M. l"ne Chairman explained that OPEN HOUSE at Saratoga lligh School had necessi- tated the transfer of the Planning Commission meeting to Foothill School. He further explained that the City had been unaware of this relocation until after the agendas had been mailed, and extended apologies for any inconvenience incurred because of the change. MINTJTES Commissioner Kellum moved, seconded by Co=aissioner Crisp, that the reading of the minutes of September 28, 1964 be waived and that the minutes be ap- proved as distributed to the Commission; motion carried unanimously. A, C-7___~1 - Maxmar Investment Company, Walnut Avenue - Change of Zoning from "R-1-12,500" (Single Family Residential) to '~-M-S,C00 P-C" (Multi- ple Family Residential Planned Community) - Continued from Septem- ber 28, i964 ~e Secretary briefly reviewed this application and advised that the docu- ments re~uested by the Subdivision Committee (Sample Grant Deed and Declara- tion of Covenant, Conditions, and Restrictions) had been submitted, MYREN B. STERN of Los Altos Hills (owP~er of Brookside Glen Apartments) stated that at no time would the use of the easement through the Brooksida Glen Apartment property be extended...that it was a private road and would always be. A. J. OBERI~AUS, Alta Vista Avenue, again opposed the granting of the sub- ject application for change of zoning. In answer to a question regarding Mrs. Eaton, former owner of the subject property, Mr. Resne~ of the Maxmar Investment Comp~any advised that hs was mgare of his obligation and satisfactory arrangements would be made. Commissioner Crisp read the report of the Subdivision Counttree relative to this application. C-71 - Maxmar investment CompanX After discussion Commissioner Crisp moved, seconded by Cou~aissioner Kcllum, that the Subdivision Committee Report of October 2, 1964 relative to Maxmar Investment Company, be adopted and tranmnitted to the City Council with the recommendation that this application for change of zoning be ap- proved. C-73 - Westhope Presbyterian Church, Cox Avenue - Change of Zoning from '~-1-10,0~" (Single Family Residential) to "C-N" (Neighborhood Cpnmercial) - qontinue__dfro~ September 28. 1964 The Secretary briefly reviewed this application and advised that the appli- cant had filed a x~ritten request that the subject property be fezshed to Conditional Neighborhood Commercial, limiting uses to those not already established in the Quite Shopping Center. He also read a letter from Mr. Renzel of the Qulto Shopping Center suggesting that perhaps multiple family zoninE might provide better use of the Church property. Elmer Garrison was present to represent the Church but stated that he had no further comment at this time. After a brief discussion, Chairman Norton directed C-73 continued until the next regular meeting to allow time for further study of this matter. C. C~74 - Frank Bonnet, Pierce Road - Change of Zoning from '~-1-4C,G09" (Single Family Residential) to '~-1-40,C~0 P-C" (Single Family Resi- dential Planned Community} - Continued from ~eptemb~r 28~ 1964 Commissioner Crisp advised that there were no further developments in con- nection with this matter ~:cept that tile applicant had filed a letter granting a three month extension relative to action on the tentative map. In view of this, he suggested that C-74 be continued until the meeting on October 26, 1964. Chairman Norton so directed. D. ~-70 - Robert Adair, Prospect Avenue - Use Permit to allow Cocktail Lounge in Commercial District on Prospect Avenue - Continued from Septera- Ser 28. 1964 The Secretary briefly reviewed this application and read a letter filed by Mrs. Elsie Patrick in opposition to the proposed Use Permit. He then read a letter from Mr. and Mrs. Lloyd Fulton, presented by Rev. Nelson of the Saratoga Avenue Baptist Church, opposing the granting of this Use Permit. The applicant was present but stated that he had no further comment at this time. Rev. Nelson, Messrs. Stapleton, Carhey, Dixon, Adler, and Salter, and Me'- dames McGee and Schults were present to represent the Saratoga Avenue Bap- tist Church, and opposed the granting of this Use Permit on the basis of 1) possible influence of the Cocktail Lounge on the Church and Z) possible increased traffic hazard at the interesection. Commissioner Crisp advised that he and Commissioner Kellum had visited the site and it was their recommendation that this m~tter be continued to allow time for the other members of the Co~ission to nmke an on-site inspection. The hearing on V-249 was opened at 8:35 P. tdo 'l"ne Secretary advised that Notices of Hearing had been mailed and read a communication from LaRue Moo=e, adjacent property owner, stating that he was not