ROUTINE ORGANIZATION : The meeting ~as called to order by Chairman Norton at 7:30 P. M. A. ROLL CALL Present: Commissioners Crisp, Cowley, Glenn, Kellum, McFall, Norton, and OgRorke~ Absent: None. B. MINUTES Commissioner Cowley moved, seconded by Commissioner Kellum, that the reading of the minutes of'April 13, 1964 be ~aived and that the minutes be approved subject to the following modification: Page 3... Insert the following paragraph between paragraphs 3 and 4: "Commissioner Crisp read the reportfor the Subdivision Committee relative to this application, recommending that the application be denied." Motion carried unanimously. II. PUBLIC HEARINGS The 6hairman declared public hearings open for the evening at 7:38 P. M. A. C-67 - Dr. A. W. Bab~enco, ·Saratoga Avenue and Kosich Drive - Change of Zoning from '~-1-~0,'000" (Single Family Residential) to "P-A" (Professional-Administrative} - Continued fromApril 13,. 1964 The Secretary·read a petition opposing the proposed change of zoning which had been signed by 64 residents of the general area. He then read a letter from the applicant setting forth his reasons for request- ing the subject change of zoning. The applicant was present to discuss this matter with the Commission. He presented a map showing the subject property in relation to San Jose, together with photos of the vicinity. He also read a statement favoring the proposed change of zoning which had been signed by 16 residents of the immediate area. MRS, DELORES PEARSON, Radoyka Drive, opposed the granting of this change of zoning on the basis ~f traffic congestion. After further discussion, Chairman Norton directed C-67 continued until the meeting on May 11, 1964, and referred same to the Subdivision Com- mittee for study and a report at that time. B, C-68 - Mason Enterprises, Inc., Wardell Road - Change of Zoning from "R-l,15,000" and '~-l-40,000"(Single Family Residential) to '~-1-15,000 P-D" (Single Family Residential Planned Unit p~velopment) - Continued from April 1~.~ 1964 -1- II. C.-68 - Mason Enterprises~ Inc. : Dick Roger, was present to represent Mason Enterprises, Inc., but stated that he had no further comment. MARSHALL HALL, Wardell Road, observed that the objective of incorporation had been to keep Saratoga a low density city and that while this one subdivision might not greatly affect the City, it ms one of many appli- cation for development that could slowly deplete the low density areas. There was no one. else present who .wished to cogent with regard to this matter. Commissioner Crisp read the report' of the Subdivision Committee relqtive to this application, recommending .that it be denied. Commissioner Glenn moved, seconded: by Commissioner Crisp, that the public hearing on C-68 be closed; motion carried unanimously add the hearing was closed at 7:55 P. M. C. ~-242 - Stephen,, Glenmont Drive - Variance in connection with Front and Side Yard Setback Requirements - Continued fromApril 13~ 1964. The Secretary advised that the engineering studies requested by the Variance Committee had been received but the applicant had n~t sub- mitted the written agreement with the adjacent property owner. The applicant was present and reaffirmed the oral .agreement w~th his neighbor and stated that a written agreement would be filed. Commissioner Kellum advised 1) the Variance Committee had visited the site and conferred with the applicant 2) the requested engineering studies had not been received in time for review by the City Engineer and 3) the Committee felt that'a written statement from Mr. Stephen, neighbor should be filed for r~cord. After further discussion, .Chairman Norton directed V-242 continued until the meeting on May 11, 1964, at which time the Variance Com- mittee will give a further report. II. D. W. T. Sowell - Request.for PlanBing Commission to add Dance Studio to list of Permitted Uses for C-N (Neighborhood Commercial) Zonin~ District ~ Continued ~rom Apri~ 13~ 1964 The hearing on this matter was.opened at 8:01P. M. The Chairman explained that it ~ras an infor.mal hearing to allow residents of the area to express their