Conunissioner Kellum advised that the Variance Co~"nittee had been unable to
make the findings required by law for the granting of a Variance. It was
the reconmendation of the Comittee, therefore, that this Variance be
denied.
Conunissioner Glenn moved, seconded by Connnissioner Crisp, that the public
hearing on V-237 be closed. ltotion carried unanimously and the hearing
was closed at 7:40 P. N.
Connissioner Crisp moved, seconded by Commissioner Glenn, that V-237, Win.
L. Cooley, be denied since the findings required under Section 17.6 of
Ordinance NS-3 could not be made; motion carried unanimously.
B. V-238 - Helen K. Rayburn, Big Basin Way - Variance to allow Uncovered
Parking Spaces for Residence in lieu of Carport or Garage and to
allow Parking Spaces for both Residence and Antique Shop to be
nine feet in width in lieu of the required ten feet - Continued
from January 27~ 1964 .,
Dwl4~ht Gaswell was present to represent the applicant ~,a advised that
the need for the Variance was created by the peculiar shape of the
property,
Sam Hernandez, Big Basin Way, opposed the granting of the subject Variance.
Connissioner Glenn stated that he felt the applicant was trying to crox~d
too much onto this lot. Re observed that decreasing the number of
buildings or the space within the buildin~s would eliminate the need for
the Variance.
Comnissioner Crisp concurred with Commissioner Glenn.
Cuaunissioner Kellt~n advised that the Variance Comittee had reviewed this
matter very carefully and was unable to make the findings necessary for
the grantin~ of the Variance. The Committee recommended, therefore, that
this application be denied.
Commissioner Glenn moved, seconded by Co~nissioner Kellum, that the public
hearing on V-238 be closed. Motion carried unanimously and the hearing
was closed at 7:51 P. M.
Comnissioner Crisp moved that V-238, Helen K, Bayburns be denied since the
findings required by law for the granting of a Variance could not be made.

sory Structure in required rear yard to be 20 feet'in height in

The applicant was present but stated that he had no further toEmerit ~rith
regard to this request unless there were questions to be answered.
There was no one in the audience who wished to speak ~ith reference to
=his matter.
Con~issionerKellum advised that the Variance Cobalttee had visited the
site and had carefully studied the plans but had been unable to make the
findings required by Section 17.6 of Ordinance NS-3. He stated that it
was the C~,.~r..tttee~s reco~nendation, therefore, that this application be
denied.
Commissioner Cowley moved, seconded by Commissioner Crisp~ that the public
hearing on V-239 be closed. l~otion carried unanimously and the hearing
was closed at 7:58 P. ~.
Counissioner Glenn moved, seconded by Commissioner Kellum, that V-239s
Clarence Neales be denied on the basis that the findings required for the
granting of a Variance could not be made. Notion carried unanimously.
D. 8-65 - }!acKay & Somps, Inc., Cox Avenue - Change of Zoning from "Agricul-
tural' and '~-1-12,500!' to "~-1-10,000"
The hearing onC,*,65 ~as opened at 7:59 P. N. The Secretary advised tha~
a Notice of Hearh~g had been published and there was one written co~uni-
cation on file.
Jim Colet representing the applicantt requested that this matter be defer-
red until later ~n the evening since his client had not arrived.
This request was granted and Chairman Norton directed C-65 continued uut~1
later in the evening.
E. L~..-61 - Town and Country Realty Company, Saraview Drive - Use Permit for
Temporar~j Sa~es Qffic~ for Sarahills Subdiv.ision .
The public hea=i~lg on UP-61 ~as opened at 8:01 P. ~. The Secretary advised
that Notices of Hearing had been mailed and there were no written comnuni-
cations on file, He then read a Staff Report pertaining to this matter.
Ty Papalias was present to represent the applicant and explained that
~nstead of ustag a model home sales office, they would like to bui[d n
smalX office on one of the lots in the subdivision.

