ROUTINE ORGLNIZATION The meeting was called to order by Chairman Norton at 7:30 P.M. A. ROLL CALL Present: Commissioners Cowley, Crisp, Kellum, Johnson, McFall, Norton and O~Rorke. Ab sent: Ncne B. ~TINUTES Chairn~n Norton advised that the minutes of the meeting of 11 October 1965 had not been completed (because of the increased work-load during vacation absences) so would be given consideration at the next regular meeting. II. PU. BLIC HF~RINGS The Chairman declared public hearings open for the evening at 7:32 P.M. A. C-80 - Clarence Neale, Saratoga-gunnyvale Road - Request for Additional Permitted Uses under Conditional Commercial Zoning - Continued from I1 October 1965 The continued hearing on C-80 was re-opened at 7:32 P.M, The Secretary read a letter written by W. H. Lee in support of the sub- ject application. The applicant was present but did not wish to make any comment. Mr. Nick Miletlch and Gerald Stepovich of Oak Street, Murray Brookman of Pamela Way, B. D. Johnson of Brookglen Drive and Richard Butera of Thelma Avenue all spoke in support of the subject request. Commissioner Crisp read the report of the Subdivision Committee relative to C-80, recommending approval of the request for additional permitted uses under Conditional Commercial Zoning. Commissioner McFall moved, seconded by Commissioner O~Rorke that the public hearing on C-80 be closed; motion carried unanimously and the hearing closed at 7:44 P.M. Commissioner Crisp moved, seconded by Commissioner Kellum, to recommend for approval to the City Council the Subdivision Committee Report subject to the following additions: I. P.a~e 2 . . . Item 2 . . . paragraph 4 Change "Sporting Goods Shop (Gun Shop)" to "Sporting Goods Shop (Including Gun Sales and Repair 2. Page 2 . . . l,aragraph 4 Add Item 5 - Beauty Shop Zo existing list. Motion carried unanimously. -1- Planning Con~nission Minutes - 25 October 1965 B. 8-87 - M.V.SoCompqny, Saratoga Avenue - Request for Change of Zoning from "A" (Agricultural) to "R-M-4,000 P-C" (b~ltiple Residential Planned Comr~xnity) - Continued from 11 October 196~ The public hearing on C-87 ~me resumed at 7:50 P.M. The Secretary read 1) a letter from the Saratoga Chamber of Conuncrce filed in support of this application and 2) a letter from Dr. Abrams requesting an extension of C-87. b~. Kocher, Saratoga Merchant, presented a petition, with forty (40) signatures, opposing this request. Charleo M~phy, Peach Hill Road, ms present and stated 1) that his signs- ture was on the petition, but he had not seen the petition in type 2) he did not want the contents of the petition to be his final word and 3) he felt that the Planning Commission should make a study and do what is best for Saratoga. R. E. Kauffman, Glen Brae Drive, was present and 1) spoke in favor of the sub3ect application and 2) stated that he felt that this would be the best use of the land other than orchards. Mr. Sam Hernandez, Big Basin Way, stated that he was opposed to the appli- cation for the same reasons Vnc. Kocher stated in his petition. On the basis of the request made by Dr. Abrams, Chairman Norton (at 8:06 P.M.) directed C-87, M.V.S. continued until the next regular meeting. C. Ordinance NS-3.11 - Proposed Amendment to Ordinance NS-3 - Clarifying certain definitions, adding the definition of "KEEPING", clarifying sections relating to the keeping of horses in residential districts, and adding sections relating tc horses for riding lesson§ - Continued from 11 October 1965 The continued hearing on Ordinance NS-3.11 was resumed at 8:07 P.M. The Secretary stated that Horse Ordinances from other cities had been received, Mr. Quinton Manchester, Via Regina, advised that he and the group of about fifteen (15) people with him were present to verify what Mr. Teerlink had said at the last meeting. After discussion, Chairmen Norton (at 8:14 P.M.) directed Ordinance NS-3.11, continued until the next regular meeting on 8 November ].965 and referred same to Subdivision Committee for study and a report and to give the Sub- division Committee time to meet with a representative from the group mentioned above. D. C-92 - Columbus-Founders Savings and Loan Association, Wardell