V-283 - Donald Miller Commissioner Crisp moved, seconded by Commissioner Eellum, that the'public hearing on V-283 be closed (7:40 P.M.) and that the applicant's request for withdrawal of this. appli- cation be granted; motion carried unanimously.~ C. DR. Y0~G - informal Hearing in connection with Request that Pet Clinic be added to the List of Uses Permitted in the Community Commercial Zoning District The informal hearing on Dr. Young's request for an addi- tional use was opened at.7:39 P~. M. The Secretary briefly reviewed this matter and advised that the proposed develop- ment plan and other'information submitted by the architect had been placed in the Commissioners' folders. Warren Heid,.applicant's architect, ~s present to discuss this request with the Commission and advised 1)' while the applicant's parking requirements could be met with approxi- mately six spaces, 2# spaces had been shown on the develop- ment plan to indicate that the space ~as available and'could be u~ed if ~h~ Ol~y so desired 2) thl~ o~fer would al~o support Dr. Young's statement that he did not plan to e~pand the proposed operation 3) a visit to one of Dr. Young's other cliniss (he had visited two) would confirm that the soundproofing, sanitary 'conditions and such were as pre- sented by Dr. Young and #) Dr. Young planned to operate the Saratoga Clinic himself. Commissioner Kellum advised that he had visited Dr. Young's~ clinic in Irvington, had been quite impressed and had learned a great deal.about what can be done with a Pet' Clinic. He explained that he had found the building attrac- tive, the soundproofing .~ood (the animals could not be heard in front of the buildingS, the odor c~ontrol quite adequate and the clinic no more objectionable,than a doctor's office. He further stated. that he felt such a clinic.would be a cre- dit to our Village or any like it. John J. Hayes, jr., attorney, discussed this proposal with the Commission and 'requested that a copy of the written re- port relative to this request be made available to him when completed. Chairman Norton requested that the Secretary contact Mr. Hayes when the report was ready. !~illiam L. Higgins of Broo~ood Lane informed the Commission. that he and his neighbors (Baker McGinnis, Richard Bennett, Barney Deasy, Wm. E. Golden and Charles L. Johnston, Jr. ) ~.vere concerned, and requested that the Commission protect their homes (located across the creek from the proposed site for the clinic) from such an imposition. Chairman Norton suggested that a review of the plans and other information submitted in connection with this proposal might ease their minds somewhat. Clarence Neale, lwho owns the property across the street from this site, spoke in support of the subject request. He stated that.he felt the proposed clinic would be an asset to Saratoga, .something the City could be proud of. Dr. Charles L. Johnston, Jr. stated that while his home probably would not be within sigHt.of the proposed building, he was concerned that' it might be wibhin hearing of same. -2- Plannin~ Commission MinUtes - 12 September_. 19_66 II. C. Dr. 'Young After further discussion, Chairman Norton (8:09 P. M. ) direc-' ted this matter continued 'until the next regular meeting and. referred same to the Subdivision Committee for study and a report at that time. D. C-98 - Quito Park Business Center, Cox Avenue - Request for Change of Zoning from "R-l-lO, 000"! ( Single · Family Residential ) to "C-N" (~Yeig.h~oorhood Commercial ) The public hearing on C-98 was opened at 8:10 P. M. The Se- cretary advised that a Notice of Hearing had been published, briefly reviewed the application, and read a statement of reason filed by the applicant. Messrs. Stern and Renzel were present to discuss this mat- · ter with the Commission. Mr. Renzel advised l) while the subject property was not necessarily needed at this time, it was felt that it would be in the future, particularly in connection v;ith possible expansion of the library 2) in view of this, they felt it should be acquired now ~,fnile it is available 3) at the present time the site could be used for additional parking, especially employee parking, and ,. perhaps in the future the nursery would be moved to this location and 4) in any event, when developed, this parcel would become an integral part of the Quito Shopping Center. After. further discussion, Chairman Norton (8:20 P.M.') direc- ted C-98 continued until the meeting on 26 September 1966 and referred same to the Subdivision Comittee for study-and a report at that time.. Gal'.eb, Saratoga-Smnyvale i~oad - Request for Change of Zoning from "R-l-lO, OOO" (Single Family Residential ) to "C-N" (Neighborhood Commercial ) The public hearing 'on C'99 was opencalf at 8:21 P. M. The · ' Secretary advised' that a Notice of Hekring had been published and there were no .written communications on file. ' .... .......................... · .......