PLACE: City Council Chambers, Fruitvale Avenue, Saratoga, California TYPE: Regular Meeting I. ROUTINE ORGANIZATION The meeting was Called to order'by Chairman Norton at 7:30 P. M. A. ROLL CALL Present: Comm. issioners Crisp, Johnson, Kellum and Norton. Absent: Commissioners Kasner,'McFall and O'Rorke. B. MINUTES Commissioner johnson moved, seconded by Commissioner Crisp, that the reading of the minutes of 27 June 1966 be waived and that the minutes be approved as submitted to the Commission; motion carried unanimously. II. PUBLIC HEARINGS A. ~-97 - Margot A. Arenchild, Fruitvale Avenue - Request for Change of Zoning from "R-i-40,000" (Single Family Residential) to "R-I-40,000 P-C'.' (Single Family Residential Planned Community) Continued from 27 June 1966 The Secretary read a letter from the applicant's engineer (Jim Kaiser) 1) requesting that this application (C-97) be withdrawn and 2) advising that the applicant planned to reinstate same at a later date (approximately six months) when plans had been completed.' Commissioner Kellummoved, seconded by Commissioner Crisp, that the request for Withdrawl of C-97, Margot A. Arenchild, be granted; mo- tion carried unanimously. B. V-279 - Tom Greenleaf, Saratoga Avenue - Request for Variance in con- nection with Front Yard Setback Requirement - Continued from 27 June 1966 The continued hearing on V-279 was re-opened at 7:37 P. M. The Secre- tary briefly reviewed this matter and advised that nothing further had been added to the file. The applicant was present but stated that he had no further comment at this time. There was no one else in the audience Who wished to speak with regard to this request for variance. Commissioner Crisp read the report of the Variance Committee relative to this application, recommending that (in'accordance with Sec- tion 14.6 of Ordinance NS-3) the Commission designate the setback on the westerly side of the property that of a side yard setback, making a variance unnecessary. After discussion Commissioner Kellum moved, seconded by Commissioner Johnson,.that the public hearing on V-279 be closed; motion carried unanimously and the hearing was closed at 7:40 P. V-279 - Tom Greenleaf Commissioner Crisp moved, seconded by Commissioner Kellum, that the Variance Committee Report of 11 July 1966 relative to V-279, Tom Greenleaf, be approved and that the Commission designate the set- back on the westerly side of the property as a side yard setback in accordance with Section 14.6 of Ordinance NS-3, making a variance unnecessary; motion carried unanimously. C. UP-109 - Saratoga Foothills Development Corporation, Miljevich Drive - Bequest for Use Permit for Model Home Sales Office The public hearing on UP-109 was opened at 7:43 P.M. The Secretary advised that Notices of Hearing had been mailed and there were no written communications on file. He then briefly reviewed this matter. There was no one present who wished to speak with regard to this're- quest for a Use Permit. The Secretary read a Staff Report recommending that UP-109 be . approved, subject to certain conditions. After discussion Comnissioner Crisp moved, seconded by Commissioner Kellum, that the public hearing on UP-109 be closed; motion carried unanimously and the hearing was closed at 7:46 P. M. Commissioner Crisp moved, seconded by Commissioner Kellum, that the. Staff Report of 11 July 1966 relative to UP-109 be approved and that the Use Permit be granted subject to the conditions set forth in said report; motion carried unanimously. D. UP-110 - Pacific Shore Properties, Inc., Via Roncole - Request for Use Permit for Model Home Sales Office and Administration Office The public hearing on UP-110 was opened at 7:47 P. M. The Secretary advised that Notices of Hearing had been mailed and there were no written communications on file. He then briefly reviewed the sub- ject application. The applicant's representative spoke briefly and explained that the residents would be unaware of the Administration Office inasmuch as no more than two people would be using same. There was no one else present who wished to comment with regard to this matter. The Secretary read a Staff Report recommending that UP-110 be approved subject to certain conditions. After discussion, Commissioner Johnson moved, seconded by Commis- sioner Crisp, that the public hearing on UP-110 be closed; motion carried unanimously and the hearing was closed at 7:50 P. M. It was moved by Commissioner Kellum and seconded by Commissioner Johnson that the Staff Report. of 11 July 1966. relative to UP-110 be approved and that the Use Permit be granted subject to the conditions set forth in said report; motion carried unanimously. E. V-280 - Bell-Scott Developers, Bank Mill Road - Request for Variance in connection with Front Yard Setback Requirement The public hearing on V-280 was opened at 7:51P. M. The Secretary advised that Notices of Hearing had not been necessary since the applicant held title to all the property within a 500 foot radius of the subject site. Y-280 - Bell-Scott Developers There was no one present to represent the