MINUTES : Commissioner Crisp moved, seconded by Commissioner Kellum, that the reading of the minutes of June 14, 1965 be waived and that the minutes be approved subject to the following modification: .EaSe 8...Item III-E...Paragraph 2...Change the comma at the end of line 2 (after the word "Church") to a period and omit the rest of the paragraph. Motion carried unanimously. I1. PUBLIC HEARINGS Chairman Norton declared public he=arings open for the evening at 7:33 P';M. A. C-83 - Hamilton Development Corporation, Pierce Road - Request for Change of Zoning from '!R-i-I~O,000" (Single Family Residential) to "R-1-40~O00 P-C" (Single Family Residential Planned Com- munity) - Continued from June 1.4s .1.965 Commissioner Crisp recommended that this application be continued until the next regular meeting since it was still under study by Mr. Lackey and the Subdivision Committee. C-85. - Loma Setend Development Company, Inc., Prospect Road - Request for Change of Zoning f~om '*A" (Agricultural) to "R-l-10,000" (S.in~le Family Residential) - Continued frgm' June 14~ 19~5. The Secretary briefly reviewed this application and read a letter from the Southern Pacific Company indicating that they felt a public cros- sin~ at the proposed location!would fill no present need and would bene- fit no one. The letter further stated that, on this basis, such a pro- posed crossing would be opposed by the Southern Pacific Company. Mr. Sheshahs representin~ the iapplicant, advised that Mr. St. Claire of Southern Pacific had told himhe felt 1) while there would probably be no particular objection to the proposed crossings it would no doubt be opposed at this time because there was no particular need for it at the present and 2) the street sh6uld be stubbed at the railroad and the request made again at a later date when the property beyond was actually bein~ developed. In answer to a question from Commissioner Crisps Miles Rankinadvised that he had been unable to establish the status of the right-of-way for the existing crossing. Commissioner Crisps on behalf of the Subdivision Con~nittee, recommended that 8-85 be continued until ~he next regular meeting to allow addi- tional time to try to work out a solution to this problem. Company~ Saratoga Avenue - Request for Change of Zoning from "A" (AgriCultural). to '~-M-4,000 P-C' (Multiple Residential Planned.Community At the request of Dr. Abrams and with the concurrence of the Connnission, Chairman Norton deferred the hearing on C-87 until the end of the public hearing agenda. D. C-88 - Finnegan Construction Company, Xnc., ~arde11. Road - Request for Chan~e of Zoning from "R-1-15~000" and '1-1-40~000' (Single ~m.!.ly Residential} to .' '~-1-20~000" {Sin~le Family .Residential}. The hearing on C-88 was opened at ~:45 P. M. The Secretary advised that a Notice of ~earing had been ~ublished and read 1) a co~,h~unication pro- testing the proposed chan~e of zoning and requesting review of a peti- tion filed in protest of a previous application on this property signed by Alexander L. Jetts Jean Preston Jett, Shirley E. Diemer~ Douglas Diemet and D. F. Diemet of ~ardell Road and 2) a communication signed by eight (8) residents of theiFoothill Lane-Pierce Road area protesting the proposed change of zoning~and again requesting review of the 127- signature petition previously filed in connection with the subject property. -2.- Plannin~ Comission Minutes - June 28~.1965 11. D. ~-88 - Finne~an Construction Company, Inc. Miles Rankins representing the applicant, observed 1) the previous application for change of zoning on this property requested "R-1-12,500" zonin~ 2) the subject request for change of zoning would not increase the density over that of the existing zonin~ on the pro- perty since only 27 lots are proposed for the 19 acres 3) the proposed half-acre lots would provide a gradual transition from the "R-1-12,500u zoning to the ~-1-40,000" zoning and 4) the p~oposed change of zonin~ would permit the developer tolestablish one price category for his homes in lieu of the two that.would be required under the existing zoning. In answer to a question raise~ by Mr. Ottenberg, Chairman Norton di- rected that the 127-signature petition filed in protest of the previous request for chan~e of zoning on this property be considered a part of the file on the subject application for change of zoning insofar as it is relevant. After further discussion, Chairman Norton directed C-88, Finnegan Con- struction Company, Inc., continued until the meeting on July 12, 1965 and referred same to the Subdivision Committee for study.and a