Road - Request for Change of Zoning from "R-l-15,000" and "R-1-40,O00" (Single Family Residential) to "R-I-20,000" (Single Family Residential) The public hearing on C-92 ~ms opened at 8:16 P.M. The Secretary advised that a Notice of Hearing had been published and 1) read a letter from Mr. Frank R. Maggi, Vice-President of Columbus-Founders Savings and Loan Association, listing the reasons why the proposed Change of Zoning would be in the public interest and 2) read a letter from Fff. and ~s. A. Ottenberg stating the reasons ~hy they were opposed to this request. There was no one present who wisked to comment with regard to this matter. The Chairman (at 8:23 P.M.) directcd C-92 continued until the next regular meeting and referred same to the Subdivison Committee for study and a report at that time. V-263 - Kieth Siegrist, Pertoe Drive - Request for Variance in connection wi~'h Street-Side Setback Requirement and Site ~xea RecL~irem'~nt The public heariug on V-263 was opened at 8:24 P.M. The Secretary advised 1) that Notices of Hearing had been m~iled and 2) that the following correc- tions were required: Lj~pe 3 of Descriptive Pare. graph Change "northwest" to read "northeast". ~ine 4 of Descriptive Para~rap~ Change "(I~t 22 - Tract 2544)" to read "(Lot 32 - Tract 2544)". The Secretary read a letter from Mr. and Mrs. Ernest G. Murray stating their reasons for opposing this application. Mr. Kieth Siegrtst, the applicant was present and explained 1) that the house could be reduced in size 2) a smaller house, but a nice house could be put on this lot and 3) that without the Variance the development of the property was not feasible. F~s. Tarton, Mr. James Grafton, and Mrs. Freeman of Portos Drive and Harry Carlson of Myren Court were present and voiced their objections to this application. After discussion, Chairman Norton (at 8:36 P.M.) directed V-263, Kieth Sicgrist, continued until the meeting on 8 November 1965 and referred same to Variance Committee for study and a report. On the. basis of the foregoing, Kieth Sicgrist, requested SDR-603 be continued until the next regular meeting on 8 November 1965. The Chairman declared public hearings closed for the evening at 8:36 P.M. RECESS AND RECON~/ENE Chairman Norton extended a welcome to Couhc~lman Larry Tyler and to Mesdames R~uffman and Parker of the Good Government Group and MrS. Ottenberg of the League of Women Voters. He also expressed appreciation for the coffee served by Mesdames Parker and Kauffman at recess. III. SUBDIVISIONS AND BUILDING SITES A. SD-592 - Western Hills Investment Company, Pierce Road - Subdivision 26 Lots - Continued from 11 October 1965 Ihe Secretary read a letter, from the applicant, requestin~ an extension of forty-five (45) days since the requested site developemtn plan for this proposed plan was not quite completed. The applicant was not present. Commissioner Crisp recormnended that SD-592, Western Hills In-,estment Company, be continued on the basis of the above mentioned request. Chairman Norton so directed. B. SDR-600 - Ben H. Smith, Pierce Road - Building Site Approval - 4 Lots Continued from 11 October 1965 Mr. Jim Cole, present to represent the applica:.~, expressed concern over Specific Condition 2 of ~he Building Site Con~nittee Report and inquired about the possibility of posting a bond for this task. Commissioner Crisp, with concurrence of the other members of the Committee assured Mr. Cole that this procedure would be acearable. -3- Plannin$ Cormnission Minutes - 25 October 1965 III. B. SDR-600 - Ben H. Smith~ Pierce Road Commissioner Crisp moved, seconded by Commission Johnson, that the Building Site Committee Report of 25 October 1965 relative to SDR-600 be adopted and that the tentative map (E~libit "A", filed 1 October 1965) be approved in accordance with the site development plan (Exhibit "B", filed 14 October 1965) subject to the conditions set forth in said report; motion carried unanimously. C. SDR-601 - George Flynn, Pierce Road - Building Site Approval - 4 Lots - Continued from 11 October 1965 Jim Cole, representing the applicant, expressed satisfaction with the proposed conditions of approval. Commissioner Crisp