opinion.' The Secretary advised that Notices of Hearing had been mailed to all property owners within a 500 foot radius of the subject property and there were no written communications on file. There was no one present who wished to comment with regard to this matter. Commissioner Crisp advised thai, based on the available information, it appeared that the neighbors ]did not object but it was the feeling of the Subdivision Committee that a use such as this could be con- ditioned. Commissioner Kellum explained that the City Attorney had suggested in a telephone conversation with the Staff that the'subject use be added as a permitted use subject to the granting of a Use Permit. Commissioner Crisp moved, seconded by Commissioner Kellum, that the public hearing'be closed; motion carried unanimously and the hearing was closed at 8:08 P. M. -2- II. D. W. T. So~ell Commissioner Crisp moved, seconded by Commissioner Kellum, that the following be added to Section=7.2a(1) of Ordinance NS-3: "Music and Dance Studios subject to the granting of.a use Permit in accord with Article Motion carried. unanimously. The Staff advised that the City At'torney had suggested that the Zoning O~dinance be amended to allow the Planning Commission to add conditional uses in the same manner that they 'are now allowed to add permitted uses. Chairman Norton requested that the' Subdivision Committee begin work on the draft of this amendment. II. E. V-243 - E. L. Isbell, Thelma Avenue - Variance to allow an 8' Side Yard Setback in lieu o'f the required 10' Side Yard Setback The hearing on V-243 ~s opened at 8:12 P. M. The Secretary advised that Notices of Hearing had been mailed and only one written communi- cation had been received. He then read the communication which was a letter from Robert Finnie, adjacent property owner, favoring the granting of the subject Variance. The applicant was present and explained 1) finances had prevented his building a garage at the time the house was built 2) now that he could afford the garage he could not meet the requirements of the existing Ordinance so 3) a Variance was needed. There was no one else present Who wished to comment with regard to this application. ; After discussion, Chairman Norton directed V-243 continued until the meeting on May 11, 1964, and referred same to the Variance Committee for study and a report at that.time. F. V-244 - Virgil P. Force, Buckhall Road - Variance to allow 21' Front Yard Setback in lieu of the required The hearing on V-244 was opened at 8:19 P.M. The Secretary advised that Notices of HearinE had been mailed and there were no written communications on file. Mr. Force was present and explained that it was necessary for him to put a new roof on his home so fie would like to add the subject porch at the same time. There was no one else present who wished to speak with re~ard to this matter. Chairman Norton directed V-244 'continued until the meeting on May 11, 1964, and referred same to the ZVariance Committee for study and a report at that time. The Chairman declared public hearings closed for the evening at 8:25' P. M. TEN MINUTE RECESS Chairman Norton welcomed Mrs. Ottenberg Of the League of Women Voters and Smith of the Good Government Group and expressed appreciation fo~ their attendance. III. SUBDIVISIONS AND BUILDING SITES A. SDR-474 - Lloyd C. Tidball, Palomino Way - Building Site Approval - 1 Lot - Continued from April 13~ 1964 -3-: III. A. SDR-474 - Lloyd C. Tidball Con~nissioner Crisp advised that the requested site development plan had not been received so recommended that this application be continued. On the basis of this recommendation, Chairman Norton directed SDR-474 continued until the meeting on May 11, 1964. B. ~DR-4~.