interested in sel- ling the applicant additional land as requested. Bill Kaemmerling of George Nolte, Inc. was present to represent the appli- cant. He advised that the City policy relative to creek dedication, toge- ther with the uced for a 40 foot right-of-ways created the need for the subject Variance, He further explained that although the two lots in ques- tion were of substandard depth, they contained more thcn sufficient area. Mrs. Jett, Wardell Road, protested the granting of this Variance on the basis tlmt it would set a precedent in the area. )~s. Ottenberg, Foothill Lane, questioned the purpose of the Ordinance if hardships were to be removed by the granting of variances. After discussion Chairmau Norton directed V-249 continued until the meeting on October 26, 1964 and referred same to the Variance Committee for study and a report at that thee. F. V-250 - Harold A. Beaudole, Wildwood Way - Variance in connection with FJont and Street-Side Setback R~quirements .. The hearing on V-250 was opened at 8:54 P. M. The Secretary advised that Notices of Hearing had been mailed and there ~.zene no ~ritten communications on file. He then read the statement of reason filed in conjunction with the subject application. The applicant wag present but stated that he had no further co=~.ent at this time. Commissioner Kellum advised that the Variance Committee had considered the subject application but was not prepared to make a recommendation at this time. He explained 1) the subject property hss been a legal lot for 60 years 2) tlm applicant's adjacent property is a credit to the neighbor- hood and it was felt that the subject property would be developed in the same manner and 3) the Committee had a few suggestions to make to the applicant when an appointment could be arranged. Mrs. Sherle, Paul Avenue, stated that she was happy that Mr. Beaudoin planned to build a new house in the area but questioned 1) whether the granting of the Variance might set a precedent in the area and 2) whe- ther development of this property might create a traffic hazard at the intersection. After further discussion, Chairman Norton directed V-250 continued until the next regular meeting and referred same to the Variance Co~aittec for study and a report at that time. Tee Chairman declared public hearings closed for the evening at 9:~6 P. M. Corunissioner Crisp advised that a three month extension had been granted in connection with action on the tentative map so suggested that this matter be continued until the next regular meeting. Chairman Norton so directed. B. ~DR-523 - United Presbyterian Church, 11erriman Avenue - Building Site Approva~ - 1 Lot Reese Williama was present to represent the Church and expressed satis- faction with the proposed conditions of approval. Commissioner Crisp moved, seconded by Commissioner Kellum, that the Buil- ding Site Co=~ittee Report of October 13, 1964 relative to SDR-523, United Presbyterian Church, be adopted and that the tentative map (Exhibit "A", filed October 2, 1964) be approved subject to the conditions outlined in the Committee Report; motion carried unanimously. Stubbe, Chester Avenue - Subdiy].sion Approval - 13 Lot~ Commissioner Crisp advised that the Subdivision Committee had met with the applicant's engineer to discuss this subdivision and the Committee would be ready to make a recommendation at the next meeting. In view of the foregoing, Chairman Norton directed SD-524, R. F. Stubbe, continued until the meeting on October 26, 1964. D. SD- 525 - Wynn & Dumas~ W~rdell Road - Subdivision Approval - 11 Lots Commissioner Crisp recommended that this matter be c6ntinued until action had been taken on the Variance (V-249) filed in conjunction with this application. On the basis of this reco~mendation, Chairman Norton directed SD-525, Wynn & Dumas, continued until the meeting on October 26, 1964. E. SDR-526 - }la[ol~ Beaudoin~ Wildwood Way - Buildin~ Site Approval - 1 Lot Co~missioner Crisp explained that since the applicant's application for Variance (V-250 - continued until October 26, 1964) relates to setbacks only, there was no need to delay action on the tentative map. Ihe applicant was present and, after discussion, expressed sauisfacEion with the proposed conditions of approval. Connnissioner Crisp moved, seconded by Commissioner McFall, that the Building Site Committee Report of 13 October 1~64 relative to SDR-526 be adopted and that the tentative map (Exhibit "A"~ filed October 2, 1964) be approved subject to the conditions outlined in the Committee Report; motion carried unanimously. Cormmissioner Crisp read 1) Subdivision Committee Report reconuending approval subject to certain conditions and 2) report relative to access to