ROUTINE ORGANIZATION ~he meeting was called to order by Vice Chairman Kellum at 7:30 P. M. A. ROLL GALL Present: Commissioners Cowley, Crisp, Glenn, Kellum, McFall and O'Rorke. Absent: Connnissioner Norton. (Commissioner Norton arrived at approxi- mately 7:35 P. M.) Bo MINUTES Commissioner Glenn moved, seconded by Commissioner Cowley~ that the reading of the minutes of February 10, 1964 be waived and that the minutes be approved as submitted; motiou carried unanimously. iI~ PFBLIC HEARINGS The Chairman declared public hearings open for the evening at 7:34 P. M. A. C-65 - MacKay & Somps, Inc., Cox Avenue - Change of Zoning from "Agricul- tural" and '~R-1-12,500" to '~-1-12,500 P-D" - Continued from February 10, 1964 .. Con~nissioner Crisp advised 1) the subject application had been revised so it mould be necessary to publish a revised notice setting the public hearing for the next regular meeting (March 9, 1964) 2) a tentative map showing the proposed subdivision had not been submitted and 3) for these reasons, no action could be taken on C-65 at this time. Commissioner Norton arrived at approx4mntely 7:35 P. M. and, at the request of Vice Chairman Kellum, assumed the Chair. B. T. Galeb, Seagull Ways stated that at the time the General Plan was adopted (1960), the Planning Consultant (Lawrence Livingston) had referred to the property between the proposed freeway and the railroad as a problem area and had indicated that special consideration should be given in con- nection with the development of same. He stated that he, personallys felt that large lots in this area would be a detriment rather than an asset. He also indicated that he felt that by allowing smaller lots it would be possible to develop a park in the area that would actually cost very little but would benefit all of Saratoga. In reply to a remark from Commissioner Glenn~ Mr. Galeb stated that it might be too late to discuss this matter at the time the General Plan was reviewed. ~l~ PlanninLCom!ssion Minu~zes - Fo_bruaz'y 74 1~64 - Con,~,',nued II. He then directed C-65, Ma~ay & Somps, Inc., continued until the meeting on March 9, 1964. B. UP-62 - Blossom View Homes, Coyins Court - Use Permit for Model Home Sales Office for Blossom View Subdivision The hearing on lIP-62 was opened at 7:4.8 P. M. The Secretary advised that the property owners within a 500 foot radius of the subject property had been notified and there were no written communications on file. He then read a Staff Report pertaining to this application. Morris J. Lee was present to represent the applicant. · here was no one in the audience who wished to comment with regard to this matter. Commissioner Crisp moved, seconded by Commissioner Cowley, that the public hearing on UP-62 be closed. Motion carried unanimously and the hearing was closed at 7:50 P. M. Commissioner Crisp moved that UP-62, Blossom View Homes, application for a Use Permit for Model Home Sales Office, be granted for a period of one (1) year. Commissioner Cowley seconded the motion which carried unanimously. C. VT240 - Jack Carlsen, Lutheria Way - Variance to eliminate temporarily the requirement for two off.,street parking spaces, located in a Sara~e or carports fpr the r~sid~e located at 14330 Lutheria Way The hearing on V-240 was opened at 7:51P. M. The Secretary advised that Notices of Hear~n~ had been mailed and there was one written communication on file. He then read the communication which had been filed by Dorothy V. Fannin~ in opposition to the proposed Variance. George Worn, Lutheria Way, stated 1) the lack of off-street parking for the Carlsen residence had created a hazardous situation on this curve 2) he was aware of Mr. Carlsen's problem but felt that the City had shown every consideration 3) ten of the 13 property owners on Lutheria Way felt that Mr. Carlsen should provide the off-street parking but ~) he, personally, would like to see the City grant him a little more time. V-240 - Jack Carlsen Cor~misaloner Kellum advised that after visiting the site it was the recom- mendation of the Variance Counittee that this application be denied since the findings required by Section 17.6 of Ordinance NS-3 could not be made. He also observed that since the garage had not been built the house had become an illegal, non-conforming building, C~..