PLACE: City Council Chambers, Fruitv~le Avenue, Saratoga, California TYPE: Regular Meeting I. ROUTINE ORGANIZATION The meeting was called to order by Chairman Norton at 7:30 P.M. A. ROLL CALL Present: Commissioners Crisp, Johnson, Kasner, Kellum, Norton and O'Rorke. · Absent: Commissioner McFall. B. MINUTES Commissioner Crisp moved, seconded by Commissioner Johnson, that the reading of the minutes of 11 April 1966 be waived and that the minutes be approved subject to the following corrections: Page 4.. .Item II, I.. .Change the word Subdivision to Variance in the second line of the fourth paragraph. Page 5.. .Item III, B.. Insert the name Crisp after Commissioner in the first line of the first paragraph. : Page 6.. .Item IV, A.. .Change the word inconsistent to consistent in the third line of the third paragraph. ' Motion carried unanimously. II. PUBLIC HEARINGS The Chairman declared public hearings open for the evening at 7:35 P.M.,..,.,,. A. C-96 - Joseph J. Pon, Verde Vista - Request for Change of Zoning .from "R-1-40,000" (Single Family Residential) to "R-1-40,000 P-D''~ (Single Family Residential Planned Development) - Continued= from 11 April 1966 The public hearing on C-96 was resumed ~t 7:36 P.M. The Secretary briefly reviewed this application. '~' Mr. Jim Cole was present to represent the applicant and stated that 1) the change of zoning would provide the opportunity to put the building sites on the lower ground area 2) the subject property is completely surrounded by smaller .lots and 3) it would be possible to get better building sites with less cut and fill. Commissioner Kellumread the report.of the Subdivision Committee relative to C-96, recommending to the City Council that this application (C-96) be denied. Commissioner Crisp questioned whether it would be possible to get the proposed ten (10) sites with the existing zox~ing. Commissioner Kasner stated that he was opposed to the recommendation for' denial of this application, because he felt the applicant should not be limited to eight (8) lots when it was possible to get ten (10). After discussion, Chairman Norton declared the public hearing on C-96 closed at 7:46 P.M. Planning Commission Minutes - 25 April 1966 - Continued II. A. C-96 - Joseph J. Pon Commissioner Kellummoved, seconded by Commissioner johnson, that'the Subdivision Committee Report of 25 April 1966 relative to C-96, Joseph J. Pon, be approved and transmitted to the City Council' as the recommendation of the Commission. Roll call vote: Ayes: Commissioners Crisp, Johnson, Kellum, Norton and O'Rorke. Noes: Commissioner Kasner. Absent: Commissioner McFall. Motion carried. B. V-273- Michael E. Purcell, Pierce Road - Request for Variance in connection with Side Yard Setback Requirements - Continued from 11 April 1966 The public hearing on V-273 was re-opened at 7:52 P.M. The Secretary briefly reviewed this application and quoted from a communication submitted by the applicant. The applicant was present to.discuss this matter with-the.members..0f.the".~ Commission.. Commissioner Crisp stated 1) the Variance Committee had met with the appli- cant and they were not entirely convinced that this Variance w~s correct 2) the Committee had suggested a change in the location of the building and now felt it Was necessary to have a certificate from a qualified soil engi- neer stating why the building could not be located where the Variance Committee had suggested. In view of the foregoing, Chairman Norton (at 7:59 P.M.) directed V-273 continued until the next regular meeting. C. V-274 - C. P. Fernandez, Quito Oaks Way - Request for Variance in connec- tion with Rear Yard Setback Requirements - Continued from 11 April 1966 The continued hearing on V-274 was re-opened at 8:00 P.M. The Secretary advised that nothing further had been filed in connection with this. application and then briefly reviewed this matter." '. The applicant was present but stated that he' had no further comment at this time. Commissioner Kasner read the report of the Variance Committee rela[ive to this application, recommending that V-274 be approved. After discussion, Commissioner Crisp moved, seconded by Commissioner Kellum, that the public hearing on V-274 be closed; motion carried unanimously and the hearing.was closed at 8:05 'P.M. It was moved by Commissioner Crisp.and seconded by Commissioner Kasner that the Variance Committee Report of 25 April 1966 relative to V-274 be approved and that the request for variance be granted subject to the condition listed in the subject report; motion carried unanimously. D. V-275 - Earl Quirk, Sarahills Drive - Request for Variance in connection with Side Yard Setback Requirements - Continued from 11 April 1966 ... The hearing on V-275 was resumed at 8:07 P.M. The Secretary briefly review- ed this application and advised that nothing further had been added to the file. Mr. Quirk was present but stated that he had no further comment at this time. Commissioner Kasner, at the request of Commissioner .Crisp, read the report of the Variance Committee relative to this matter, recommending that the Variance in connection with V-275 be granted. After discussion, Commissioner Crisp moved, seconded by Commission Kasner, that the public hearing on V-275 be closed; motion carried unanimously and ., the hearing was closed at 8:09 P.M. Commissioner Crisp moved, seconded by Commissioner Kasner, that the report of the Variance Committee dated 25 April 1966 relative to' V-275 be approved " and that the variance request be granted for V-275; motion carried unanimously. Plannin~ Commission Minutes - 25 April 1966 - Continued E. -~.