PLACE: City Council Chambers, Fruitvale Avenue, Saratoga, California TYPE: Regular Meeting .. I. ROUTINE ORGANIZATION A. ROLL CALL Present: Commissioners Crisp, Johnson, Lively, McFall, Norton, and Smith. Absent: Commissioner Kasner. B. MINUTES Commissioner Johnson moved, seconded by Commissioner 'Smith, that the reading of the minutes of the 11 March 1968 meeting be waived and that they be approved as distributed to the Commission subject to the following deletions: page 3. . .delete paragraph 3 under II. D page 7 .... delete paragraph 2, 3, 4, and.5 under III. A. 2. V-313; motion carried unanimously. .! ."2 C. COMMITTEES "z Chairman Norton explained that it has been the policy in the past to have the Chairman of the Subdivision Committee serve on the General Plan Conm~ittee; therefore, Commissioner Smith will' replace Commissioner Crisp on the General Plan Committee in keeping with the. above mentioned practice. He then appointed .........................Commissioner Kasncr to the General Plan Committee .to fill the .vacancy ].eft by ....................... Commissioner O'Rorke; and appointed Commissioner Lively to take the place of Commissioner Kasner on the Variance Committee. Chairman Norton stated 1)' a problem existed that he would like to discuss with the Commission 2). the Subdivision Committee meets on each· Monday after- that the person appointed to this Committee must have time to attend the " specified meetings and...4) some alternative' might;'be to !' !' ~ ..... . a) have evening meetings with the Staff and applicants '~'!i " · b) have the Staff take care of the initial contact work' ..... with the applicant and then present the problem to' the Commission c) increase the. Staff which ·-would be a~ additional expense. He th'en advised that the evening meeting may be a hardship for the a~plicant. Commissioner Johnson stated that if the members of the Commission are willing to give up their evenings it should not be wrong to ask applicants to give up their evenings.. Commissioner Crisp stated that 1) evening meetings will mean overtime for the Planning and Public Works Staff and this will involve additional monies 2) he preferred afternoon meetings for the convenience of the Committee mem- bers, applicants, and Staff 3) another alternate would be to have a two man Committee to attend the scheduled day.;time meetings with the third member sitting in whenever possible. : ": Co,~nissioner Smith stated that with. a two man Committee (with a possible third member when available) the applicant can meet with the Committee on the Monday of the Planning Commission meeting; whereas, with the evening meetings this would not be .feasible. _1_· Planning Commission Minutes - 25 March 1968 - Continued II. PUBLIC HEARINGS A. V-314 - Larry G. Swenson, Bohlman Road - Request for Variance in Connec- tion with Front Yard Setback Requirements - Continued from 11 March 1968 The public hearing for V-314 was re-opened at 7:40 P.M. The Secretary stated that nothing further had been added to the file. The applicant and his architect were present but offered no further comments. The Secretary read the Staff Report of 25 March 1968 recommending, L'~ith concurrence of the Variance Cormn~ittee, that the subject Variance be granted. At 7:50 P.M. Commissioner Johnson moved, seconded by Commissioner Crisp, to close the hearing on V-314; motion carried unanimously. Commissioner Crisp moved, seconded' by Commissioner Smith, that the Staff Report of 25 March 1968, relative to V-314, be adopted and the Variance r~Jt~e' since the findings required by Section 17.6 of Ordinance NS-3 can be made; motion carried 'unanimously.. ",. B. V-315 - Atlantic Richfield Company, Cox Avenue and Paseo Presada - Request for Variance in Connection with Sign Requirements The public hearing relative to V-315 was opened at 7:52 P.M. The Secretary stated that the Notices of Hearing had been mailed and then briefly reviewed this file. No .'one was present to represent the applicant. At 7:54 P.M. Chairman Norton closed this hearing temporarily and deferred same to the latter part of the public hearings in order to allow time for the applicant to arrive. C. V-316 - L. B. Nelson, Prospect Road - Request for Variance in Connection With Sign Requirements Chairman Norton opened the public hearing relative to V-316 at 7:55 P.M. The Secretary stated the Notices of Hearing were mailed and then briefly explained this application. M~. Jerry Gurley, present to represent the applicant, stated ..that 1) he understood that the normal procedure in these matters is to refer the application to the Variance Committee for study 2) he would like to meet with the Committee and seek their advice 3) he felt the City has a good Sign Ordinance in that it is short and plain in comparison to some others he has worked with 4) since the City Ordinance is short it does not cover all situations 5) the proposed sign will b.e in competition with other larger signs which are governed by different sign laws 6) the other signs are five to six times larger than the one proposed and 7) in view of the..