After discussion, Mr. Papalias was informed that Design R.~viewwould be
required in connection with the subject sales office. He expressed will-
ingness to comply with this requirement.
There was no one in the audience who wished to tomeat with regard to this

Co~lssioner Glenn moved, seconded by Connnissioner Crisp, that the public
hearing on UP-61 be closed. gotion carried unanimously and the hearing
was closed at 8:05 P. M.
Commissioner Crisp moved that ~P-61s Toxin and Country Realty Companys be
granted subject =o Design Review of the proposed sales office and any
signs =o be used in connection with ss~e, and that a time limit of one (1)
year be placed on this Use Permit. Con~issioner Cowley seconded the
motion which carried unanimously.

Ch~n~ Conditions of Co~ditional Reclassificetion
The public hearin~ on Ordinance NS-3.5 was opened at 8:07 P. M. The
Secretary advised that a Notice of Hearin~ had been published and there
Were no written connnunications on file. He th~n read the proposed ordi-
nance~ relatin~ to chan~ing conditions of conditional reclassification.
There was no one in the audience who wished to comment with re~ard to this
matter.
After discussion, Cona~lssioner Crisp moved, seconded by Commissioner Glenn,
that ~he public hearing on Ordinance NS-3.5 be closed. Motion carried
unanimously and the hearing was closed at 8:11P. M.
Commissioner Crisp movnd, seconded by Commissioner Kellum, that the Plan-
ning Co,~,~ssion reco~end to the City Council ~hat Ordinance NS-3.5 be
adopted; motion carried unaP~usly.
D. .8-65 - ~aeKay & Somps, Inc., Cox Avenue - Change of Zoning from
rural" and '~-1-12,500" to '~-1-10,000" - Continued from earlier

The Secretary read a connnunication from Betty Jane and A. L. Irwin opposinE
the proposed change of zoning.
Mr. Cole explained 1) the subject property is located on the north side
of Cox Avenue between the railroad tract and the proposed West Valley
Freeway 2) it is a difficult parcel to subdivide 3) the applicant felt
that the railroad tract and the proposed freeway would make natural
barriers for this zoning.

II. D. C-65 - MacKay &S~o~s, Inc.
Mo J. Lee, Woodmoat Drive~ opposed the proposed change of zoning. He
stated that he would like to see the city maintain the low density indi-
cated by the General Plan and the granting of this change of zoning would
set a precedent that would m~e similar applications hard to deny.
John Ostrowskt, lone Court, concurred with Mr. Lee and observed that the
developer would gain approximately 20% density if this change of zoning
was approved.
George Towne, Jr., Wolcott Way~ stated that he had moved to Saratoga
because of its objectives with regard to density, zoning, etc. and would
not like to see it changed. tie, therefore, opposed the proposed change
of zoning.
James Lovely, lone Coul-t~ opposed the proposed change of zoning because
of the increase in density.
Richard Brfan~ Glenbrae Drives spoke in opposition to the proposed chan~e
of zoning because of the increased density. He further stated that he
might feel differently if the builder had bought the property prior to
plans for the freeway.
B. T. Galeb, Seagull Way, stated 1) he did not feel that large lots
would be an asset in the subject area 2) he felt that smaller lots would
provide the best use of the land so 3) he was in favor of the proposed
change of zoning.
A show of hands indicated that 16 of the interested parties present
opposed the proposed change of zoning and two (2) favored the proposed
change.
Jim Cole explained that a flexible lot size was needed in connection with
this particular area to enable them to work out the street pattern but
that they had no desire to chamge the density. In answer to a question
from the Chairman, Mr, Cole stated that if a '~D" District would accom-
plish their purposes this would be fine. He explained that they would
like to make the lots along the freeway and the railroad deeper than the
others.
A representative of the developer stated that because of a 70 foot PG&E
easement, the railroad and the proposed freeway, a problem had been created
in connection with development of the subject parcel. He further stated
that, actually, their applica=ion was a request for nothing more than
a '~D" Zone.

