CITY OF SARATOGA PLANNING COMMISSION
TIME: Monday, May 24, 1965, 7:30 P.M.
PLACE: City Council Chambers, Fruitvale Avenue, Saratoga, California
TYPE: Regular Meeting
I. ROUTINE ORGANIZATION
The meeting ~.ms called to order by Chairman Norton at 7:30 P.M.
A. ROLL CALL
Present: Commissioners Cowley,' Crisp, Kellum, McFall, O'Rorke, Norton
and Wright.
Absent: ~'iNone
B. MINUTES
Commissioner McFall moved, seconded by Commissioner Wright, that the
reading of the minutes of May 1.0, 1965 be waived and that the minutes
be approved as submitted; motion carried unanimously.
II. PUBLIC HEARINGS
The Chairman declared public hearings open for the evening at 7:32 P.M.
A. C-83 - Hamilton Development Cor'poration, Pierce Road - Request for
.... Change of Zoning from "R-i-40,000" (Single Family Residential)
to "R-i-40,000 P-C" (Single Family Residential Planned Community)
- Continued from May 10~ 1965
The Secretary briefly reviewed this application and stated that no
communication had been filed.
Mr. Jim Cole ~m~ present to represent the applicant and stated that he
had brought a model showing contour of the land and planned clustering.
On the bagis of a request from Commissioner Crisp, .Chairman Norton
deferred inspection of this mo~el until the application of SD-569
under Subdivisions and Building Sites.
Mr. Robert Walker and Mr. Burnerr, both of Surrey .Lane, spoke in
opposition of the subject change of zoning.
After discussion Chairman Norton directed C-83 continued until the
next regular meeting and closed this hearing at 7:39 P.M.

II. B. C-85 - Loma Serena Development:Company, Inc., Prospect Road - Request
for Change of Zoning from "A" (Agricultural) to "R-l-10,000"
(Single Family Residential)
The public hearing on C-85 ~.ms!opened at 7:40 P.M. The Secretary advised
that a Notice of Hearing had been published and read a letter filed by
applicant.
Bill Heiss was present to represent the applicant but stated that he
had no further comment at this' time.
On the basis of a request from Commissioner Crisp, and with the
concurrence of the Subdivision: Committee, Chairman Norton deferred
further discussion of this matter until time of hearing for subdivi-
sion application SD-567 and closed the hearing for C-85 at 7:43 P.M.
until the next regular meeting on June 14, 1965.
C.~. C-86 - Nell K. Chase, Saratoga. Avenue - Request for Change of Zoning
from "R-l-10,000" (Sing2le Family Residential) to "R-M-3,000"
(Multiple Residential) z
The Secretary briefly'reviewed this application and read a communication
received from the Good Government Group protesting this Change of Zoning.
The applicant was present and stated that it was felt that this area ~ms
of little practical use for anything else other than apartments because
1) The Saratogan Apartments are on one side of this property 2) The
Brookside Glen Apartments across the creek behind this property and 3)
Crystal Terrace Apartments (a legal non-conforming lot) are on the other
side of the subject property..
The applicant further stated that the proposed building would have twenty-
four (24) units of two and three (2 and 3) bedroom apartments with rentals
of approximately $250.00 to $400.00 with no residents under eighteen (18)
years of age.
After further discussion Chairman Norton directed C-86 continued until the
meeting on June 14, 1965 and closed this hearing at 7:50 P.M.
D. UP-80 - Church of the Ascension, Prospect Avenue Request for Use Permit
for Church and School
The public hearing on UP-80 w~s opened at 7:51 P.M. The Secretary advised
· 1) a Notice of Hearing h~d been published and 2) no communications had
been filed. ~
The applicant, Father Warner, ~as present and explained 1) the school
would start off with six (6) grades with fifty (50) students in each
grade and perhaps add the seventh and eighth grades later and 2) the
church in its original state would be more of a hall type structure
until additional funds could be raised.

II. D. UP-80 - Continued
Mr. Pisano, the engineer, was present and stated that the school and
church would be located in the. center of the site.
After further discussion, Chairman Norton directed UP-80 continued
until the meeting on June 14, 1965 and referred same to the Subdivi-
sion Committee for study and a, report at that time.
E. UP-81 - Bryce W. Baker, Cox Avenue - Request for Use Permit for Nursery
School
The hearing on UP-81 was opened at 7:57 P.M. The Secretary advised that
Notices of Hearing had been mailed and briefly reviewed the application.
Mr.'and Mrs. Baker were presen't and advised that their plans were more or
less the same With four classr'ooms with a maximum of twenty (20) children
per classroom and a maximum of~ ten (10) students per teacher. It was
further explained they plannedi to have 1) a living area over the nursery
2) a two car garage and 3) some area for storage.
After disaussion Chairman Nortlon closed this hearing on UP-81 at 8:02 P.M.
and directed it continued until the meeting on June 14, 1965 and referred
same to the Subdivision Commit:tee for study and a report at that time.
Fo V-257 - Claire C. Goodwin,.Sullivan Way - Request for Variance in connec-
tion with Required Fr6nt and Side Yard Setbacks
The public hearing on V-257 was opened at 8:03 P.M. The Secretary advised
that Notices of Hearing had b~en mailed and then read a communication from
G. C. McKinney, Canyon View D~ive, stating that he was in favor of this
Variance.
The applicant was present to discuss this matter further with the Commission.
Mr. W. R. Swain, Wildwood Heights, was present and advised that he was in
opposition of this variance and filed a communication with the Secretary
from Mr. Emil Kissel stating his opposition.
Dr. Everett Eden and Mr. Don Roberts, neighbors of the applicant, were
present and stated that they 6pposed the Variance because they felt
1) the lot was large enough to put a house on it without varying from
the Ordinance 2) the Variance would decrease value of property and
3) would disrupt view.
After discussion, Chairman Norton directed V-257 continued until the
next regular meeting on June !4, 1965 and referred same to Variance
Committee for study and a report.

