PLACE: City Council Chambers, Fruitvale Avenue, Saratoga, California TYPE: Regular Meeting. / .. I. ROUTINE ORGANIZATION The' meeting was called to order by Chairman Norton at 7:30 P.'M. A. ROLL CALL Present: Commissioners Crisp, Kasner, Kellum and Norton.' Absent: Commissioners Johnson, McFall and O'Rorke. B. MINUTES Commissioner Kellummoved, seconded by Commissioner Crisp, that the reading of the minutes of 25 April 1966 be waived and that the minutes be approved' as submitted to the Commission; motion carried unanimously. II. PUBLIC HEARINGS The Chairman declared public hearings open for the evening at 7:34 P.M. A. V-273 - Michael E. Purcell, Pierce Road - Request for Variance in connec- tion with Side Yard SetbaCk Requirements - Continued from 25 April 1966 The continued hearing on V-273 was resumed at 7:35 P.M. The Secretary briefly reviewed this application and advised that nothing further had been added to the.file. Commissioner Crisp stated that 'according to the soils report the garage would be placed in an area considered unsuitable by the' Variance Committee; there- fore, he felt, that a meeting with the eng.ineers was'.~necessa.ry.to.clari.fy'this matter. The applicant and his father-in-law, Mr. Brown, were present to discuss this request with the Connnission, and explained that the placement of the drive- way created further problems in. considering the relocation of the garage. Commissioner Crisp advised that the Director of Public Works had reduced the front driveway approach area from twenty fee (20') to twelve feet (12'), but the applicant had never given this or the suggestion of the Variance Committee any consideration. After further discussion,' Chairman Norton (at 7:50 P.M.) directed V-273 con- tinued until the meeting on 23 May 1966 and referred same to Variance Committee for further study. B. C-97 - Margot A. Arenchild, Fruitvale Avenue - Request for Change of Zoning from "R-1-40,000" (Single Family Residential) to "R-1-40,000 P-C" (Single Family Residential Planned Community) - Continued from 25 April 1966 The public hearing on C-97 was not re-opened at this time since the applicant had requested this matter continued to allow time to submit new plans. In view of the foregoing, Chairman Norton directed C-97 continued until the next regular meeting. Plannin~ Commission Minutes - 9 May 1966 - Continued II. C. V-276 - Vern L. Adair, Prospect Road - Request for Variance in connection with Identification Sign Requirements'- Continued from 25 April 1966 The continued hearing on V-276 was resumed at 7:53 P.M. The Secretary, at the request of Chairman Norton, read the VarianCe Committee.' · : ..Report reconnnending approval of the signs shown on Exhibit 'B" as 'an exten- --. siOn of Variance V-274 and recommending disapproval of the large revolving sign shown on Exhibit 'A". The applicant, and his client, Mr. Henderson were present and inquired if the sign on Exhibit f~t, could be given further consideration. Chairman Norton answered that a more moderate sign might be acceptable, · but that the one proposed on Exhibit "A" was much to9 large. · There was no one else present that wished to speak in regard to this matter. Commissioner Crisp moved~ seconded by Commissioner Kasner, that the public · ' hearing on V-276 be closed; motion carried unanimously and the hearing was closed at 8:01 P.M. Commissioner Crisp moved, seconded by Connissioner Kasner, that the Variance Committee Report of 25 April 1966 relative to V-276 be approved and that the variance requested in connection with Exhibit "B" be granted and that the variance r'equested in connection with Exhibit "A" be denied as reconmaended in said report; motion carted unanimously. UP-102 - San'Jose Water Works, Congress Springs Road - Request for Use Permit for Construction of a Backwash Tank - Continued from 25 April 1966 The Secretary stated that the applicant plans to submit a letter requesting .L'.' that this application be withdrawn. Commissioner Crisp moved, seconded by Co~issioner Kellum, that the request for withdrawal be granted subject to receipt of a letter from the applicant; .. motion carried unanimously. E.' UP-103 - Manuel Lozano, Prospect Road - Request for Use Permit for...an Automatic ,.- Conveyor System Car Wash with Gasoline Sales .°.V "~ .: The public hearing on UP-102 was opened at 8:04 P.M. The Secretary advised = that Notices of Hearing had been mailed and that there were no further addi- " tions to the file. He then briefly reviewed this matter. The applicant and his representative, Mr. Crist, were present and discussed. this matter with the Commission . . .i After discussion, Chairman Norton (at 8:07 P.M.) directed UP-I'03 continued until the next regular meeting of 23 May 1966 and referred same to the Sub- division Committee for study and a report at that time. F. UP-104 - James Davi, Souza Lane - Request for Use Permit for a Convalescent .. Hospital with a Ninety-Nine (99) Bed Capacity The public hearing on UP-104 was opened at 8:08 P.M. The Secretary advised that a Notice of Hearing had been published and there were no further addi- tions to the file. He then briefly reviewed this application. In answer to inquiries from Chairman