MINUTES Commissioner McFall moved, seconded by Commissioner Cowley, that the reading of the minutes of 10 January 1966 be waived and that the minutes be approved as distributed to the Commission; motion carried unanimously. !' " II. PUBLIC HEARINGS The Chairman declared public hearings open for the evening at 7:36 P.M. i. A. C-92 - Columbus-Founders .Savings and Loan Association, Wardell Road'.- Request for Change of Zoning from '~-1-15,000" and "R-i-40,000" (Single Family Residential) to "R-I-20,000" (Single Family Resi- dential) - Continued from 27 December 1965 .... The continued hearing on C-92 was resumed at 7:36 P. M. The Secre- tary briefly reviewed this application and advised that nothing.fdr- ther had been added to the file. : Mr. Maggi, representing the applicant, 1) expressed appreciation for the time and energy expended by the Commission in connection with this '.' application 2) requested that the'application be withdrawn and 3) advised that a tentative map 'was being prepared in conformante w~th .. the present zoning on this property. M.. Mi The Secretary advised that the request for a variance in connection with . . He then read a communication from Ray T. Lindsay of Calson Properties~ Inc. relative to 'this matter. Warren Held was present to represent the applicant but stated that he had no.'. further comment at this time. Commissioner. Crisp read the report of the Variance Committee relative to V-265, recommending that the subject variance be granted. C-94 - Saratoga Foothills Development Corporation, Charters Avenue - Request for Change of Zoning from "A" (Agricultural) to .~.~-1-12,500" (Single Family Residential) The public hearing on C-94 was opened at 7:49 P.M. The Secretary advised that a Notice of Hearing had been published and there were no written communications on file. Mr. Splitstone, engineers was'preSent to represent the applicant and, in discussing this matter'with the Commission, observed that this request was in accord ·with·the General Plan. " There was no one else present who wished to comment with-regard to.:- this application. The Secretary read a Staff Report relative to C-94, recommending ap- proval of this request for change of zoning. Commissioner Crisp recommended that action on this matter be deferred until the subdivision map on this property (SD-611) had been reviewed. · !'8-94" On the basis of this recommendation, Chairman Johnson directed; continued until later in the evening when SD-611 was discussed'. m. The Secretary advised that Notices of Hearing had been mailed and there were:. no written communications on file .... The applicant and his architect, Mr. Clatt, were present to discuss this request with the Commission, and explained that the terrain created the need for the variance. .!. After discussion, Chairman Johnson (at 7:57 P. M.), at the sugges- tion of Commissioner Crisp, directed V-267 continued until the meeting on 14 February 1966 and referred same to the Variance Com- mittee for study and a report at that time. i. F. V-268 - Gerald Schmidt Mr. Schmidt was present to discuss this request for variance with · the Commission.. Messrs. Jas. H. Guerin and Robert T. Abbott, adjacent property owners, were present and voiced full endorsement and support of the subject request. for ·variance..: After discussion, Chairman Johnson (at 8:00 P. M.) directed V-268 continued until the next ,regular meeting aD~t referred same to the Variance C~mmittee for study and a report at that time. The Chairman then declared public hearings closed for the evening the exception of C-94 which had been continued until later in the ~=i~. meeting when SD-611 was discussed. 11I. SD-607 - Douglas Hines, Pierce Road - Subdivision -'5 Lots - Con1 · '-. tinued from 10 January 1966 The Secretary advised that the applicant had requested that SD~607 be continued until the meeting on 28 February 1966 ·since additional time was needed for preparation of revised plans. Chairman Johnson, with concurrence of the Commission, so direceed. B. SDR-609 - John Lyngso, Saratoga-Sunnyvale Road - Building Site Approval - 1 Lot - Continued from 10 January 1966 The Chairman directed this matter continued until the end of the .. Subdivision and Building Site Agenda to allow adequate time for the applicant ts representative to review the proposed conditions of .. approval. .. C. SD-611 - Saratoga Foothills Development Corporations Charters Avenue - Subdivision - 15 Lots Mr. Splitstone, applicant~s engineer, expressed satisfaction with the .proposed conditions of approval. After a brief discussion, it was moved by Commissioner Kellum and seconded by Com~ssioner Crisp that the Subdivision Connittee Report of 24 January' 1966 'ralatiVe to SD-611, Saratoga Foothills Development Corporation., be adopted and' that the tentative map (Exhibit "A", filed 7 January 