applicant and no one in the audience who wished to comment with regard to this application. After discussion, Chairman Norton (7:53 P. M.) directed V-280 con- tinued until the next regular meeting and referred same to the Variance Committee for study and a report at that time. Commissioner Crisp, Chairman of the Variance Committee, requested that the Secretary inform the applicant that the Variance Committee would make its on-site inspection shortly after 8 A.M. On Saturday, 16 July 1966. III. SUBDIVISIONS AND BUILDING SITES A. SDR-630 - W. Austin Elmore, Canyon View Drive - Building Site Approval 1 Lot - Continued from 27 June 1966 Since the required site development plan had not yet been submitted, Chairman Norton, with concurrence of the Commission, directed SDR-630 continued until the next regular meeting and requested that the Secre- tary advise the applicant that due diligence was'expected with respect to preparation of said plan. B. SDR-636 - Roman T. Chavez, Canyon View Drive - Building Site Approval - 1Lo.t - Continued from 27 June 1966 Since the soils report needed in connection with this site had not yet been submitted, Chairman Norton, with concurrence of the Commis- sion, directed SDR-636 continued until the meeting on 25 July 1966 and requested that the Secretary advise the applicant of the Commis- sion's newly adopted policy relative to proceeding with'due diligence. C~ SDR-638 - Walter E. Hileman, Peach Hill Road - Building Site Approval - 1 Lot - Continued from 27 June 1966 The Secretary advised that the Health Department had not yet completed the percolation studies on this property and suggested that 'SDR-638 be continued until the next regular meeting. Chairman Norton so directed. D. SDR-640 - Stanley Forster, Saratoga-Los Gatos Road - Building Site Approval - 2 Lots - Continued from 27 June 1966 The Secretary read a letter from the applicant requesting that SDRm640 be withdrawn. Commissioner Kellummoved, seconded by Commissioner Johnson, that the request for withdrawal of SDR-640 be granted; motion carried unanimously. E. SDR-646 - Samuel E. Pace, Saratoga-Los Gatos Road - Building Site Approval - 1 Lot There was no one present to represent the applicant and the Secretary advised that the applicant had not had occasion to review the pro- posed conditions of approval. In view of the foregoing, Chairman Norton, with concurrence of the Commission, directed SDR-646 continued until the meeting on 25 July 1966. -3- Planning Commission Minutes - 11 July 1966 - Continued III. F. SDR-647 - Leo J. Bianchi, Carniel Avenue - Building Site Approval - '2 Lots Mr. Bianchi was present to discuss the proposed 'conditions of appro- val with the Commission. It was moved by Commissioner Keilum and seconded by Commissioner Johnson that the Building Site Committe. e Report of 11 July 1966 rela- tive to SDR-647'be adopted'and that the tentative map (Exhibit "A", filed 1 July 1966) be approved subject to the conditions set forth in said report; motion carried unanimously. IV. DESIGN REVIEW A. A-222 - Manuel Lozano, Prospect Road - Preliminary Design Review - Car Wash - Continued from 27 June 1966 The Secretary advised that Mr. Gurley (Mr. Lozano's representative) was presently appearing before the Board of. Supervisors in an attempt to obtain better access for. this property and it was his recommendation that the matter be continued in view of this. ~e Design Review Committee concurred with this recommendation, and Chairman Norton so directed. B. A-225 - Pacific Shore Properties, Inc., Via Roncole - Final Design Review - Subdivision Homes for "Granada Hills" Commissioner Crisp advised that the Design Review Committee had re- viewed the plans for the subject homes and it was the recommendation of the Committee that the subject seven homes be approved subject to 25% of the total seventeen residences having curved driveways. After discussion, Commissioner Crisp moved, seconded by Commissioner Johnson, that A-225 be granted final design approval for seven homes as shown on Exhibits "A" "B-i" through "B-5" and "C" subject to · · 25% ofthe 17 homes in this tract having curved driveways; motion carried unanimously. C. A-226 - Dr. John Oliver, Saratoga-Sunnyvale Road - Preliminary Design Review - Commercial Buildin~ The Design Review Committee recommended that A-226 be continued until the next regular meeting to allow adequate time for a meeting between the applicant· the Director of Public Works and the Planning Director with regard to access to this proposed building. Chairman Norton so directed. D.. A-214 - Sacred Heart Church, Saratoga Avenue - Final Design Review - Faculty Residence After discussion Commissioner Crisp moved, seconded by Commissioner Johnson, that final design approval be granted A-214, Sacred Heart Church· for the proposed Faculty Residence as shown on Exhibit "A-I"; motion carried unanimously. E. SS-48 - Purcell Realty· Reid Lane - Final Design Review - Temporary Subdivision Sign for "Tetra Ladera" Commissioner Crisp advised that the Committee had reviewed plans for the subject 'sign and found that.it met all requirements of Ordi- nance NS-3o Commissioner Crisp moved, seconded by Commissioner Kellum· that final design approval be granted SS-48 on the basis of Exhibit "A"; motion carried unanimously. -4- PlanninM Commission Minutes - 11 July 1966 - Continued IV. F. SS-49 - Arcadia Palms, Chester Avenue - Final Design Review - Tem- porary Subdivision Sign Commissioner Crisp advised that a review of the plans for the sub- ject sign revealed that it was in accordance with the ordinance. Commissioner Crisp moved, seconded by Commissioner Johnson, that SS-49 be granted final design approval on the basis.of Exhibits and "B"; motion carried unanimously. G. SS-50 - Saratoga Foothills Development Corporation, Miljevich Drive - Final Desinn Review.