site, prepared for Chalrman's signacute. biyren B. Stern again advised that access across the Brookside Glen Apart- ment property would be denied and legal proceedings would be instigated immediately. SD-527 - Maxmar I~veZtment Corporation A. J. Oberhaus, Alta Vista Avenue, obsel~-ed that a previous Subdivision CoFanittee Report (August 12, 1964) acknowledged the potential traffic increase on Walnut Avenue but failed to recognize the possible increase on Alta Vista and Williams Avenues. Mr. Rasher, on behalf of Maxmar Investment Corporation, expressed satis- faction with the proposed conditions of approval. Co~missioner Crisp moved, seconded by Commissioner Kellum, that the Sub- division Committee Report of 13 October 1964 relative to SD-527~ Maxmar Investment Corporation, be adopted and that the tentative map (Exhibit "A-I", filed 13 October 1964) be approved in accordance with the final developn~:~t plan (Exhibit "B", filed 13 October 1964) subject to 1) conditions 1 through 11 as set forth in the Subdivision Committee Report and 2) City Council approval of C-71, application for change of zoning of the subject property, and that this application (SD-5~7) be transmitted to the City Council for its study and review in connection with further action on the application for rezoning this property (C-71); motion carried unanimously. It was moved by Commissioner Crisp and seconded by Co~issioner Kellum that the Con~nission make the finding that Condition '~" of the Subdivision Com~ mittee Report of 1~ August 1964 has been met by the applicant as set fortIx in the report from the Chairman dated October 7, 1964~ and that the Chair- man he authorized to sign this statement for the fil~. Motion carried unanimously. IV. DESIGN REVIEW A. A-154 - Richfield Oil Corporation, Big Basin Way - Preliminary Design Review - Plans for Remodel~xg Service Station - Continued from September 28~ 1964 Commissioner Cowlay advised that no further exhibits had been received in connection with this application and recommended that same be continued until the next regular meeting. Chairman Norton so directed. B. A-J]4 - Eichler Homes, Inc., Cox Avenue - Final Design Review - Subdivision Homes for Tract 3572 Co~missioner Co~qley advised that the applicant had submitted a new eleva- tion with a request that he be allowed to substitute same for use in Tract 3572 as sho~.m on the accompanying site plan. He further advised that the new elevation was similar to those already approved for this subdivision and stated that the Design Review Committee had no objections to the pro- posed substitution. Commissioner Cowlay moved, seconded by Commissioner Kellum, that final design approval be granted the new elevation (Exhibit "K") and the new site plan (Exhibit "B-4") submitted under File No, A-114 in connection with Tract No. 3572; motion carried unanimously. C. A-140 - Finnegan Construction Company, Inc. - Final Design Review - Subdi- vision Homes for Traq~ 3034 Comlnissioner Cowley advised l) the applicant planned to use the same elevations for the second unit that were previously approved for the first unit and 2) he had no objection to granting the same flexibility that had been granted in connection with the Lindsay subdivision as to selection of the elevations for the various lots. After discussion Commissioner Cowlay moved, seconded by Cor~missloner Kel- lum, that final design approval be granted A-14~ for the second unit of Tract 3034 subject to submittal of a site plan, complying with Design Standards for Residential Subdivisions, for the approval of the Planning Director; motion carried unanimously. ~lannin~ Commisbion Minutes .- October 13. 1964 - Continued IV. D. ~-141 - Claude T. Lindsay, Cox Avenue - Final Design Revi~ - Subdivision Homes for Tract 3737 Commissioner Cowley advised that the applicant planned to use the same elevations as in the previous unit and that the lay-out indicated tbat the criteria established by the Planning Co~ission was being followed with the exception of one item which the applicant had agreed to change. After discussion Commissioner Cowlay moved, seconded by Commissioner Crisp, that final design approval be granted for the second unit of Tract 3777 as shown on Exhibit I~,~ subject to use of a curved driveway on Lot No. 10; motion carried unanimously. E. ~-156 - Saratoga United Presbyterian Church, Herriman Avenue - Preliminary Design Review - Church Buildin~ Co~issioner Cowley advised that the preliminary plans appeared satisfac- tory, but observed that the building would look better without the side- ~qalk and fence required under the subdivision conditions. ~e Secretary explained that the applicant would not be required to com- ply with the