Norton and Coum~issioner Crisp, Mr. Johnson, present to represent the applicant, stated 1) that the sixty-six (66) bed capacity proposed under UP-74 is not economically feasible 2) in most cases convalescent hospitals do not create a lot of traffic 3) the buildings in which these convalescent hospitals are housed have to meet, essentially,' the same requirements as hospitals and 4) Forest Hospital in San Jose is a conva- lescent hospital similar, in size, to the one proposed by Mr. Davi. After further discussion, Chairman Norton (at 8:14 PoM.) directed UP-104 continued until the meeting of 23 May 1966 and referred same to the Subdivision Committee for study and a report. -2- Planning Commission Minutes - 9 May 1966 - Continued G. V-277 - Harry E. R. Carlson, Hyren Court - Request for Variance in connec- tion with Side Yard Setback Requirements . The. public hearing on V-277 was opened at 8:15 P.M. The Secretary advised that a Notice of Hearing had been.published and read.l) the applicant's statement of reason and 2) a communication filed by ..Mr. &Mrs. E. G. Murray of Portos Drive supporting the proposed Variance. The applicant was present.but stated that he had no comment at this'time.. After a brief discussion. ,Chairman Norton (at 8:20 P.M.) directed V-277 continued until the next regular meeting and referred 'same to the Variance Committee for further study. · uIII. SUBDIVISIONS AND BUILDING SITES .A. SDR-630 - W. Austin Ellmore, Canyon View Drive - Building Site Approval - ·1 Lot - Continued from 25 April 1966 ". There was no one present to represent the applicant. B. SDR-631 - William R. Veideman, Palomino Way - Building Site Approval - 1 Lot ~ - Continued from 25 April 1966 · --: There-was no one present to represent the applicant, but the Secretary advised that the applicant had 1) reviewed the proposed conditions of approval and had .. expressed satisfaction with same and 2) submitted a new and more detailed 'map · of this site. .. Commissioner Kellum moved, seconded by Commissioner Crisp, that the Building ..f Site Committee Report of 25 April 1966 relative to SDR-631, William R. Veideman, " be adopted and that the tentative map (Exhibit "A", filed 6 April 1966) be' approved in accordance with the site development plan (Exhibit "B", filed 25 April 1966) subject to the conditions set forth in said report; motion carried unanimously. Leeper, Pal'omino Way - Building' Site Approval ~ 1 Lot {' .. - Continued from 25 April 1966 l' ' Commissioner Kellum advised that Condition "C" should be deleted from the "Building Site Committee Report of 9 May 1966, because the terrain on ~this { ""' lot is not suitable for underground utilities. " The applicant was present and 1) expressed concern over Condition "A" and 2) stated the owner of 'the joint right-of-way does not wish to cooperate 'in accomplishing Condition "A". " } " Commissioner Crisp stated that, be'felt, the Director of Public Works should inspect this access road prior to the Co~-~lssion taking any action on this application. .f After discussion, Chairman Norton directed SDR-632 continued until the next . .. regular meeting. .D. SDR-633 - San Jose Water Works, Congress Springs Road - Building Site Approval - 1 Lot - Continued from 25 April 1966 .. There was no one present to represent the applicant, but the Secretary-stated · ' that the applicant intends to submit a letter requesting withdrawal of this application. Commissioner Crisp moved, seconded by Commissioner Kasner, that the request for withdrawal be granted subject to receipt-of a letter from the applicant; . motion carried unanimously. !. SDR-635 - Manuel Lozano, Prosp.e.ct Road - Building Site Approval - 1 Lot Due to the fact that no action had been taken on UP-103 relative to this matter, Chairman Norton directed SDR-635 continued to the next regular . meeting and referred same to the .Subdivision Committee for 'furthelc consider- ation. F. SDR-636 - Roman T. Chavez, Canyon View Drive - Building Site.Approval - 1 Lot The Secretary advised that before any action Could be taken on this appli- cation it would be necessary to meet with the applicant and discuss the pad and driveway access relative to SDR-636. The applicant was present and stated he would be available to meet with the Subdivision Committee on 16 May 1966. .i: In view of the foregoing, Chairman Norton directed, SDR-636 continued to the next regular meeting. G. SDR-637 - Wade H. Hovera Peach Hill Road - Buildin~ Site Approval - I Lot Mrs. Hover,! wife of the applicant, was present and' after discussign, expressed satisfaction with the proposed conditions of approval. Commissioner Kellum moved, seconded by Commissioner Crisp, that the. Build- ing Site Committee Report of 9 May 1966 relative to SDR-637, Wade Hover, be adopted and that the tentative map (Exhibit "A,, filed 29 April 1966) be approved subject to the conditions set forth in.said report; motion carried unanimous ly. :' RECESS AND RECONVENE IV. DESIGN REVIEW A. A-219 .