MINUTES Conunissioner Xasner moved, seconded by Commissioner Crisp, that the reading of the minutes of 27 February 1967 be waived and that the minutes be approved subject to the following modifications: page 2.. .Section D. PUBLIC HEARINGS A. UP-120 - Sisters of Notre Dame de Namur, Norton Road - Rquest for Use Permit for Construction of New.Novitiate Facilities - Continued from 27 February 1967 The public hearing on UP-123 was'not re-opened at this time. Chairman Norton directed this matter continued to the next regular meeting since the applicant is still considering the proposed conditions of approval. B. UP-123 - Robert L. Schaeffer, Sobey Road - Request.for Use Permit for the KeepinS of One ~1) Horse - Continued from 27 February 1967 The public hearing on UP-123 was opened at 7:47 P.M. The Secretary advised that Notices of Hearing had been mailed and there were no written communica- tions on file. Mrs. Schaeffer was present but stated that she had no further comment at this time. Chairman Norton brought up the subject of minimum areas for. corrals and "' suggested that this might be studied at the time of consideration of the new horse ordinance. .. There was no one else present who wished to speak with regard to this matter. The Secretary read the Staff Report of 13 March 1967, recommending with concurrence of the Subdivision Committee the UP-123 be granted subject to planting of sufficient screening on the north and east sides of the pro- posed corral. After discussion, Commissioner McFall moved, seconded by Commissioner Kasner, that the. public hearing on UP-123, Robert L. Schaeffer, be closed; motion carried unanimously and the hearing was closed at 7:51 P.M. Commissioner McFall moved, seconded by Commissioner Kasner, that the Staff . · Report of 13 March 1967 relative to UP-123, Robert L. Schaeffer, be approved in accordance with said report; motion carried unanimously. C. UP-124 - Claude T. Lindsay, Inc., Fredricksburg Drive - Request for Use Permit for Model Home Sales Office The public'hearing on UP-124 was'opened at 7:52 P.M. The Secretary advised that Notices of Hearing had been mailed and there were no written communica- tions on file. He then briefly reviewed the subject application. Mr. Oei was present to represent the applicant, but stated that he had no further comments at this time. Chairman Norton advised that this should be used strictly_as a model home sales office. The Secretary read the Staff Report of 13 March, 1967,'recommending approval of UP-124. Commissioner Kasner moved, seconded by Commissioner Kellum, that paragraph 1 . . line 3. .of the Staff Repo~ of 13 March, 1967, Claude T. Lindsay, be modified to read as follows: "office only." At 7:55 P.M. Commissioner Kellummoved, seconded by Commissioner Kasn~r, that the public hearing on UP-124 be closed; motion carried unanimously. Commissioner McFall~moved, seconded by Commissioner Kellum, that the Staff Report of 13 March, 1967 relative to UP-124 be approved, subject =o modifica- tion stated above, and the Use Permit be granted'; motion carried unanimously. -2- .... . ..... ~ .................. PlanninS Commission Minutes - 13 March 1967 - Continued D. UP-125 - Donald McConnell, Prospect Road - Request for Use Permit for Car Wash with Gasoline Sales The public hearing on UP-125 was opened at 7:57 P.M. The Secretary 1) advised that Notices of Hearing had been mailed 2) briefly reviewed this file and 3) read a communication from Mrs. Elsie Patrick, Oakhaven Drive, stating her objections to the proposed Use Permit. The applicant was present and explained' that they would be using the same basic plan, but with a more attractive building, than.~proposed..'by the previous applicant, Manuel Lozano. He further stated that the residue resulting from the proposed car wash would be very limited. There was no one else present who wished to comment oni~this matter. Commissioner McFall suggested that the applicant submit a letter from the owner of the property granting permission to rescind UP-112, Manuel Lozano, and stating that Donald McConnell has the consent of the property owner to apply for a Use Permit for a car wash on this property. After discussion, Chairman Norton (8:03 P.M) directed UP-125 continued until the next regular m~eting and referred same to the Subdivision Committee for study and a report at that time. E. UP-126 - Brown & Kauffmann, Inc., Ingrid Court and EriCDrive - Request for Use Permit for Model Home Sales Office The public hearing on UP-126 was opened at 8:04 P.M. The Secretary advised that Notices of Hearing had been mailed and read a co,~i~nication filed by Merle H. and Dorothy Barton, Ingrid C6urt, in opposition to the proposed Use Permit. William Driscoll, present to represent the applicant, stated 1) this is an additional unit in the same development 2) this new area is further away from the proposed model home sales office, but some of the homes in the old unit were even further away and 3) this model home is necessary