II. G. V-258 -'Clay V. Brown, Canyon View Drive - Request for Variance in
Connection with Required Front Yard Setback
The Secretary advised that Notices of Hearing had been mailed and
read a statement filed by applicant and a communication from Mr.
Shannon Lightfoot advising he was in favor of this Variance.
Mr. Kraeber was present to speak for the applicant and stated that
Mr. Brown was not aware of the!zoning laws at the time he purchased
this property.
Mr. Brown was present and stated he was informed that the property
had Building Site Approval forz400 foot frontage.
Mr. Norm Cockshawwas present and stated that he has no objections
to this Variance. z
After discussion Chairman Norton directed V-258 continued until the
next regular meeting and referred it to the Variance Committee for
study and a report.
III. SUBDIVISIONS AND BUILDING SITES
A. SDR-563 - Joe N. Neville, PierCe Road - Building Site Approval -
3 Lots - Continued from May 10, 1965
The Secretary 1) read a communication from the applicant requesting
an extension and 2) stated that the communication did not bear the
signature of the applicant. z
On the basis of the foregoing Commissioner Crisp moved, seconded by
Commissioner Kellum, that the application be denied without prejudice.
Motion carried unanimously.
B. SD-567 Loma Serena Development Company, Inc., Prospect Road - Sub-
division - 55 Lots
Mr. Bill Heiss was present to represent the applicant.
After discussion it was the consensus of the Commission that they would
like to meet with Mr. Heiss on. the afternoon of June 7, 1965, for further
discussion of this application..
Chairman Norton then directed SDR-567 continued until the next regular
meeting.

III. C. SDR-568 - Continued
Commissioner Crisp moved, seconded by Commissioner Kellum, that the
Building Site Committee Report~of May 24, 1965 relative to SDR-568,
D. R. Monroe, be adopted and t~at the tentative map (Exhibit '~",
filed May 4, 1965) be approved'subject to the conditions set forth
in said report; motion carried!unanimously.
D. SD-569 - Hamilton Development Corporation, Pierce Road - Subdivision
- 65 Lots
Mr. Cole was present to represent the applicant and explained in detail
the model showing planned cluseering and contour of land for this pro-
posed subdivision.
Mr. Norman Cockshaw came forward to look at the model and stated that
he felt this plan would be detrimental to the community.
After further discussion Chairman Norton directed SD-569 continued until
the next regular meeting and referred same to the Subdivision Committee
for study and a report at that=time.
E. SDR-570 - Montessori School~ Nqrton Road - Buildins Site Approval - 1 Lot
Mr. French, architect, ~ms present to represent the applicant, and after
discussion expressed satisfaction with the proposed conditions of approval.
Commissioner Crisp moved, seconded by Commissioner McFall, that the Build-
ing Site Committee Report of May 24, 1965 relative to SDR-570, Montessori
School, 1 Lot on Norton Road, be adopted and that the tentative map (Exhibit
"A", filed May 10, 1965) be approved subject to the conditions set forth in
said report; motion carried unanimously.
F. SDR-571 - Dr. Mo H. Quickert, kittridge Road - Building Site Approval -
1 Lot :
The applicant was not present..
Commissioner Crisp moved, seconded by Commissioner Kellum, that the Build-
ing Site Committee Report of May 24, 1965 relative to SDR-571, Marvin H.
Quickert, be adopted and that the tentative map ( Exhibit "A", filed May 14,
1965 ) be approved ~ub~ect..c~'o=.>the.~dohdi~ons set forth in said Committee
report; motion carried unanimously.
G.SDR-572 - Hans Zwei~.PiedmontZRoad - Building Site Approval - 1 Lot
The applicant was not present.!
Commissioner Crisp moved, seconded by Commissioner McFall, that the Build-
ing Site Committee Report of May 24, 1965 relative to SDR-572, Hans J. Zweig,
be adopted and that the tentative map (Exhibit "A", filed May 24, 1965) be
approved subject to the conditions set forth in said report; motion carried
unanimously. :