-.larger signs a smaller sign will be a distinct disadvantage; therefore, the applicant felt it necessary to submit this request for Variance. Chairman Norton stated the Planning Commission did grant the Big Tree Shopping Center (located near the applicant's property) some ~Var,iance on their sign but not to the degree proposed by the applicant. Gurley stated that he felt the proposed sign is very much in keeping with the architecture of Saratoga 2) the sign does not involve moving parts or flashing lights 3) in order to catch the eye of the passing motorists a different kind of sign is needed and 4) more sign area than the 32 square feet allowed by the Sign Ordinance is needed. No one else present wished to comment. Commissioner Crisp, on behalf of the Variance Committee, arranged an appointment with Mr. Gurley for Saturday at 9:00 A.M. on 30 March 1968. He, also, instructed the Secretary to inform the representative for Atlantic Richfield Company that their application for Variance will be discussed at this meeting. After discussion, Chairman Norton (8:03 P.M.) closed the hearing relative to .V-316 for the evening, referred the matter to the Variance Committee for further study and continued same to the next regular meeting. D. UP-146 - Finnegan Construction Company, Manor Drive - Request for Use Permit to Allow a Model'Home Sales Office - Continued from 11 March 1968 The hearing relative to UP-146 was re'opened atS:04 P.M. The Secretary stated there was nothing new in the file. There was no one present to represent the applicant and no one in' the audience wished to comment. The Secretary read the Staff Report of 25 March 1968 recommending that UP-146 be granted. Commissioner Smith stated that paragraph 2. .lines 2 and 3. .should be changed to read as follows: "a period of one (1) year for sales only and prohibition of any use .as a construction yard,.engineering Or. design office.." Commissioner Smith moved, seconded by Commissioner Johnson, at 8:06 to close the public hearing for UP-146; motion carried unanimously. Commissioner Smith moved, seconded by Commissioner Johnson, that ~he Staff Report of 25 March 1968 be adopted, as amended, and the Use Permit'be<gr~nt'e~ in accordance with said report and subject to the conditions'Stated therein; 'motion carried unanimously. E. UP-147 - St. Archangel Michael (Serbian Orthodox Church), Allendale Avenue - Request for Use Permit for Sanctuary, Classrooms, and a Parish House - Continued from I1 March 1968 The hearing for UP-147 was re-opened at 8:07 P.M. The Secretary.stated nothing further had been added to the file. The Pastor of the church was present and stated that the requested additions were shown on their Master Plan five (5) years ago., but then due to lack of funds it was necessary to postpone construction of same. The Secretary read the Staff Report of 25 March 1968 recommending that the requested Use Permit be~' granted subject to the conditions stated in said report. Commissioner crisp pointed out that the church can have a larger sanctuary if they provide additional parking. -3- Plannin~ Commission Minutes - 25 March 1968 - Continued II. E. UP-147 - Continued At 8:10 P.M., Commissioner Smith moved, seconded by Commissioner McFall, that the public hearing on UP-147 be terminated; motion carried unanimously. It was moved by Commissioner Smith, seconded by Commissioner McFall, that the Staff Report of 25 March 1968, relative to UP-147 be adopted and the Use Permit be granted subject to the conditions stated in said report; motion carried unanimously. F. qUITO PARK BUSINESS CENTER, Cox Avenue - Informal Hearing - Request that Veterinarian Office be Added to the List of Conditional Uses in the Neighborhood Commercial Zoning District - Continued from 11 March 1968 The Secretary stated nothing further had been added to the file. No one was present to represent the applicant. The Secretary read the Staff Report of 25 March 1968 recommending that this