PLACE: Saratoga High School, Herriman Avenue, Saratoga, California, TYPE: Regular Meeting. I, ~OUTINEORGANIZATION The meeting ms called to order by Chairmen Norton at 7:30 P. M, A. MINVEES Cou~lssioner Glenn Moved, seconded by Commissioner Crisp, that the reading of the minutes of June 8, 1964 be waived and that the minutes be approved as submitted to the Commission; motion carried unanimously. II. PUBLIC HEARI.N. GS Chairmen Norton declared public hearings open for the evening at 7:34 P. M. A, C-69 - Mario R, Barbieri, Prospect Road - Change of Zoning from '~gricultural" to '~-1-10,000" (Single Family Residential The hearing on C-69 was opened at 7:35 P. M. The Secretary advised that a Notice of Nearing had been published and there were no written co~unications on file, He then briefly reviewed this application. Gene Mastin, engineer for the applicant, was present and advised that so far as they knew the subject application was in conformity with the objectives of both the Zoning Ordinance and the General Plan. Commissioner Kellum arrived at approximately 7:40 P, M, and assumed his chair with the Commission, There was no one else present who wished to comm-nt with regard to this matter. After discussion Chairman Norton referred C-69s Mario R. Barbieri, to the Subdivision Committee for study and a reports then directed this application continued until the meetins on July 13, 1964. B. The Secretary advised that a Notice of Hearing had been published and there were t~o written communications on file. He then read 1) applicantss statement of reason for proposed change of zoning and 2) a peti- tion signed by 111 residents of the immediate area opposing the pro- posed change of zoning. -1- Planning Coxmnission Minutes - June 22~ 1964 - Continued B. R, MagSiore Edward LaCrotxs appllcantss attorneys ~ns present and advised l) the applicant had previously filed applications for Hulttple Zonlng and Professional-Administrative zoning but both ~ere denled 2) since the subject property is not appropriate for residential use because of existing zoning and uses in the innsdiets areas there is no market for residential use of this property 3) the development proposed will not offer competition for the Quito Shopping Center and 4) it is felt that a study should be made of this corner (northwest cornor of intersection of Saratoga and Cox Avenues) to determine proper use of this perty~ .' Chairman Norton inquired as to whether it would be agreeable with the applicant to allow the General Plan Conmittee study this matter in the me]or review of the General Plan scheduled sometime within the next year, I~, LaCroix advised that he would like to confer wi~h M~', Maggiore before connnenting, O, W, JOHNSONs ~R,s Saratoga Glen P].aces ~ae present to represent the residents who signed the petition opposing this proposed changes together with approximately 35 other residents who had st~ned the petition, He stated 1) the subject property is located in a resi- dential area 2) the property is within a block of the Quito Shop- ping Conter~ within a mile of the West Valley Shopping Centers and little mo~e than a mile from the Argonaut Shopping Centers so it ~as felt tlmt no further c~m~uercial area ~s needed in this neigh- borhood 3) the intersection is busy but the traffic light slimi- ronies any problems £or the residents 4) Mr, Maggiore (the appli- cant) had on two previous occasions filed for zoning other than residential and residents of the area had cane in each time with an alternate plan for residential use, He then presented a pro- posed plan for a seven lot subdivisions each lot containing 18s000 square feet and fronting on a cul-de-sacs which development would preserve the majority of the ~alnut trees, In answer to a question from the chairmans Mr, Johnson etated that only a small church could be built on this property because of the parking requirements, KENNETH F, SANFORDs Saratoga Glen Places stated that he felt the subject property could be developed into very desirable residential area by erecting a ~all or fence along Saratoga and Cox Avenues, FLOYD A, STEINBERGs Saratoga Glen Places observed that Heuterrey Pines could be planted along the fence o~ ~all proposed by Mr, Sanford to farther screen a subdivision, JUSTIN VE~NEMANs Saratoga Glen Courts indicated that he felt that the proposed comm~rcial development would create a far greater problom at this intersection than a residential development would, He observed that the proposed development would require a great number of trucks which could ereate quite a hazard at this inter- section, After further discussions Chairman Norton referred this matter to the Subdivision Connittee for study and a reports then directed C-Y0 continued until the meeting on July 13s 1964, C, UP-6? - Claude T, Lindsays Cox Avenue - Use Permit for Temporary Sales Office - Lot 2~ Unit I~ Tract 3742 The hearing ou UP-67 ~as opened at 8:12 P, M, The Secretary ad- Vised that Notices of Hearing had been mailed and there ~ere no k~citten connuntcations on file, He then briefly reviewed the