PLACE: City Council Chambers, Fruitvale Avenue, Saratoga, California TYPE: Regular Meeting I. ROUTINE ORGANIZATION The meeting was called to order by Chairman Norton at 7:32 P. M. A. ROLL CALL Present: Commissioners Cowley, Crisp, Kellum, McFall and Norton. (Commissioner Wright arrived at approximately 7:35 P. M.) Absent: Commissioners O'Rorke and Wright. B. MINUTES Commissioner Crisp moved, seconded by Commissioner Kellum, that the reading of the minutes of April 26, 1965 be waived and that the minutes be approved as submitted; motion carried unanimously. II. PUBLIC HEARINGS The Chairman declared public hearings open for the evening at 7:34 P. M. A. V-255 - Joseph B. Krajeska, Pierce Road - Variance in connection with Front Yard Setback Requirement - Continued from ~pril 26~ 1965 The Secretary briefly reviewed this application and read an addi- tional statement filed by the:applicant. Commissioner Wright arrived at this time (approximately 7:35 P. M.). The applicant was present but~advised that he had no further com- ment at this time. Commissioner Wright read the report of the Variance Committee rela- tive to V-255, recommending that this application be denied. After discussion CommissionerSCrisp moved, seconded by Commissioner McFall, that the public hearing on V-255 be closed; motion carried unanimously and the hearing was closed at 7:39 P. Kra~eska Commissioner Crisp moved, seconded by Commissioner McFall, that the report of the Variance Committee (dated May 10, 1965) rela- tive to V-255, Joseph B. Krajeska, be adopted and that the sub- ject. application be denied on the basis of the report; motion carried unanimously. B. V-256 - Alex Menicucci, Westv:iew Drive - Variance in connection with Side Yard Setback Requirement on Street Side - Continued,fromApril 26~ 1965 The Secretary briefly reviewed this application and advised that no communications had been filed. Robert W. Buckles and Raymond A. Magnini, both of Westview Drive, spoke in support of the sUbjeCt variance. Commissioner Wright read the report of the Variance Committee (dated May 10, 1965) relative' to this matter, recommending that V-256 be denied. ; After further discussion Commissioner Crisp moved, seconded by Com- missioner McFall, that the hearing on V-256 be closed; motion car- ried unanimously and the hearing was closed at 7:48 P. M. Commissioner Wright moved, seconded by Commissioner Crisp, that the report of the Variance Committee relative to V-256, Alex Menicucci, be adopted and that this application be denied for the r~asons set forth in said report; motion Carried unanimously. C. C-83 - Hamilton Development Corporation, Pierce Road - Request for Change of Zoning from !~-1-40,000" (Single Family Residential) to "R-I-40,000 P-C" (Single Family Residential Planned Community) The public hearing on C-83 was opened at 7:50 P. M. The Secretary advised that a Notice of Hearing had been published and there were no written communications on file. He then briefly reviewed this application. Rodney Bayne was present to represent the applicant and advised 1) it was felt that ~-C" zoning would allow retention of some of the natural beauty of this area 2) a Condominium development was proposed and 3) it was uncertain as to whether the applicant would develop:.the entire area or would sell the lots to individuals. -2- Planning Commission Minutes - May 10~ 1965 - Continued II.' C. C-83 - Hamilton Development Corporation Mr. and Mrs. Robert M. Walker2, Surrey Lane, expressed concern with regard to development of this. property on the basis of objections to the recent Rodrigues Subdivision (Sarahills), particularly with respect to street lights. After discussion Chairman Norton directed C-83 continued until the meeting on May 24, 1965 and referred same to the Subdivision~Com- mittee for study and a report]at that time. D. C-84 - Miio R. Miljevich, Sar~toga-Sunnyvale Road - Request for Change of Zoning from .'