request be denied. Chairman Norton stated that in paragraph 2. .line 4. . .of the subject Staff Report the word "hospital" should be inserted between the words "animal" and "can". After the discussion on this matter was ended, Commissioner Smith moved, seconded by Commissioner Lively, that the Staff Report of 25 March 1968 relative to this matter be adopted, as amended, and the !r'equest.i!i be ~%q_nj. ed on the basis that the findings necessary under Section 14.1 of e Saratoga Zoning Ordinance NS-3 cannot be made; motion carried unanimously. B. V-315 - Atlantic Richfield Company, Cox Avenue and Paseo Presada - Request for Variance in Connection With Sign Requirements The hearing relative to V-315 was re-opened at 8:16 P.M. Mr. William H. Malpas, applicant's representative, stated that the smallest sign the Atlantic Richfield Company uses is 42 square feet and they would prefer this size sign for the station to be located at the corner'of Paseo Presada and Cox Avenue. : Chairman Norton stated it did not'seem that a'great expense would be involved for consturction of a Smaller sign. Mr. Malpas explained that 1) the 42 square 'foot signs are pre-constructed and 2) there is a 42 square foot.sign at the Atlantic Richfield Station across the street from the one under discussion. Chairman Norton advised that there is no competition at this location that would create a necessity for larger signs. M~. Lester Prinz, owner of property directly across the street, inquired about the hours.the gas station would be open. ~. Malpas stated he was under the impression the station would close at 10:00 P.M. Chairman Norton explained that under the present Zoning Ordinance the gas station could be open all .night. V-315 - Continued Chairman Norton (8:23 P.M.) closed the hearing relative to V-315 for the evening, directed the matter continued to the next regular meeting and referred same to the Variance Committee for study. Com~n~issioner Crisp, on behalf of the Variance Committee, made an appoint- ment with Mr. ~alpas to meet with the Committee on Saturday morning, 30 March 1968 at 9:30 A.M. to discuss this matter. G. S~LL PET ORDINANCE - Proposed Amendment to Ordinance No. NS-3 Relating to the Keeping of Certain Birds and Small Mammals as Pets in "R" Districts - Continued from 28 August 1967 Chairman Norton opened the hea~ing relative to this matter at 8:23 P.M. and then requested the Secretary to read Section (1) of the proposed Pet Ordi- nance for the information of the audience. The Secretary read Section (1) of the Ordinance which states the number of different types of animals permitted in "R" Districts. Chairman Norton explained that the Zoning Ordinance does not state anything relative to Small Pets and anything not specifically mentioned in the Zoning Ordinance is automatically prohibited; therefore, the 'proposed Small Pet Ordinance has been prepared to set forth reasonable limits. Commissioner Smith stated that he felt the Rodentia family should be some- what more limited and it should be specified that they should be kept in cages. Commissioner Johnson stated that the General Plan Committee investigated a number of Ordinances and the one proposed is more restrictive than most. The Secretary inquired if any mention should be made concerning the keeping of lambs, kids, and calves. Commissioner Crisp stated that these animals should not be permitted except under 4-H Projects and in that case the 4-H Ordinance will govern ~he keep- ing of same. The Secretary then explained that no mention is made about the keeping of wild and undomesticated animals. Chairwoman Norton stated that since'they 'are not speCifiCally mentioned they are prohibited and anyone wishing to keep them as pets would have to apply for a Variance. Commissioner McFall stated there is a lot of doubt among residents in Saratoga as to whether or not they are required to keep their dogs and cats on leashes or. in enclosures. Chairman Norton stated the he was more concerned with cats than he was about dogs and recommended that a clause governing leashing of cats and dogs be added to the City Ordinance. The SeCretary explained that the Santa Clara County Health Department will come out and pick up a dog if he is not licensed or, if he is licensed, the~ ": will return him to his owner. Commissioner Crisp stated that there seem to be a lot of wild, unlicensed cats running around Saratoga and these seem to be the ones that should be controlled since they do go after the birds.