PLACE: City Council Chambers, Fruitvale Avenue, Saratoga, California TYPE: Regular Meeting I. ROUTINE ORGANIZATION A. ROLL CALL Present:Commissioners Crisp, Johnson, Kasner, Kellum, McFall, Norton, and O'Rorke. Absent: None In view of the absence of Mr. Stanley Walker, Planning Secretary, Chairman Norton directed · that Mr. Gary Bonfiglio, Junior Planner, act as Secretary for this meeting. B. MINUTES Commissioner Johnson moved, seconded by Commissioner McFall, that the reading of the minutes of 14 February 1967 be waived and that the minutes ba approved subject to the following revision: page 7.. .paragraph 6.. .line 2. .Change to read as follows: "submitted a new preliminary plan and asked that the Commission informally consider it in light of the Commission's approval, at a recent meeting, of a Staff Report concerning development of the Kosich property."' motion carried unanimously. II. PUBLIC HEARINGS .'A. UP-120 - Sisters of Notre Dame de Namur, Norton Road - Request for Use Permit for Construction of New Novitiate Facilities - Continued from 14 February 1967 The public hearing on UP-123 was not resumed at this time. Commission McFall requested that this matter be continued to the next regular meeting since the · applicant is still considering the proposed conditions for site approval. In view of the foregoing, Chairman Norton directed UP-123 continued to the next regular meeting on 13 ~rc~ 1967. B. UP-100 - Youth Center, Fruitvale Avenue - Request for Use Permit for Youth Center Build inS on the Civic Center Site -. Continued from 14 February 1967 The public hearing on UP-100 was re-opened at 7:37 P.M. The Secretary briefly reviewed this application and read the Staff Report relative to UP-100, recommend- ing that this application be approved.' Mr. Heid, applicant's architect, and Mrs. Sitney, Chairman of the Board for the Youth Center, were present and stated they had no further comments at this time. UP-100 - Youth Center - Continued After discussion, Commissioner Crisp moved, seconded by Commissioner McFall, that the public hearing on IIP-100 be closed; motion carried unanimously and the hearing was closed at 7:41 P.M. Commissioner McFall moved, seconded by Commissioner Kellum, that the Staff Report of 27 February 1967 relative to UP-100 be approved and that the Use Permit be granted subject to the conditions set forth in said report; motion carried unanimously. C. IIP-123 - Robert L. Schaeffer, Sobey Road - Request for Use Permit for the Keeping of One ~1) Horse The public hearing on UP-123 was Opened at 7:43 P.M. The Secretary advised that Notices of Hearing had been mailed. There was no one present to represent the applicant. Chairman Norton (7:44 P.M.) directed UP-123 continued to the next regular ~' meeting and referred same to the Subdivision Committee for study and a report. D. V-289 - R. L. Maahs & Dr. R. D. Young, Saratoga-Sunnyvale Road - Request for Variance in connection with Minimum Lot Size - Continued from 14 February 1967 The continued hearing on V-289 was re,opened at 7:45 P.M. The Secretary advised that nothing further had been added to the file. Mr. Warren Heid, architect, was present and stated that since this was going to be a smaller building it would seem reasonable to use a smaller piece of property. John J. Hayes, Jr., attorney for Dr. Oliver, was present and stated he did not feel that the findings, necessary to grant a Variance of 50%, could be made in accordance with Ordinance NS-3. Commissioner Crisp read the report of the Variance Committee pertaining to this matter, recommending that V-289 be denied. Commissioner Kellum stated'that while it was difficult to disagree with the report of the Variance Committee it should be taken into consideration that the people who drew up the Ordinance could not foresee the problems that would arise in this area. Dr. Young was present and 1) stated that they were planning a building the City of Saratoga could be proud of and 2) expressed W~lingn~ss to cooperate completely with the Planning and Building Departments in this matter. At 7:57 P.M. Commissioner Crisp moved, s~conded by Commissioner Johnson that the public hearing on V-289 be closed; motion carried unanimously. Commissioner Crisp moved, seconded by Commissioner Johnson, that the Variance Committee Report of 27 February 1967 relative to V-289 be approved and the request for Variance be denied with the recommendation that the property in question be given special consideration at the time of the General Plan Review. Bitter, D.D.S., Cox Avenue - Request for Variance· in connection with Front and Side Yard Setback Requirements The public hearing on·V-290 was opened at 7:59 P.M. The Secretary stated there was nothing new in the file. Mr. Heid, architect, was