ROLL CALL Presenti Commissioners Crisp, Kellum, Norton and OgRorke. Absent: Commissioners Johnson~ Kasner"and McFall]" B. MINUTES Commissioner Crisp moved, seconded by Commissioner OgRorke, =hat the reading of the minutes of i3 June 1966 be waived and that the minutes be approved as submitted to the Commissionl motion carried unanimously. II. PUBLIC. HEARINGS Chairman Norton declared public hearings open for the evening at 7:31 Dr. Rowe (UP-106) was present and 1) explained that, because of an emer- gency, he.had been called to the hospital and 2) inquired as to whether it would be. possible for the Commission to open his application for dis- cussion at this time or postpone it until. the-end of the meeting to allow sufficient time for his return. .. In view of the foregoin~, Chairman Norton directed that UP-106 be brought before the Commission as the first item under t~ublic Hearings". "'. C. .UP-1.06 - MarvinRowe, M.D., San Marcos Road - Request for Use Permit for Horse - Continued from 13 June 1966 The continued hearin~ on UP-106 was resumed at 7132 P. M. The Secre- tary'briefly reviewed this matter and read a communication filed in support of the subject application by Nr. Richard Kline and Mrs. Betty Wells of Fruitvale Avenue. Dr. Kellum, on behalf of the Subdivision Committee (to whom this mat- · . ter had been referred for study)', gave an oral report recommendin~ approval subject to compliance with Ordinance NS-3. After discussion, Commissioner Crisp moved, seconded by Commissioner Kellum, that the public hearing on UP-106 be closed; motion carried unanimously and the hearing was closed at 7134 It was moved by Commissioner Crisp and seconded by Commissioner Kellum that UP-106, Dr. Marvin Rowe, be approved subject to compliance with Ordinance NS-31 motion carried unanimously. Commission. : After a brief discussion, Commissioner Crisp'moved, seconded by Com- :' missloner O'Rorke, that the public hearing on UP-108 be closed; motion . carried unanimously and the hearing was closed at 7:4! Wood, be approved and that the-Use Permit be granted accordingly; motion carried with ' Chairman Norton dissenting. . ............. -- " Chairman'Norton explained that while he agreed that the site appeared · . ample for the keeping of a horse and the proposed corral area would · -, be well screened~ he was opposed to the granting of'the Use Permit -L since.he felt that this particular area of the City was more suburban · '..' than rural and, for this reason, would not lend itself well to horses. Commissioner Crisp stated that while he agreed basically with Chair- man Norton, .he had supported the subject application on the basis that it met all requirements of the existing ordinance. · '. E. 7-278 - Gary L, Menzemer Commissioner Crisp advised that after revisiting the site, the Variance Committee had unanimously agreed to reaffirm its report of 13 June 1966 which had been submitted to the Commission at the last regu].ar meeting. He then read the subject report. After discussion, Commissioner O'Rorke moved, seconded by Commissioner hilum, that the public hearing on V-278 be closed; motion carried unanimously and the hearing was closed at 7:47 P. M. Commissioner Crisp moved, seconded by CommiSsioner Kellum, that the Variance Committee Report of 13 June 1966 relative to V-278, Gary L. Menzemer, be approved and that the Variance be denied since the required findings could not be made; motion carried unanimously. B. UP-105 - '.Gary L. Menzemer, Saratoga Avenue - Request for Use Permit for '. .. Horse - Continued from 13 June 1966 · ' Since consideration of this application was contingent upon the "~. granting of the Variance (V-278), Chairman Norton, in view of the fore- going and with concurrence of the Commission, dispersed with further' hearing on UP-105 and directed that same be removed from the agenda. F. y-279 - Tom Greenleaf, Saratoga Avenue - Request for Variance in connec- .'. tion with Front Yard Setback Requirements -' The public hearing on V-279 was opened at 7:49 P. M. The Secretary ad- vised that Notices of Hearing had been mailed and there were no written communications on file. He then briefly reviewed this application. " The applicant.was present and advised 1) their home fronts on a short, : private road which terminates at the creek 2) the variance was requested , for a proposed addition to the main structure_ 3) approval of this pro- posal had been obtained from the people who own the road'4) to locate this addition' elsewhere would require the removal of a fish. pond and two .." or possibly three trees and .5) the private road actually provides ac- cess for no one else. " The Secretary advised that Mr. Dennee, who owns the property across the private road, had come into the.office earlier in the day to inform him 1) he would be unable to attend the meeting and 2) he was opposed to the granting of this variance since his garage was. located almost adja- · cent to the private road and he felt any new structures should be set back in accordance with requirements of the ordinance. The applicant discussed this objection with the Commission and explained that the subject garage was used for repairing race cars. After further discussion, Chairman Norton (7:55 P.M.) directed V-279 continued until the next regular meeting and referred same to the · Variance Committee for study and a report at that time. " The Chairman declared public hearings closed for the evening at 7:56 P. M. III. SUBDIVISIONS AND BUILDING SITES . A. SDR-630 -.W. Austin Elmore, Canyon View Drive - Building