in this area so that people coming into this particular section of the subdivision can contact a representative to answer their questions. He further stated that 1) the model home will be furnished with a desk and a phone in a room large enough to meet people 2) there will be other model home sales offices in ~he new unit and 3) the model home requested will not be used for more than four (4) months. There was no one in the audience who wished to comment with regard to this matter. Commissioner O'Rorke advised that he would like to look at the subject .property before making a decision on this matter to see what effect the additional traffic would have on the neighborhood. Commissioner Crisp stated 1) that the office described sounded more like a real estate office than a model home sales office and 2) that'he too would like to visit.the property before reaching a conclusion. After further discussion, Chairman Norton (8:13 P.M) continued this matter to the next regular meeting and referred the,'..~atter to the Subdivision Committee-for study. Planning Commission Minutes - 13 March 1967 - Continued F. UP-127 -'Gene C. Buthenuth, Palomino Way - Request for Use Permit for the' Keeping of Two (2) Horses The public hearing on UP-127 was opened at 8:14 P.M. The Secretary 1) advised that Notices of Hearing had been mailed 2) briefly reviewed this file 3) read a communication filed by Mr. & Mrs. Tom Leong in'.favor of the proposed Use Permit and 4) read a communication filed by Mr. Phillip D. Collins"in opposition to the subject application. The applicant was'present and explained that 1) he did not have!"a Use Permit for the one (1) horse he now had 2) he intended tO 'increase the size of the corral if the proposed Use Permit is granted and 3) the property he plans to lease, to make it possible for him to ha~e'a second horse, Ks adjacent south of his own property. The Secretary read the lease'signed by the applicant and Mr.'Victor L. Befera owner of the property to be leased. Chairma~ Norton explained that if the Use Permit is granted there=will have to be a clause provided limiting:the applicant to one ,horse should the addi- tional property be sold. There was no one else present who w~shed to comment regarding this matter. Chairman Norton at 8:22 P.M. directed UP-127 continued to the next regular meeting on 27. March 1967 and referred same to the Subdivision Committee for study and a report. G. C-105 - George W. Day Company, Allendale Avenue - Request for Change of Zoning from "R-i-40,000" (Single Fami!y Residential) to "R-I-20,000" (Single Family'Residential) The public hearing on C-105 was opened at 8:23 P.M. The Secretary advised that Notices of Hearing had been published, briefly reviewed the subject request and read a communication filed by the applicant~s representative.' Chairman Norton s~at'ed'.that there had been some questions in 'his mind regarding the zoning along this strip. Mr. Nestor B~rrett, Planning Consultant, was present to represent the applicant and advised that-:the salea; of level land with single family residential homes' is becoming exuremely difficult especially if they fron~on a street that will. be a major thoroughfare. Commissioner Kellum advised that some members of the Subdivision Committee had long been aware that this strip would some day have to be changed from R-i-40,000 zoning since.it does not lend itself very well to single family homes.on acre lots. Mr. Clifford Feak, homeowner on Allendale Avenue, was present and stated he was opposed to the proposed change of zoning for the following reasons: 1) he recently purchased his property thinking the zoning in the area would remain at R-i-40,000; 2)- if this change :of zoning is granted it will set a precedent for other areas now zoned R-i-40,000; 3) his house was built in conformance with the regulations required for the R-I-40,000 Zoning District and he felt that smaller lots-" in the area would decrease the value of his property. Y~. A. L. Plansen, homeowner on the corner of Allendale Avenue and Dolphin · Drive,'was present and stated that while he agreed with Mr. Feak he alse felt that the acre lots along this area remained dormant except for the building of churches and schools and he preferred to live ~n a resident~al neighborhood. -4- Planning Commission Minutes - 13 March 1967 - Continued II. G. C-105 - Continued Mr. Barrett stated that the depth of the lots would average between 190 and 200 feet. Mr. Feak stated that if these depths were maintained then the widths provided should be comparable to widths in the R-1-40,O00 ' zone. After discussion, Chairman Norton (8:39 P.M.) directed C-105 continued to the next regular meeting and referred same to the Subdivision Committee for further study.