subject application and read a Staff Report recommending approval subject to certain conditions, -2- Plannin~ ConnissionNfnutes - June 22m 1964 - Continued C. Harold Brays Vickery line - Building Site Approval - 1 Lot - Continued from June 8~ 1964 The Secretary advised that the applicant ms unable to be present because of illness but had requested that the Cu,,-,~fssion proceed with approval of his tentative map if possible. Commissioner Crisp movedr seconded by Commissioner Kellum Building Site Committee Report of 22 June 1964, relative to SDR-493 be adopted and that the tentative map (Exhibit ~"~ filed 27 April 1964) be approved in accordance with the site development plan (Fadlibit "B", filed 22 June 1964) subject to the conditions detailed in the Building Site Committee Report; motion carried ~-~nnimously. B, SDR-497 - NoJet Company, Inc.s Quito Road - Building SiZe Approval 3 Lots - Continue.d from June 8~ 196~ At the request of the applicant~s representative, Hrs, Ann limbourne, Chairman Norton directed SDR-497, NoJet Company, Inc., continued until the meeting on July 13, 196~. Commissioner Crisp moved, seconded by Con~nissioner McFall, that the Subdivision Committee Report of 22 June 196/4 relative to SD-~99 be adopted and that the tentative map (Exhibit '~-2", filed 15 June 196~) be approved subJec~ to =he conditions outlined in the Subdivision Com- mittee Report; motion carried umanimously. ~, SDR-500 - ~ames R. Johnson Cor. misstoner Crisp moved, seconded by Commissioner McFall, that the Building Site Committee Report of 22 June 1964 relative to SDR-500 be adopted and that the teutative map (Exhibit *~", filed 29 Nay 1964) be approved in accordance with the site development plan (Exhibit filed 18 June 1964) subject to the conditions outlined in the Building Site Committee Report; motion carried unanimously. F. SD-501 - L. A. D. Development Company, Sobey Road - Subdivision Approval - 9 Lots - Continued from June 8s 1964 Commissioner Crisp advised that the applicant had requested that this application be continued since additional time ~as needed to ~ork out a problem relative to the semer requirement and to apply for a Variance ia connection with lot dimensions. On the basis of this request, Chairman Norton directed SD-501 continued until the meeting on July 13, 1964. G. SD~.496 - Nario R, Barbieri, Prospect Road - Subdivision Approval - 19 Lots Since no action had been taken on C-69~ application for Change of Zoning filed in conjunction with this applioation, Chairman Norton directed SD-496 continued until the meeting on July 13, 1964. H. SD-503 - Clay NcCullough & Company, Sobey Road - Subdivision Approval 10 Lots Comm~ssioner Crisp advised that the applicant mas in the process of having his tentative map revised and site development plans prepared, so reconunended that SD-503 be continued until the next regular meeting. Chairman Norton so directed. I. SDR-504 - Charles P. Conran, Pierce Road - Building Site Approval - The applicant expressed satisfaction with the proposed conditions of apprvval. Co~mtesioner Crisp moved, seconded by Cvmissioner McFall, that the Building Site Committee Report of 22 June 1964 relative to SDR-504 be adopted and that the tentative map (Exhibit ~"s filed 9 June 1964) be approved subject to the conditions derailed in the Building Site Committee ReportJ motion carried unanimously. J. SDR-505 - Elmer E. Scherfs Canyon View Drive - Building Site Approval - Counnisetoner Crisp advised ~hat the requested site development plan had not been submitted so rec~u~nded that this application be con- tinued. On the basis of this rec~-~udation~ Chairman Norton directed 8DR-505 continued until the meeting on July 13, 1964. C, S~-498 - MacKay & Scraps, Inc,, Saratoga-S, mnyvale Road - Subdivision Approval - 25 Lots - Continued The Secretary advised that a cou~uunioation had been received from Fred A, Wool of Wool, Richardson & Colbert requesting that the street pattern for the subject subdivision be designed to provide access to the property of Julia Lan~ and George Buck, located south of the rail- road, w~st of the creek, and east of the Cupertino School District pro- perty, ~. and i~rs. Laug w~re present and explained 1) they had access to Prospect Avenue over the railroad but the access ~as not practical aod 2) they were not concerned wi~h the location of the additional access as loog as it ~as provided, A~ter discussion Chairman Norton referred this mattor to both the Subdivision C~mnittea and the General Plan Co~nittee for study and a report~ thou directed SD-498 continued until the meetin~ on July 13, 1964. Chairman Norton acknowledged, with pleasure, the presence of Councilman Berry, attending for the first time in an official capacity, and ~rs. O~ans of the Good Government Croup, 1V, DBSICN REVIEW. A, .A..