ROb~iNE ORGANIZATION The meeting was called to order by Vice-Chairnmn johnson. A. ROLL CALL Present: Con~issioners Crisp, Johnson, ~sner, Lively, and Metcalf. Absent: Conm~issioners Norton and Smith. ~I~iUT~c Contmissioner Crisp moved, ·seconded by Co~aissioner ~sner, that the reading of ~_~ minutes of the 22 AD~{] 1968 meeting be waived and tha~ they be approved as distributed to the Commission; motion carried unani- mously. II. PUBLIC HEARINGS A. C-Ill - Wayne F. Pendergraft, Ca!abazas Creek and Foothill lane - Request for Change of Zoning from "R-!-40~000" (Single Family Residential) to "R-!-20,000" (Single Fa~iiy Residential) - Continued from 22 April 1968 The hearing relative to C-ill was re-opened at 7:33 P.M. The Secretary explained that the City Attorney has reviewed this application. Ehe applicant and his attorney were present and inquired if the City Attorney indicated any legal complications existed relative to C-Ill. The Secretary answered that according to the City Attorney there were no !~ga.! complications; therefore, the Planning Com~ission will determine if the Change of Zoning can or cannot be granted. He further stated that the Subdivision Co~nittee and Staff are not prepared to make a recommendation at this time and suggest that the matter be continued to the next regular meeting. Commissioner Crisp stated that a report relative to the m~tter will be ready by the 27 ~y 1968 meeting. Conn~issioner johnson (7:35 P.M.) closed the hearing, relative to C-i!i, for the evening, referred the matter to the Subdivision Committee and ~directed same continued to the ne~:t reEn!ar meeting. B. UP-i48 - West Valley United Church of Christ - Congregational Church, Quito Road - Request 'for 'Use Permit for Church Facilities - Continued from 22 April 1968 The Chairman re-opened the hearing relative to ~-148 at 7:36 P.M. Warren Heid, architect, requested 'that consideration be given o:~ to detern:ine if a church would be an appropriate use on this g~ite and t~.~ 'the normal' steps taken for consideration of a Use' Permit be followed. Reverend Donald F. B!anchette, ~-.linister of the West Valley United Church of Christ, advised that the facts stated in the letter submitted by Mr. Campbell were all twisted. ~,ir. Le Roy Broun, 18584 Vessing Road, read and submitted a petition with sixty-signatures, filed in protest, to the proposed Use Permit. Captain Donald McKenzie, 18680 Vessing Road, stated that the roads . in the area sb. ould be kept free at all times for fire trucks and ambulances and this would not be possible if the subject Use Permit were granted. i~-s. Blanchette, wife of Reverend B!anchette, stated that the young people from the church conducted a survey of the area and found the people to be five to one in favor of the church. ~'~f. Simone, Old Adobe Way, stated there are some Saratogans interested in this church and he was one of them. The Secretary read the Staff Report dated 13 M~y 1968 recommending that UP-i48 be denied. At 8:00 P.M. Con~m-issioner Crisp moved, seconded by Commissioner Kasner, to close the public hearing relative to UP-148; motion carried unanimously. Co...~:~issioner Crisp moved, seconded by Commissioner Metcalf, that the Staff Report of 13 !~y lo6~ relative to UP-148, be adopted and the Use Permit be denied since the findings necessary under Section 16.6 of Zoning Ordi- nance NS-3 cannot be made for the reasons set forth in said report; motion carried with Commissioner r~sner abstaining. Com-n~issioner Kasner reco:mn~ended that the communication submitted by ~_~. Campbell not be included as part of the evidence considered by the Planning Comnission in making their recomz.~endation relative to this application. Chairman johnson so directed. C. S.i.'zALL PET ORDINANCE - Proposed J.n~endment to Ordinance No. NS-3 Relating ° to the Keeping of Certain Birds and Small ?Y.-~mma!s as Pets in "R" Districts - Continued from 8 April 1968 The public hearing was opened. at 8:03 PoM. i~~. C. SIqALL PET ORDiN.."ti,,~CE - CO2'i'TIN'O'ED Con~issioner Kasner advised that the proposed ordinance will stipulate regulations relative to sanitation, nuisance, and confinement of animals. Mrs. Rdth O.:.:en stated that she believed that an ordinance, such as the one proposed, would be difficult to enforce. Con,~issioner Kasner explained that if a nuisance does develop and a complaint is registered nhe ordinance will give· the City the authority to abate same. Captain McKenzie stated that he felt that requiring people to confine their animals might: forc.e.._~.l~.em to construct unsightly fences. Co~n~issioner r~sner explained the animal could be tethered or fenced but in no case should non-animal ox,~aers or animal ovmers who keep their o~,m. pets confined tolerate the use of their yard by stray or unconfined animals belonging to someone else. He then recon~mended that this n~tter be continued until more appropriate language, relative to control of Small Pets can be ~,Ti~en into the proposed ordinance Con~n~issioner johngon (8:10 P.M.) closed the hearing for the evening and referred the Small Pet Ordinance to the General Plan Comamittee and directed same continued to the next regular meeting on 27 M~y 1968. D. C-I!2 - Peter Paulsen, Saratoga Avenue - Request for Change of Zoning from ':R-l-!0-,000" (Single Family Residential) to. "R-M-3,000" l~iulti-Fami!y Residential) Chairman johnson opened the public hearing relative to C-ll2 at 8:11 P.M. The Secretary stated the NOtices of Hearing were mailed and published. He then read comznunications received from 1) Fred W. DeKlotz, jr., applicants