1966) be app'roV~ed subject 'tO the conditions set forth in said report' and City Council approval of the change of zoning on this property requested under C-94; motion carried unanimously. Commissioner Kellum then moved, seconded by Commissioner Crisp, that the Staff Report of 24 January 1966 relative to C-94, Saratoga Foot- hills Development Corporation, be approved, and that the Planning Com- mission recommend to the City Council that the 'change of zoning (from "A" to "R-1-12,500") requested under C-94 be approved. Roll call vote: Ayes: Commissioners Cowley, Crisp, Johnson, Kellum, and McFall. Noes: None. Absent: .Commissioners Norton and O *P, orke. Motion carried unanimously. B. SDR-609 - John Lvn~so l~r. Held (applicant*s representative) advised that he had reviewed the- proposed conditions of approval and found them satisfactory. Commissioner Kellum moved, seconded by Commissioner McFall, that the Building Site Committee Report of 24 January 1966 relative to SDK-609, John Lyngso, be adopted and that the tentative map (Exhibit f~led 20 January 1966) be approved subject to the conditions .set-forth in said report; motion carried unanimously. RECESS AND RECOh~/~ IV. DESIGN REVIEW A. A-205 - Tidewater Oil Company, Saratoga Avenue - Preliminary Design '-. Review - Plans for Remodelin~ Service Station The Secretary read a Staff Report pertaining to this applications reconnnending that same be continued until further information could be obtained in connection with plans for the canopy. He advised that ' he had spoken with the applicantms representative on the telephone .. and had been assured that' plans for the canopy would be ,submitted prior to the next meeting. A-207 - John LynEso, Saratoga-Sunnyvale Road - Preliminary Design Re- view - Nursery BuildinM The Secretary read a Staff Report pertaining to A-207s recommending that preliminary design approval be granted subject to certain condi- tions relative to fencing. After discussion, Commissioner Cowley moved, seconded by Commissioner Crisp, that preliminary design approval be granted A-207 on the basis of Exhibit "A"s subject to the applicant's providing a screening fence, a minimum of five feet in heights along the entire south and west boun- daries of the property~ motion carried unanimously. D. ~-195 - Clarence Neale, Saratoga-Sunnyvale Road - Final Design Review - Commercial. BuildinM The Secretary read a Staff Report pertainir~ to this application, recommending that final design approval be granted subject to certain conditions .... .~. A-195 - Clarence Neale Commissioner Cowley moved, seconded by Commissioner McFall, that final design approval be .granted A-195, Clarence Neale, subject to the conditions set forth in the Staff Report of 24 January 1966 relative to this application, including Condition No. 4 which was added during the meeting; motion carried unanimously. Chairman Johnson ·acknowledged", with pleasure, the presence of Mrs. Stark and Mr. Kaufmann of the Good Government ·Group and Mrs. Ottenberg of the Leaguer of Women Voters, and expressed appreciation for'the coffee served by Mrs stark at intermission. ' .... V. CITY COUNCIL REPORT Commissioner Kellnm gave a brief report on the City Council meeting of 19 January 1966, with emphasis on items of particular interest to the Commis s ion. VI. ~',vEW BUSINESS A. Planned Community Ordinance - LACKEY Study and Analysis ,The Secretary advised 1) under the original agreement with Lackey & Associates for the study and analysis in connection with Sara- toga's Planned Community Ordinance, this firm agreed to furnish mimeographed copies of the report and large reference maps 2) the' City had been advised that for an additional $2,000 a more formal printed report could be provided with expanded text and with maps and diagrams included and 3) the City Administrator had requested the Commission's opinion as to whether the additional expense was warranted. During the discussion that followed, Commissioner Kellum observ!ed 1) after the Planned Community Ordinance was adopted, it had proven : difficult to try to explain to the developers what the City wanted 2) when the study and analysis had been completed, the developer of the BOnnet property (with whom the Committee had been working for " some time) had discarded his previous plans and in a short time developed a satisfactory map ohm the basis of Mr. Lackey's report and : 3) he felt it would be of great benefit to have a. comprehensive!