RECESS AND RECONVENE
IV. DESIGN REVIEW
A. A-180 - Montessori School, Norton Road - Preliminary Design Approval
Mr. French, architect, was pre~ent to represent the applicant.
Commissioner Cowley advised that the Design Review Committee had met
and found this site satisfactory.
After discussion Commissioner O'Rorke moved, seconded by Commissioner
Wright, that preliminary desigh approval be granted A-180, Montessori
School on Norton Road; motion carried unanimously.
B. A-87 - California Steel Buildings, Saratoga-Sunnyvale Road - Final
Design Approval - Revised Plans
The applicant requested this application be withdrawn.
Commissioner O'Rorke moved, seconded by Commissioner Crisp, that the
request for withdrawal of A-87, California Steel Buildings, be granted;
motion carried unanimously.
C. A-172 - Dura Style Homes, Inc.', Cox Avenue - Final Design Approval -
Additional Model
The applicant was not present.
After review of the plans the Commission questioned the garage facing
Cox Avenue, because of the unsightly situation on Highway 9 with the
garages being noticeable over the fence.
On the basis' of a request fromi Commissioner Wright, Chairman Norton
directed this matter continued until the next regular meeting and
referred same to the Design ReView Committee for study and a report
at that time.
V. CITY COUNCIL REPORT
Commissioner Kellum gave a brief r~port on action taken at the City Council
meeting on May 10, 1965, with emphasis on items of interest to the Commission.
VI. NEW BUSINESS
STUDY relative to Regulation of OpEn Storage of Vehicles, Materials and
Refuse in Yards or on Vacant Lots
Commissioner Crisp gave a report which introduced Ordinance NS-3.10 written
by the City Attorney relative to this matter.

VI. STUDY of Storage and Refuse - Continued
After discussion the Chairman directed this matter left off of the agenda
until further notice and referred Same to the General Plan Committee for
study.
Chairman Norton extended a welcome to Councilman Richard Drake and to Mrs.
Dorothy Parker of the Good Government Group and expressed appreciation for
the coffee served by Mrs. Parker at intermission.
VII. OLD BUSINESS
A. Design Standards for Subdivision Homes - Continued from May 10, 1965
Mr. Jim O'Brien was present t~ discuss this matter with the Commission.
Commissioner Cowley moved, sehonded by Commissioner O'Rorke to adopt
the recommended changes made by the Design Review Committee Report
of April 26, 1965; motion carried unanimously.
B. Los Gatos Community Theatre - Request for Sign
After discussion Chairman Norton 1) directed this matter continued
2) referred it to Design Review Corf~aittee and 3) requested the Com-
mittee to contact the State ~ighway Department in the form of a form-
al coff~unication to see if they had any objection to this sign.
C. Resolution No. 114 - Relativei to Time and Place of Planning Commission
Meetings=
After discussion Commissioner% Cowley moved, seconded by Commissioner
MCFall to adopt Resolution No.. 114 changing the meeting place of the
Planning Commission to the ne~ City Council Chambers on Fruitvale Ave-
nue as of November 23, 1964; motion carried unanimously.
VIII. COMMUNICATIONS
A. WRITTEN
SDR-565 - Robert F. Plane, Dohglas Lane - Request for Reconsideration
After discussion Chairman Nor:ton directed this matter continued until
the next regular meeting sinc'e the Director of Public Works h~d been
unable to make a necessary in]spection relative to drainage in this
matter.
SDR-400 - William McKinnon - Pierce Road - Request for Extension
The Secretary read a communication from Mr. R. J. Hunter requesting
an extension of six (6) month's in connection with SDR-~00.

Commissioner Crisp moved, seclonded by Commissioner Kellum, that a
extension of six (6) months from the present date of expirations:be
granted in connection with SDR-400; motion carried unanimously.

SD-499 - MacKay and Somps - Saratoga Avenue - Request for Extension
The Secretary advised that an extension of one (1) year had been
requested in connection with SD-499.
After discussion, Commissioner2 Crisp moved, seconded by CoF~nissioner
McFall, that an exten.~ion of six (6) months from the present date of
expiration be granted in connection with SD~.499~'; motion carried un-
animous ly.
SDR-421 - M. A. Broemser - Saratoga Hills Road - Request for Extension
At the request of Chairman Nor'ton, the Secretary read a communication
from the new owner of this property, Mr. F. Reed Whitlam, requesting an
extension of six (6) months for SDR-421.
After discussion Commissioner Crisp moved, seconded by Commissioner
Kellum, that SDR-421 be extended to June 15, 1965 to give the Commission
time for further study; motion. carried unanimously.
B. ORAL
Commissioner Cowley advised that he would be unable to attend the Plan-
ning Commission meetings during the month of June since it was necessary
for him to be out of town.
IX. ADJOURNMENT
Chairman Norton declared the meeting adjourned at 10:12 P.M.