present to represent the applicant. Commissioner Crisp stated that it was the opinion of the Variance Committee that this is an administrative matter that should be resolved by the Staff. On this basis, Chairman Norton (8:09 P.M.) closed the hearing on V-290 and 'referred same to the Staff for consideration. F. C-101 - M.V.S. Company, Saratoga Avenue - Request for Change of Zoning from "A" (Agricultural) to "R-M-4,000 P-C" (Multi-Family Planned Community) Continued from 14 February 1967 The public hearing on C-101 was resumed at 8:10 P.M. The Secretary'briefly reviewed this application and advised noth.ing further had been added to the 'file. The applicant was present and requested this matter be continued to the meet- ing on 27 March 1967 to allow him enough time to amend his application. At 8:11 P.M. Chairman Norton so directed and referred C-101 to'the Subdivision Committee for study and a report. G. C-102 - George Oldham, Saratoga Avenue and Saratoga-Sun~yvale Road - Request for Change of Zoning from "P-A" (Professional-Administrative) to "C-C" · ~Community-Commercial) - Continued from 14 February 1967 The public hearing on C-102 was re-opened at 8:·12 P.M. The Secretary briefly reviewed this matter and advised that nothing further had been added to the file. Mr. Edward Henshaw, attorney, was present to represent Mr. Oldham and explained 1).the applicant was not in a position to develop this property himself and 2) the Union Oil Co. was prepared to spend a considerable amount of money to develop this corner. The Secretary read the Staff Report of 27 February 1967 relative ·to this request, recommending denial of same. Commissioner Crisp stated that he wished to disqualify himself due to a conflict of interest. After discussion, Commissioner McFall moved, seconded by Commissioner Johnson, that the public hearing on C-102 be closed; motion carried unanimously and the hearing was closed at 8:19 P.M. , It was moved by Commissioner McFall and seconded by Commissioner Kasner that' the Staff Report of 27 February 1967 relative to C-102 be approved and trans- mitted to the City ]ouncil as the recommendation of the Commission. C-103 - Saratoga Foothills Development Corporation, Cox Avenue - Request for Change of Zoning from "A" (Agricultural) to "R-1-12,500" (Single Family Residential)- Continued from 14 February 1967 The continued hearing on C-103 was resumed at 8:22 P.M. The Secretary stated .t~ere was nothing new in the file. Mr. Bernie Turgeon was present to represent the applicant but stated that he had no further comments at this time. There was no one else present who wished to speak with regard to this matter. The Secretary read the Staff Report pertaining to this matter, recommending, with concurrence of the Subdivision Committee, approval of the subject application. Commissioner Crisp moved, seconded by Commissioner Kasner, that the public hearing on C-103 be closed; motion carried unanimously and the hearing was closed at 8:25 P.M. Commissioner McFall moved, seconded by Commissioner Kellum, that the Staff. Report of 27 February 1967 relative to C-103 be approved and transmitted to the'City Council as the recommendation of the Commission; motion carried unanimously. III. BUILDING SITES AND SUBDIVISIONS A. SDR-669 Frank Pringle, Canyon View Drive - Building Site Approval - 1 Lot - Continued from 14 February 1967 Commissioner McFall advised that the applicant had requested additional time to submit new plans and recommended this matter be continued to the next regular meeting on 13 March 1967. .' Chairman Norton so directed. B. SDR-670 - Douglas Hines, Sobey Road - Building Site Approval - 1 Lot - Continued from 14 February 1967 Commissioner McFall advished that the applicant had submitted a letter request- ]ng an extension in order to allow time to resolve Specific Condition II-A and II-J. On this basis, Chairman Norton directed this matter continued to the next regular' meeting.. C. SDR-671 - Richard L. Allen, Pierce Road - Building Site Approval - 1 Lot - Continued from 14 February 1967 The applicant was present and stated he had reviewed the proposed conditions'of approval and found themsatisfactory. Comm'issioner McFall moved, seconded by Commissioner Kellum, that the Building Site Committee Report of 14 February 1967 relative to SDR-671, Richard Allen, be adopted and that the tentative map (Exhibit "A", filed 30.January 1967) be approved subject to the conditions set forth in said report; motion carried unanimously. -4- Planning Commission Minutes 27 February 1967 - Continued III. D. SD-672 - Saratoga Foothills Development Corporation, Cox and Cumberland - Subdivision - 41 Lots - Continued from 14 February 1967 Cormnissioner McFall stated that the Subdivision Committee and the Director . of Public Works had met with the applicant and recommended this matter be continued to the next regular meeting to allow the applicant time to re-sub- mit new street plans. Chairman Norton so directed. E. SDR-674 - West Valley Baptist Church, Allendale & Fruitvale Avenues - BuildinS Site Approval - 1 Lot - Continued from 14 February 1967 CommiSsioner McFall advised that the conditions of approval had been prepared but Specific Condition .II~J (improvement of Fruitvale Avenue) would result in a reduction.'