~-1-12,500" (Single Family Residential) to "P-A" (ProfessionalsAdministrative) The public hearing on C-84 was opened at 7:58 P.M. The Secretary advised 1) a Notice of Hearing had been published and 2) since that time the applicant had submitted a letter requesting that this appli- cation be withdragon. Commissioner Crisp moved, seconded by Commissioner Wright, that the request for withdrawal of C-8~, Milo R. Miljevich, be granted with- out prejudice; motion carriedZ unanimously. Chairman Norton declared public hearings closed for the evening at 8:00 PoM. III. SUBDIVISIONS AND BUILDING SITES A0 SDR-563 - Joe N. Neville, Pierce Road - Building Site Approval - 3 Lots - Continued 'from April 26~ 1965 On the basis of a request from Commissioner Crisp, Chairman Norton deferred discussion of this application until the end of the Building Site and Subdivision agenda.: B. SDR-564 - Sam J. Cirigliano, Leonard Road - Building Site Approval - 4 Lots Jim Cole, engineer, present tlo represent the applicant, expressed satisfaction with the proposed conditions of approval. Commissioner Crisp moved, seconded by Commissioner McFall, that the Building Site Conm~ittee Report of May 10, 1965 relative to SDR-564, Sam J. Cirigliano, be adopted and that the tentative map (Exhibit filed April 21, 1965) be apprOved in accordance with the site develop- ment plan for Lot 1 (Exhibit ."B", filed May 7, 1965) subject to the conditions set forth.in said Committee report; motion carried unanimously. Plane, DoUglas Lane - Building Site Approval - 1 Lot The applicant was present and: expressed satisfaction with the pro- posed conditions of approval.= Commissioner Crisp moved, seconded by Commissioner Kellum, that the Building Site Committee Report of May 10, 1965 relative to SDR-565, Robert F. Plane, be adopted and that the tentative map (Exhibit '~", filed April 22, 1965) be apprbved subject to the conditions set forth in said report; motion carried unanimously. D. SDR-566 - Helmut Wanka, Madrone Hill Road - Building Site Approval - 1 Lot The applicant was not present'. Commissioner Crisp moved, seconded by Commissioner Kellum, that the Building Site Committee Report of May 10, 1965 relative to SDR-566, Heimut WaNca, be adopted and that the tentative map (Exhibit "A", filed April 27, 1965) be appr0ved in accordance with the site develop- ment plan (Exhibit "B", filedMay 6, 1965) subject to the conditions set forth in said Committee report; motion carried unanimously. A. SDR-563 - Joe N. Neville, Pierce Road - Building Site Approval - 3 Lots Commissioner Crisp raised a q~estion as to whether the bulb shown on Mr. Neville's tentative map constituted a cul-de-sac, thereby pro- viding Lot C with legal frontage. The applicant was present to discuss this matter with the Commission. After discussion it was the consensus of the Commission that the bulb could not be used as a cul-de~sac for frontage purposes, but that there was a possibility that Lot C could be made legal by providing 100 feet of frontage on the bulb. Chairman Norton then directed~SDR-563 continued until the next regu~ lar meeting to allow time for'Mr. Neville to try to find a solution to this problem. IV. DESIGN REVIEW A. A-175 - Saratoga Carpet, Saratoga-Sunnyvale Road - Final Design Review - Identification Sign - Continued from April 26~ 196.~ Commissioner Cowley advised that the last of the previously existing signs had been removed the day after the last meeting, so he had authorized the Planning Department to issue a permit for the subject sign. Ao A-175 - Saratoga Carpet Commissioner Cowley then move~, seconded by Cormnissioner Wright, that A-175, Saratoga Carpet, pe granted final design approval of the proposed ~entification sign as shown on Exhibits "A" and "B"; motion carried unanimous%y. B. A-155 - Westhope PresbyterianSChurch, Saratoga Avenue - Preliminary Design Review - Relocation of Buildings - Continued from ~pril 26~ 1965 Commissioner Cowiey advised that an on-site inspection revealed 1) the applicant proposed to relocate the subject buildings on the rear of the new church property and 2) with landscaping and paint the Committee felt that the buildings would be acceptable. After discussion Commissioner