Site Approval - .. B. SDR-636 - Roman T. Chavez, Canyon View Drive - Building Site Approval - 1 Lot - Continued from 13 June 1966 The Chairman directed SDR-636 continued until the meeting on 11 July 1966 since the soils report needed in connection with this site had not yet been submitted. C,' SDR-638 - Walter E..Hileman, Peach Hill Road - Building Site Approval - 1 Lot - Continued from 13 June 1966 Chairman Norton directed SDR-638 continued until the next regular meeting to allow the applicant'further time for consultation with the Health Department with respect to the septic tank. D, SDR-640 - Stanley Forster, Saratoga-Los Gatos Road - Building Site .. Approval - 2 Lots - Continued from 13 June 1966 The applicant and Miles Rankin,. realtor, were present to discuss this. application with the Commission. After reviewing the proposed condi- tions of approvals Mr, Rankin raised a question with regard to Condi- tions '~" and "F" and, after discussion, requested that SDR-640 be continued until the next regular meeting.. When the Secretary advised that time for action on the tentative map would expire prior to the meeting on 11 July 1966, Commissioner Crisp moved, seconded by Commissioner Kellum, that SDR-640 be denied unless _ an appropriate extension was received from the.applicant prior to ex- piration of time for action on the tentative map, in which case the application would be continued until the next regular meeting; motion carried unanimously. · g, SDR-642 - Dr, James Merino, Montalvo Lane - Building Site Approval - 1 Lot The applicant was present and after reviewing the proposed conditions of approval, expressed satisfaction with same. Commissioner Kellummoved, seconded by Commissioner Crisp, that the Building Site Committee Report of 27 June 1966 relative to SDR-642, Dr James Merino, be adopted and that the tentative mp (Exhibit "A" filed 6 June 1966) be approved subject to the conditions..set' forth in said report; motion carried unanimously. · F, SDR-643 - Thomas B. Fryer, Saratoga Hills Road - Building Site Approval - 1 Lot .." The applicant was not present but the Secretary advised that' he had reviewed theproposed conditions of approval and had expressed satis- faction with same, ~'.. Commissioner Kellummoved, seconded by Commissioner Crisp, that the. . Building Site Committee Report of 27 June 1966 relative to SDR-643, Thomas B Fryer, be adopted and that the tentative map.(Exhibit "A" filed 14 June 1966) be approved subject to the conditions set forth in said report; motion carried unanimously. C. SDR-644 - Dr. John Oliver, Saratoga-Sunnyvale Road - Building Site Apprpyal - 1 Lot The applicant was not present but the Secretary advised that he had reviewed and approved the proposed conditions of approval. Commissioner Kellummoved, seconded by Commissioner Crisp, that the Building Site Committee Report of 27 June 1966 relative to SDR-644, Dr. John Oliver, be adopted and that the tentative map (Exhibit "A", filed 17 June 1966) be approved subject to the conditions set forth in said report; motion carried unanimously. -4- Planning Commission Minutes - 27 June 1966 - Continued III. H. SDR-645 - Leonard Ferace, Saratoga-Los Catos Road - Building Site Approval - 2 Lots Miles Rankin, realtor, was present to represent the applicant and after a brief review of the proposed conditions of approval, expressed satis- faction with same. Commissioner Kellummoved, seconded by Commissioner Crisp, that the Buil- ding Site Committee Report of 27 June 1966 relative to SDR-645, Leonard Ferace, be adopted and that the tentative map (Exhibit "A" filed 15 June 1966) be approved subject to the conditions'set forth in said report; mo- tion carried unanimously. IV.' DESIGN REVIEW A. A-222 - Manuel Lozano, Prospect Road - Preliminary Design Review - Car Wash - Continued from 13 June 1966 Commissioner O'Rorke reconmended that A-222, Manuel Lozano,.'be continued until the next regular meeting pending receipt of a revised plan in con- nection with traffic circulation. " Chairman Norton so directed. B. .SS-47 - Nell Chase, Prospect Road - Final Design Review - Permanent Sub- Commissioner O'Rorke advised that the necessary changes had been made (since the brief discussion at the Commission meeting on 13 June 1966) and that the subject sign now met all requirements of Ordinance NS-3. · It was moved by Commissioner O'Rorke and seconded by Commissioner Crisp that final design approval be granted SS-47, Nell Chase, for the permanent subdivision identification sign shown on Exhibit "A"- motion carried V. CITY COUNCIL MEETING Commissioner Crisp gave a brief resume of discussion ap~ action at the City Council meeting on 15 June 1966, with emphasis on items of particular in- terest to the Commission. VI. NEW BUSINESS '~ 'A. UP-103 - Manuel Lozano, Prospect Road - Request for Use Permit for Car. Wash The Secretary 1) advised that the City Council had requested that the Commission recommend conditions to be imposed in connection with appro- val of UP-103, Manuel Lozano, and 2) read a list of proposed conditions =:. prepared by the Subdivision Committee. '.]z': :' After discussion, Commissioner Kellummoved, seconded by Commissioner · '.' O'Rorke, that the list of conditions proposed by the ·Subdivision Commit- :' tee in connection with UP-103, Manuel Lozano, be approved and that the Secretary' be directed to transmit same·to the City Council as the recom- mendation of the Commission; motion carried unanimously. B. Commission Policy ........... The 'Commission discussed possible solutions to the problem of