report at that tithe. : E. UP-83 - Banta Clara Eounty Library Comission - Request for Use Permit for Branch Library at quito Bhoppin~ Ce~.e~ · he public hearin~ on UP-B3 was opened at B:04 P. M. ~he Becretary advised that ~otices of ~earing were mailed and there were no ~r~itten connnunications on file. George Fartier, County Librarians advised that the County Library Commission had obtained a ten .year lease with a ~ive year option on this proposed buildin~ in the ~Quito Shoppin~ Center and that the buil- din~ would be built according to County specifications. Mrs. Jamison and Mr. Olmer of the Quito area spoke in support of the subject application and advised that a branch library was badly needed in this area. After further discussion, Chairman Norton directed UP-B3 continued until the next regular meeting and referred same to the Subdivision Committee for study and a report at that time. UP-84 - Saratoga Union School District, Via Escuela Drive - Request for Use Permit for Elementary School (Congress Spri.n~s S~o~l) The public hearing on UP-84'was opened at 8:09 P. M. The Secretary advised that Notices of Hearing had been mailed and there were no written communications on file. He further advised 1) the subject school had already been constructed and 2) the subject application was filed in compliance with Ordinance NS-3 when it was realized that it had previously been overlooked. There was no one present who Wished to comment with regard to this matter. : After discussion Commissioner Crisp moved, seconded by Commissioner McFall, that the hearing on U~-84 be closed; motion carried unanimously and the hearing was closed at .8:13 P. M. Commissioner Crisp moved, secdnded by Commissioner McFall, that UP-84, Saratoga Union School District, application for Use Permit for Congress Springs School, be granted subject to Building Site Approval and Design Approval; motion carried unan'..lmously. G. v-260 - Haven Nursery, Saratoga-Sunnyvale Road - Request for Variance to allow Bxpansion of Legal Non-Conformin~ Nursery The public hearing on V-260 was opened at 8:14 P. M. The Secretary advised that Notices of Hearing had been mailed and there were no written communications on file. He then explained 1) the subject application covers approximately three acres behind the origi~a~ Haven Nursery 2) the nursery is a legal non-conforming use 3) the present owner 4cquired the nursery and' the subject three acres approximately a year and a half ago and expanded the nursery into the additional pro- perty at that time 4) the Court supported the City of Saratoga and ordered that the nursery be reduced to its original size by August of this year and 5) the owner is, now in the process of reducing the size of the ~ursery ~nd is requesting a variance to allow legal expansion into the additional three acres. Ross Pardtore, owner of the Haven Nursery, was present to discuss this matter with the Co~nission, and advised that the subject property was almost completely screened with shrubbery at this time. John Turner of Wardell Court opposed the granting of this variance on the hasis of the use of ~ardell Court as access for trucks and semi- trailers. Plannin~ Commission Minutes - June 28s.1965 II. G. V-260 - Haven Nursery Mr. Pardtore explained that the 40 foot access off Wardell Court was blocked and had not been used as vehicular access for more than a year. He further explained that he does not propose to use this ac- cess in connection with future operation of the nursery. Andre Bogarts Wardell Road, spoke in support of the proposed expan- sion on the basis that it is the best use of the land. Douglas Darling of Wardell CoUrt stated that he was in favor of the grantin~ of the subject application providing that cans and other materials were not allowed to ~ccumulate on the property. George En~strom of Carniel Avenue stated that he was in favor of the proposed expansion providing there would be no access from Wardell Court ar~ materials were not a~lowed to accumulate on the property. After further discussion, Chairman Norton directed V-260, Haven Nur- sery, continued until the meeting on July 12, 1965 and referred same to the Variance Committee for study and a report at that time. C. ~-87 - M.V.S. Company, Saratoga Avenue - Request for Change of Zoning from "A" (Agricultural). to "R-M-4,000 P-C" (Multiple Residen- tial Planned Conmnunitv)' The hearing on C-87 was opened at 8:30 P. M. The Secretary advised that a Notice of Hearing had been published and read comnunications from 1) Mrs. Fes James 2) M~s. Louise Jones and 3) Mrs. Dorothy Parker filed in support