CITY OF SARATOGA PLANNING COMMISSION
TIME: Monday, April 27, 1964, 7:30 P. M.
PLACE: Saratoga High School, Herriman, Saratogas California
TYPE: Regular Meeting
I. ROUTINE ORGANIZATION
The meeting was called to order by Chairman Norton at 7:30 P. M.
A. ROLL CALL
Present: Commissioners Crisps Cowley~ Glenns Kellum~ McFall,
Norton, and O~Rorke.
Absent: None.
B. MINUTES
Counissioner Cowley movedj seconded by Commissioner Kellum, that
the reading of the minutes of April 13, 1964 be mived and that
the minutes be approved subject to the following modification:
Page 3... Insert the following paragraph between paragraphs 3 and 4:
"Commissioner Crisp read the reportfor the Subdivision
Committee relative to this application, recommending
that the application be denied."
Motion carried unanimously.
II. PUBLIC HEARINGS
The Ohairman declared public hearings open for the eveninE at 7:38 P. M.
A. C-67 - Err. A. W. Babienco, Saratoga Avenue and Kosich Drive - Change of Zoning from '~-1-~0,000" (Single Family Residential) to
"P-A" (Professional-Administrative) - Continued from April 13~ 1964
The Secretary read a petition opposing the proposed change of zoning
which had been si~ned by 64 residents of the general area. He then
read a letter from the applicant settinE forth his reasons for request-
ing the subject change of zoning.
The applicant was present to discuss this matter with the Commission.
He presented a map showing the subject property in relation to San
Jose, together with photos of the vicinity. He also read a statement
favoring the proposed change of zoning which bad been signed by 16
residents of the immediate area.
MRS. DELORES PEARSON, Radoyka Drive, opposed the ~ranting of this
change of zoning on the basis of traffic congestion.
After further discussionJ Chairman Norton directed C-67 continued until
the meeting on May 11, 1964, and referred same to the Subdivision Com-
mittee for study and a report at that time.
B. C-68 - Mason Enterprises, Inc., Wardell Road - Change of Zoning from
"R-1-15,000" and '~-l-40,000"(Single Family Residential) to
"R-1-15,000 P-D" (Single Family Residential Planned Unit

IX. C-68 - Mason Enterprises, Inc.
Dick Rogers ~as present to represent biason Enterprises, Inc., but stated
that he had no £urther comment.
MARSI~ALLHALL, Wardell Road, observed that the objective of incorporation
had been to keep Saratoga a low density city and that while this one
subdivision might not greatly affect the City, it vas one of many appli-
cation for development that could slowly deplete the low density areas.
There ~ras no one else present who wished to comment with regard to this
matter.
Commissioner Crisp read the report of the Subdivision Committee relative
to this application, recommending that it be denied.
Commissioner Glenn moved~ seconded by Commissioner Crisp~ that the ~ublic
hearing on C-68 be closed; motion carried unanimously add the hearing was
closed at 7:55 P. M.
C. V-242 - Stephens, Glenmont Drive - Variance in connectton~ith Front
and Side Yard Setback Requirements - Continued from April
l~t 1964.
The Secretary advised that the engineering studies requested by the
Variance Committee had been received but the applicant had net sub-
mitted the written agreement with the adjacent property owner.
The applicant was present end reaffirmed the oral agreement with his
neighbor and stated that a written agreement would be filed.
Cou=aissioner Kellum advised 1) the Variance Committee had visited the
site and conferred with the applicant 2) the requested engineering
studies had not been received in time for review by the City Engineer
and 3) the Con~ntttee felt that a written statement from Mr. Stephens
neighbor should he filed for record.
After further discussion~ Chairman Norton directed V-242 continued
until the meeting on May 11, 1964, at which time the Variance Com-
mittee will give a further report.
I1. D. ~. T. Sowell - Request for Planning Commission to add Dance Studio to
list of Permitted Uses for C-N (Neighborhood Commercial)
Zoning District - Cpntinued from April 13t 1964
The hearing on this matter ms opened at 8:01P. M. The Chsirman
explained that it was an informal hearing to allow residents of the
area to express their opinion.
The Secretary advised that Notices of Hearing had been mailed t~ all
property owners within a 500 foot radius of the subject property and
there were no written communications on file.
There was no one present who wished to comment with regard to this
matter.
Co~uissioner Crisp advised that~ based on the available information,
it appeared that the neighbors did not object but it ms the feeling
of the Subdivision Committee that a use such as this could he con-
dttioned.
Commissioner Kellum explained that the City Attorney had suggested
in a telephone conversation with the Staff that the subject use be
added as a permitted use subject to the granting of a Use Permit.
Commissioner Crisp moved, seconded by Commissioner Kellum, that the
public hearing be closed; motion carried unanimously and the hearing
was closed at 8:08 P. M.