- Temporary Subdivision SiMn The Design Review Committee advised that the subject plans had been reviewed and that final approval was recommended. Commissioner Crisp moved, seconded by Commissioner Kellum, that SS-50 be granted final design approval on the basis of Exhibits "A" and."B"; motion carried unanimously. Commissioner Crisp suggested that the Planning Director be authorized to approve temporary subdivision signs in the future if they met all require- ments of the ordinance. During the discussion that followed, the conflict between Section 10.8(e) and Sections 10.2(b) and 10.2(c) was brought to the attention of.the ,. Commission. Commissioner Crisp moved, seconded by Commissioner Johnson, that Sec- tion 10.8(e) override Section 10.2(b) and 10.2(c) and that the Planning Director (Zoning Administrator) be authorized to. issue permits for tem- porary subdivision signs if they met the requirements of Ordinance NS-3; motion carried unanimously. V. CITY COUNCIL REPORT Chairman Norton gave a report on discussion and action at the City Council"' meeting on 6 July 1966, with emphasis on items of particular interest to the Conm~ission. In connection with a review of the discussion relative to the purposes and objectives of the P-D Zoning District as established under Ordinance NS-3, Chairman Norton read a communication from the Planning Committee to the City Council, advising that the Planning and Subdivision Committees had directed the Staff to prepare proposed amendments to the ordinance which would correlate zoning district densities with tOpography.rather than lot area requirements. Co~r~nissioner Crisp suggested that perhaps this section of the ordinance should be eliminated since there was little, if any, property left in Saratoga which would qualify under the requirements of P-D Zoning. After a discussion relative to the proposed amendments to the ordinance, it was the consensus of the Commission that prospective applicants should be warned that 1) the Commission probably would take no action on an application for P-D Zoning pending the outcome of the study 2) therefore, if an application was filed it would probably be continued pending com- pletion of the study and 3) insistence upon action on such an application could result in denial. Chairman Norton also read a letter from Louis Pasquinelli, attorney for Mr. Garcia (SDR-615), pertaining to the dedication required in connection with site approval. Following Chairman Norton's review of the discussion relative to cable TV, the Commission requested that the Secretary ask the City Attorney to include (in the proposed ordinance) a r~quirement that the cables be placed underground. VI. ~W BUSINESS VII. OLD BUSINESS = Urban Beautification The Secretary read a portion of a letter from the Department of Housing and Urban Development, advising that a finding by the Planning Commis- sion that the beautification program is important to the comprehensively planned development of the locality will be required. Chairman Norton moved that the following statement be adopted as the finding of the Commission and transmitted to the Department of Housing and Urban Development: "The Commission finds and resolves tha~ the landscaping of the Civic Center, of Blaney Plaza, and of the median strip of the Saratoga- Sunnyvale Road, the tree-planting in the Azule Area and the design and construction of the entrance to Montalvo are all important to the comprehensively planned development of the City of Saratoga and the surrounding locality." Commissioner Johnson seconded the motion which carried unanimously. VIII. COMMUNICATIONS A. WRITTEN SD-567 - Loma Serena Development Company, Inc., Prospect Road - Request for Extension The Secretary read a letter requesting an extension in connection with Unit 2 (18 lots) of SD-567. Commissioner Kellum advised that the Subdivision'Committee had re- viewed this request for extension and recomnended approval of same. It was moved by Commissioner Kellumand seconded by Commissioner Johnson that an extension of one (1) year from the present date of expiration be granted in connection with Unit 2 (18 lots) of SD-567; motion carried unanimously. B. ORAL Chairman Norton acknowledged, with pleasure, the presence of Mrs. McGuire of the Good Government Group and Mrs. Ottenberg Of the League of Women Voters. IX.