.. of parking and recommended this matter be continued to permit the applicant time to work out a solution to this problem with the Director of Public Works. In view of the foregoing, Chairman Norton directed this matter continued to the meeting of 13 March 1967. F. SDR-675 - Campbell Union High School District, Prospect Avenue - Building Site Approval - 1 Lot - Continued from 14 February 1967 Cormmissioner McFall advised that conditions of approval had been prepared but the applicant had expressed d~ssatisfaction with Specific Conditions II-J and II-K. Mr. Ward Cullin was present to represent the applicant and advised that the School District had neither the money nor the authority to provide for Specific Conditions II-J, II-K, and/or II-B. The Secretary stated that the applicant had submitted a letter to the Plan- ning Commission requesting reconsideration of the above mentioned conditions. Commissioner McFall moved, seconded by Commissioner Kasner, that the Building Site Committee Report of 27 February 1967 relative to SDg-675 be adopted and that.the tentative map (Exhibit "A", filed 7 February 1967) be approved sub- ject to the conditions set forth in said report; motion Carried unanimously. At this time Chairman Norton, after reviewing the conditions of approval stated that Specif{c Condition II-H was not specifi~ .enough and recommended .. that.Specific Condition II-H be changed to read as follows: "H. Subject to Design Review." and then directed this matter continued to the next regular meeting to allow time to modify the Building Site Committee Report of 27 February'1967. In view of the foregoing, Commissioner McFall withdrew his motion for approval of the Building Site Committee Report relative to SDR-675. -5- Planning Commission Minutes - 27 February 1967 - Continued III. G. SDR-676 - Robert A. Huch, Elisa and Scully Avenue - Building Site Approval - 1 Lot The applicant was present to question Specific Condition II-B and stated that other homes in the surrounding area were not serviced by underground ·utilities. After. discussion, Commissioner McFall moved, seconded by Commissioner Crisp that the Building Site Committee Report of 27 February 1967 relative to SDR-676 be adopted and that the tentative map (Exhibit "A", filed 15 February 1967) be approved subject to the conditions set forth in said report; motion carried unanimously. RECESS AND RECONVENE IV. DESIGN REVIEW A. A-238 - Youth Center, Fruitvale Avenue - Final Design Review - Youth Center Buildins - Continued from 14 February 1967 Commissioner O'Rorke stated that since no formal plans have been received this matter should be continued. In view of the foregoing, Chairman Norton directed this matter continued off the agenda until the applicant submits a plan fo~ consideration. B. A-241 - Prospect High School, Prospect Avenue - Final Design Review - High School Building - Continued from 14 F~hruary 1967 Commissioner McFall recommended that this matter be continued to the next regular meeting to allow more time to work out the plans relative to SDR-675 (Campbell Union High School District). Chairman Norton so directed. " C. A-242 - Rayne Soft Water, Saratoga-Sunnyvale Road - Final Design Review - Identification Sign The Secretary explained that Rayne Soft Water in reality fronts on the side of the building to the rear of the property and would like to have a sign on Saratoga-Sunnyvale Road in order to help his customers locate his place of business. Commissioner O'Rorke recommended that this matter be continued to the next regular meeting. Chairman Norton so directed and referred the matter to the Design Review Committee for study. V. CITY COUNCIL REPORT Commissioner O'Rorke observed that the minutes of the last City Council meeting had been distributed and advised that he had nothing further to add. -6- Plannin8 Commission Minutes - 27 February 1967 - Continued VI. NEW BUSINESS : REPORT ON COUNTY PLANNING POLICY COMMITTEE Commissioner Kasner represented Saratoga at this meeting (along with Mayor Glennon and Mr. SCan Walker) and stated that 1) a large amount of time was devoted to discussion and approval of by-laws 2) the entire group plans to meeC every other month but the Executive Committee will meet more