subject condition in connection with construction of the Church. He further advised that the applicant would like to provide par- king at the ratio of t~yo spaces for five seats at the present time and post a bond guaranteeing improvement of the additional spaces at a later date. Commissioner Cow!ey indicated that this might be arranged if a plan was submitted demonstrating that the required number of spaces could be pro- vided on the site. After further discussion Commissioner Cowlay moved, seconded by Commis- sioner Kellum, that A-156 be granted preliminary design approval as shol-zn on Exhibit "A" iqith the provision that at the time of issuance of a building permit a bond be posted guaranteeing iu~rovement of the balance of the required parking spaces that are not being improved at the time of construction of the building; motion carried unaniFausly. F. A-157 - Columbus Savings & Loan, Big Basin Uay - Final Design Review Identification sign for commercial Buildin~ The applicant's representative requested, in addition to the subject application, permission to post a temporary siZn on the front of the building during the period of construction. After discussion Co~nissioner Cowley moved, seconded by Con~issioner Ke!- lum, that final design approval be granted A-157, Columbus Savings & Loan, for the sign shown on Exhibits "A" and "B" subject to the condition that the illumination not exceed 430 milliamperes, and that the applicant be granted permission to erect a temporary sign (4' x 4') o~1 the front of building during the time of construction; motion carried unanimously. -6- Planning Co~aission Minutes .-. CITY COU~.CIL REPORT Commissioner Cowley gave s brief report on action tel:on during the first half of the City Council meeting on October 7, 1964, and explained that he had left at that time because of illness. VI. NEW BUSINESS A. Richfield Oil Corporation - Quito Shopping Center - Request for Informa- tion relative to possible Remodeling or Reconstruction of Station at Paseo Prosads and Cox Avenue Ihe Secretary suggested that this request be referred to the Staff for consultation with the City Attorney and a report to the Commission as soon as pousible. Chairman Norton so directed. B. ~amDbell High School. District, Prospect Aven~e -.[uture School Sit_ae Ihe Secretary read a letter from the Campbell IIi~h School District statin~ that the District was contemplating the purchase of property on Prospect Avenue for a future school site. After discussion Chairman Norton suggested that an informal hearing be held relative to this matter at the next meeting. The Commission con- curred and requested that the Secretary advise the applicant and the newspapers. The Chairman then directed this matter continued until the meeting on October 26, 1954 and referred same to the General Plan Committee for study and a report at that time. C. .Campbell Elementary Schoo.~ Distr~ct, Allendale Avenue - Future School Site The Secretary advised that the Campbell Elementary School District had submitted a letter stating their intent to purchase property on Allendale Avenue for a future Elementary School. After discussion Chairman Norton directed that this matter be included in the informal hearing to be held in connection with the proposed Campbell High School District site and continued same until the meeting on Octo- ber 26, 1964. VII. Snore had submitted a letter requesting an extension of one (1) year in connection with SDR~447. Elizabeth Gaudreau - Big Basin Way - Request that "Real Estate Office" be added to List of Pe_-mitted Uses for Profes- sional-Administrative Distriqt .... ~e Secretary read s letter from Elizabeth Gandreau requesting that '~eal Estate Office" be added to the liste of permitted uses for Professional-Administrative Districts so that her office could be moved to the former Catholic Church property on Big Basin Way. Chairman Norton directed this matter continued until the meeting on October 22, 1964 and referred same to the Subdivision Committee for study and a report at its earliest convenience. 3. Henry A. Dietz Letter re ~roposed I,~.pt Valley Junior College. S4. te Yhe Secretary advised that Henry A. Dietz had submitted a copy of a letter written to the Governing Beard of the West Valley Junior Col- lege District. I~ explained that Mr. Dietz was a resident of Saratoga, a former Assistant Attorney General of Califoznia, a former County Counsel of San Diego County, and, at present, a Professor of Law at the University of Santa Clara, and had written a letter that he felt would be of interest to the Commission. Chairman Norton directed that the letter be filed and suggested that the Commissioners read the letter at their earliest convenience. B.