Commissioner Crisp explained that while the Subdivision Cornre{tree did not
normally make a report on zoning matters, a study had been made in con-
nection with the subject application because of the pending subdivision.
He stated that the Committee was not in favor of rezoning this property
to 10,000 square foot lots.
Jim Cole advised that perhaps the '~8D" zonln~ would accomplish their pur-
pose as well as the requested '~-1~10,000" zoning~ so requested that this
matter be continued to allow adequate time to change the application.
On the basis of the foregoing, Chairman Norton directed C-65, MacKay &
8omps, Inc., continued until the next regular meeting and referred same
to the Subdivision Committee for study as to whether this property was
suitable for '~D" zoning.
The Chairman declared public hearings closed for the evening at 8:40 P. M.
FIVE MINUIE RECESS
Chairman Norton acknowledged, with pleasure, the presence of Mr. Gordon Hunter of
the Good Government Group and observed that Mr. Louis Wine, another member of this
groups had been present earlier in the evening.

Willard Thompson was present to represent the applicant and expressed
satisfaction with the proposed conditions of approval.
Commissioner Crisp moved, seconded by Commissioner Kellum, that the Sub-
division Committee Report of February 10, 1964, relative to SD-465, be
adopted and that the tentative map (Exhibit "A", filed January 3, 1964)
be approved in accordance with the site development plan (Exhibit '~-1",
filed February 10, 1964) subject to the 16 couditions detailed in the
Subdivision Committee Report; motion carried unanimously.
B. ~DR-467 - Joyce DLeudry, Canyon View Drive - Building Site Approval-- 2 Lots -

Commissioner Crisp advised that the applicant had mat with the Building
Site Coumalttee to discuss the street and utilities. He further advised,
however, that the Co=mittee still was not prepared to make a recormnenda-
tion with regard to the utilities~ so suggested that this matter be con-
tinued until the next regular meeting to allow time for further study of
this situation°

III. B. SDR-467 - Joyce Henar~
Mr. Hendry was present and expressed willingness to have the matter con-
tinued further.
On the basis of the foregoing, Chairman Norton directed SDR-467, Joyce
Hendry, continued until the meeting on February 24, 1964.
C. SDR-468 - C__arl L. Dozier~ Saratoga Avenue - Building Site Approval - I Lot
Fir. Dozier and Mr. Ton were present to discuss tI~ proposed conditions of
approval with the Commission.
Chairman Norton advised that the City Attorney had ruled that the westerly
100 feet of the old Saratoga Inn property (not under ownership to the
applicant but included in the change of zoning covering the applicant~s
property) could only be used for parking until a further change of zoning
was granted. He explained, however, that this did not affect the existing
building located on this property.
Co~nnissioner Crisp explained that building site approval would not include
approval of the apartment sho~m on the plan nor the location of the
building. He further explained that these items would be discussed under
Design Review.
Co-~n{ssioner Crisp moved, seconded by Con~nissioner Xellum, that the
Building Site Comittee Report of February 10, 1964 relative to SDR-468,
Carl L. Doziers be adopted and that the tentative map (Exhibit '~', filed
January 30, 1964) be approved subject to the ca~itions detailed in the
Building Site Con~itteeHeport; motion carried unanimously.
D. SDR-469 - Rose R~..bertson. PiedmoOt Road - Bui!~ing Site Approva~ - i Lot
Comissioner Crisp advised that a revised site development plan xeuld be
required in connection with this application and that septic tank
clearance had not yet been received from the Health Department. It was
the reco~nendation of .the Building Site Conm~ttee, therefore, that this
matter be contLnued until the next regular meeting.
On the basis of this reconnendation, Chairman Norton directed SDR-469
continued until the meeting on February 24, 1964.

Commissioner Cowley moved, seconded by Commissioner Glenn, that final
design approval be granted A-132, Dr, John Oliver, for the addition to
the Pet Clinic as shown on Exhibits "A", 'B", "C:;, and '~"; motion car-
ried unanimously,