-. ......... Mr. Galeb and his architect, Mr. Menard, were present to discuss this application with the Commission. i'~. Menard explained l) the subject application is'a request to extend' the existin~ C-N .Zoning District 2) the property is now '.' occupied by a seriously sub-standard residential development which would be eliminated and 3) the. applicant feels that the change of zoning would permit the best possible use of the land. Sam .Hernandez of Big Basin ~Yay spoke in favor of the pro- posed change of zoning. He stated that he was quite impres-.. sed with the recent changes ~. Galeb had made in this 'area and felt that the subject. proposal-would be a further improvement.. .~. After f~ther discussion, Chairman Norton .(8:26 P. M. ) directed. The Secretary advised that Notices or Hearing 'had been mailed and there were no v~itten communications on rile. .. There was no one else present who wished to comment ~ith regard to this'matter. Kaspar of Saratoga Glen Place "- opposing the granting or the. requested variance. SDR-650 - Charles Harden, Sobey Road - Building Site Approval 2 Lots - Continued from 22 AuMus~ 1966 The Secretary advised that the applicant' planned to file a revised map prior to the next regular meeting, so recom- ,. mended that SDR-650 be continued until that time. Chairman Norton so directed. C. ~ - Donald Miller, Cody Lane - Building Site Approval - I Lot - Continued from 22 August 1966 The applicant. prote'sted Condition II-B of the proposed con- ditions of approval'and explained that he had no prior knowledge of this'requirement. After discussion with the Commission, however, he agreed to accept the conditions and try to work the matter out with i~. Cody. Commissioner Kellum moved, seconded by Commissioner Crisp, that the Building Site Committee Report of 12 September 1966 reiative to SDR-6~6 be. adopted and that the tentative map (Exhibit "A-l",'filed 7 September 1966) be approved subject. to the conditions set forth in said report; motion carried unanimously. D. SD-659'- Joseph J. Pon, Verde Vista Lane - Subdivision Appro- val - 8 Lots ~@. Pon and his engineer, Mr. Kaiser,~ were present and, after discussion, expressed satisfaction with the proposed condi- tions of approval. Commissioner Kellum moved, seconded by Commissioner Crisp, that the Subdivision Committee Report of 12 September 1966 relative to SD-659 be adopted and that the tentative map (E~hibit "A-l", filed 12 September 1966) be approved in ac- cordance with the site deVelopment'plans (Exhibit "B") sub- ject to the conditions set forth'in said report; motion car- ried unanimously. E. SDR-660 - B. T. Galeb, Saratoga-Sunnyvale Road - Building ~ite An~roval - i Lot i~. Galeb and his architect, Mr. Menard, were present and expressed satisfaction with the proposed conditions of approval. Commissioner Kellum moved, seconded by Commissioner Crisp, .~ that the Building Site Committee Report of 12 September' 1066 relative to SDR-660 be adopted and that the tentative map (Eyjaibit "A", filed 2 September 1966) be approved sub- Ject to the conditions set forth in said report; motion carried unanimously. -5- Plannin~ Commission Minutes - 12 September 1966 IV. DESIGN REVIEW ~S-5i- Pacific Shore Properties, Inc., Via Roncole - Design Review - Permanent Subdivision Identification Sign for ,Granada Hills Subdivision After briefly reviewing the plans for the proposed sign, Commissioner O'Rorke moved, seconded by Commissioner Crisp, that final design appro- val be granted SS-S1, Pacific Shore Properties, Inc., for the sign as sho~n on Exhibit "A"; motion. carried unanimously. V. CITY COUNCIL REPORT Con~issioner Kasner gave a brief report on discussion and action at the City Council meeting on ? September 1966 with emphasis on items of par- ticular interest to the Commission. VI.NEW BUSINESS' Russell Lane The Secretary read a petition signed by residents of the two unconnected sections of Russell Lane, opposing the proposed connection. Dr. Lee of Russell Lane was present and explained that more than any- thing else, the residents wanted clarification of this situation and had felt that perhaps it could be discussed under the major review of the General Plan. :. After discussion, Chairman Norton .referred this matter to the General .: ·Plan