-..Issioner Crisp moved, seconded by Conniseloner Crisp, that the hearing on V-2~0 be closed, Hotion carried ;m~_ot~o_usly and the hearing was closed at 8;10 P. M. Commissioner Crisp moved, seconded by Comissioner Cowley, that V-240, Jack Carlsan, be denied since ~he findings required by law for the granting of a Variance could not be made; marion carried unavt~usly. The Secretary advised that Notices of Hearing had been mailed and there were no witten communica- tions on file. He then briefly reviewed this application. ~he applicant was present but did not wish to cogent with regard to this request. Jack Hotdan, representing Lockheed, observed that t~o innocent parties ~ere involved in this matter and that he, personally, felt that a Variance was justified. Commissioner Kelltun advised 1) the Variance Committee had visited the site 2) in addition to the encroaclunent into the required rear yard, the Building Code had been violated in s~veral ways and 3) the Committee could not make the findings required by law for the granting of a Variance.' After bitthat discussion, Commissioner Glenn moved, seconded by Cou~nis- sioner Crisp, that the public hearing on V-241 be closed, Hotion carried unanimously a~d the hearin8 was closed at 8:22 P, H. By unanimous consent, the Chairman re-opened the hearing on V-241 lon~ enough for the Secretary to read a ~ritten communication (which had been over-looked earlier) from Barbara R. and Charles I~. Netcalf ~no s~ated that they had no objection to the proposed Variance. The hearing was then closed by unavtm~us consent, Corsnissioner Crisp moved, seconded by Commissioner Kellum, that V-241, John H, Nichelmore, be denied since the findings required by Section 17.6 of Ordinance NS-3 for the Erantlng of a Variance could not be made; motion carried. Cor~mtssioner Coylay abstained. Plannin~ Commission Minutes - February 24, 1964 - Conti:~ued Chairman Norton acknowledged, with pleasure~ the presence ef Councilman Bra~tl and observed that it was the first time a member of the City Council had artended in some time. The Chairman also welcomad Fws. Owen and Mro Wilberding of the Good Government Group and expressed the Coum~ssion~s appreciation for their attendance. TEN MINITEE RECESS III. SUBDIVISIONS AND BUILDING SITES A. SDR-467 - Joyce Hendry, Canyon View Drive - Building Site Approval - 3 Lots - Continued fro~February lOs 1964 Commissioner Crisp advised 1) the Connnittee ms not ready to make a reco~nendation in connection with this application 2) the applicant had requested that this matter be continued until the next regular meeting and 3) it was the rec~endation of the Committee that this request be granted. On the basis of the foregoing~ Chairman Norton directed SDR-467 continued until the meeting Qn March 9, 1964. B. SDR-469 - Rosemarie Robertson, Piedmont Road - Building Site Approval - I Lot - Continued from February 10, 1964 The applicant was present and expressed satisfaction with the proposed conditions of approval. In answer to a question from Morris J. Lees the Commission assured Mrs. Robertson that the conditions of approval established in connection with SDR-469 wonld have no effect on her existing driveway (off Piedmont Road) which crosses the subject property. Commissioner Crisp moved, seconded by Commissioner Kellum, that the Building Site Co-n~ttee Report of February 10, 1964 relative to SDR-469 be adopted and that the tentative map (Exhibit 'A-i', filed February 6, 1964) be approved in accordance with the site development plan (Exhibit filed February 10, 1964) subject to the conditions detailed in the Buil- ding Site Counl=tee Reports Condition II, G, of which has been modified by inserting the ~ord 'additional' between the words 'no' and "direct". Motion carried unanimously. C. SDR-470 - Ben M. Commissione~ Crisp moved, seconded by Commissioner Kellam, that the Building Site CouFaittee Report of February 24, 1964 relative to SDR-471 be adopted and that the tentative map (Exhibit '~A", filed February 5, 1964) be approved subject to the conditions detailed in the Building Site Com- mittee Report; motion carried unanimously. C~lssioner Crisp moved, seconded by Commissioner Glenn, that the Subdi- vision Committee Report of February 24, 1964, relative to SD-472, Wesley Kosich, 24 lots on Kosich Drive, be adopted and that the tentative mop (Exhibit "A", filed February 14, 1964) be approved subject to the condi~ tions outlined in the Subdivision Committee Report; motion carried unanimously. S.D-473 - Brown & Kauff-mann, Inc., Scully Avenue - Subdivision Approval 62 Commissioner Crisp advised 1) this subdivision was more or less an exten- sion of Prides Crossing 2) the street pattern had not been completed since it was being coordinated with that of the future Lindsay Subdivision and 3) it was the recommendation of the Subdivision Committee that this matter be continued until the next regular meeting. On the basis of the foregoing, Chai~nan Norton directed '3D-473 continued until the meeting on Ma=ch 9, 1964. Ao A-131 - C__upertino Un~on School__~ls~r.