of this application. Dr. Abrams presented color slides of the proposed development and advised 1) the subject property had been bought '(together with other property which has since been sold to Paul Masson) in an effort to control the environment of the Medical Village 2) in considering the needs of the community to try zto determine the best development of the property, it was found that while there seemed to be sufficient homes for growing families, there appeared to be a need for a develop- ment of this type for adults whose families were grown and who still wanted quality but without the maintenance of a home 3) research revealed that many such peopl~ were leaving Saratoga because of the lack of.such a development 4) they were striving to provide such an environment with open space, privacy and the individuality of a home 5) the location seems appropriate since the property is isolated by the railroad on the south, the creek on the west, the Medical Village on the north and Paul Messon on the east 6) smaller units would be Planning Commission Minutes - June 28, 1965 II. Company provided in the larger buildings in the background and traditional town houses for adult families in the smaller buildings 7) a com- munity buildin~ ~rith a dining ~room and a pool would be provided at the entrance 8) the dining room would serve residents only 9) the units would rent from $175 to :$350 (approximately) 10) thirty to forty units would be developed first, then additional units as the demand materialized and ~) a .total of approximately 175 units were planned for the 17 acre parcel. Dr. Robert O*Neill spoke in support of the subject application and stated that he felt the proposed development would be an asset Saratoga. Messrs. Conrad Fischer and Carl Peters of the Eichler Subdivision opposed the subject change of'zoning on the basis of an increase in density. A show of hands indicated thai many of those present (approximately 30 to 35) were interested and'had artended in support of the subject application. Commissioner Crisp suggested that the Planning Commission and City Council hold a joint study session to discuss the subject application. After further discussion, Chairman Norton 1) directed C-87 continued until the meeting on JUly 12, 1965 2) requested that the Secretary arrange a date for a joint study session of the Commission and Council and 3) referred C-87 to the SUbdivision Committee for study and a report at the next regular meeting. RECESS AND RECONVENE III, SUBDIVISIONS AND BUILDING SITES A, SD-5.67 - Loma Serena Development Company, Prospect Road - Subdivision 55 Lots - Continued f~om June. 14~ 1965 Commissioner Crisp l) advised that the question of obtaining access across the railroad to the property beyond still existed and 2) sug- gested that, for this reason, SD-567 be continued until the next regu- lar meeting. .' SD-569 - Hamilton Development Corporations Pierce Road - Subdivision - 65 Lots -.Continued from June 14a 1965 Commissioner Crisp advised that the Committee report was not ready since Mr. Lackey had not completed his review and analysis of the proposed planned community. In view of the foregoing, Chairman Norton directed SD-569, ,Hamilton Development Corporation, continued until the meeting on July 12, 1965. C. SDR-574 - John Kirkpatrick, P~ke Road - Bui~ ing Site Approval - I Lot Continued from June'14t 1965 The applicant was present and !advised that the Health Department had run percolation tests that afternoon. He requested that this matter be continued until a report could be obtained from the Health Department. On the basis of this request, Chairman Norton directed SDR-574, John Kirkpatrick, continued until ~he next regular meeting. D. SDR-576 - Walter Hileman, MadTone Hill Road - Building Site Approval - 1 Lot - Continued from June 14~ 1965 The applicant was not present.! It was moved by Commissioner Crisp and seconded by Commissioner HcFall that the Building Site Committee Report of June 14, 1965 relative to SDR-576, Walter Hilenmn, be adopted and that the tentative map (Exhi- bit "A", filed June 4, 1965) be approved subject to the conditions set forth in said report; motion carried unanimously. 