- III. BUILDING SITES AND SUBDIVISIONS A. SDR-669 - Frank Pringle, Canyon View Drive - Building Site Approval - 1 Lot - Continued from 27 February 1967 Commissioner McFall advised that 1) new plans had not yet been submitted 2) a letter of extension is. now necessary and 3) recommended this matter be continued to the next regular meeting. Chairman Norton so directed. B. SDR-670 - Douglas Hines, Sobey Road - Building Site Approval - 1 Lot Continued from 27 February 1967 Commissioner McFall briefly reviewed this application and explained the applicant has discussed Conditions II-A and II-J with the Director of Public Works and has reached an agreement with regard to Condition II-A. The applicant was present and stated that he felt Condition II-J (relative to underground storm drain) was a problem of public interest in the area and he did. not think it was fair to ask him to solve it. After further discussion, Mr. Hines agreed to accept the conditions of approval and, at a later date, request reconsideration of Condition II-J. Commissioner McFall moved, seconded by Commissioner Kellum, that the Building Site Conm~i~tee Report of 14 February 1967 relative to SDR-670, DOuglas Hines, be adopted and that the tentative map (Exhibit "A", filed- 23 January 1967) be approved subject to the conditions set forth. in said report; motion carried. C. SD-672 - Saratoga Foothills Development Corporation, Cox and Cumberland Subdivision - 41 Lots - Continued from 27 February 1967 -' Commissioner McFall advised that the Subdivision Committee and the Director of Public Works have met with the applicant to work out a satisfactory tentative map and that on the advice of the City Attorney conditions of approval for this tentative map have been prepared; how- ever, since this tentative map includes additional property'not a part of the original Change of Zoning (C-103), the applicant still will need further Change of Zoning, C-107 (for which applicant has already applied), for the additional property in order to complete the development. The Secretary, in referring to the Subdivision Ordinance, stated that if for some reason the Change of Zoning for this additional piece of prop- erty were not approved then that portion of the tentative map would be void and this entire procedure is at the sole risk of the subdivider as provided for in the Subdivision Ordinance. Chairman Norton inquired if the applicant understood the foregoing and asked that this be clarified in the official record. Plannin~ Commission Minutes - 13 March 1967 - Continued III. C. SD-672 - Continued Commissioner Crisp stated that he ~as of' the opinion this type of procedure would be in ~direct violation of the Sub- division Ordinance and if the other members of the Commission decided to act to approve this map he would have to abstain. Commissioner O'Rorke indicated that his decision would be to go ahead and approve the map. The .Secretary stated 1) the City Attorney had stated it .. would be legal to go ahead with approval and 2) the Subdivision Committee Report could be amended to add Condition 12 as follows: .: 12. Subject to completion of proceedings under Change of Zoning C-107. " After further discussion, Commissioner McFall moved, seconded by Commissioner Kellum, that the Subdivision ., Committee Report of 13 March 1967 relative to SD-672, Saratoga' Foothills Development, . be adopted , !'as amended, and that the tentative map (Exhibit "A-l", filed 6 March 1967) be approved subject to the conditions ;'set forth in said report; motion carried unanimously with Co..R~.issioner Crisp abstaining'. ~ Plannin~ Commission Minutes - 13 March 1967 - Continued III. D. SDR-674 - I~st Valley Baptist Church, Allendale and Fruitvale Avenues - Buildins Site Approval - 1 Lot - Continued item 27 February 1967 Con~nissioner McFall advised that the applicant was still working with the Director of Public Works on the. improvements r~quired with regard to this building site and has requested that this matter be continued. Chairman Norton so directed. E. SDR-675 - Campbell Union High School, Prospect Avenue - Building Site Approval - 1 Lot - Continued from 27 February .1967 ~z~. Wade Hover attorney for the ppl'ca~t, was , a 1 present and stated that 1) Conditions II-B, II-J, and II-K were still objectionable to his client since the money was not availabe 2) the Street and Highway Code, Section 203, states that if the school does not have the funds the local jurisdiction is' responsible for the subject improvements and in other instances when the school did not have .the money the City and the County worked together and' paid-for the subject improvements 3) the school was prepared to pay for only 20* of the 60t of street improvements required under Condition II-B since the funds were more urgently needed to take care 'of the needs of the students 4) not many of the residents in this area would be using ..' these particular roads and he had talked to people in! this area and they did not approve of Condition 'II-B and 6) Condition ~I-Kwas, also, objectionable due to the lack of funds and if a signal light must be put at this intersection it should be done jointly by the City of Saratoga and' the City of San Jose. Chairman Norton 1) stated that subdividers were required to take care of street improvements; therefore, schools should be required to do the same 2) inquired where the people driving their children to school would. go to turn around if Condition II-J were not provided 3) advised that.the Prospect Road beautification should be considered when discussing these proposed conditions and 4) suggested that. Condition II-K of the Building Site Committee Report should be modified to read as follows: "Pay proportional cost of signal installation on Prospect Road, opposite Lyle Drive, if sho~n to be necessary by Engineering Traffic Study and required by Director of Public Works so that the location of the light will not be in question. ..