PLACE City Council Chambers, Fruitvale.Avenue, Saratoga, California TYPE: Regular Meeting I. ROUTINE ORGANIZATION " The meeting was called to order by Chairman Norton at ?:30 P. M. 'A. ROLL CALL: "' Present: Commissioners Crisp, Rasher, Kellum, Norton and O'Rorke. 'Absent: Commissioners'Johnson'and McFall. B. MINUTES : Commissioner Crisp moved, seconded by Commissioner Kellum, that the reading.of the minutes of 8 August. 1966 be waived and that the minutes be approved as distributed to the Commission; motion carried unanimously. C. NEW STAFF MEMBER Chairman Norton introduced and extended a welcome to Gary Bonfiglio, new member of the Planning Staff, and explained that he would be working 'full time under the direction of the Planning Director. II. PUBLIC HEARINGS A. V-282 - Saratoga Foothills Development Corporation, Upper Hill Drive - · . Request for Variancein connection.-with Rear Yard Setback Requirement for Lot 66 of Tract 3101 (Blue Ridge Subdivision) - Continued from 8 AuEust 1966· The continued hearing on V-282 was re-opened at 7:34 P. M. The Secre- tary briefly reviewed this application and advised that nothing fur- .. ther had been added to the file. Burney Turgeon was present to represent the applicant, but advised that he had no further comment at this time. · ' There was no one. in the audience who wished to speak with regard to ' this matter. Commissioner Crisp advised that the three members of the Variance Com- mittee had visited the site, and requested that Commissioner Kasner .. read the report prepared by the Committee.' The Variance Committee Report (read by Commissioner Kasner) recom- · ·mended that the Commission, in view of the rugged terrain and irregu- "lar shape of the site, make a determination (in accordance with Sec-- tion 14.6 of Ordinance NS-3) that a variance was unnecessary,'.subject to any conditions set forth. by the Grading and Excavation Committee in connection with further·development of the site. The Secretary advised that the proposed encroachment into the slope easement on this lot had been approved previously and that the appro- val was still valid. After discussion, Commissioner Kasner moved, seconded by Commissioner Kellum, that the hearing on V-282 be closed'; motion carried unanimously and the hearing was closed at 7:38 P. V-282 - Saratoga Foothills Development Corporation Commissioner Crisp moved, seconded by Commissioner Kellum, that the Variance Committee Report of 22 August 1966 relative to V-282, Saratoga Foothills Development Corporation, be adopted and that no variance be required subject to the condition set forth in said report; motion carried unanimously. B. V-283 - Donald Miller, Cody Lane - Req~esk for Variance in connec- tion with. 1) Lot Depth 2) Rear Yard Setback and 3) Side Yard Setback on Residual Parcel The public hearing on V-283 was opened at 7:39 P. M. The Secretary. advised that Notices of Hearing had been mailed and read a communi- cation from Perry Polenz of Cody Lane opposing the granting of this Variance on the basis of 1) setting an undesirable precedent and 2) .incompatibility with the surrounding area. The applicant was present to discuss this matter with the Commission, and explained that the problems were created by the location of the existing buildings on the residual parcel. After discussion, Chairman Norton (7:48 P. M.) directed V-283 con- tinued until the next regular meeting and referred the matter to the Variance Committee for study and a report at that time. C. C-8Q - clarence Neale, Saratoga-Sunnyvale' Road - Informal Hearing in connection with Request for Additional Use.under Conditional 'Zonin~ and Additional Buildin~ .on Property The informal hearing on C-80 was opened at 7:49 P. M. The Secretary read a communication from the applicant requesting that. action on this reques~ be continued until the meeting on 12 September 1966. There was no one in the audience who wishe4 to comment with regard to this matter. Commissioner O'Rorke observed that this property was becoming a sea of blacktop that had not been covered under the applicant's De~..ign .--! Review application. In view of this, he requested that the Secretary ask .the applicant to submit a detailed site plan for the entire parcel. After further discussion, Chairman Norton (7:58 P. M.) directed C-80 continued until the next regular meeting and referred. same to the Sub- division Committee and Design Review Committee for review. D. UP-87 - University Pre-School of Saratoga, Big Basin Way - Informal Hear. i.n~ in connection with Request for Renewal of Use Permit The informal hearing on UP-87 was opened at 7:59 P. M. The Secretary briefly reviewed the subject request and read communications from 1) Amelia Deasy of Pamela Way opposing the renewal of the subject Use Permit on the basis of preserving the rural beauty of the area 2) Mr. and Mrs. Harold P. Blair of Pamela Way stating that they felt this · Use Permit should be reviewed annually and 3) Mrs. Mary Moss of Pamela Way opposing the requested renewal on the basis of noise and the ques- tion of need for such operation. The applicant was present. but stated that she had no further comment at this time. -2- Planning Commission Minutes - 22 August 1966 - Continued iI. D. UP-8____/7 - University Pre-School of Saratoga Mrs. Moss was present to re-affirm her opposition to this request. She also advised that she represented other property owners in the area who were unable to attend this meeting and requested that this· matter be continued to give them another opportunity to attend. During