- Walter E. Mileman, 'Peach ttill Road - Building Site Approval - 1 Lot - Continued from Apri! 13., ~964 The applicant ms not present. Commissioner Crisp moved, seconded by Commissioner McFall, that the Building Site Committee Report of April 27, 1964 relative to SDR-482, Walter E. Mileman, be adopted and that the tentative map (Exhibit "A", filed March 13, 1964) be approved in accordance with the site develop- ment plan (Exhibit "B", filed April 27, 1964) subject to the conditions outlined in the Building Site Committee Report; motion carried un- animously. C. SDR-484 - Andrew P. Lassen, Sobey Road - Building Site Approval - 2 Lots - Continued .fromApril 13, 1~64 The applicant was present and expressed satisfaction with the pro- posed conditions of approval.. Commissioner Crisp moved, seconded by Commissioner McFall, that the Building Site Committee Report of April 27, 1964 relative to SDR-484, Andrew P. Lassen, be adopted and that the tentative map (Exhibit "A", filed March 27, 1964) be approved in accordance with the site develop- ment plan (Exhibit "B", filed April 27, 1964) subject to the condi- tions detailed in the Building Site Committee Report; motion carried unanimously. D. SDR-486 - Ed F. Owens, Vessing Road - Building Site Approval - 1 Lot - Continued from April 13, 1964 The Secretary advised that t~e applicant had requested that this appli- cation be continued. Commissioner Crisp recommended that this request be granted. On the basis of the foregoing, Chairman Norton directed SDR-486 con- tinued until the meeting on May 11, 1964. E. SDR-488 - C.'W. Cruey, Saratoga-Los Gatos Road - Building Site Approval - 1 Lot The applicant was present and expressed satisfaction with the proposed conditions of approval. Commissioner Crisp moved, seconded by Commissioner McFall, that the Building Site Committee Report of April 27, 1964 relative to SDR-488, C. W. Cruey, be adopted and that the tentative map (Exhibit "A", filed April) be approved subject to the conditons detailed in the Building Site Committee Report; motion carried unanimously. F. Scott, Via Regina - Building Site Approval 7 1 Lot The applicant was present and expressed satisfaction with the pro- posed conditions of approval~ Commissioner Crisp moved, seconded by Commissioner McFall, that the Building Site Committee Report of April 27, 1964 relative to SDR-489, M. T. Scott, be adopted and that the tentative map (Exhibit "A", filed April 17, 1964) be approved in accordance with the site develop- ment plan (Exhibit "B", filed April 27, 1964) subject to the conditions detailed in the Building Site Committee Report; motion carried unanimously. ~4- III. Commissioner Crisp moved, seconded by Connnissioner McFall, that the Building Site Committee Report of April 27, 1964 relative to SDR-~90, Joseph Longs be adopted and that the tentative map (Exhibit filed April 17, 1964) be approved subject to the conditions detailed in the Building Site Committee Report; motion carried unanimously. H. SDR-491 - Jerry N. Broadus, Bohhnann Road - Building Site Approval - I Lot Commissioner Crisp advised that the 'applicant had been present earlier in the evening and had expressed satisfaction with the pro- posed conditions of. approval.. Commissioner Crisp moved, seconded by Commissioner HcFall, that the Building Site Connittee Report of April 27, 1964 relative to SDR-491, Jerry N. Broadus, be adopted and that the tentative map (Exhibit "A", filed April 17, 1964) be approved in accordance with the site develop- merit plan (Exhibit "B", filed' April 27, 1964) subject· to the conditions outlined in the Building Site Connnittee Report; motion carried mcus ly. . IV. DESIGN REVIEW A. A, 141 - Claude T. Lindsay, COx Avenue - Final Design Review - Subdivi- sion Homes - Continued from A~ril 13~ 196.4 Commissioner Cowlay advised that a further meeting with the applicant would be necessary so recoaended that this application be continued. On 'the basis of this reccnnendation, Chairman Norton directed A-141, Claude T. Lindsay, continued .until the meeting on Hay ll, 1964. B. A-114 - Eichler Homes, Inc., Cox Avenue - Final Design Review - Subdi- vision Homes '. Commissioner Cowlay advised that the Design Review Committee had reviewed the exhibits and found that further details were needed. He reconnended that this app!ication be continued to allow adequate time for a meeting between the Committee and the applicant. Chairman Norton directed A-114 continued until the meeting on May 11, 1964. C. A-145 - Joseph