-97 - Margot A. Arenchild, Fruitvale Avenue - Request for Change of Zoning from "R-i-40,000" (Single Family Residential) to "R-I-40,000 P-C" (Single Family Residential Planned Community} The public hearing on C-97 was opened at 8:10 P.M. The Secretary advised that a Notice of Hearing had been published and read a letter filed by Mrs. Harry Brown in opposition to the proposed change of zoning. .The applicant's representative, Mr. Jim Cole, was present and r'~quested this application be continued since the Subdivision Committee'h~d'Suggest~d some changes in the plans that were submitted. There was no one else present who wished to comment with regard to this· , application. Chairman Norton (at 8:14 P.M.) directed C-97 continued until the meeting on 9 May 1966 and referred same to the Subdivision Co~.,~ittae for further study. F. V-276 -Vern L. Adair, Prospect Road - Request for Variance in connection .with Identification Sign Requirements The public hearing on V-276 was opened at 8:15 P.M. The Secretary advised that a Notice of Hearing had been published and there were no written communications on file. He then briefly reviewed this application. The applicant and Mr. Henderson were present to discuss this request with the Commission and explained 1) where the sign would be placed and 2) they needed a sign so they can be seen since their customers "~.. are having a difficult time finding them. After discussion, Chairman Norton (at 8:24 P.M.) directed V-276 continued until the meeting of 9 Fmy 1966 and referred same to the Variance Committee for study and a'report at that time. G. UP-102 - San Jose Water Works, Congress Springs Road - Request for Use Permit for Construction of a Backwash Tank The public hearing on UP-102 was opened at 8:25 P.M. The Secretary advised that Notices of Hearing had been mailed and that there were no further additions to the file. He then briefly reviewed this matter. There was no one present who wished to comment with regard to this application. Commissioner Kellum stated that the SuBdivision Committee had talked with Mr. Andrews of the San Jose .Water Works and he had requested more time to .. work out problems with regard to storm drainage fees. -. In view of the foregoing, Chairman Norton ,(at 8:27 P.M.) directed UP.~102j. continued.'until.the next.regular meeting on 9 May 1966. III. SUBDIVISIONS AND BUILDING SITES A. SD-592 - Western Hills Investment Company, Pierce Road - Subdivision - 26 Lots - Continued from 11 April 1966 There was no one present to represent the applicant. Commissioner Kellum stated that the proposed conditions had been discussed.. with the applicant previously and he had disagreed with the imposition of conditions six and seven listed in the Subdivision Committee Report of . 25 April 1966 ......... ..-~ ........ ...' '.~. ~.i~ .. .' .: .j...~ ....... · -- '.-' However, after discussion of the problems in requiring conditions six and seven Commissioner Kellum moved, seconded by Commissioner Crisp, that the Subdivision Committee Report of 25 April 1~66 relative to SD-592, Western Hills Investment Company, be adopted and that the tentative map (Exhibit "A-i", filed 14 March 1966) be' appro~ed' subject '.to.: the~ c~nd!t!ons..set :.forth in said report;.~motion carried unanimously. Pon, Verde Vista - Subdivison - lO.Lots - Continued from 11 April 1966 The applicant was not presentl Chairman Norton advised that some action should be taken on this appli- cation. In view of the Planning Commission's recommendation,' to the City Council, for denial of the zoning relative to this proposed tentative map, Commissioner Kellum moved, seconded by Commissioner Johnson that this tentative map be disapproved; motion carried unanimously. C. SDR-624 - Leroy Hiatt, Saratoga-Los Gatos Road --Building Site Approval - 1 Lot - Continued from 11 April 1966 The applicant was present to discuss these conditions and expressed dissatisfaction with Specific Condition "C". After further discussion the Chairman directed that Specific Condition "C" be amemded to read as follows: C. Construct acceleration and deceleration lanes in accordance with provision of the Division of Highways. Commissioner Kellummoved, seconded by Commissioner Johnson, tha~ the Building Site Committee Report of 25 April 1966 relative to SDR-624, LeRoy Hiatt, be adopted (as amended) and that the tentative map (Exhibit "A", filed 18 March 1966) be approved subject to the amended conditions contained in said report; motion carried unanimously. D. SDR-630 - W..Austin Ellmore, Canyon View Drive - Building Site Approval - 1 Lot There was no one present to represent the applicant and the Secretary requested that this application be continued until the next regular meeting to allow adequate time for'the applicant to submit a 'site develop- ment plan. In view of the foregoing, Chairman Norton directed this matter continued until the next regular meeting on 9 May 1966. E. SDR-631 - William R. Veideman, Palomino Way - Building Site Approval - 1 Lot The applicant was present to discuss the proposed conditions of. approval and 1) expressed concern over Specific Condition "B" and '..2) stated that' he was under the impression that the storm drainage fees had been paid. ~, Commissioner Kellum suggested that the applicant 1) discuss this matter with the Director of Public Works and the Planning Director since they had visited the site and ~.2)..subm~t-La. new'..and.m0re..detailed..map.