the discussion that followed, it was established that l) all conditions of the original Use Permit had been met 2) the land- scaping and continued maintenance of the property had greatly im- proved the appearance of the area 3) a 6-foot wall or hedge had been required since the property did not adjoin a residential dis- trict and 4) the chain-link fence had been preferred by the Commis- sion for the protection of the children. In view of the foregoing, the Commission concurred that a continu- ance seemed unnecessary. Chairman Norton (8:21 P. M.) terminated the informal hearing on UP-87, and requested that the Subdivision Committee discuss this matter at recess and see if a decision could be reached on its recommendation. III. BUILDING SITES AND SUBDIVISIONS A. SDR-630 - W. Austin Ellmore, Canyon View Drive - Building Site Appro- val - 1 Lot - Continued from 8 August 1966 Commissioner Kellumadvised 1) the applicant had requested that· SDR-630 be continued until the next regular meeting and 2) the necessary extension of time to cover this continuance had been provided· In' view of the foregoing, Chairman Norton so directed. B. SDR-638 - Walter E. Hileman, Peach Hill Road - Building Site Appro- -val - 1 Lot - Continued from 8 August 1966 The Secretary read a communication from the~'applicant requesting that SDR-638 be withdrawn. Commissioner Kellummoved, seconded by Commissioner Crisp, that Mr. Hileman's request be granted; motion carried unanimously. .. C. SDR-650 - Charles Harden, Sobey Road - Building Site Approval - 2 Lots Continued from 8 August 1966 The Secretary advised that the..applicant was in the process. of run- ning percolation tests on this property and had filed a letter grant- ing an extension of time with a request for further continuance. On the basis of a recommendation from the Building Site Committee, .. Chairman Norton directed SDR-650, Charles Harden, continued until the meeting on 12 September 1966'. D. SPR-654 - Richfield Oil Company, Cox Avenue - Building Site Approval - 1 Lot The applicant's representative reviewed the proposed conditions of approval and expressed satisfaction with same. Commissioner Kellummoved, seconded by Commissioner Crisp, that the Building Site Committee Report of 22 August 1966 relative to SDR-654, Richfield Oil Company, be adopted and that the tentative map (Exhi- bit "A", filed 12 August 1966) be approved subject to the conditions set forth in ~aid report; motion carried unanimously. -3- Plannin~ Comm{ssion Minutes'- 22 August 1966 - Continued III. E. SDR-655 - Dr. DOnald Hambey, Farwell Avenue - Building Site Approval - 1 Lot The Commission reviewed .this matter with the applicant and explained 1) conditions of approval for this site had been completed with the exception that'there was a question with regard to the requirement for underground utilities and 2) the Commission would like to con- tinue SDR-655 until the next regular meeting unless the applicant was · -- willing.to accept the requirement for underground utilities· After further discussion, the applicant expressed satisfaction with the propesed conditions of approval. Commissioner Kellum moved, seconded by Commissioner Kasner, that the Building Site Committee Report' of 22 August 1966 relative to SDR-655, Dr. Donald Hambey, be adopted and that the tentative map (Exhibit "A", filed 10 August 1966) be approved subject to the conditions set forth in said report; motion carried unanimously. LeRoy Johnson, architect, was present to represent the applicant and, , after review,.expressed satisfaction with the proposed conditio.ns of approval. Commissioner Kellum' moved, seconded by Commissioner Crisp, that the Building SiZe. Committee Report of 22 August 1966 relative to SDR-657, James R. Davi, be adopted and that the tentative map (Exhibit "A" filed 12 August 1966) be approved subject to the conditions set.lforth in said report; motion carried unanimously., H. SDR-658 - Robert F. Plane, Douglas Lane - Bditding Site Approval - 1 Lot Mr. Plane was present.to discuss this application with the Commission and 1) expressed satisfaction with the proposed conditions of appro- val and 2) explained that he had now obtained financing for the pre- viously proposed subdivision so would, barring unforeseen developments, develop this lot under .the subdivision map instead of the subject application. .' ATter further discussion, Commissioner Kellummoved,.seconded by Com- missioner Crisp, that the Building Site Committee Report of 22 August. 1966 relative to SDR-658 be adopted and that the tentative map (Exhi- bit "A", filed 12 August 1966) be approved subject to the conditions set forth in said report;.motion carried unanimously. D. ~UP-87 -.Univer~"ity Pre-School of Saratoga_ Commissioner Kelium advised that the Committee had met at recess as requested to discuss this matter further and the;.: following decisions' had been reached: 1) the service rendered by this school is needed.. in Saratoga 2) reports indicate that this schooI provides this ser- vice remarkably well 3) the site appears to have/worked out quite well and 4) in view of the foregoing, it is the recommendation of the Subdivision Committee that the request for r~newal of this Use Permit be granted for an indefinite period of time. After discussion, Commissioner Kellum moved, seconded by Commissioner Crisp, that the request for renewal of UP-87, University Pre-School of Saratoga, be granted subject to the-original' conditions of appro- val, with the'exception that the time limitation be eliminated and the Use Permit