-.:. '- At this time, Chairman Norton stated that this matter should be referred "- to the City Council (since finances were involved) for them to work it '. out with the City Attorney. Mr. Hover agreed that this would be the best solution. Commissioner Kasner stated that while he was interested in the legal points mentioned by Mr. Hover he did not feel that too many of the students that would be using this schoolc~ ~ould be children from Saratoga and pointed out that anyone could ~id~:themselves of a traffic problem by handing it to the City. Commissioner McFall moved, seconded by Co,xgaissioner Crisp, that the Building Site Committee Report of 13 March 1967 relative to SDR-675 be adopted, as amended in Condition II-K, and that the tentative map (Exhibit "A", filed 7 February 1967) be approved subject to the conditions set forth in said report; motion carried unanimously. Mr. Hover advised that '~z~he ~n~uld like to remind the Planning Co~ission of the legal technicalities involved with regard to Section 203 of the Street and Highway Code. -7- Planning Commission Minutes - 13 March 1967 - Continued III. E. SDR-675 - Continued Chairman Norton explained that the Planning Commission had a limited amount of time in which to act 0nm,application and suggested that Mr. Hover discuss any further problems he might have with the City Council and the City Attorney. Mr. Hover then requested that A'241 (.Campbell Union High School District) be heard at this time. '. '- Commissioner Kasner explained that other people w&re waiting and the- items had to be heard in the proper~ order listed on the agenda. F. SDR-677 - George Coley, E1Camino Grande, Building Site Approval - .. 1 Lot There was no one present to represent'Mr. Coley, but the Secretary advised 1) the applicant had reviewed the proposed conditions earlier and had expressed satisfaction with same and 2) the percolation studies .. have not been completed by the Health Department, but.this. matter is covered in the General Conditions stated in the Building Site Committee Report. '. Commissioner McFall moved, seconded by Con~nisstoner Kellum, that the Building Site Committee Report of 13 March 1967 relative to SDR~677, ..,-j. George Coley, be adopted and that the tentative map (Exhibit "A", filed .23 February 1967) be approved subject to the conditions set forth in ,.' said report; motion carried unanimously. G. SDR-678 - Dr. John E. Cox, Jack's Road - Buildin~ Site Approval - 2 Lots ~. Bohannon, engineer, was present to represent the applicant and expressed .~. satisfaction with conditions of approval, but requested the right to ask for reconsiderati0n'of Condition II-A. Chairman.Norton suggested that Mr. Bohannon discuss Condition II-A with the DireCtor of Public Works. The Secretary then read the report submitted by the Santa Clara County Health Department indicating that .sanitary sewers would be required for these two 1.ors. Chairman Norton advised Mr. Bohannon that:.l) approval of the Health Department requirements were not. covered by the Building Site Committee Report and.2) he would have to contact the Santa Clara County Health Department with regard to aforementioned requirement. Commissioner McFall referred to the note listed below Condition II-H and stated that same should be deleted since it no longer applied.as shown on Exhibit "A" in file SDR-678. Commissioner McFall moved, seconded by Commissioner Kellum, that the Building Site Committee Report of 13 March 1967 relative to SDR-678 be adopted (as modified to delete the note listed at the end of the Building Sit. e Committee i'. Report) and that the tentative map (Exhibit "A", filed 24 February 1967) be approved subject to the conditions set forth in said report; motion carried unanimously. H. SDR-679 - Loren L. Maninger, Palomino Way - Building Site Approval.'