$~nce the. present map dQes~not give.~an.'acc~rate,.piCtur~-;.2.~.~..-i~.-...~ ....... ,.~ ......~ On the basis of this suggestion, Chairman Norton directed SDR-631 continued until the next regular meeting and referred same to .the Subdivision Committee for further study.. F. SDR-632 - Robert M. Leeper, Palomino Way - Buildins Site ADDroyal - 1 Lot The applicant was present. Chairman Norton advised Mr. Leeper that 1) the Commission was unable to act on SDR-632 at this time since the site development plan requested had not been submitted and 2) the plan should be submitted as soon as possible befor'e the next regular meeting so that the Subdivision Committee would have !'.'an opportunity to study it and make a recommendation. On this basis, Chairman Norton directed SDR-632 continued until the next regular meeting on 9 May 1966. -4- ~lanning Commission Minutes - 25 April 1966 - Continued III. G. ~9R-633 - San Jose Water Works, Congress Springs Road - Building Site Approval - 1 Lot The applicant was not present. Chairman Norton directed this matter continued until the next regular meeting on 9 May 1966 since no action had yet been taken on the Use Permit application submitted in connection with SDR-633. H. SDR-634 - ~oy M. Westly, Prospect Road - Building Site Approval - 1 Lot The applicant was not present. Commissioner Kellum moved, seconded by Commissioner Johnson, that the Building Site Committee Report of 25 April 1966 relative to SDR-634, Roy M. Westly, be adopted and that the tentative map (Exhibit "A" filed 15 April 1966) be approved subject to the conditions set forth in said report; motion carried unanimously. '.. ~ECESS AND RECONVENE IV. DESIGN REVIEW A. A-219 - Vern L. Adair, Prospect Road - Final Design Review - Identi- fication Signs Commissioner O'Rorke advised 1) the Committee had met with the applicant and 2) requested that this matter be continued until the Variance appli- cation submitted in connection with this matter can be resolved.· In view of the' foregoing, Chairman Norton directed A-219, Vern L. Adair, · continued to the next regular meeting on 9 May 1966. B. A-220 - Roy M. Westly, Prospect Road - Preliminary Design Review - Car Wash Commissioner O'Rorke advised that"the.... Committee had reviewed the plans and found same satisfactory for preliminary approval with the same conditions as were imposed with the approval of the Use Permit.submitted in connection with this application. In"'addition,.'Commissioner O'Rorke sta~edthat 1) the circulation pattern needed to be improved and 2) this preliminary approval does not include approval for the sign. After discussion, Commissioner O'Rorke moved, seconded by Commissioner Kasner, that preliminary design approval be granted A-220, Roy M.~,W~Stly.~ on the basis of Exhibit "A"- motion carried unanimously V. CITY COUNCIL REPORT The Secretary gave a brief report on action taken at the City Council meeting on 20 April 1966 with emphasis on items of particular interest. to the'Comission.' VI... NEW BUSINESS The Secretary brought up the subject of proposed amendments to the zoning ordinance and said that he was unprepared at this time to present them; however, he would try and have them ready by the next meeting. In answer to an inquiry by Chairman Norton, as to the procedure to be taken, the Secretary stated that he would publish a notice and attempt to send out a draft of the proposed amendments to the Planning Commissioners in advance of the hearing. Planning Commission Agenda - 25 April 1966 - Continued VII. OLD BUSINESS A. UP-74 - Dr. Robert Wade, Souza Lane - Request for Extension in connec- tion with Use Permit for Convalescent Home Commissioner Kellum recommended that this application be continued since the new plans were to include an.' increase in the bed capacity in this Convalescent Home and so it would be necessary to obtain a new Use Permit rather than get an ·extension. · 3 On this basis, Chairman Norton directed this matter continued until the next regular meeting. B. UP-75 - Luceal Westmoreland, Souza Lane ' Request for Extension in connec- tion with Use Permit for Convalescent Home The Secretary read a communication from the applicant's representative requesting an extension in connection with this Use Permit. After discussion,'Commissioner' Kellummoved, seconded by Commissioner O'Rorke, that an extension of one (1) year from the present date of. expiration be granted in connection with UP-75, Luceal Westmoreland; motion carried unanimously. C. SD-586 - Robert F. Plane, Douglas Lane - Request for deletion of Curb and Gutter Requirements The Secretary stated that the request of Robert F. Plane, SD-586, 'concerning curb and gutter requirements had been referred to the Planning Commission by the Council for a report and recommendation. In view of the foregoing, Chairman Norton directed this matter continued until the next·regular.meeting and referred same to the Subdivision Committee for review and a report. ORAL VISITORS Chairman Norton acknowledged, with pleasure, the presence of Councilman Tyler, Mrs. Stark of the·Good Government Group, Mrs. Ottenberg of the League of Women Voters·and Mrs. Walker, wife of the Planning Director.