Cowley moved, seconded by Commissioner Wright, that preliminary design approval be granted A-155, Westhope Presbyterian Church, proposal to relocate buildings from the present church property to the new church property; motion carried unanimously. C. A-179 - Briggs Realty, Sarato~a-Sunnyvale Road - Final Design Review - Identification Sign The Secretary advised 1) the'applicant plans to occupy a portion of the LuRay Plumbing Building 2) this building is permitted 373- Square feet of sign area and the existing sign is 20 square feet and 3) plans are to remove the existing 20 square foot sign and use the subject 37~ square.foot sign for both operations. The applicant's representative (from AD ART) explained 1) overhead wiring was proposed since the'parking area had already been paved and 2) intensity of illumination would not exceed 430 milliamperes total. After discussion Conm~issioner. Cowley moved, seconded by Commissioner Wright, that final design approval be granted A-179, Briggs Realty, for the proposed identification sign as shown on Exhibits "A" and '~B", Exhibit "B'~ to be modified to eliminate the word "lamps'.' to make it clear that the total illumination will not exceed 430 milliam- peres; motion carried unanimously. RECESS AND RECONVENE -5- Planning Commission Minutes - Fray 10~' 1965 - Continued Chairman Norton extended a welcome to;. Councilman Burry and to Mrs. Owens and Mr. Robbins of the Good Government GrOup. He also expressed appreciation for the coffee served by Mrs. Owens at re'cesso V. CITY COUNCIL _REPORT Conm~issioner Cowley advised that he had attended the Council meeting on May 5, 1965 but would give no report since the meeting was brief and there was nothing on the agenda of spec'ial interest to the Commission. VI. NEW BUSINESS Los Gatos Con~nunity ~neatre - Reqhest for Sign %]~e Secretary read a letter from '.the Los Gatos Connnunity Theatre Group requesting permission to place a banner at Saratoga-Los Gatos Road and Oak Street intermittently for a p'eriod of five years to advertise their various productions at the City C~uncil Chambers. After discussion the Chairman directed this matter continued until the next regular meeting and referredi same to the Design Review Committee for study and a report at that time. VII. OLD BUSINESS A. Design Standards for Subdivision Homes - Continued from April 26~ .1965 Jim O'Brien of the Builders A~ssociation (Santa Clara-Santa Cruz Counties) requested that action on this matter be deferred until the next regular meeting to allow adequate time for the Builders Associa- tion to prepare a presentation. The Chairman, with concurrenc'e of the Commission, granted this request and directed this matter continued until the meeting on May 24, 1965. B. Fencing and Planting along Ma"jor Thoroughfares - Continued from April 26 ~ 1965 Commissioner Cowley observed 'that the comments from the last meeting had been incorporated into th'e revised statement. After a review of the report,. Commissioner Cowiey moved, seconded b~i..' Commissioner Crisp, that the !report of the Fencing Committee (dated May 10, 1965) relative to fencing and planting along major thorough- fares be adopted and for~,yarde.d to the City Council as the recommenda- tion of the Commission; motion carried unanimously. Porter, Fifth Street - City Council Request for Review and Recommendation Commissioner Crisp, on behalfiof the Subdivision Committee, reques- ted reconsideration of actionztaken at the last meeting in connec- tion with this matter. He explained that after further review of this application it was the COmmittee recommendation that the time limit be removed from this conditional zoning but that the use re- strictions be retained. After discussion CommissionerlCrisp moved, seconded by Commissioner Kellum, that the Commission recommend to the City Council that the time limit on the conditional' zoning established under C-62, Warren D. Porter, be removed but that the use restrictions on this zoning remain in effect; motion carried unanimously. VIII. CO}~ONICATIONS A. ~,~ITTEN B.