'E. SDR-579 - Richard W. Rutowski~ Sobey Road - Building Site Approval - 2 Lots The Secretary recommended thaw this application be continued to allow time for consultation with the Health Department in regard to septic t~nk approval. On the basis of this recommendation, Chairman Norton directed SDR-576 continued until the meeting on July 12, 1965. F. SDR-580 - Santa Clara County Library Commission - Building Site Approval 1 Lot - quito Shopping Center Commissioner Crisp recommended that SDR-580 be continued until the next regular meeting since the UsezPermit application filed in conjunction with this matter had been coneinued until that time. Conanissioner Crisp moved, seconded bY Commissioner Kellum, that the Buildin~ Site Connittee Report. of June 28, .1965 relative to SDR=581, Helen K. RaTburn, be adopted and that the tentative map (Exhibit "A", filed June 21, 1965> be approved subject to the conditions set forth in said report~ motion carried unanimously. H. SDR=582 - Saratoga Union School District, Via Escuela Drive - Buildin~ Site Approval - 1 Lot Warren Held, architect, was present to represent the applicant and requested that this matter be continued until the next regular meeting to allow time for him to discuss the proposed conditions of approval with the applicant. Chairman Norton so directed. 1. SDR-583 - Dr. Robert B. Richards, Sobey Road - Building Site Approval - 1 Lot Warren Held was present to rep[esent the applicant and observed that it would be a tremendous hardship for his client to meet the condition requiring improvement of Sobey: Road in view of the amount of fill that would be needed. After further discussion of this matter, Chairman Norton directed SDR=S83 continued until the next regular meetin~ to allow time for Mr. Heid and the applicant to discuss this matter further with the Building Site Comnittee. : ~II. A. SPR-565 = Robert F. Plane, Douglas Lane - Request for Reconsideration Continued from June ~14z 1965 Commissioner Crisp read the report of the Buildin~ Site Con~nittee rela- tive to the applicant's request for reconsideration, reconnending modi= fication of Conditions II-C and II-F of the conditions of approval. The applicant was present to discuss this matter with the Commission and expressed satisfaction with the proposed modifications. Commissioner Crisp moved, seconded by Conunissioner Kellum, that the report of the Building Site Connittee of June 28, 1965 relative to SDR-565 be approved and forwarded to .t.he City Council as the recommen- dation-'of the Commission; motion carried unanimously. -8-' Plannin~ Commission Minutes - June 28~ 1965 VIII. A. SDR-568 - D. R. Monroe~ P~ul Avenue - Request for Reconsideration The applicant was present to discuss the proposed modifications with the Commission and stated that the offer of dedication presented a problem with respect to the mortgage company. He explained that the mortgage company that now holds the loan on the property has control and will not sign the offer of dedication. After further discussion of t~is matter, Chairman Norton directed this request continued anti1 the meeting on July 12, 1965 and reques- ted that the applicant obtaina statement in x~riting from his mort- gage company. IV. DESIG~REVIE~ A. A-184 - Mijo Corporation, 8aratoga-Sunnyvale Road - Preliminary Design Review - Commercial BUildin~ - Continued from June l~s .1965 A~'J. Menard, architect, was present to represent the applicant and explained 1) the building being moved onto the rear of this property would have a new exterior 2) 'the existing garage operation on the front of the property will move into this building 3) the existing service station use (which is~incidental to the gar~ge) will also be moved to this building and 4Y the building now housing the garage will remain at this time. After discussion Commissioner 'O~Rorke moved, seconded by Commissioner Kellum, that preliminary design approvalbe granted A-184, Mijo Cor- porations for a connercial building as shown on Exhibit "A"~ ~mO. tion carried unanimously. B. A-185 - Santa Clara County Library Commission - Preliminary Design Review - Branch Library Building - Quito Shoppin~ ~enter Commissioner O~Rorke requested that A-185 be continued for ~urther review inasmuch as the Use Permit application and Building Site appli- cation had been continued. On the basis of this request, .Chairman Norton directed A-185 contin- ued until the meeting on July!12, 1965. C. A-186 - Saratoga Union SchoolDistrict, Via Escuela Drive - Final Desinn Review - Elementary School (Congress Springs School) Commissioner O'Rorke advised ~hat the Committee had reviewed the plans for this school and had 'found them satisfactory, but suggested that A-186 be continued until'the next regular meeting in view of the request (by Mr. Held) tha~' the Building Site Approval application be continued. A-18____! - Saratoga Baptist Mission, Saratoga Avenue - Final Design Review - Sign ; Commissioner O'Rorke advised ~hat the proposed sign met all requirements of