~ -5- plannin5 Commission Minutes 25 March 1968 - Continued iI. SPF, LL PET ORDINANCE - CONTINteD A gentlemen in the audience stated that keeping a dog in a completely enclosed cage would be extremely difficult since you would have to fence your entire yard including the top. Chairman Norton directed the Staff to contact the City Attorney to see if there is any feasible language that can be written into the Ordinance that would require cats and dogs to be kept on the owners property at all t in'~e s. Commissioner McFall stated that such a Ordinance is badly needed in the City and when the Ordinance is adopted it should be given as much publicity as possible. Conm~issioner Johnson recommended that the Small Pet Ordinance be referred back to the General Plan Committee for further study. He then pointed.out that when the Co~nittee worked with this proposed Ordinance theyr~onbidered the practicability of enforcement. After discussion, Chairman Norton (8:48 P.M.) closed the hearing relative to the Small Pet Ordinance for the evening, referred same to the General Plan Con~nittee for further study and directed the matter continued to the next meeting ................. ~ H. C-104 - Roy Kosich, Saratoga Avenue and Radoyka Drive - Request for Change of Zoning from "R-l-10,000" (Single Family Residential) to "C-N'~ (Neighborhood Commercial) and from "R-l-10,000" (Single Famil. y Residential) to "R-M-4,000" (Multi-Family Residential) - Continued from 14 Auaust 1967 Chairman Norton re-openedz'.'the' public hearing for C-104 at 8:50 P.M. The' Secretary stated that the Notice.'. of Hearing had been published and then read a communication received from D.K. Sunm~erville, 12350 Radoyka Drive · .filedi. j".'.l in opposition to the requested Change of Zoning. Chairman Norton explained that this hearing was postponed because'of the General Plan Study and now after completion Of that study it is evident that this Change of Zoning cannot be granted. Mr. Dick Foust, applicant's architect, stated that 1) he realized that architects generally agreed with one another but in this case he disagreed with the reco,nm~endation made by Mr. Livingston against this proposed Change of Zoning 2) he again wanted to re-state .that the area under discussion is a problem area because of the encroachment of the freeway 3) the pro- posal submitted is a reasonable one and 4) the applicant intends to pursue this proposal further. Chairnmn Norton pointed out that it might be advisable for the applicant to withdraw C-104 so that he can go.ahead with some other proposal without wait-. ing the one year required if an application is denied. Commissioner Smith suggested ~hat the applicant meet with the Subdivision CoF~ittee so that the policy of the Planning Commission and City Council in connection with these matters can be explained to him. F~. Ed Demerick, Saratoga Park Woods Homeowners Association, submitted a brochure stating their reasons for opposing the subject application. Commissioner Smith recommended that the Secretary make an appointment with the applicant to meet with the Subdivision Committee. Chairman Norton closed the public hearing relative to C-104 at 8:58 P.M., referred same to the Subdivision Committee for further study and directed the matter continued to the next regular meeting. -6- PlanninS Commission Minutes - 25 F~rch 1968 - Continued RECESS AND RECONVENE :: '. Site Approval - 1 Lot - Continued from 11 ~arch 1968 Commissioner Smith recommended that this application be continued to allow time for the applicant to .submit additional information. Chairman Norton so directed. B. SDR-734 - Manfred G. Kahl, Allendale Avenue - Building Site Approval - 1 Lot - Continued from 11 March 1968 Commissioner Smith stated that the proposed conditions of approval were ready at the last meeting but' some points required clarification by the City Attorney and then asked the Secretary to explain what infornmtion he had obtained. · The Secretary explained (after discussing the matter with the City Attorney) that 1) even though it is a burden on the applicant the Planning Commission can treat this Building Site (SDR-734) as part of Mr. Buehner's subdivision until Mr. Kahl's name appears on the Tax Rolls as the legal owner of the property" and 2) the only recourse for M~. Kahl is for him to withdraw SDR-734 and await adoption o.f the Tax Rolls or to accept the proposed conditions and go ahead with. the improvements. Mr. Kahl stated he would like to withdraw the subject application. Commissioner Smith stated that the Subdivision Committee had no objection to this withdrawal as long as the.applicant submits his intentions in writing. Chairm~n Norton directed' that the applicant submit a written statement withdrawing SDR-734 and continued the matter to later on the agenda. C. SDR-737 - Larry Swenson, Bohlman Road - Building Site Approval.