II. D. W. T. Sowell
Commissioner Crisp moved, seconded by Commissioner Kellum, that the
following be added to Section 7.2a(1} of Ordinance NS-3:
"Music and Dance Studios, subject to the granting of a Use
Permit in accord with Article 16."
Motion carried unanimously.
The Staff advised that ~he City Attbrney had suggested that the Zoning
Ordinance be amended to allow the Planning Commission to add cond{tional
uses in the same manner that they a~e now.~ilowea to add permitted uses.
Chairman Norton requested that the Subdivisidn Cdmmittee begin work on
the draft of this amendment.
II. E. V-243 - E. L. Isbell, Thelma Avenue - Variance to allow an 8' Side
Yard Setback in lieu of the required 10' Side Yard Setback
The hearing on V-243 ~ms opened at 8:12 P. M. The Secretary advised
that Notices of Hearing had been mailed and only one written communi-
cation had been received. He then read the communication which was
a letter from Robert Finhie, adjacent property owner, favoring the
granting of the subject Variance.
The applicant was present and explained 1) finances had prevented
his building a garage at the time the house was built 2) now that
he could afford the garage he could not meet the requirements of the
existing Ordinance so 3) a Variance was needed.
There was no one else present who wished to comment with regard to
this application.
After discussion, Chairman Norton directed V~243 continued until the
meeting on May 11, 1964, and referred same to the Variance Committee
for study and a report at that time.
F. V-244 - Virgil P. Force, Bucknail Road - Variance to allow 21' Front
Yard Setback in lieu of the required
The hearing on V-244 was opened at 8:19 P.M. The Secretary advised
that Notices of Hearing had been mailed and there were no written
conmmnications on file.
Mac. Force was present and explained that it was necessary for him to
put a new roof on his home so he would like to add the subject porch
at the same time.
There was no one else present who wished to speak with regard to
this matter.
Chairman Norton directed V-244 continued until the meeting on May 11,
1964, and referred same to the Variance Committee for study and a
report at that time.
The Chairman declared public hearings closed for the evening at 8:25 P. M.
TEN MiNUTE RECESS
Chairman Norton welcomed Mrs. Ottenberg of the League of Women Voters and
Smith of the Good Government Group and expressed appreciation for their attendance,

Commissioner Crisp advised that the requested site development plan
had not been received so recon~mended that this application be continued.
On the basis of this recommendation, Chairman Norton directed SDR-4?4
continued until the meeting on May 11, 1964.
B. SDR-4~.- Waiter E. Hileman, Peach Hill Road - Building Site Approval -
1 Lot - Continued from April 13w 1964
The applicant was not present.
CoL~uissioner Crisp moved, seconded by Commissioner McFall, that the
Building Site Committee Report of April 27, 1964 relative to SDR-482,
Walter E. Hileman, be adopted and that the tentative map (Exhibit "A",
filed March 13, 1964) be approved in accordance with the site develop-
ment plan (Exhibi~ "B", filed April 27, 1964) subject to the conditions
outlined in the Building Site Committee Report; motion carried un-
animously.
C. 5DR-484 - Andrew P. Lassen, Sobey Road - Building Site Approval -
2 Lot.s ? Continue.d from April 13, 1964
The applicant was present and expressed satisfaction with the pro-
posed conditions of approval.
Commissioner Crisp moved, seconded by Commissioner McFall, that the
Building Site Committee Report of April 27, 1964 relative to SDR-484,
Andrew P. Lassen~ be adopted and that the tentative map (Exhibit '~",
filed March 27, 1964) be approved in accordance with the site develop-
ment plan (Exhibit "B", filed April 27, 1964) subject to the condi-
tions detailed in the Building Site Committee Report; motion carried
unanimously.
D. SDR-486 - Ed F. Owens, Vessing Road - Building Site Approval - 1 Lot -
~ontinued from April 13, 19~4
The Secretary advised that the applicant had requested that this appli-
cation be continued.
Commissioner Crisp recommended that this request be granted.
On the basis of the foregoing, Chairman Norton directed SDR-486 con-
tinued until the meeting on May 11, 1964.
E. SDR-488 - C. W. Cruey, Saratoga-Los Gatos Road - Building Site
Approval - 1 Lot ..
The applicant was present and expressed satisfaction with the proposed
conditions of approval.
Connnissioner Crisp moved, seconded by Commissioner McFall, that the
Building Site Con~nittee Report of April 27, 1964 relative to SDR-488,
C. W. Cruey, be adopted and that the tentative map (Exhibit "A", filed
April) be approved subject to the eonditons detailed in the Building
Site Committee Report; motion carried unanimously.
F. SDR-489 - M. T. Scott, Via Re~ina - Buildin~ Site Approval - I Lot
The applicant was present and expressed satisfaction with the pro-
posed conditions of approval.
Con~nissioner Crisp moved, seconded by Con~nissioner McFall, that the
Building Site Committee Report of April 27, 1964 relative to SDR-489,
M. T. Scott, be adopted and that the tentative map (Exhibit "A",
filed April 17, 1964) be approved in accordance with the site develop-
ment plan (Exhibit "B", filed April 27, 1964) subject to the conditions
detailed in the Building Site Committee Report; motion carried
unanimously.