Commissioner Cowley advised that the Design Review Committee could find
no justification for approving the apartment shown on the axhibits.
After discussion, Chairman Norton explained that the applicant would have
to apply for thn apartment to be added to the conditional zoning since
it was mot originally included.
Co~issioner Cowley moved, seconded by Co~missioner Glenn, that preliminary
design approval be g~'anted A-134, Carl L. Dozler, as shown on Exhibits
'j', and 'C", ~rlth the exception of the apartment sho~m as a second story
on building ~[2 on said exhibits; motion carried unanimously.
C. A-131 - Cupertino Union School District, Titus Avenue - Final Design
Review - .Laurel Hansen School.
~e Secretary advised that l~r. Lofgreu had requested that this matter be
continued since their landscape plan was not ready.
Commissioner Cowley recommended that this request be granted.
On the basis of the foregoing, Chairman Norton directed A-131 continued
until the meeting on February 24, 1964.
D. A_-.135 - _Clarence Toy, St. Charles Street - Final Design Review - Apartments
Conmafssioner Cowley moved, seconded by Comrn4 esioner Glenn, that A-135,
Clarence Toy, be granted preliminary design approval instead of final
design approval as requested until the Design Review Cu~,lttee had an
opportunity to review the plans more carefully; motion carried unanimously.
V. CXI~/COUNCIL RE~ORT
Connissioner Crisp gave a brief report on the City Council meeting of Feb-
ruary 5, 196~, with particular emphasis on City Council approval of an assess.
ment district for the improvement of portions of Saratoga and Cox Avenues and'
appofntmen~ of the t~o new Planning Commissioners.

The Secretary read a letter from Player Glennon relative to church parklug.
Chairman Norton referred this matter to the Subdivision Committee for
study and a report as promptly ae possible.
B. Subdivision Fence. s
The Secretary advised that a question had been raised at the last City
Council meeting as to whether the solid board subdivision fences along
major streets were advis4ble or whether a more open design should be
considered.
Connissioner Crisp advised that the Plannin~ Committee of the Council had
requested that consideration be given to a more open type fence since the
solid board fencess from an aesthetic point of view, deteriorated rapidly.
He further advised that it was felt that perhaps the residents would help
maintain the right-of-way if a more open desio~n was used.
After discussion, Chairman Norton referred this matter to the Design
Review Comittee for study and a recommendation as soon as convenient.

Commissioner Glenn reviewed the request from the City Councils then read
a report from the General Plan Con~nittee pertainin~ to this matter.
After discussion, Commissioner Glenn moved, seconded by Commissioner Crisp,
that the report of the General Plan Counnittee dated February 3, 1964~
relative to the Chester Avenue Assessment District, be adopted and trans-
mitted to the City Council as the reconnendation of the Con~nissionI motion
carried unanimously.

Commissioner Glenn advised that the General Plan Committee had met with
the Director of Public Works to review the proposed precise plan line for
Fruitvale Avenue-from Gardner Lane to Saratoga-Los Gatos Roads and it was
the recommendation of the Cou~ittee that this plan line be approved.
After discussion, Commissioner Glenn moveds seconded by Commissioner Crisp,
that the proposed precise plan line for Fruitvale Avenue from Gardner Lane
to Saratoga-Los Gatos Road be approved as shown on the Plan Line Maps and
that the Secretary be directed to advise the City Council of this action;
motion carried unanimously.
D. Street. Lights - Referred by City Council - Continued. from Januaz7 27, 1964
Commissioner Glenn advised that he had discussed this matter with Mayor
Glennon and he had suggested that it be placed on the agenda for the
General Plan Revi~{.
After discussion, Chairman Norton directed tha~ the Secretary place this
item on the agenda as suggested.

The Secretary requested that this matter he continued until the next regu-

F. Planned Cg~nun~ty District - Draft of Proposed Ordinance for Review
Commissioner Crisp suggested that this ordinance be set for public henring
on I.~rch 9s 1964, and requested that each Commissioner study the proposed
ordinance in the meantime°
Commissioner Glenn moved, seconded by Commissioner Crisp, that the Commis-
sion tentatively approve the draft of the proposed ordinance and direct
that the Secretary set same for public bearing on March 9s 1964; marion
carried unantmnusly,

The Secretary displayed colored maps showin~ a subdivision that conformed
to the suggested design ~tandards and one that did not,

Commissioner Cowlay requested that each of the Commissioners review th~

Chairman Norton directed this matter continued until the meeting on
February 24, 1964,

After discussions Comissioner Crisp moved, seconded by Comissioner
Kellum~ that the Plannlng Commission approve the proposed amendment to
Ordinance NS-5 (relative to minimum access road reimbursement) as submit-
ted and transmit same to the City Council for enactment; motion carried
unanimously.