~c_~t three or four year plan which would be completed as soon as possible and 2) the fence along M~linda Circle would be installed immediately fol- lowing construction. Commissioner Cooley moved, seconded by Commissioner Glenn, that A-131, Cupstrine Union School District, be granted final design approval subject to 1) landscaping to be completed within a period of four (4) years and 2) fencing along the south property line to be installed prior to occu- pancy of the school. Motion carried unanimously. B. A-135 - ~laE~c~ Toy, St. ~harl.~es Street - Final,.D~i~n Review - A~artments Commissioner Cowlay advised that the City Council, in compliance with Mr. Toy's request, had authorized a refund of all fees paid in connection with Mr. Toy's application for Building Site Approval (~rlth the exception of the filing fee) since he had decided not to develop the property. He further advised that the exhibits submitted in connection with the subject application were inadequate and it was the reconmendation of the Design Review Cavities that this application be denied. Commissioner Cowlay moved, seconded by Conmissioner Glenn, that A-135, Clarence Toy, be denied; motion carried unanimously. C. ~-136 - Virgil R. ~rring, Big Basin Way ~ Final Design Review - Antique Shop Commissioner Cowlay advised that the City Council had approved acceptance of a bond covering Mr. Herring's required off-street parking for a period of one (1) year. He further advised that after reviewing the exhibits the Design Review Committee recommended 1) that the number of parking spaces re~uired for this building be seven plus one, the one being the existing space if it is used for parking or an additional one if the existing space is used for something else and 2) that the four spaces indicated on the front of the building be required no~ (as a condition of design review) and that the bond cover instailation of the three spaces indicated at the rear of the building within one (1) year. Commissioner Cowlay moved, seconded by Con~issioner Glenn, that final design review be granted A=136, Virgil R. Harring~ subject to the following conditions: 1) provide eight parking spaces 2) four parking spaces to be i~stalted now and three future spaces to be guaranteed by bond, Motion carried unanimously. Commissioner Cowlay advised that the Design Connittee felt that the Village Parking District might be well enough along within one year to u~ke installation of the throe spaces at the rear of the building unnecessary. A-137 - Town & Country Realty, Saxahills Drive - Final Design Revi~ - ~empo~a~V _Sales Office .for ~arah!ll~ Subdivision, Commissioner Cowley advised that the DesignReview Committee had no objections to the design of the sales office and that the location was satisfactory. lte further advised, bwever, that the signs as shown, was located in the right-of-way and it had not been the policy of the Commission to approve signs of this type in the right-of-way. Ty Papalies was present to represent the applicant and advised that the location of this sign would be a problem if it could not be placed in the right-of-way. Commissioner Cowley moved, seconded by Conmmissioner Glenn, that A-137, temporary sales office for Sarahills Subdivision, be granted final design approval as shown on Exhibits A, B, and Cs but that this approval not include the sign indicated in the right-of-way; motion carried unanimously. After further discussion w~th regard to the proposed sign~ Chairman Norton directed the sign under ~-137 continued until the meeting ohM arch 9, 1964, and requested that the Secretary establish title to the property in ques- tion and take a look at the area. V. CITY COL~ClL REPORT Commissioner Cowley gave a brief report on action taken at the City Council meeting on February 19~ 1964, with particula= emphasis on the following: 1) final map approval was granted the Kirkorian Subdivision excluding the Ted Avenue extension and 2) building site approval for the Casa Bells Nursing Home was extended for a period of sixmonthso VI. h~EW BU~INES~ VII. Church Off-Street PaE~_.n~ After discussion, Commissioner Crisp moved that the Commission approve the Subdivision Committee Reporu relative to church off-straet parking and forward same to the City Council in reply to Mayor Glennon's letter of January 27, 1964. Commissioner Cow!ey seconded the motion which car- ried uuanimously, Commissioner Glenm requested that a copy of this report be placed in the General PlanReview fileo ~he Secretary suggested that the Commission wait to hear from the City Council before starting proceedings to amend the Ordinance. -7- Plannin~ Conn~ission Minutes - February. 