I. ·ROUTINE ORGANIZATION
A. ROLL CALL
Present:Commissioners Crisp, Johnson, Kasner, Kellum, McFall, Norton,
and O'Rorke.
Absent: None.
B. MIN~£ES
Commissioner Johnson moved, seconded by Commissioner McFall, that the
reading of the minutes of 27 December 1966 be waived and that the minutes
be approved as d~stribUted to the Commission; motion carried unanimously.
ELECTION
The Secretary advised that it was time for the election of new officers
for the coming year.
Chairman Norton, with concurrence of the Con~nission, deferred this matter
to the next regular meeting on 23 January 1967.
PROCEDURE
Chairman Norton brought up the subject of taking a vote on a motion ~en·
it does not receive a second.
After discussion, it was the conclusion of the Commission that if the maker
of the motion requested a vote the Commission would comply with said request.
II. PL~LIC HEA~RINGS
A. UP-119 - West Valley Junior College District, Fruitvale Avenue - Request for
Use Permit for Junior Colle~e Campus '- Continued from 27 December 1966
The continued hearing on UP-119 ~.ms re-opened at 7:36 P.M.. The Secretary
briefly reviewed this matter and stated there x.~as nothing new in the file.
There were several representatives present to represent the West Valley junior
College i~cluding ~. Brydon, I~. Arnold, and Dr. Hall.
The Secretary read the Staff Report recommending, with concurrence of the
Subdivision Conunittee, that the request for UP-119 be' granted subject to the
conditions stated in said report.
I~-. Arnold, of the West Valley Junior College, stated that all conditions
listed in the Staff Report were satisfactory.
In answer to an inquiry from the audience Chairm~n Norton advised that item 3
of the Staff Report (which limits the college to 5,000 day studentS) was not
completely binding, but that the Planning Commission did want to reserve the
· right to confer with the West Valley Junior College Board should they decide
to have more students, so·that proper.'.provisions for parking and traffic can
be provided.

II. A. UP-119-West Valley Junior College District~ Fruitvale Avenue
After discussion, Commissioner Johnson moved, seconded by Conm~ission~r
Kasner, that the public hearing on UP-119 be closed; motion carried
unanimously and the hearing was closed at 7:45 P.M.
It x,~s moved by Commissioner Kellum ~nd seconded by Co~nissioner
Crisp that the'Staff Report of 9 January 1967 relative to UP-119
be granted subject to the conditions contained in said report;
motion carried unanimously.
At this tim~ both the Planning Commission and the representatives
of the West Valley Junior College concurred that the spirit
Coop~ration'.7=that_'haS..been experienced between the City and the
District should be continued in future negotiations.
B. C-101 - M.V.S. Company, Saratoga Avenue -.Request for Change of
Zoning from "A" (Agricultural) to "R-M-4,000 P-C" (Multi-
Family Planned Community) - Continued from 27 December 1966
The continued'hearing on C-101 was resumed at 7:49 P.M. The Secretary
briefly reviewed this matter and stated that the applicant had met with
the Subdivision Committee.
There was no one present who wished to comment with regard to this
request.
Commissioner Kel!um advised that the~epresentative for the applicant
~ubmitted a preliminary plot plan and a lot of work remains to be
done and suggested that C-101 be continued until the meetingOn
13 February'1967.,
Chairman Norton so directed at 7:53 P.M.
C. V-287 - Robert D. Hoose, Afton Avenue - Request for Variance in
connection with Required Rear Yard Coverage Limitation -
Continued from 27 December 1966
The continued.hearing on V-287 was re-opened at 7:54 P.M. The
Secretary briefly reviewed this application and advised that
nothing further had been added to the file.
The applicant was present but stated that he had no further comment
at this time.
Comraissioner Kasner read the report of the Variance Committee with
regard to this request, recommending approval of'same.
Afte~-~discussion, CommissiOner Crisp mo~ed, seconded by Commissioner
Johnson, that the hearing on V-287 be closed;.motion carried unani-
mously and the hearing ~ms closed at 7:56 P.M.
It was moved by Commissioner Crisp and seconded by Commissioner Kasner
that the Variance Committee Report of 9 January 1967 relative to V-287,
Robert D. Hoose, be approved and that the Variance be granted in accord-
ance with said report; motion carried unanimously.

