PLACE: Saratoga High School, Herriman Avenue, Saratoga, California TYPE: Regular Meeting I. ROUTINE ORGANIZATION The meeting was called to order by Chairman Norton at 7:30 P. M. A. ROLL CALL Present: Commissioners Crisp~ Glenn, Kellum, McFall, Norton and O'Rorke. Absent: CommisSfoner Cowley~ (Comissioner Cowley arrived at approximately 7:34 P. M. ) B. MINUTES Commissioner Glenn moved, seconded by Commissioner McFall, that the reading of the minutes of=May 11, 1964 be waived and that the minutes be approved as submitted to the Commission; motion car- ried unanimously. II. PUBLIC HEARINGS : Chairman Norton declared public hearings open for the evening at 7:33 P. M. A. V-242 - Stephen Stephens, Glenmont Drive - Variance in connection with Front and Side Yard Setback Requirements - Continued from May 11,. 1964 The Secretary advised that no additional communications had been filed in connection with this'application. CommissiOner Cowley arrived at this time and assumed his chair with the Commission. The applicant was present but. stated that he had no further comment. There was no one else present who wished to speak with regard to this matter. Commissioner Kellum read the report of the Variance Committee rela- tive to this request, recommending that the subject variance be granted since the Committee had been able to make the findings required by law for the granting of a Variance. Commissioner Crisp explained that while this subdivision (Wildwood Heights) had been approved by!the County prior to incorporation, much of the area had been developed under City of Saratoga ordinances. For this reason, he continued, it had been necessary for the Plan- ning Commission to grant a number of variances to make feasible development of these lots possible. Commissioner Glenn moved, seconded by Commissioner Crisp, that.the hearing on V-242 be closed; ~0tion carried unanimously and the Chair- man declared the hearing closed at 7:36 P. M. Commissioner Kellum moved tha~ V-242, Stephen Stephens, application for variance to allow a frontSyard setback of 10 feet and side yard setbacks of 5 feet on the east side and 10 feet on the west side, be granted since the findings required by Section 17.6 of Ordinance NS-3 had been made. V-245 - Ruth & Going, Arroyo de Saratoga - Variance to allow an 8' Side Yard for Lot No~ 147 of the Arroyo de Saratoga Sub- division ( Via Escuela) in lieu of the required 10' Side Yard Setback - Continued from May 11, 1964 The Secretary advised that no further communications had been filed in connection with this application. The applicant was not present, and there was no one in the audience who wished to comment with regard to this· matter. Commissioner Kellum read the report of the Variance Committee rela- tive to this request, recommending that it be denied since the Com- mittee had been unable to make the findings required by law for the granting of a variance. Commissioner Glenn moved, sedonded by Commissioner McFall, that the public hearing on V-245 be closed; motion carried unanimously and Chairman Norton declared the:hearing closed at 7:43 P. M. It was moved by Commissioner~Kellum and seconded by Commissioner O'Rorke that V-245, Ruth & Gbing, Inc., application for variance to allow an 8 foot side yardSsetback for Lot No. 147 of Arroyo de Saratoga, be denied since the findings required under Section 17.6 of Ordinance NS-3 could not be made. Motion carried unanimously. Chairman Norton declared public hearings closed for the evening at 7:44 P. M. III. SUBDIVISIONS AND BUILDING SITES : A. SDR-493 - A. Harold Bray, Vickery Lane - Building Site Approval - 1 Lot - Continued from May 11~..1964 Commissioner Crisp advised that there was a question as to whether or not the subject parcel was a legal lot. He recommended, there- fore, that this matter be continued so that it could be discussed with the City Attorney. On the basis of the foregoing, Chairman Norton directed SDR-493 continued until the meeting on June 8, 1964. B. 8DR-494 - Ruth & Going, Inc., Via Monte Drive - Building Site Approval - 3 Lots . There was no one present to iepresent the applicant. Commissioner Crisp moved, seconded by Commissioner McFall, that the Building Site Committee Report of 25 May 1964 relative to SDR-494, Ruth & Going, Inc., be adopted and that the tentative map (Exhibit "A", dated 14May 1964) be approved subject to the conditions de- tailed in the Building Site Committee Report; motion carried unan- imously. C. SD -495 - Marweig ConstructiOn, Montalvo Lane and Hill Avenue- Subdivision Approval - 8 Lots There was no one present to represent the applicant. Commissioner Crisp explained. that because of monuments and trees, there was a problem in connection with the improvement of Montalvo Lane. For this reason, he continued, the Co~aittee'had requested that the City Engineer prepare improvement plans that would allow the monuments to remain in place and would require. the removal of as few trees as possible. H~ recommended, therefore, that this matter be continued until the next regular meeting to allow ade- quate time for further study. of this matter. A~145 - JQseph Long, SaratOga' Avenue - Preliminary Design Review - Office Building'- Continded from~__~q~Lll.'