gr~nted for an indefinite period of' time; motion. carried unanimously. IV. DESIGN REVIEW A. A-222 - Manuel Lozano, Prospect Road - Preliminary Design Review - Car Wash - Continued from 8 August 1966 Commissioner O'Rorke advised that the applicant had requested that this matter be dropped from the agenda, but that no written request for withdrawal had been received. In view of this, Commissioner O'Rorke recommended that, for clarification purposes, A-222 be denied. It was moved by Con:nissioner 0 'Rorke and seconded by Commissioner Crisp that. A-222, Manuel Lozano, be denied; motion carried unanimously. B. .A-226 - Dr. John Oliver, Saratoga-Sunnyvale Road - Final Design Review Commercial 'Build Commissioner O'Rorke briefly reviewed this.'matter and advised that the applicant had revised his plans to comply w~th the requests made by the Committee. After discussion, Commissioner O'Rorke moved, seconded by Commissioner Kasner, that A-226, Dr. John Oliver, be granted final design approval for the proposed commercial building as shown on Exhibits "A-2" and "B"; motion carried unanimously. · C.' A-228 - Joseph R. Naud, Prospect. Road - Final Design Review'- Identi- fication Sign for "Round Table Pizza" ' ....... l_n_ Big Tree Shopping Cente,. After discussion, Commissioner 0 'Rorke moved, seconded by Commissioner Crisp, that final design approval be granted A-228 as shown on Exhi- bits "A" and "B" subject to elimination of the bulbs shown around 'the border of the sign; motion carried unanimously. D., A-229 - James R. 'Davi, Souza Lane - Final Design Review - Convales- cent Home Commissioner O'Rorke read the Staff Report relative to A-229 and recom- mended that preliminary design review be granted in accordance with said report. After discussion, it was moved by Commissioner O'Rorke and seconded by Commissioner Crisp that the Staff Report of 22 August 1966 relative to A-229 be adopted and that preliminary design approval be granted in accordance with said report; motion carried unanimously. Planning Commission Minutes - 22 August 1966 -'Continued V.. CITY COUNCIL REPORT Commissioner Kellumgave a brief report on discussion and action at the City Council meeting on 17 August 1966, with emphasis on items of parti- cular interest to the Commission. A matter of major interest to the Commission was the Council's action on a request for waiver of the underground utility requirement for Dr. Marino's site on Montalvo Lane (SDR-642)~ Dr. Kellumi 1) advised that the waiver had been granted, 2) read a report from the Planning Committee = to the City Council relative to SDR-578 and SDR-599 (December 1965), in which report the Committee recommended continuation of the existing policy of requiring underground utilities in connection with development of sin- gle lots 3) explained the awkward position of the Planning Commission after having this requirement waived by the Council on several occasions/' and 4) read a draft ofa letter prepared for the Chairman's signature, requesting that the Council re-affirm the policy set forth in the pre- viously mentioned Planning Committee Report or enact an 'ordinance covering underground utilities. After discussion, Commissioner Kellummoved, secoD~ed by Commissioner Kasner, that the Chairman be authorized to sign the subject letter and ..~ that same then be transmitted to the City Council; motion carried with Commissioner O'Rorke dissenting. After Commissioner O'Rorke.~explained that his dissenting vote was not based on the objective of the letter but the wording of same, the.Commis- sion concurred and gave unanimous consent for Chairman Norton to revise the letter accordingly. VI. NEW BUSINESS Following a brief discussion of the report submitted by Riches Research, Inc. in connection'with the study of the Commercial Service Zoning District, the Commission was advised 1) the City Attorney had suggested that suspen- sion of the uses in this zoning district pending the outcome of this study would be inappropriate, but an emergency .ordinanCe could be enacted making all uses in this zone conditional and 2) the ma~ter had been referred to the Planning Commission for an opinion. After further discussion, Commissioner Kellummoved, seconded by Commis- sioner Crisp, that the City Council be advised that it is the opinion of the Planning Commission that all permitted uses in the Commercial Service Zoning District should be made conditional pending formation of final plans for this area; motion carried unanimously. VII. OLD BUSINESS VIII. COMMUNICATIONS · . A~ I~RITTEN UP-88 - George Day Construction Compahy, Cumberland Drive - Request for Extension of, Use Permit for Model Home Administrative- Sales Office The Secretary advised that the applicant had requested renewal of the subject Use Permit .for Model Home Administrative-Sales Office for a period of one year. A. 2. Dr.. Youn~ - Request for Additional Permitted Use in Community Com- ,mercial (C-C) ZoninM District ..... The Secretary read a 'letter from .Dr. Raymond D. Young requesting that Pet Clinic be added 'to the list of uses permitted in the C-C Zoning District. After a brief review of Dr. 'Young's letter, Chairman Norton directed that an informal hearing be set on this' request for the meeting on 12 September '1966, and referred the matter to .the Subdivision Com- mittee for study and a report at that time... Bo ORAL The Chairman extended a welcome to Councilman and Mrs. Tyler, Mrs. Parker of the Good Government Group, and Mr. Sam Hernandez. He also expressed app.reciation for the coffee served by MrS.