II. D. GENEP~AL PLAN AMENDmeNT - Proposal to incorporate proposed Village
Parking Plan as element of Village Development
Plan Section of General Plan
The public hearing on this proposed amendment was resumed at 7:57 P.M.
The Secretary brfefly reviewed this application and advised that nothing
further had been.added to the file.
~son Shaw, Big Basin Way, was present to represent himsel'f and ~. & Mrs.
Chabre, Big Basin Way, and spoke in protest of this proposed amendment.
He stated 1) that he had previously submitted another.plan ~ich was never
recognized 2) he was not against a parking district but does not approve
of this particular plan because, he felt, it favored some and not others
3) the proposed parking plan will eliminate rental properties because
of the noise that will result 4) that most of the business places in the
Village already have ample parking and 5) that further study was necessary
and would like to see that take place at the .time of the major review of
the General Plan.
Mr. &Mrs. Worden, Big Basin Way, were present and again Spoke in opposition
of the proposed amendment and inquired who initiated this plan at this
particular time.
Chairman Norton explained that this was only a long range plan (under
study by the General Plan Committee and initiated by the Staff with
concurrence of the Subdivision Conm~ittee) ~ich would be added to the
General Plan to have something more satisfactory than the existing .plan.
Mr. Borden Melton, Brookglen Drive, ~.~s present and reaffirmed his
opposition to this proposed parking plan.
Con~nissioner O'Rorke stated l) that each time the Design Review Committee
reviews a new application the' problem of adequate parking arises and
2) that parking by the existing pieceraeal. 7. meth6d was neither efficient
nor beneficial.
After further discussion Chairman Norton (8:18 P.M.) directed this matter
continued to the next regular meeting and referred it to the General
Plan Committee for further study.
E. UP-120 - Sisters of Notre Dame de Namur,.Norton Road - Request for Use
Permit for Construction of new'Novitiate Facilities
The public hearing on UP-120 was opened at 8:19 PoM. The Secretary
advised that NotiCes'of Hearing had been mailed and read letters from
I) Bessie Lundy Schellback and 2) Edwin D. and Willa R. Kilbourne
protesting the construction of new novitiate facilities on Norton Road.
Hollis LOgue, architect, was present to answer questions and stated
that they.will be. replacing many of the old building with new ones.
In answer. to an .inquiry from Mr.. Langwill of Norton Road ~. Logue
advised that the ~xisting buildings were approximately fifteen (15)
to eighteen(18) years old.

ii. E. UP-120 - Sis'ters of Notre Dame de NamUr~ Norton Road
l,iessrs. Charles Smith and Gedrge Heiser of 'Norton Road and Mesdames
Perry and Quickerr of Bohlman Road were present and stated 1) Norton
Road was too narrow to accon~n~odate any more traffic and 2) the
Montessori School has already aggravated the traffic problem.
~.iessrs. George Russ and Charles Murphy and Dr. Quickerr were al~
present and questioned what would happen 'to all existing buildings
and stated they ~.~ere not completely .sure the novitiate 'should be
built even if the traffic problem is resolved.
After further discussion, Chairman Norton (8:40 P.M.) directed UP-120
continued until the meeting on 23 January 1967 and referred same
to the Subdivision Committee for study and a report.

A. SDR-661 - B. T. Galeb, Saratoga-Sunnyvale Road - Building Site Approval
- 1 Lot - Continued from 27 Decenfoer 1966
The applicant and his architect', i~'. Menard, were present and stated that

Comaissioner Kellum moved, seconded by Con~missioner CriSp, that the
· Building Site Conumittee Report of 9 january 1967 relative to SDR-66i
be adooted and that the tentative map (Exhibit "A'.', filed 19 September
" 1966) be approved subject to the conditions set forth in said report;
motion carried unanimously.
B. SD-666 - Wynn and Dun~s, Wardell Road - Subdivision - 11 Lots -
Continued from 27 December 1966
The applicant was not present, but the Secretary advised that he was
aware of the proposed conditions Of approval and had expressed satis- :
· faction of same.
Commissioner Kellum mov. ed, seconded by Commissioner McFal!, that the
Subdivision Con~mittee Report of 27 December 1966 relative to SDR-666
be adopted and that the tentative map (Exhibit "A", filed 28 November
1966) be approved subject to the conditions set forth in said report;
motion carried unanimously..
C. SDR-667 - West Valley Junior College District, Fruitvale Avenue - Building
Site Approval - 1 Lot-
The representatives for the West Valley junior College were present and
expressed satisfaction with the proposed conditions of approval.
Commissioner Kellmn~ moved, seconded by Conm~issioner McFall, that the
Building Site Comm~ittee Report of 27 December 1966 relative to SDR-667
be adopted and that the tentative map (Exhibit "A" filed 2 December
1966) be approved subject to the conditions set forth in said report;
motion carried unanimously.