~. 1964 CommiSSioner Cowley advised l) the Committee had discussed the sub- ject plans with the architect and had recommended that the p~rking stalls be redesigned to provide better~acces~ 2) because of the increasing number of small cars, the Committee had f~!t that coni sideration should be given to small car stalls bu~ had Suggested to the architect that not. more ~han two of the ~wenty stalls. be. pro~ posed as such and 3) t~e revised plan reflected these suggestions. After. further discussion, Commissioner Cowley. moVed that A-145, Joseph Long, be granted preliminary design approval of the office building as shown on Exhibit :"A-2", filed May 25, 1964. Commiss- ioner Glenn seconded the moti0~ which carried unanimously. B. A-146 ~ ~orinthian Studios, Saratoga-Los Gatos Road - Preliminary Design Review - Sales and Storage Building - Continued from. May 11~ 1964 Commissioner Cowley advised that the Design Review Committee had met with the architect to discuss the subject plans and it was agreed 1) the apartment would be eliminated 2) the new building would be limited to storage and commercial service furniture sales and 3) while the revised plan indicated that the apartment had been elimin- ated, it did not specify a restriction on the use of the new build ing. There was no one present to represent the applicant. After further discussion, Con~nissioner Cowley moved that A-146, Corin- thian Studios, be granted preliminary design approval in accordance with EF~ibit "A-I" subject to 1) sales area to be designated as "Com- mercial Service Sales Enterprise" and 2) sufficient parking signs to be posted prior to occupancy of the building. Comnissioner Glenn seconded the motion which carried unanimously. C. A-141 - Claude T. Lindsay, Cox Avenue - Final Design Review - Sub- division Homes Commissioner Cowley explained that the applicant had submitted plans for a split level model (~333) with a request that he be allowed to use it in Unit I of Tract 3742 in lieu of the two story model (~4205) approved by the Commission on May 11, 1964. After discussion, Commission~r Cowley moved, seconded by Commissioner Glenn, that A-141, Claude T. Lindsay, be granted final design approval of the split level model (~333) as shown on Exhibit "B-3" and that the applicant be allowed to alterZnate this model with the two story model (~4205) previously approved for Unit I of Tract 3742 in lieu of being allowed to substitute the sp!it level for the two story as requested; motion carried unanimously. D. A-150 - Lou J. Chabre, Big Basin Way - Final Design Review - Addition for Whitlow's Department Store and Saratoga Drug Store Mr. Higgins of Higgins and Root was present to represent the applicant. He advised that while details had not been worked out in connection with the parking area, both he and the applicant were a~mre that it would be necessary to provide the required parking. He requested that preliminary approval be granted so that they could proceed with working drawings. Planning Commission Minutes - May 25, 1964.- Continued IV. D. A-150 - Lou J. Chabre. Big Basin Way After discussion, Commissioner Cowley moved that A-150, Lou J. Chabre, be granted preliminary design approval of the addition to Whitlow's Department Store and the Saratoga Drug Store as shown on Exhibit "A", filed May 12, 1964, subject to 1) the required parking to be paved and marked at the rear of the building in accordance with City standards and 2) alignment of the parking area to be in conformity with the General Plan and the Village Parking District as proposed by the Planning Director, and to the satis- faction of the Planning Commission. Commissioner Glenn seconded the motion which carried unanimously. 5 MINUTE RECESS : Chairman Norton acknowledged, with Rleasure, the presence of Mr. Merke,1 of the Good Government Group and Mrs. Ottenberg of the League of Women Voters and expressed the Commission's appreciation for their attendance. V. CITY COUNCIL REPORT Commissioner McFall, who represented the Commission.at the City Council meeting on May 20, 1964, gave a brief report on action taken. Items of particular interest to the Commission included: 1) Ordinance 38.2, an ordinance' prohibiting parking on public thorough- fares for more than 72 hours or for the purpose of repairing or dis- playing vehicles for sale,.was adopted by the Council. 