having applications filed then temporarily abandoned by the applicants, . leaving the Commission to carry these items from one agenda to another until convenient for the applicant to proceed. B, Commission Policy Chairman Norton moveds seconded by Commissioner O~Rorkes that the Commission adopt as standard procedure a policy that l) appli- cants are expected to pursue applications to. completion promptly and diligently and 2) failure to pursue an application with promptness and due diligency will be grounds for denial; motion carried unanimously. C. PathWay al.on~ S~rato~a-Sunn.yvale Road Commissioner O~Rorke stated that with traffic increasing, he felt a pathway was needed along Saratoga-Sunnyvale Road. He also com- mented that if the City would not vote a bond issue for construc- tion of such a pathway, he felt the Commission should do what it could toward obtaining one. In answer to a question from Commissioner Crisp~ the Secretary ad- vised that the .Staff had been working on the proposed Capital Im- provement Programs preparing a list of things to be done. He fur- · "' ther advised that the City Administrator felt it would be too late to obtain a Commission reconmendation this. year so should be made a matter of information at this time, then referred to the Commis- sion next year. Commissioner Crisp observed that it had been his understanding that the Staff was to draft this proposed program in consultation with the General Plan Committee. After further discussion, Chairman Norton requested that the Secre- tary advise the City Administrator that the Commission would be happy to discuss this program prior to its going before the City Council. VII. OLD BUSINESS A. .C-80 - Clarence Neale,'Saratoga-Sunnyvale Road - City Council Request. for Recommendation relative to Request for Additional St~ns - The Secretary read a Staff Report relative to C-80s recommendh~g that the single sign limitation be removed and the permitted uses be allo- cated signs in accordance with the standards established by City of Saratoga Zoning Ordinance NS-3~ Commissioner Kellum advised that the subject Staff Report had'the en- dorsement of the Subdivision Committee. ..During the discussion that followed, the Secretary explained 1) Mr. Neale has a Building Permit to finish construction of the portion.of his new building that will house "The Barn" 2) while this operation is still being donducted at the old location at this time, it will be moved to the new location when construction has been completed and 3) at that t/me, all operations will cease at the old location and the site will be completely abandoned. Commissioner Kellummoved, seconded by Commissioner Crisp, that the Staff Report.of 27 June 1966 relative to C-80~ Clarence Neale, be approved and transmitted to the City Council as the reco~nendation of the Commission; motion carried unanimously. -6-' · Plannin~ Commission Minutes - 27. June 1966 - Continued VII. B. SD-592 - Western Hills Investment Company, Mr. Eden Road - Request for Exception on Conditions of Subdivision Approval - Continued from 13 June 1966 .. The Secretary advised· 1) this matter had previously been continued at the request of the applicant~s engineer (Mr. Heiss) so that he could confer further with his clien~ and 2) following the consulta- tion, Mr. Heiss had written a letter to the City Council, requesting its consideration of the matter. The Secretary then read the sub- ject letter (dated 27 June 1966) and explained that Mr. Heiss had felt it should be addressed to the Council· since he was requesting · . that the City be committed to participation in 'the cost of improving "' the access road and bridge required under SD-592.. · ' During the discussion that followed, Chairman Norton observed that · . ~ She subject letter was rightfully addressed to the City Council since the Commission could not make such a commitments but that the request for exception was still before the Commission and, without action, ":'-' 'would have to remain on the agenda. After further discussion, Commissioner Crisp moved, seconded by Com- '. ... . missioner Kellum, that the Secretary be directed to notify the City · -'... '. Council that the Cormnission, after hearing Mr. HeissI letter of " 27 June 1966, reaffirmed its original recommendation (Subdivision '.'" 'Committee Report of 25 April 1966, adopted by the Commission on 25 April 1966) in connection with SD-592; motion carried unanimously. ' ' C. .SDR-574 - John Kirkpatrick, Pike Road - Request for Extension ~- Con-- tinued from 13 June 1966. Commissioner Kellum advised 1) the Committee had reviewed this re-' quest for extension and 2) it was recommended that same be granted. It was moved by Commissioner Kellum and seconded by Commissioner Crisp that an extension of one ·year from the present date of expira- .. tion be granted in connection with SDR-574, John Kirkpatrick; motion carried unanimously. ..... VIII. COMMUNICATIONS · .. ". · . .,. A. WRITTEN ' - SD-639 - Margot A. Arenchild, Fruitvale Avenue - Request for Exception · - on Con.d, itions of Subdivision Approval ~ .'. The Secretary read a letter from the applicant~s engineer requesting exception in connection with certain conditions established under· · . =. SD-639. After a brief discussion, Chairman Norton directed SD-639 continued until the applicant's engineer could meet with the Director of Public Works to discuss this application. ... B. ORAL Chairman Norton acknowledged, with ·pleasure, the presence of l~cs'. McGuire and Mr. Yore of the Good Government Group and Mr. Hernandez.