- 1 Lot - Continued from 11 March 1968 The applicant and his architect, Mr. Ellmore, were present. Mr. Ellmore stated that Condition II-C was not clear. The Secretary stated ~hat Condition.II-C involves~an Offer of Dedication for the street which the City may or may not accept. Chairman Norton directed that Condition II-C be changed to read as follows: "C. Submit irrevocable Offer of Dedication on Bohlman Road to provide for a 30-foot half-street as approved by Director of Public Works." The Sacretary, in answer to an inquiry from M~. Ellmore, stated that if a storm drain is put on a lot and it carries water from lots other than the one the storm drain is located on the applicant will receive credit on the Storm Drainage .Fee which he is required to pay as part of the Condition of Approval. 'After discussion, Commissioner Smith moved, seconded by Commissioner McFall, that the Building Site Committee Report of 25 b~rch 1968 relative to SDR-73~: be adopted, as amended and that' th'e tentative map (Exhibit "A-I", filed 18 M~rch 1968) be ~pprg~ subject t~ the conditions set forth in said report; motion carried unanimously. Kahl, Allendale Avenue - Building Site Approval - 1 Lot - Continued from !1 March 1968 Mr. Kahi stated he ·was ,prepared to submit his letter of withdrawal for SD~.-734 at this time. Comn~issioner Smith moved, seconded by Commissioner McFall, that the letter of withdrawal submitted by Mr. Kahl be accepted and the withdrawal of SDR-734 be ·granted; motion carried unanimous.ly. D. SD-738 - Donald R.'McCormack. Douglas I~ne - Subdivision Approval - 5 Lots The applicant was present and stated he had reviewed the proposed conditions of approval and expressed satisfaction of same. Commissioner McFall recommended that another condition be added to the Subdivision Committee Report requiring underground utilities. The Secretary stated that the underground utilities are required as part of the' Standard Engineering Conditions already mentioned in the Subdivision Report and most engineers are aware that underground utilities are required. Chairman Norton stated that in the interest of clarification Condition 8 · should be added to the Subdivision Committee Report as follows: "8. Provide underground utilities." He then instructed the Secretary'to check with the City Attorney to see if 1) some simple statement can be worked out to cover the General Conditions in the Building Site Committee Reports and 2) if a brief statement regarding Standard Engineering Conditions could be outlined. Commissioner Smith moved, seconded by Commissioner McFall, that the Subdivi- sion Committee Report of 25 March 1968 relative to SD-738 be adopted, as amended, and that the tentative map (Exhibit "A",· filed 8 March 1968) be approved subject to the conditions set forth in said report; motion carried unanimously. E. SDR-739 - Wells Fargo Bank, Saratoga-Los Gatos Road - Building Site Approval - 4 Lots Mr. David Hammond, present to represent the applicant, stated that he had reviewed the proposed conditions of approval and ~xpressed satisfaction of same. It was moved by Commissioner Smith, seconded by Commissioner McFall, that the Building Site Comanittee Report of 25 March 1968 relative to SDR-739 be adopted and that the tentative map (Exhibit "A", filed 12 March 1968) be approved subject to the conditions set forth in.said report; motion carried unanimously. F. SDR-740 - S. L. Tyler and G. S. Kocher, Fourth Street - Building Site Approval - 1 Lot Commissioner Smith stated that the applicant requested that this matter be continued to the next regular meeting. Chairman Norton so directed. SDR-741 Joe Neville~ Pierce Road - Build.ing Sit~ Approval - 3 Lots Commissioner Smith advised that th~ proposed conditions of approval were basically the same as those approved for SDR-598 with the exception of some minor adjustments'for the access road going into the property. The applicant was present and stated that he had reviewed the proposed conditions of approval.and.expressed satisfaction of same. He then inquired if the street name Chalet Ciotilde Drive could be changed to something else. Chairman Norton explained that it could be with the unanimous agreement of all the people living on the