Committee for review. VII. OLD BUSINESS A. ·Retail Specialty Shoppin~ Center (C-S Zone~ o Commissioner Crisp questioned the·advisabif~ty of considering the suggested Retail SpeCialty Shopping Center (proposed for the C-S Zone) under the General Plan Review because of the time element involved, and further suggested that perhaps it should not be reviewed at that time since the matter pertained to a specific area. After discussion, Chairman Norton, with concurrence of the Commis- sion, directed that an informal hearing be set·for the·next regular meeting to consider the addition of "Retail Specialty Shopping Center" as a Conditional Use in the Conm~ercial Service Zoning District, and referred same to the Subdivision Committee for the exact wording to be used in this proposed additional use. B. Retiremeht Facilities Following a discussion of the recent study relative to Retirement · Facilities in Saratoga, it was decided that this matter should be placed on the agenda for discussion at the next regular meeting. The Conmission authorized the Subdivision Committee to meet with the City Attorney to determine the needs with.respect. to this matter and the best way to accomplish same by ordinance. C. Ordinance Regulatin~ ·the Keepin~ pf Horses Following a brief 'discussion, Chairman Norton requested that the· Secretary 1) transmit a copy of the draft of ~he proposed ordinance regulating the keeping of horses to Mr. Teerlink and 2) set the public hearing On this ordinance and. any·o~ the other,proposed ordi- nance amendments that had been drafted for the meeting on 10 Octo- ber 1966. A-222 - Manuel Lozano, ProSpect Roa_d The Secretary read a letter from the County Sheriff's Office relative to access to this site, 'confirming that the access, as proposed, is poor. Since the subject application had been denied by. the Commis- sion, Chairman Norton requested that the letter be file~ for future reference in connection with development of this site. ViII. COI~fONICATIONS .......... A. ~.~IlTTEN 1. DR. OLIVER - Request for Approval of Light I'~chine Shop Occupancy ... in Building in Commercial Service Zoning District The Secretary read a letter from Dr. John Oliver requesting Staff approval of Light Machine Shop occupancy in his new building in " the C-S Zoning District. The Commission concurred with the Plan- ning Director's interpretation of the Ordinance, i.e., that this use would· not qualify as a permitted use in this zone. After discussion, Chairman Norton directed that an informal hearing be set for the next regular meeting to discuss the possi- bility of adding "Light Machine Shop" as a use in this zone. 2. SDR-655 - Dr. Donald Hambey, Farwell Avenue - Request for Recon- sideration in connection with Conditions of Approval The Secretary read a' communication from Dr. Hambey requesting a waiver of Conditions II-D and II-E of the conditions of appro, val for SDR-655. D.r. Hambey was present to discuss this request further witti the Commission. After discussion, Chairman Norton directed this matter continued until the next regular meeting and refer'red same to the Building Site Committee for review and a recommendation. 3. C-64 - Virgil Herring, Big Basin Way - Request that Conditional C-C Zoning be changed to full C-C Zonin~ The Secretary read a letter from Mr. Merring, requesting that his Conditional C-C zoning be changed to full C-C zoning and setting forth his reasons for requesting the change. After discussion, Chairman Norton asked that the Secretary set an informal hearing on this matter for the meeting on 26 Septem- ber 1966 and that, since this pertained to a zone change, indi- vidual notices be mailed to all property o~a%ers within a 500 foot' · . radius of the subject property. B. ORAL 1. Illegal Signs Commissioner I(asner advised that the Big Tree Shopping Center was displaying several illegal signs at the entrance that de- tracted greatly from the general· area. The Planning Director advised that he would check into this matter. 21 Dump Commissioner O'Rorke advised that the area north of the Argonaut Shopping Center was being used for dumping and requested that the Planning Director check ,into this matter. Dura-Style Homes~ Inq. ~e temporary "A-frame" sales office used by Dura-Style Homes, Inc., located at Cox Avenue and DeHaviland Drive, was brought to the attention of the Planning.Director, who advised that he would request that it be removed. 4. Guests '" Chairman Norton acknowledged, with pleasure, the presence of Councilman Burry,' Mrs. Parker of the Good Government Group, and Mrs. 0ttenberg of the League of Women Voters.
