letter 1) setting forth his reasons for requesting a Variance and 2) discussing compliance with Section 17o6 of Ordinance NS-3. DONALD STAMPER~ Marion Avenues opposed the granting of the Variance on the basis that the building might be used in connection with the applicant~s business. There was no one else present who wished to comment with regard to this matter. : Chairman Norton~ with concurrence of the Commissions directed V-239 continued until the meeting on February 10, 1964~ and referred same to the Variance Committee for study and a report at that time. Longsons CanYOn View Drive - Subdivision Approval - 26 Lots - Continued 'from Janua~7 13~.1964 Co~lssione~ Crisp advised that although the site development plans had been submitteds they had not been approved by the City Engineer° He suggesteds therefore, that =his matter be continued until the next regular meeting. On the basis of the foregoing,= Chairman Norton directed SD~465 con- tinued until the meeting on February 10, 1964. Bo SDR-467 - Joyce Hendry~ Canyon View Drive - BUilding Si~e Approval - 3 Lots .. The applicant was presentand requested that discussion of this application be deferred Until inter in the meeting =o allow time for a general review of the proposed conditions of approval. The reques~ was granted and Chairman Norton directed disuussion of SDR-467 continued until later in the evening. IV. ~_waI~NREVIEW Ao A-132 - Dro John Olivers Sarat'oga-SunnT~ale Road - Final Design Review - Addition to Pet Clinic - Continued from January 13s 1964 Commissioner Cowley advised that the applicant had submitted further exhibits but they had not been received in time for the Committee to review them prior to the meeting. He suggested, therefore, that this application be continued unti! the next regular meeting. The Chairman, on the basis of .the foregoing, directed A-132 continued until the meeting on February '10s 1964. II° B. A-133 - Sto Androws Episcopal Churchs Saratoga Avenue - Final Design Review - P~rtable ClaSsroom for Educational. Use Mro Emerson was present to repL.esent the Church and stated 1) the subject portable classroom was the same as the one p~eviously approved except for the addition of restrooms 2) these classrooms were designed to be portable but would be used until another wing was built onto the existing permanent building and 3) the additional wing could not be built for four to eight years, possibly even longer. since the loan on the church building would have to be paid first. -5- Plannin5 Commission Minutes - January 279 1964 - Continued B, UP-59 - St. Andrews Episcopal Church IV. B, A-133 - St. Andrews Episcopal Church There was no one in the audience who wished to comment with regard to this matter, Comissioner Cowley stated that the Design Review Committee had no objections to the architectural conception of the classroomo However~ he raised a question as to whether use of the word "portable" was misleading since it indicated a more temporary use of the classroom, After further discussions Chairman Nortons with concurrence of the Commission~ directed that the word "portable" be omitted, In response to a request from Commissioner Cowleys Mr. Emerson advised that a. copy of the Churchss General Plan would be filed with the Commission, Commissioner Glenn moveds seconded by Commissioner Kellums that the hearing'on UP.-59 be closed~ motion carried, Commissioner Crisp abstained, Commissioner Glenn moveas seconded by Commissioner Kellums that UP-59s St, Andrews Episcopal Churchs be granted subject to Design Review; motion carried, Commissioner Cowley moveds seconded by Commissioner Kellum~ that A-133s St, Andrews Episcopal Churchs be granted final design review for classroom as shown on Exhibit "A"; motion carried unanimously, Co A-134 - Carl L, Doziers Saratoga Avenue - Preliminary .Design Review - Restaurant and Office Buildings Robert Tons designers ~as present to discuss this application with the .Commission, He advised that .the proposed restarTant included .. 1') banquet room~ 1400 oquare feets sea~ing capacity 100 2) dinin~- rooms 1225 square feets seating capacity 50 3) bar~ 535 square feet 4) offices 400 square fee~ 5) kitchens 950 square feet 6) miscellaneous storages 745 square feet and 7) basement storages 1000 square feet. The Commission agreed that this was within the original concept of the restaurant. Doz~i~ A further question ~as raised as to whether the restaurant.~ in its proposed location~ would encroach upon the Flood Control easement, The Commission suggested that Mr, Ton cheCk with Flood Con~r0i District representatives as Soon as possible. Chairman Norton, on the basis o~ the foregoing, directed A-134 continued until the'meeting on February 10, 1964. The Corma~sSiOn then 1) informed Mr. Ton than'they had no objections to the proposed architecture and 2) requested that the Planning Director keep Mr, Ton advised o.f further developments in connection with this matter. IIIo SDR-467 - Joyce Hendry, Canyon View Drive - BUilding Site Approval'- 3 Lots - Continued from earlier in the Meetin~ After reviewing the proposed conditions of approval, the applicant requested that this application be continued until the next regular meeting to allow time for a further meeting with the Building Site Committee~ This request was granted and Chairman Norton directed SDR-467 con- tinued until the meeting on February 10, 1964. V. CITY COUNCIL REPORT The Secretary read a repo=t from former Commissioner Webster pertaining to action taken by the City Council at the meeting on January !5, 1964. Chairman Norton expressed the Commission~s appreciation for Mro Websterse a~tendance and the report. NEW BUSINESS A. Proposed Ordinance NS-3.5 The Secre't~y read proposed Ordinance NS-'3.5 relative to changing conditions of conditional reclassificationo The Chairman explained the need for the proposed amendment and advised that it would be on the agenda for public hearing at the meeting on February 10, 1964° B. Chester Avenue Assessment District The Secretary read a communication from the City Administrator ad- vising that the City Council had referred the matter of the Chester Avenue Assessment Dist~'ict to the Planning Commission with a request that the Commission review the ~proposed plan to determine how it would fit into the overall development of the area. -6- Planning Commission Minutes - January 27, 1964 - Contint:ed VT. Co FruitVale Avenue Plan 'Line The Secretary advised that the City Council had referred the pro- posed Frultvale Avenue Plan Line to the Planning Commission for their appr ova 1. Chairman Norton referred this matter to the General Plan Comnttttee for review and a report at the meeting on February 10, 1964. D. Street Lighting at Major: Intersections The Secretary advised that the City Council had requested that the Plauning Commission make a study relative to street lighting at ~nsjor intersections with particular emphasis on aesthetics. Chairman Nor-ton referred this matter to the General Plan Committee for study and a report at their e~=:liest convenience, Eo The Chairman acknowledged the presence of Wmo C. Henley, City Admin- istrator, and Cordon Hunter, Go'od Gove..'nment Group representatives and expressed the Commission's appreciation for their attendance. VIIo OLD BUSINESS The Commission ~as advised that work on the Retirement Development Pro- gram ~as progressing arAd that a report would be submitted soon. Chairman Norton 'requested that the .S~aff transmit a copy of the prelim- inary draft to each member of the Commission as soon as it was ready. VIIi o COMMUNICATIONS A. WRITTEN 1. SDR-402 - Alex S~anson, Sara.tpga Hills Road - Request for Extension The Secretary read a letter requesting an extension of one year in conr. ection with SDR-402. Commissioner Glenn moved, seconded by Commissioner Cowlay, that SDR-402, Alex S~ansen, be extended to the meeting on February 103 1964s and that consideration be given to further extension at that time; motion carried unanimously.