~ re- ':' port available and that the money for same.would be well spent.!i Commissioners Crisp and McFall concurred that the printed document with maps and diagrams would be far=more convenient (than the mimeo- graphed report and large maps originally proposed) and would be of .. great assistance in working with the various developers. ~'. ~lanning Commission Minutes - 24 January 1966 - Continued VI. A. Planned Community Ordinance · After further· discussion, Chairman ·Johnson 1) stated that the con- sensus of the Commission was that the additional $2,000 for a more formal report would be well spent and 2) directed that the' .Se~:re- tary advise the City Administrator accordingly;f B. Urban Beautification Program The Secretary outlined the Urban Beautification Program proposed .by the City of 'Saratoga and' advised that;'the Council had requested a statement'~onfirming the ~ommission's endorsement of the .program and the City's application for Federal funds After a brief discussion, CommiSsioner Crisp moved, 'seconded b~ Com- missioner Kellum, that the Secretary' be authorized to prepare for the' · - Chairman's signature a resolution confirming the Commission's' endorse-'~'.. ment and strong support of the Urban Beautification Program as' pro- posed by the City Council; motion carried unanimously. C. Open Space Land Acquisition The Secretary outlined the City Council's proposal to apply for Federal funds under the Open Space Land Grant to help finance the acquisition of three sites (Hakone, Wildwood Park, and an additional five acres at the Civic Center site) for park and recreation pUt- · poses, and advised that the Council had requested a statement con- · '= firming the Commission's .endorsement of such a program~ Commissioner Kellum observed that the report on the annual review of the General Plan, transmitted to the City Council as the recommenda- tion of the Commission, had suggested that the City give considera- tion to acquisition of land for park and recreation purposes. After discussion, Commissioner Cowley moved, seconded by Commissioner McFall, that the Secretary be authorized to prepare for the Chairmants signature a resolution conveying the Commissionts endorsement and sup- port of this program; motion carried unanimously.' OLD BUSINESS A. 9-90 - Town& 'Country Realty, Saratoga and Cox Avenues - City Council Request for Recommendation on Revised Application - Continued .' from 10 January 1966 Commissioner Kellum suggested that this applicatiop be continued un- til the next regular meeting to allow adequate time for the Subdivi- .. sion Committee to re~iew the comments submitted by the Design Review · ' Committee earlier in the evening. Chairman Johnson so directed. B. SDR-440 - Shannon Lightfoot,-Springer Avenue - Request for Extension - Continued from 10 January '1966 Commissioner Kellumadvised that the Building Site Committee had' com- pleted its review of this request (including an on-site inspection) and was prepared to recommend that the extension be granted. After discussion, Commissioner. Kellummoved, seconded by Commi~'sioner Crisp, that an extension of 60 days from the present date of e~pira- =ion be Branted in connection with SDR-440; motion carried unanimously. C. SDR-544 - Charles Wynn, Pike Road - Request for Extension -'Continued from 10 January 1966 ....... · Commissioner Kellumadvised that after a thorough review of this mat- ter, it was the recommendation of the Committee that the request for extension.be granted. :"' After discussion, Commissioner Kellummoved, seconded by Commissioner Crisp, that an extension of one year from the present date of expira- tion be granted in connection with SDR-544; motion carried unanimously'- VIII. COMMUNICATIONS A. WRITTEN B. ORAL 1. HiKhway 9 Sam Hernandez, Big Basin Way, advised the Commission that he felt " a traffic hazard had been.created in the area of the Plaza where the two traffic lanes to Los Gatos merge, and suggested that a stop sign be installed at.this point (for the lane merging.with ',.... Highway 9 from Big Basin Way). Chairman Johnson explainedi. t'o Mr. Hernandez that this. matter was not under the jurisdictiOn.of the ..' Commission and suggested that he contact the Director of Public Works regarding same. Plannin~ Commission Minutes - 24 January 1966 - Continued VIII. B. 2. Park and Recreation P. rogram.. Mr. Hernandez stated 1) he had previously suggested that Wildwood Park be developed by the City as a cultural center 2) he would Cit ' again like to bring this proposal to the y s attention and 3) he would like to see the City acquire the property on both sides of the creek. 3. Traffic Signs ,- Mrs. Ottenberg brough,t to .the Commission'S attention the '~{eep Right''· 'sign posted for the north-bound lane of Highway 9 near the Saratoga Market, and observed that the sign directed you into the Post Office exit. She also questioned the location of the temporary power pole in this area. The Secretary advised that the City Admin- istrator was working to have the pole relocated. The possibility of installing a sign on the Post Office exit ('~xit Only") was also'. discussed. Chairman Johnson requested that the Secretary check 'into these matters. IX.