street. Commissioner Smith moved, seconded by ComMissioner Crisp, that the Building Site Committee Report of 25 M~rch 1968 relative to SDR-741 be adopted and that the tentative map (Exhibit "A", filed 15 March 1968) be approved subject to the conditions set forth in said report; motion carried unanimously. H. SDR-742 - Apn Valk, BiS Basin Way - BuildinS Site Approval - 1 Lot The Secretary stated that the applicant has reviewed the proposed conditions of approval and has expressed satisfaction of same. IV. DESIGN REVIEW A. A-273 - Franklin Homes Company, Fourth Street and. Saratoga Creek - Preliminary Design Review - Apartment Complex - Continued from 11 March 1968 The Secretary recon~mended, on the basis of the procedure followed relative to SDR-732, that this.matter be continued. Chairman Norton so directed. B. A-274 - St. Archangel Michael (Serbian Orthodox Church), Allendale Avenue - Final Design Review - Residence and Classroom Buildin~ The Secretary re~d the Staff Report of 25 March 1968 recommending that Final Design Review be granted ~for A-274. Chairman Norton directed that the report should be amended as follows: In the title. ."Parish Residence". .should be deleted. Paragraph 2. . .line 3. ."on Exhibit "A" for the residence". . .should. be deleted. Paragraph 2. .line 5. . ."and subject to the following condition". . . should be deleted. The following be left in the Staff Report as a Note. . "NOTE: Maximum seating capacity of new sanctuary shall be 150 seats." Chairman Norton so directed. D. A-277'.- S. L. Tyler and G. S. Kocher, Fourth Street - ~eliminary Design Review- Commercial Buildings ... The Secretary stated that since the development as presently designed encroaches into the creek channel and, therefore, the situation requires substantial revision on the site development plans. He then reco~ended that A-277 be continued. . .';. Chairman Norton so directed. E. A-278 - Ann Valk, Big Basin Way - Preliminary Design Reivew - Commercial BuildinSs The Secretary recommended that this matter be continued to the next regular meeting to allow the Design Review Committee time z~0~st~dyythef.~l~ns'.iS~bmitted by the applicant and her. architect. Chairman Norton so directed. V. CITY COUNCIL REPORT Chairman Norton gave a summary on items reviewed and action taken at the City Council meeting of 20 March 1968. He then advised that the City Council returned the General Plan Committee Report (stating the recommendations made by the Committee relative to the General Plan Report submitted by Livingston and Blayney, Planning Consultants) to the Planning Commission for clarification on some items. Commissioner Johnson stated that the General Plan Committee would meet on Saturday:. morning, 30 March 1968, to discuss the subject report and prepare the clarifications requested by the City Council. VI. OLD BUSINESS A. B. T, GALEB, Saratoga-Sunnyvale Road - Request for Con~ideration~of Apartments - Report of Subdivision Committee Con~missioner Smith stated that the Subdivision Committee met with the applicant and explained to him that 1). the policy of the Planning Commission is to move slowly to approve any more apartment zoning until it becomes apparent how the property already approved for apartments will develop 2) this is the policy of the City Council as well as that of Livingston and Blayney, Planning Consultants 3) it might be well to withhold any formal application for Change of Zoning until after the General Plan is approved or.until after some of the existing Multi-Resi- dential Zoning is developed or the zoning expires and 4) he might appear before the full City Council and present a petition stating his request. Chairman Norton stated that he understood Mr. Galeb and his neighbors were not interested in a mobile home park for this area as he suggested at the last meet-': ing. ~. Galeb advised that he felt his request is a reasonable one and the neighbor- hood is in favor of upgrading this area with the proposed apartment zoning. CAPITAL IMPROVEMENTS The Secretary explained that a draft of the Capital Improvement Program has been submitted to the General Plan Committee and the City Council and is ready to be discussed at the meeting of the General Plan Committee on 30 M, nrch 1968. Commissioner Johnson pointed out that no mention of Parks is made in the the subject report. The Secretary explained that Parks are included but not specifically mentioned since they will come up under a Bond Issue; therefore, will not necessarily come out of Capital Improvement Funds. VII.