2) Actlob on Ordinance NS-3.6, which pertains to Planned Community Dis- tricts, was continued for t~e purpose of incorporating suggestions made by the City Attorney. 3) The Council continued action on the application of ~son Enterprises for Change of Zoning 4) C-67, application for Dr. A.Z W. Babienco for Change of Zoning, was denied. 5) The Council expressed concurrence with the Planning Commission recom- mendation relative to improvement requirements on St. Charles Street, but continued action to consider the needs of the School District and flexibility in changing direction of traffic flow if warranted at a later date. VI. NEW BUSINESS VII. OLD BUSINESS A. Design Standards Commissioner Cowley requested that the Secretary revise the Design Standard draft by inserting the requirements relative to driveways and garages, then mail copies to the Commission, the Planning Com- mittee and the City Attorney for review. He further requested that this item be placed on the a'genda for the meeting on June 8, 1964. Commissioner Glenn suggested that the Secretary draft a resolution for the adoption of these standards. B. A-148 - Douglas Larson, Big Basin Way - Sign for La Chains 'dor Restaurant The Secretary advised that Mr. Larson had submitted for approval of the Commission the stained glass proposed for use in the subject sign. A-148 - DoqF~_!las Larson, Big Basin WaX After discussion, Conraissioner Cowley moved, seconded by Commissioner Glenn, that the stained glass!proposed for use in the La Chaine 'dor Restaurant sign be approved and, with permission of the applicant, that the red lettering on the sign be changed to black lettering. Motion carried unanimously. C. Violations In ans~qer to an inquiry 'from COmmissioner Glenn, the Secretary explained that the matter of the violations in connection with the office of John L. Ostrowski Associates On Saratoga AVenue (forrderly the R6bert Neale Antique Shop) had been referred to the City Attorney for further action. VIII. CO}~4UNICATIONS A. WRITTEN 1. SDR-486 - Ed F. Owens, Vessing Road - Request for Reconsider- ation Commissioner McFall read the report of the Building Site Committee relative toZthe subject request for reconsideration. After discussion, Commissioner Crisp moved that the report of the Building Site Committee relative to Mr. Owens' request for reconsideration in connection with SDR-486 be adopted and transmitted to the City Council as the recommendation of the Commission. Commissioner Kellum seconded the motion which carried unanimously. 2. SDR-384 - Fenton E. S~lvey, Norton Road - Request for Extension Commissioner Crisp advised that the applicant had filed a written request for an extension of one year in connection with SDR-384. Commissioner Crisp moved, seconded by Commissioner Kellum, that an extension of One year from present date of expiration (May 29, 1964) be granted in connection with SDR-384; motion carried unanimously. 3. SDR-400 - William McKinnon, Pierce Road - Request for Extension Commissioner Crisp advised that Richard J. Hunter, new owner of the subject property, had requested an extension to allow additional time for compliance with the conditions of approval. After discussion, Commissioner Crisp moved that an extension of one year from date' of expiration (~y 27, 1964) be granted in connection with SDR-400; Commissioner Kellum seconded the motion which carried unanimously. 4. SDR-421 - M. A. Broemser, Saratoga Hills Road - Request for Extension Commissioner Crisp advised that the applicant had requested an extension of one year in connection with SDR-421. Commissioner Crisp moyed, seconded by Commissioner McFall, that an extension of one year from the date of expiration (June 10, 1964) be gra~mted in connection with SDR-421, Milton A. The Secretary read a communication from the Tri-Counties Apart- ment Association, Inc., which had been transmitted together with a resolution petitionin~ the Planning Commission to institute a study of the present critical vacancy factor with particular emphasis on a program curbing und~sirab!e and uncontrolled expansion of multiple zoning. After a brief discussion the Commission agreed that because of Saratoga's policy relative to apartment zoning, the requested study'would not be necessary, but requested that this communica- t ion be filed with the items for General Plan Review.