often. The objectives discussed at the meeting included: a) Co-ordination of General Plan. b) Cut down projection of ad-hoc committee. c) Study regional government, particularly ABAG. d) Study Transit, the Bay Shoreline, Hillside Development, the Skyline Parkway, Recreational Land, Pollution, etc. Chairman Norton requested chat each time Commissioner Kasner attends a meeting a formal report. be listed as an item on the agenda. VII. OLD BUSINESS A. SD-473 - Brown & Kauffmann, Inc., Scully Avenue - Request for Extension - Continued from 14 February 1967 The Secretary advised that this application is going before the City Council for final approval on 1 March 1967; therefore, the need for an extension will be unnecessary. B. ORDINANCE AMENDMENTS The Secretary stated that plans were in the process to introduce amendments to Ordinance NS-3 in the near future. SOme of the amendments for consideration include the following: 1. Horse Ordinance 2. Small Animal Ordinance 3. Side Yard Setback.Requirements relative to heights. Chairman Norton recommended that members of the Horse Owners Association' 'be notified prior to any hearing on the proposed horse ordinance amend- ment. C. KOSICH PROPERTY PROPOSAL Commissioner McFall advised that the new proposal submitted by the applicant seemed to hold a great amount of merit. Commissioner Kellum stated that the type of Multi-Development proposed would be very compatible with the Single Family Residential new present in the area. Commissioner Kasner stated that even though he was favorable to the plan he was not 'yet ready to approve any plans without further study.' -7- Planning Commission Minutes - 27 February 1967 - Continued VII. C. Commissioner Johnson stated that high density should be restricted in the development. Commissioner Crisp stated 1) that the property is surrounded by Commercial except on the Radoyka Drive side 2) that if the proposed Change of Zoning were approved by the Planning Commission the City Council would probably refer it to the General Plan Review Committee for study. On this basis, Chairman Norton recommended that the applicant, Roy Kosich, apply for a Change of Zoning in time to study~his:applica- tion during the General Plan Review. VIII. COMMUNICATIONS A, A to Z Rental,..Saratoga-Sunnyvale Road - Request to Allow Identification Sign 1. Mr. Cununins was present to explain that the signs were needed out at the edge of the raod so that customers could better locate the various business buildings in the area. Commissioner O'Rorke requested that pictures be submitted showing what the signs they intended.to put up would look like. Chairman Norton suggested that if there are to be future tenants in " this area their sign requirements should be taken into consideration at this time. After discussion, Chairman Norton referred this matter to the Design Review Committee and recommended that the applicant submit a formal .~.app!ication. 2. Clarence Ne~.~e, Sarato~a-Sunnyvale Road - Request to move Buildinn Jack R. Purcell, Purcell Realty,. submitted a letter on behalf of Clarence Neale'requesting that Mr. Neale be permitted to add an additional building to the present units located at Saratoga - ;'Sunnyvale Road. The building to be used would be the old Saddle Shop directly adjacent and across Saratoga Creek from Neale's Hollow. Commissioner O'Rorke requested that Mr. Neale submit a drawing explaining in detail what he plans to do with this building. Chairman Norton referred this matter to the Design Review Committee for study and asked that they meet with the' applicant. 3. The Church of Jesus Christ of Latter-Day Saints - Request for ModifiCation of Conditions A letter submitted by the representatives of the church requested. deletion of Condition H of the Specific Conditions listed on the Building Site Committee Report of 14 February 1967 relative to SDR-673 and suggested an alternate plan. Chairman Norton referred this matter to the Subdivision Committee for further study. -8- Planning'Commission Minutes - 27 February 1967' - Continued VIII. A. 4. SDR-598 - Joe Neville, Pierce Road - R..e..quest for Extension The applicant submitted a letter requesting an extension of his Building Site approval. for the three lots on Pierce Road. After discussion, Chairman Norton directed this matter continued to the next regular meeting and referred same to the Subdivision Committee for further study. B. ORAL Chairman Norton acknowledged, with pleasure, the presence of Councilnmn Tyler, Mrs. McGuire and Mr. Dove of the Good Govern- ment Group, Mr. Hasset of the Saratoga Park Woods Homeowner's Association (who will be present to represent the group at future meetings), Mr. Galeb of Seagull Way, and Jean Curry of the Azule Merchants Association.