24~ 19~6 - Continued VII. B. DeSign gta.nd~rds Commissioner Cowley again requested that the Commissioners make sugges- tions to the Planning Director after reviewing the colored maps at City Hall. Commissioner Crisp suggested that the "14 foot accessory structures" be reviewed because of the construction of guest houses over garages. After further discussion, Chairman Norton directed this matter continued until the meeting on March 9, 1964. C. Storage of Junk Cars The Secretary advised that some cities control situations such as this by ordinance but that he had been unable to discuss this matter with the City Attorney since he was out of town. I~. Warner, Mostrose Avenue, advised that such a problem existed in con- nection with several houses ~nhis area. Mr. Felav~u, Mostrose Avenue, advised that some of these people were conducting businesses. Chairman Norton requested that the Planning Director contact the City Attorney with regard to correcting the exist~lg situation and enacting an ordinance. D. Ordinance NS-3.~ relative t~.Plann~d__Cgmm~niEy Distrlc~ Comraissioner Glenn questioned the advisability of permitting commercial uses in the proposedPC Districts. Commissioner Cowley questioned allowing recreational centers within the PC Districts because of the City Council~s point of view relative ~o Arroyo de Saratoga~s request. Councilman Brazil explained that the City Council had not opposed recreation centers as such~ but had felt that they should be located well within the developments so that the people who enjoyed the advantages of the centers would also be the ones to cope with possible disadvantages. Commissioner Cowley also cox.ra~nted as fo!lows~ 1) If the PC Districts were intended for older residents~ would Saratoga need more than one? 2) A PC District could be combined with any RM District, but he, persona1{y, did not feel that a PC District should be located adjacent or contiguous to developed residential property in R-1 Districts. -8- Planni_na~ Connni~sign MinUtes - February 24, 1964 = Continued VII. Ordi.n~.nce NS-3.6 3) All schools should be limited to religion, eraft~ trade, etc. 4) Recreation should be for residents only except for a maximum of four guests. 5) Theater and restaurant should he restricted to residents and their guests. 6) Ledges should be restricted. 7) Medical Center should be restricted more. Connnissioner Cowlay also observed that it would be much easier to establish standards now than try to do it later. Commissioner Glenn observed that property developed by a non-profit organi- zation would be removed from the tax rolls. Commissioner Kellum observed that there were many different type develop- ments and perhaps Saratoga might need one each of one, two or three types, i.e., rental units, condominium or co-op units and permanent total care facilities. He stated that he lmd been unable to determine %Ahat the majority of the interested parties in Saratoga would prefer. Conmissioner Cowlay stated that he felt that ~e ordinance, as proposed, would open the City up to'%oo many and too much." Chairman Norton reminded the Commission that the subject ordinance had been set for public hearing before the Planning Commission on March 9, 1964. E. City Council Clmmbers The Secretary read a connnunlcation from the City Administrator ~elative to the proposed City Council Chambers. He advised that the plaBs were available for inspection at the City Hall. VIII. C__C~II3NI~ATION~.. A. 1. SD-.328 - Arroyo de Saratoga~ Saratoga Avenue - Request for Extension The Secretary read a letter from Joseph Sweany requesting an extensioD of one year in connection with SD-328. He advised that a one year extension had already been granted in connection with this application, and that while a further extension was permitted, it was not policy to grant same. Chairman Norton directed SD-328 continued until the next regular meeting and referred same to the Subdivision Committee for study and a report relative to policy position at that time. 2. SDR-397 - John P. Maltby, Woodbank Way - Request for Ex. ten_si. on The Secretary read a letter requesting a six month extension in con- nection with SDR-397. Commissioner Glenn moved, seconded by Commissioner Kellum, that an extension of six months from the date of expiration be granted in connection with SDR-397 as requested; motion carried unanimously.