moved, seconded by Connnissioner McFall, that the Building Site C~m.ittee Report of 25 October 1965 relative to SDR-601 be adcpted and that the tentative map (Exhibit "A", filed 1 October 1965) in accordance with the site developm6nt plan (Exhibit "B", filed 14 October 1965) subject to the conditions set forth in said report; motion carried u.nanimously. D. SDR-602 - Church of the Ascension~ Prospect Road - Building Site Approval - 1 Lot The applicant was not present. Commissioner Crisp, seconded by Cu~,,issioner Kellum, that the Building Site Committee Report of 25 October 1965 relative to SDR-602 be adopt- ed and that the tentative map (Exhibit "A", filed 7 October 1965) be approved subject to the conditions outlined in said report; motion carried unanimously. E. SDR-603 - Kieth Sie~rist~ Portos Drive - Building Site Approval - 4 Lots At the request of the applicant SDR-603 was continued until the next regular meeting on 8 November 1965. F. SD-604 - Even V. Judd~ Austin Way - Subdivision Approval - 5 Lots Dr. Hardy, present to represent the applicant, expressed satisfaction with the proposed conditions of approval. Commissioner Crisp moved, seconded by Commissioner Johnson, that the Subdivision Committee Report of 25 October 1965, relative to SD-604, be adopted and that the tentative map (Exhibit "A", filed 15 October 1965) be approved subject to the conditions set forth in said report; motion carried unanimously. IV. DESIGN REVIEW A. A-195 - Clarence Neale, Saratoga-Sunnyvale Road - Preliminary Design Review - Cormnercial Building - Continued from 11 October 1965 Commissioner Cowlay requested that A-195 be continued inasmuch as Fi'. Neale was preparing a new map to present to the Commission. On the basis of this request, Chairman Norton directed A~195, continued until the next regular meeting. B. A-196 - Quito Shopping Center, Cox Avenue - Final Design Review - Identification SiBn- Continued from 11 October 1965 Since there had been no further information from the applicant regarding this matter Commissioner Cowlay recommendd,~ that A-196 be continued until the next regular meeting. A-197 - Church of the Ascencion, Prospect Avenue - Preliminary Design Review - Church Buildin~ Commissioner Cowley advised that the Committee had reviewed the subject plans and recommended approval for Preliminary Design Review subject to 1) the elimination of the ingress off Prospect Avenue and 2) the elimin- ation of the egress to Prospect Avenue. Commissioner Cowley moved, seconded by Commissioner O'Rorke, that Preliminary Design approval be granted A-197, in accordance with Exhibit "A" subject to the change stated in the above paragraph. D. A-198 - A to Z Rental Center, Saratoga-Sunnyvale Road - Final Design Review - Identification SiSn The applicant was not present. It was moved by Commissioner Cowley and seconded by Commissioner Johnson that Final Design approval be granted A-198, A to Z ReDtel Center, as shoxm on E~ibit '~"; motion carried unanimously. E. A-!99 - Edie's Ice Cream, Blue Hills Shopping Center - Final Design Review - Directional Sign Commissioner Cowley recommended denial of this application, because of the fact that a flashing sign is involved. After discussion Commission Cowley moved, seconded by Commissioner O'Rorke, that A-199, Edie's Ice Cream, be denied Final Design approval; motion carried unanimously. F. A-200 - P_au___l Flanagan~ Big Basin I~y - Final D~sign .Review - Retail Store. Commissioner Cowley advised that the Co~nmittee was not prepared to make a reconmendetion at this time since the sketch submitted in connection with A-200 was not adequate and a new presentation of same would be necessary for further study. On this basis, Chairman Norton directed this matter continued until the next regular meeting on 8 November 1965. G. A-193 - Prince of peace Lutheran Church, Cox Avenue - Final Design Review - Church Building The applicant was not present. After a brief discussion, Co,~-~nissioner Cowley moved, seconded by Commis- sioner O'Rorke, that Final Design approval be granted in connection with A-193, Prince of Peace Lutheran Church, as shol~ on' EF~ibit "A-I"; motion carried unanimously. H. Vern