Long, Saratoga Avenue - Preliminary Design Review - Office Buildin~ . C~issioner Cowley .advised [1) adequate perkinS had not been indicated on the site plan 2) the appl. icant had been advised and 3) a con- tinuance had been requested. ~= On the basis of the foregoing, Chairman Norton directed A-145 con- tinued until the meeting on Hay 11, 1964. D. A-146 - Corinthian Studios, Saratoga-Los Gatos Road - Prelhninary DesiSn Review - Sales and Storage Buildin~ Architect Warren Heid was present to discuss this application with the Commission. Commissioner Cowley advised 1) after discussion the Committee had agreed that nine parking spaces in addition to the five recently acquired would be sufficient for this site 2) it was felt that Mr. Heid~s solution was the best .possible so there were no objections to the architecture and 3) it was the recommendation of the Com- mittee that this matter be continued to allow sufficient time for revision of the site plan. On the basis of this recomm~-'dat~n~ Chairman Norton directed A-146 continued until the meeting o.n May 11, 1964, E. A-147 - St. Michaels Church~ Allendale Avenue - Final DesiSn Review - .. Commissioner Cowley advised that the Connittee had reviewed the exhibits and had no objections to the subject sign, Commissioner Cowley moveds seconded by Co~nissioner Glenns that A-147s sign for St. Michaels Churchs' be approved as shown on Exhibits 'A' and 'B'; motion carried unanimons.ly. Vo CITY COUNCIL REPORT : Chairman Norton gave a brief rep~t on the City Council meeting of April 15 1964, with particular emphasis on the following= 1) John T. Ball was appointed Chief of Police to replace retiring Police Chief Barney Rosasco. 2) Retiring Councilman Burton Brazil ~as presented with a plaque. 3) The County had proposed a uniform house numbering system but the Council preferred to use the existing system in Saratoga. 4)The Council authorized the Planning Director to review the General Plan with the assistance of additional temporary perscnnel. 5) There was discussion of an aSr. eement between Saratoga, Monte Sereno and Los Catos relative to possible areas of annexation, The matter ms continued to a'llow trine for study to establish policy. VI, NEIq BUSI}IESS The Secretary advised that the University of California Divisien ef Extensi~n was holding a short course fbT Planning Commissi~ners on May 7th and 8th in San Francisco. Chairman Norton requested that information pertaining to this matter be mailed to each of the Commissioners. VII, OLD BUSINESS A, Design Standards - C.ontinued fr. om A~r~l 13~ 196.4 Commissioner Cowley advised that the Co _mm_ittee had no further report at present and suggested that' this item be continued off the agenda until the report had been prepared. Chairman Norton so directed.: B. Ordinance 38.1 - An Ordinance's amending the Saratoga City Code by adding Article VI tb Chapter 13 thereof, relating to Official Plan Lines -' Continued from April 13~ .1964 The Secretary advised that the report was not ready and suggested that this matter be continued until the next regular meeting. Chairman Norton directed discussion of Ordinance 38.1 continued until the meetin~ on May 11, 1964. C. St. Charles Street - Council Request for Review of Riaht-of-Way and Improvement Requirements Cc~missioner Crisp advised 1) full street improvements had originally been proposed because of the apartment development along this street 2) the Subdivision Cummittee, in view of the City Council referrals -6- VII, C, St, Charles' St~.eet : had requested that the Plann.ing DirectOr and City Etigineer review this proposal 3) seven alternate proposals had been submitted by the Planning Director and City Ehgineer 4) the Committee would like to review these proposals further since one proposal in particular, that for a one-~ay street~ ~as qu.ite interesting 5) therefore, a con- tinuance ~as requested, 0n the basis o£ the forege.ing, Chairman Norton directed this matter continued until the meeting On 14ay 11, 1964, VIII, COI~tlINICATTONS A, 14RITTEN B, ORAL IX, AD3OURNNENT Chairman Norton declared the meeting adjourned at 9:35 P, N,