IiI. D. SDR-668 - Ronald Clayton, Fruitvale Avenue and Saratoga-Los Gatos
~ ad - Buil~in~ Site Approval 1 Lot

Com~issioner Kellum advised that the Co~nittee ~.ms not yet prepared
to make a recomnendation in connection with t~is application and
suggested that same be continued until the meeting on 23 January
1967 to.allow time to work out the right-of-Way requirements for
Fruitvale Avenue.
Chairn~n Norton so directed.
IV. DESIGN REVIEW
~'-237 - B. T. Galeb, High~.~y 85 at Seagull I~y - Final Design Review -
Commercial Buildin~
Commissioner O'Rorke briefly reviewed this application and advised that
1) the pr6posed parking plan was adequate 2) the applicant agreed to
plant trees and 3) the existing fence would be raised to a height of
six (6) feet.
Commissioner O'Rorke moved, seconded by Commissioner Kasner, that final
design approvalbe granted A-237 on the basis of Exhibits "A", "B", and
"C" subject to approval of the fence by the Planning Director; motion
carried unanimously.
V. CiTY COUNCIL REPORT
Co~nissioner Kellum gave a brief report on discussion and action at the
City Council meeting on 4 January 1967 with emphasis on items of particular
interest to the Commission. ~

VII. OLD BUSINESS
A.. UP-ll6 - Roy and Luceal Westmoreland, Souza Lane - Request for
' Reconsideration of Use Permit Conditions
The Secretary briefly reviewed this application and read the Staff
Report relative to this request and recommending approval of same.
After discussion, Commissioner Kellum moved, seconded by COmmissioner
McFall, that the Staff Report', dated 9 January 1967 relative to UP-116
be approved subject to amending the report to include Desigh Review
Approval to the list of conditions; motion carried unanimously.

Chairman Norton read the following proposed resolution:
"As ~ matter of policy, persons addressing the Commission
are'requested not to speak for more than ten consecutive
minutes on any one matter at'any one meeting. Exceptions
may be made ~,~ere the matter is one of unusual significance
or complexity.
After discussion, Commissioner Kellum.moved, seconded by Commissioner'!.'
McFall, that the proposed resolution be approved and accepted as a
matter of policy; motion carried unanimously.

VII. C. SA!~ATOGA PLAN LINE -'Request for Recommendation
The Secretary presented the Saratoga Avenue Plan Line as proposed
by the Director of Public Works with the'request that this matter
'be referred to the General Plan Committee for review and recommenda-
tion. ..
Chairman Norton so directed.! '.
VIII. COE~bYICATIONS
A. k~ITTEN
SDR-540 - Dr..Thomas Giannett0~ Farwell Avenue - Request 'for ExtensiOn
'The Secretary briefly reviewed this application and advised that the
.poliCy, relative to extension of tentative maps, adopted at the last
meeting'would require this matter be denied.
It was moved by Commissioner Crisp, seconded by Commissioner Kasner,
that the request for extension relative to SDR-540 be denied; motion
carried unanimous ly.
B. ORAL
1. SIGNS FOR FiNNEGAN PROPERTY
Commissioner-O'Rorke advised that the Finnegan property is set back
away'from the main highway and the traffic, therefore, making it
difficult to direct people to the property.
The applicant was present and requested that he be permitted' to put
a sign or signs on a city street sign post.
The Secretary .explained :1) that signs relating.to public interest
are usually the only ones posted on city street signs and 2) the
applicant may be eligible for an encroachment permit.
After further discUssion~ Chalrmzn Norton referred the matter to
the 'Staff and Design Review Committee for further study.
2. ARROYO DE SARATOGA FOUNTAIN
Commissioner O'Rorke inquired about the ownership..and responsibility
for maintaining the fountain at the entrance to Arroyo de'Saratoga.:
Chairman Norton delegated the Planning Director to investigate this
matter and directed same continued to next regular meeting.
3. SIGNS FOR BIG TREE SHOPPING CENTER
Commissioner' O'Rorke mentioned that the Design Review Committee had
met with the representatives of the Big Tree Shopping Center located
on Propsect Road and discussed the problems concerning signs and shop
.identification. He advised that the Committee expected the occupants
of the Shopping Center t6 submit a coordinated proposal to the Plan-
ning Commission in the very near future.

VIII. B. The Chairman acknowledged, with pleasure, the presence of
~es. Ottenberg and Dove Of the Good Government Group and
M~-. Shelley Willjams, Realtor.and expressed appreciation
for the coffee served by Mrs. Owen at recess.