L. Adair - Request for Interrupatation of Sign Requirements Commissioner Cowley stated that the proposed sign exceeds the size allowed by the ordinance and that the Payless sign uould overshadow the allowed sign for this property. Co,7~nissioner Johnson advised, that when the zoning was changed on this property, there was some discussion in regard to giving this property special consideration. Commissioner Crisp stated that the same consideration should be given to the prcperttcs adjacent to t1:fs property. H. ~crn L./~lair - Request for In~.r~ret-~tJon of Sign Reouirements Commissioner O~Rorke advised, that the area is encompassed by Prospect Avenue, Saratoga Avenue and the Freeway. Commissioner McFall state~ because of the locality of this property, it might be justifiable to consider a Variance. Chairnan Norton then directed this matter continued until the next regular meeting on 8 November 1965. V. SI..TY CCI~qIL REPORT C~nmissioner Cowley gave a brief report on items discussed at the City Council meeting on 20 October 1965 with emphasis on items of particular inte~Lst to the Commission. VI. NEW BIISI~SS A. SDR--400 - R. J. Hunter, Pierce Road - Request for Extension - Continued from !1 October 1965 The applicant. was present. The Secretary read the Staff Report recommnonding the request for a one (1) year extension be granted subject to the following additional condition: "Provide underground utilities." After discussion, Commissioaer Crisp moved, seconded by Commissioner Kellum, that an extension be granted in connection with SDR-400 for a period of one {1) year subject to the above listen additional condition; motion carried unanimously. B. ~D$-56~ - Request for Peletion of Curb and Gutter Requirement After reviewing the report, Commissioner Crisp moved, seconded by Commissioner Kellum, that the report of the Subdivision Committee relative to SDR-564 recorr~ending denial of this request, but sub- stftuting the R-36 (rolled curb and gutter) for the vertical curb and gutter, be aprroved by the Commission and forwarded to the City Council as the recommendation of the Comnfssion; motion carried unanimously. C. Proposed Amendment to Section 3.5 of Ordinance NS-3. Commissioner Cowley, with concurrence of the Commission, l) advised that the word "street" inserted before the word "cul-de-saz" on the proposed amendment would give clarification and 2) recommended that this matter be continued until the next regular meeting on ~ November 1965. Chairman Norton so directed. C. Proposed Change in Existing Permitted Uses in C-S (Commercial Z~rvice) Zonin8 Districtand Additions ~ereto Commissioner Crisp reviewed the report on this matter of new Conditional Uses and modifying some uses in the C-S Distinct. Mr. Cowley suggested that the requirement for boat sales and automobile sales to be in a completely enclosed structure be eliminated. Commissioner McFall stated, that the City still would need some control over the screeni.ng of these uses. Chairman }lorton directed this matter continued until tk~ next regular meeting and asked the Secretary to prepare a composite l:~t of the existing permitted and conditionaluses and any new uses propoeed. -6- Planning Conm.~ission Minutes - 25 October 1965 A. ~{ITTEN 1. After brief discussion, Coramiesioner Crisp moved, seconded by Commissioner l(elluF. that an extension Of One (1) year from the present date of e~iration be granted in cobInaction with SD-525; motion carried unanimously. 2. SDR-440 - Shannon Lightfoot, Springer Avenue - Reques~ for Extension ~e Secretary read a letter requesting an extension of sixty (60) days in connection with SDR-440. After a brief discussion, Commissioner Crisp moved, seconded by Conmlissioner McFall, that an extension of sixty (60) days from the present date of expiration be granted in connection with SDR-440; motion carried unanimously. 3. Paul ~sson Champagne Cellars, Saratoga Avenue - Signs The Secretary 1) briefly reviewed a letter received from Paul Masson concerning Directional and Identification SiF~ne for the Champagne Cellars on Saratoga Avenue and 2) suggested that this might be referred to the Design Review Committee for a study and report.