filed April 17, 1964) be approved subject to the conditions detailed

Coa~nissioner Crisp advised that the applioant had been present
earlier in the evening and had expressed satisfaction with the pro-
posed conditions of approvalo

filed April 17~ 196~) be approved in accordance with the site develop-

IV, DESIGN REVIEW
A. A-141 - Claude T. Lindsay, Cox Avenue - Final Design Review - Subdivi-
sion Homes - Continued from April .13s 1964
Commissioner Cowley advised that a further meeting with the applicant
~uld be necessary so reco-~ended that this application be continued.
On the basis of this reconnendation, Chairn~n Norton directed A-141,
Claude T. Lindsay, continued until the meeting on l~ay 11,
B. A-114 - Eichler Homes, Inc. , Cox Avenue - Final Design Review - Subdi-
vi.sion Homes
Co.~.issioner Cooley advised that the Design Review Conmittee had
reviewed the exhibits and found that further details ~ere needed.
He recommended that this appltoation be continued to allow adequate
time for a meeting between the Committee and the applioant.
Chairman Norton directed A-114 continued until the meeting on ~ay 11,
C. A-145 - Joseph Long, Saratoga Avenue - Preliminary DesiSn Review
Office Building
C~h.issioner Cowley advised 1) adequate parking had not been indicated
on the site plan 2) the applioaut had been advised and 3) a con-
tinuance had been requested.
On the bas~s of the foregoing, Chairman Nortom directed A-145 con-
tinued until the meeting on Nay 11, 1964.
D. A-146 - Corinthian Studios. Saratoga-Los Catos Road - Preliminary
Design Review - Sales and Storage Building
Architect Warren lteid mas present to discuss this application with
the Counnission.
Commissioner Cooley advised 1) after discussion the Connittee had
a~reed that nine parkin~ spaces in addition to the five recently
acquired ~ould be sufficient for this site 2) it was felt that
Heid*s solution ~as the best possible so there were no objections
to the architecture and 3) it ~as the recomrn~ndation of the Com-
mittee that this matter be continued to allow sufficient time for
revision of the site plan.
D~ A-146 - Corinthian Studios
On the basis of this reco~nandation, Chairman Norton .directed A-146

Connnissioner Cowley advised that the Committee had reviewed the
exhibits and had no objections to the subject sign.
Commissioner Cooley moved, seconded by Connnissioner Clenn, that A-147,
sign fur St. Ntchaels Church, be approved as shown on Exhibits "A" and

V. CITX. COUNCIL REPORT
Chairman Norton gave a brief repurt on the City Council meetinE of April 15,
1964, with particular emphasis on the following:
1) John T. Ball ~as appointed Chief of Police to replace retirinE Police
Chief Barney Rosesco.
2) RetirtnE Councilman Burton Brazil was presented with a plaque.
3) The County had proposed a uniform house numberin8 system but the
Council preferred to use the existing system in Saratoga.
4) The Council authorized the PlanninE Director to review the General
Plan with the assistance of additl~unl temporary pers(mnel,
5) 19here ~as discussion of an agreement between Saratoga, l~onte Bereno
and Los Gatos relative to p~ssible areas ~f aunexation. The metter
~xs continued to allow time fur stndy to establish policy.
VI. NEW BUSINESS
The Secretary advised that the ~niversity of Califurnia Divisien sf
Extension ~as holdinE a shurt course fwr PlanninE Cu~issi~ners on May 7th
and 8th in San Francisco,
Chairman Nurton requested that information pertaining to this m~tter be
mailed to each of the Co-~m{ssioners.
VII. OLD BUSINESS
A. Design Standards - Continued from April 13~ 1964
Cutumissioner Cowley advised that the Com{ttee had no further report
at present and suggested that this item be continued off the agenda
until the repurt had been prepared.
Chairman Nurton so directed.
B. Ordinance ~8.1 - An Ordinance amending the Saratoga City Code by addinE
Article VI to Chapter 13 thereof, relatinE to Official
Plan Lines - Continued from April 13~ 196Z+
The Secretary advised that the repurt was not ready and suggested that
this matter be continued until the next regular meeting.
Chairmen Norton directed discussion of Ordinance 38.1 continued until
the meeting on May 11, 1964.
C. B.t. Charles Street - Council Request fur Review of RIght-of-Way and
Improvement Requirements
Com~,issioner Crisp advised I) full street improvements had uriEinally
been proposed because of the a~artment development alonE this street
2) the Subdivision C~mittee, in view of the City Council referral,

had requested that the Planning Director and City Engineer review
this proposal 3) seven alternate proposals had been submitted by the
Planning Director and City Engineer 4) the Cu~ulttee ~ould like to
review these proposals further since one proposal in particular, that
for a one-way street, was quite interesting 5) therefore, a con-
tinuance ~a8 requested,
On the basis of the foregeing, Chairman Norton directed this matter