the Ordinance. It was moved by Connnissioner 0'Rorke and seconded by Commissioner Kel- lum that final design approval be granted A-187, Saratoga Baptist Mis- sion, for the sign shown on E~hibit "A"; motion carried unanimously. Commissioner McFall, in answer to Chairman Norton's request, advised that he would be happy to work with Commissioner O'Rorke on the Variance Committee. V. CITY COUNCIL REPORT Chairman Norton gave a brief report on action taken by the City Council at the meeting on Juh~' 16, 1965~ with' emphasis on items of particular interest to the Commission. Chairman Norton extended a welcome to Councilman Tyler and to Mrs. Parker and Mr. Lewis of the Good Government Group', and expressed appreciation for the cof- fee served by Mrs. Parker at intermission. NEW BUSINESS A. ~ounty-Wide Census The Secretary read a co~umunication from the City Administrator 1) explaining that the County ~s planning a County-wide census and 2) advising that the CounCil had requested a recommendation from the Counission as to whether the City of Saratoga would be willing to participate at an estimated cost of $3~500. The Secretary advised that the census could be beneficial to the Plannin~ Department since it would give accurate population count and other.information helpful for plannin~ purposes. After discussion Chairman Norton directed this matter continued until the next regular meetin~ and referred same to the General Plan Co~nnittee for study and a]report at that time. B. General Plan Review Chairman NortOn =eriewed with the Commission a communication from Mayor Glennon suggesting that the Commission proceed with a typical annual review of the General Pran as soon as practicable and post- pose the full-scale five year review until the West Valley Junior College location has been settled. -10- Pl~.-in~ Commission Minutes - June 28~ :1965 V1. B. General Plan Review In compliance with the Mayor'S request and with concurrence of the Commissions Chairman Norton directed that the General Plan Commit- tee proceed with plans for a ~ypical annual review of the General Plan. C. Proposed Ordinance NS-5.9 The Secretary advised of a possible need for an amendment to Ordi- nance NS-5 with respect to site approval requirements and excep- tions thereto. He explained ~1) the Ordinance now excepts altera- tions, additions to and expansion of the main structure on the site 2) in some instances this has allowed people to, in effect, build new homes without being required to obtain site approval 3) the City Attorney feels that this section of the Ordinance should be clarified 4) the Planning!Department feels that building site approval should be required when the percentage of alterations addi- tion to or expansion of the main structure exceeds 50% and 5) the Staff would like the Subdivision Committee to review the matter av~ submit an opinion. : Chairman Norton directed this.matter continued until the next regu- lar meeting and referred same to the Subdivision Comiittee for study and a report at that time. D. Georgetown Subdivision The Secretary advised that in~compliance with a condition imposed in connection with approval of the tentative maps a map showing the pro- posed unit division of the Lindsay (Georgetown) Subdivision had been submitted for the approval ofithe Subdivision Committee and the Plan- ning Director. The Chairman referred this matter to the Subdivision Committee and the Planning Director for review and the necessary action. VIll. .eO~IfONICATIONS A. ~RITTEN 1. UP-63 - Faith Bible Chapel, Big Basin Way - Request for Cancel- lation of Use Permit The Secretary read a letter from Mr. George R. Latham, Board Chairman of the Faith Bible Chapel, expressing appreciation the City of Saratoga for ~he courtesy extended during their stay in Saratogas and requesting cancellation of their Use Permit since they were relocating in another state. -11- .,$ Plannin~ Con~nission Minutes - June 28s 1965 VII1. SDR-450 - Jerry Kocir~ Nat'ion Road - Request for Extension The Secretary 1) read a co~aunica=ion from Jerry Kocir requestin~ an extension in connection with SDR-450 and 2) explained that approval of the subject tentative.map had expired October 14~ 1964. Commissioner Crisp observed that the Planning Commission policy had been to deny requests for extension in cases where approval of the tentativemmap had already expired when the request was made. Commissioner O~Rorke moved:~ seconded by Commissioner Kellum~ tha= the request for extension .in connection with SDR-450 be denied since approval of the tentative map had expiredl motion carried unanimously.