- 1 Lot The applicant's representative requested that an access off Pierce Road be considered for this lot. : FlanninM Commission Minutes - 13 March 1967 - Continued III. H. SDR-679 - Continued The Secretary explained that this lot is one created a long time ago and approved previously under SDR-437... Chairman Norton stated that approval could be granted at this time and the applicant could submit a plan at a later date showing access off Pierce Road. He stated they did not object to putting in the street improvements , requested in Condition II-B, but felt that they should not have to provide curbs and gutters since this was essentially not a collector . .!. street. - Commissioner CriSp advised that this requirement had been"imposed"on"' other applican,~s applying for Building Site Approval. The Secretary expalined that the Director. of Public Works had included this condition since he felt it would be beneficial to drainage. Mr. Kaiser, stated that 1) the site is located-on a hilltop and water':'=."~ drains to public street and. 2) a side yard gutter would seem more feasible. Commissioner McFall moved, seconded by Commissioner Crisp, that the Building Site Committee Report of 13 March 1967 relative to SDR-680 be adopted and -" that the tentative map (Exhibit "A", filed 28 February 1967) be approved " subject to the conditions set forth in said report; motion carried unanimously.'~ .Z J. Plato, be adopted, as modified, and that the tentative map (Exhibit "A", filed 3 March 1967) be approved subject to the conditions set forth in said report; motion carried unanimously. K. DESIGN REVIEW A. A-241 - Prospect High School, Prospect Avenue - Final Design Review -' ~'. High School Buildin~ - Continued from 27 Febr,~ry 1967 Co,miissioner Kasner advised that final plans had not been submitted; therefore, the Design Review Committee could not make a recommendation for approval at this time. .. A-242.- Rayne Soft Water, Saratoga-Sunnyvale Road - Final Design Review - Identification Si=n - Continued from 27 February 1967 ~:"2 Commissioner Kasner :adviSed" that in addition to 'the.'Rayne'.:Soft Water sign request there are two similar informal requests (A to Z Rental and Big Tree Shopping Center) to be considered since all three proposals are related as. far as interpreting the objectives of the.Zoning Ordinance as'stated in the' Staff Report of 13 March 1967, Planning COmmission Minutes'- 13...March 1967 -. Continued IV. B. A-242 - Continued Commissioner Kasner further advised that 1) the ordinance does not specify physical location of sign.or specific size of sign 2) these stores have a hardship since none of their buildings front directly on the street 3) there is a possibility that there may be more appli- cations for this type of sign and 4) perhaps each of the subject applicants could apply for a Varianc~ and in this my each case could be handled on its own individual merits. Chairman Norton stated that he was in favor of the type of sign proposed by the Big Tree Shopping Center, but objected to the'size. Commissioner O'Rorke suggested that the three (3) members of the Design Review Committee meet and work out a policy to follow with regard to this type of sign. After further discussion, Chairman Norton referred this matter to the Design Review Committee and suggested that the applicants who cannot wait for a pol- icy to be adopted should apply for a Variance with the understanding that it may not be granted. C. A-243 - C. T. Lindsay, Inc., Cox Avenue - Final Design Review - Identifi- cation Sign Commissioner Kasner stated that these plans were not submitted in time for the Design Review .Committee to review them prior to this meeting; therefore,. they were not prepared to make a recommendation regarding same. A-244 - Richard Bragunier, Cox Avenue - Preliminary Design Review - Quito Home Decoratin~ Center Commissioner Kasner advised that the only thing that really had to be considered in this matter was the sign since there will be no real change in the building. After a brief discussion, Comnissioner Kasner moved, seconded by Commissioner McFall, that preliminary design approval be granted A-Z44, Richard Bragunier as shown on Exhibits "A", "B", and "C"; motion carried unanimously. E. A-245 - Virgil Herring, Big Basin Way - Preliminary Design Review - Development of Commercial Center The applicant and his architect, Mr. Warren Held, were present. Mr. Held stated 1) this site would be divided up in a series of small shops to include the existing store with the concept that it would tie in with the nearby shopping center and other shops in the area, 2) the. design would be a modernized Victorian with one and some two story buildings, 3) the center had been designed to tie in with the proposed parking district, and 4) the applicant would like preliminary approval so he could proceed with leases since there were quite a number of people interested ~t this time. SDR-613 - Columbus Founders Savings, Wardell Road - Request for Modification of Conditions The Secretary stated that the applicant had requested modification of Condition 6 of the Subdivision Committee Report dated 28 February 1966· since the subject subdivision does not have right-of-way over said road.. '~ The Secretary read the Staff Report of' 13 March 1967 recommending that Condition 6 of the Subdivision Committee .Report of 28 February 1966 be modified to not require improvement of the subject private right-of-way.