-147. - Claude T, Linds~y, Cox Avenue - Final DestErn Review - Subdi- vision Homes - Unit ~ of Tract 3~42 - Continued from June 8, 1964 Cv~lssiouer Covley briefly reviewed this application and explained 1) the applicant had submitted 10 floor plans and 30 elevations for the C~uauission~s approval and 2) ic had been requested that the buyers be allowed to select f~om these the homes for their individual lots, After discussion C~lasioner Covley moved, seconded by Co~issioner O~Rorke, that A-141, Claude T, Lindsay, be ~ranted final design appro- val of Exhibits "A' through "K", comprised of 10 differout floor plans and 30 various elevations, subject to compliance with the Design Stand- a~de for Residential Subdivisions; motion carried Lmnnimously. B. A-150 - Lou J. Chabre, Bi~ Basin ~ay - Final Design Review - Addition ~or ~hitlowss Department Store and Saratoga DF..u~...Store Co~uissioner Cooley briefly reviewed this ~plicattou then raised a question as to the need for signs aE the rear of buildings opening onto public parkinS areas. He advised that he had discussed this possibility with the Planning Director and suggested that perhaps one- half of the sign area allowed for the street frontage might be per- mitted for rear frontage on a public parkin~ area. Aftor discussion Chairman Norton suggested that the Staf~ wake a study as to the need for additional sign area at the rear of buildings open- inE onto public parkin~ areas and report the ~indings to the Commission. Chabre~ £or the addi- tion to ~hitlo~ms Department Store and the Saratoga Drug Store as sho~n on Exhibit ~-1', dated June 15, 1964, ~r~th the exception any signs shove for this addition, action on the signs being deferred pending further study; motion carried unanimously, CIT~ CO~CIL~POR~ Com~nissioner Crisp gave a brief report on action taken at the City Council meeting on June 17, 1964, Items of particular interest to the ~lannin~ Commission included: 1) Ordinance NS-5oS~ relative to hillside development, ~as adopted, 2) l~ro O~ens request for change of conditions in connection with SDR-486 ~as denied, 3)The ordinance pertaining to Planned Codaunity Development ~as adopted. OLD BUSIIqESS Ao Improvement Requirements for Planned Coumnmity Developments - Continued from June 8~ 1964 Upon the recommendation of Co~nissioner Covley, the proposed Improve- ment Requirements for Planned C~f,-,~ity Developments were modified as follows: 1) Item 4 -.l~rf --- Delete the third paragraph ~hich requires that the sprinkler system be designed by a Landscape Architect. 2) Item 6 - ~alks --- Change this section to require that primary walks be concrete and that secondary ~alks be asphaltic concrete, then delete the reference to decomposed ~ranite ~alks. 3) Item 7 - ApparaCu~ Areas --- Change this section so that the curb in the apparatus areas is limited to redweod, After ~urther discussion Commissioner Glenn moved~ seconded by Commis- sionor McFa11, that the proposed Improvement Requirements for Planned Co!-,~nity Developments~ as modifted~ be adopted as a gnide until an appropriate ordinance can be enacted; motion carried unanimously. B, SS-38 - Kirkorian Construction Company~ Klrkmont Avenue and Saratoga- Sunnyvale Road - Subdivision Sign Commissioner Cowley observed that the Commission had approved this sign as proposed except for the condition that the reference to stain be eliminated, leaving the redweod natvxal. He advised that the sign had been erected and that the redwood had been stained in violation of this condition, A~ter discussion Chairmn Norton directed that the Secretary request compliance ~ith the condition established in connection with Co-~-~ssion approval of this Planning Commission Minutes - June 22t 1964 - Continued VIII, C0~IUNICATIONS A. ~tlTTEN SDR-397 - John P. Maltby, Woodbank ~ay - Request for Explanation - C~ntipued from June 84 1964 The Secretary requested that this matter be continued until the next regular meetinn to allow additional time for a more thorouah study of the situation and a conference with the City Attorney. Chairman Norton so directed. B. ORAL 1. West Valley Junior College .~ite Ch!!rman Norton edgised that while two other sites were also being considered, the architect*s choice for the West Valley Junior CellsEe Site was 124 acres on Fruitvale Avenue. He observed that there were few 100 acre sites available in the area of this CellsEe District. This matter was discussed briefly and members of the Commission ex- pressed objections to the proposed Fruitvale location. It was suE- gested that Fw8. O%~ns bring this matter to the attention of the Good Government Croup. 2. Proposed Planned Conunity Development Mr. Resner of Maxmar Investments presented a preliminary plan for a five acre Planned Community Development on ~'alnut Avenue. He ex- plained that "R-M" ZoninE would be required since 20 structures were proposed (four per acre with 22% coverage) consisting of one and two family~ one story, one and a half story~ and one and three-quarter story units. He further explained that his request was only for an indication that the preliminary plan appeared feasible before investinS in more detailed plans. Chairman Norton expressed appreciation for the presentation but plained that the Commission, of course, could not comment because of the possible change to "R-M" Zoning. IX.