- Vern L. Adair, Prospect Road '- Final Design Review - Identification Signs - Continued from 25 April 1966 Commissioner Kasner advised that the Committee had reviewed the plans for the proposed signs and 1) reconnnend approval of the signs shown on Exhibit "B" and 2) recommend disapproval of the large revolving sign. shown on Exh.ibit "A". After discussion, Commissioner Kasner moved, seconded by Commissioner Crisp, 'that Final Design approval be granted the signs as shown on Exhibit "B" of File A-219 and that the sign shown on Exhibit "A" of File A-219 be denied; ... motion carried unanimously. B. A-220 - Roy M. Westly, .ProSpect Road - Final Design Review - Car Wash - Continued from 25 April 1966 Nr. Gurley was present to represent the applicant and answer questions. Commissioner Kasner advised that the Committee had reviewed the submitted plans and found that 1) a full 12 foot (instead' of the 6 feet shown) wide road-way, with overhead clearance, running along the westerly side of the car wash is necessary to allow for egress of all types of vehicles without passing through the car wash line 2) since this is not a use conducted in a completely enclosed structure a six (6) foot screening by hedge or fence is required on three (3) sides and 3) the Committee would like to see all these things, as well as, additional detail with regard to landscaping shown on a map before taking any action on the application. In view of the' foregoing, Chairman Norton directed this matter continued until the next regular meeting and requested the applicant to submit re~ vised plans as suggested by the Committee. A-221 - Blue Hills Market, Saratoga-Sunnyvale Road - Final Design Review - Identification Signs The Secretary explained that these new signs would be replacing the .existing larger signs. Commissioner Crisp stated that he would -l~ke to see a more representative drawing of the proposed signs than the one submitted. After a brief discussion, Chairman Norton directed A-221 continued until the next regular meeting. D. A-222 - Manuel Lozano, Prospect Road - Preliminary Design Review -'Car Wash Since no action was taken on applications UP-103 and. SDR-635, Chairman Norton directed A-222 continued until the next regular meeting. E. A-210 - W. C. Garcia, Prospect Road & Saratoga-Sunnyvale Road - Final 'Design' Review - Restaurant Commissioner Kasner advised that the Committee had reviewed the plans for the restaurant and had found them satisfactory. The applicant was present and discussed this matter with the Commission. After discussion, Co~nissioner Kas;ner moved, seconded by Commissioner Crisp, that Final Design approval be granted in connection with A-210, W.C. Garcia as shown on Exhibit "A-2'.' and "B"; motion carried· unanimously. V. CITY COUNCIL REPORT -'- The Secretary gave· a brief report on action taken at the City Council meeting on 4 May 1966 with emphasis on items of particular interest to the Commission. VI. NEW BUSINESS A.' SD-586 - Robert F. Plane, Douglas Lane - Request for Waiver of Curb and Gutter Requirements - Continued from 25 April 1966 The applicant was present to discuss this matter with the Commission. Commissioner Kellum, at the request of Chairman Norton, read the report of the Subdivision Committee dated 9 May 1966 relative to SD-586, recommending to the City Council that this request be denied. After discussion, Commissioner Crisp moved, seconded by Commissioner Kasner, that the Subdivision Committee Report of 9 May 1966 relative to SD-586, Robert F. Plane, be approved and transmitted to the City Council as the reco~f~aendation of the Commission; motion carried unanimously. B. C-80 - Clarence Neale, Saratoga-Sunnyvale Road - City Council Request. for Recommendation relative to Request for Additional Signs '. '.. .. The Secretary stated that the request of Clarence Neale, concerning an increase in the sign allowance, had been referred to the Planning Commission by the City · . Council for their recommendation. In view of the foregoing, Chairman Norton directed this matter continued until the next regular meeting and referred same to the Subdivision Committee for stud y. =. VII. OLD BUSINESS ..... A. SDR-624 - LeRoy Hiatt, Saratoga-Los Gatos Road - Request for Exception on Conditions of Site Approval The applicant was present to discuss this matter with the Commission. The Secretary quoted from a communication submitted by the applicant, and his wife, protesting Specific Contitions "A", "B" and "C" listed in the Building Site Committee Report of 28 March 1966. /' --5-- \ Plannin~ Commission Minutes - 9 May 1966 - Continued VII~ A. UP-74 - Dr. Robert Wade, Souza Lane - Request "for Extension in connection with Use Permit for Convalescent Homes .' Chairman Norton.directed this matter continued to the next regular meeting contingent upon the action by the Planning Commission in regard to UP-104. VIII. COMMUNICATIONS A. WRITTEN SDR-565 - Robert F. Plane, Douglas Lane - Request for Extension After a brief discussion, it was moved by Commissioner Kellum and seconded by Commissioner. Kasner that an extension of one year from the. present date of expiration be granted in connection with SDR-565, Robert Fi~' Plane; motion cart led unanimous ly. "' B. ORAL Chairman Norton acknowledged, with pleasure, the presence of Councilman Burry, Mrs. Owens o'f the Good Government Group.and: to".Mrs.'.Ottenberg :of the..Leag~'e.:o{ Women ;Voters.