attorney, explaining how the property will be utilized 2) ~s. Carl Lervils, 12490 Radoyka Drive, listing her objections to the proposed application and stating that the exhibits submitted by the applicant gave the appearance of army barracks and 3) Frank L. and Gleneva L. BachF~n, 12480 Radoyka Drive, stating their opposition to the proposed change of Zoning. M~. De1! Hathaway, 12511 Saratoga Avenue, stated 1) he lived two doors from the proposed development 2) Saratoga Avenue has become a freeway because of construction and if this development goes. in the traffic will increase even more 3) the cars will be parking on Saratoga Avenue and this will add to the congestion and 4) the increased traffic will cause numerous accidents. }~ '~o~' Fabian President Saratoga Park Woods Homeox,r~ers Association, stated the residents in the area feel that the proposed development is neither necessary nor desirable and are strongly opposed to same. ~-~ L~e ienhart, 12638 Radoyka Drive, stated that i) the apartment units would be in his back yard 2) he is in the Real Estate business and recently sold some 'property in that area for $43,500 3) his o~ home has been appraised for $45,000. but if the subject development is permitted the value of his home will decrease 4) the West Valley junior College will produce additional traffic on Saratoga Avenue 5) a re'Cirement facility should not be placed in an area where there is a lot of noisy traffic·· and 6) if the proposed units were not completely occupied by older people then arrangements will have to be made to rent to tenants other than the one preferred. ~-. Gray, 12562 Radoyka Drive~ stated !) he was opposed to the proposed development and 2) he did not received a Notice of Hearing relative to C-!!'2 and his home is located directly behind the subject property. ~'. Cliff Harris, 12600 Radoyka Drive, stated that he moved to Saratoga because of the rural atmosphere 2) now he can see this country coxr~munity growing into a high density area and 3) the residents of this area do not want apartment houses right in their back yards. M~. Albert Wilson, 12500 Joiene Court, stated he was opposed to the change of zoning. ?k~s. David J. Spoon, 12637 Radoyka Drive, stated that she and her husband were opposed to the subject proposal since they do not feel that apartments would be an attractive addition for this area. M~. Jones, Radoyka Drive, Stat~ he agreed with all the objections raised relative to the apartment development. ~. David Young, 18987 Mellon Drive, stated that 1) most retirement com~unities require ~!kways to shopping centers and since there are no pathways in this area the .tenants.'. would create additional traffic by using their cars and 2) a retirement community required recreationa~ areas and ~ven though the plan submitted calls for a putting green there are no parks. M~. Ray A. Heum~n, 18925 Mellon Drive, expressed concern about the high volume of traffic on Saratoga Avenue and the increase hazard created by such a high density development. ~ Pau'isen apD!icant stated that i) he constructed ({'n Illinois) apartments similar to the one proposed '2) this is a retirement facility for partially retired people 3) the facility would accomodate couples no longer in need of their large homes 4) Saratoga residents have indicated they would be interested in such a development 5) the plans submitted can be changed if necessary 6) Warren Heid (architect consulted by ~. Paulsen) suggested that fewer units be proposed ~..i to allow for more open space. M~. H. K. Schoka!, 12470 Radoyka Drive, stated that 1) he and his wife were opposed to the subject application and 2) his biggest concern is that if this is approved by the Planning Commission it will open the door for other projects of this nature. ^~ 39 PoM. Chairman .Johnson closed the hearing relative to C-!12 for the evening, referred same to the Subdivision Committee for study and directed the matter continued to the next regular meeting. Con~nissioner Crisp advised the applicant that the Subdivision Com~ittee will meet at 3:00 PoM. on Monday, 20 May 1968, ~t which time they will discuss this application and any further infornmtion the applicant may wish to submit. He further stated that anyone else interested in ~ttending the meeting could do so. E. V-317 - Dr. john Oliver, Saratoga.-Sunnyvale Road - Request for Variance in Connection With Side Yard Setback Requirements ~a ...... opened the hearing relative to V-317 at 8:40 P.M. The Secretary stated the Notices of Hearing were n~iled and then read communications received from ~% }.~. Ronald K. V-3!7 - Continued }~. Gordon Night, Green Meadow Lane, stated that he was opposed to the subject application. Mr. Allen De Grange, architect, stated that 1) only 1,000 square feet of the 6,000 square feet available would be used to keep animals 2) this property is adjacent to a railroad and it is difficult tO utilize any property next to a railroad track 3) the applicants objective is to put in parking and attractive landscaping 4) with this utilization of the land the applicant (Dr. Oliver) can put more money into the building and in that way produce a better looking deve!op~ent. Co~m~issioner Crisp, on behalf of the Variance Committee, arranged an appointment with Mr.. De Grange (architect) for an on-site inspection for 9:00 A.M., Saturday, 18 May 1968. After discussion, Chairman Johnson (8:50 P.M.) closed the hearing for the 'evening',. referred V-317 to the Variance Committee and directed same continued to the'next regular meeting. F. I~-149 - James Day, Saratoga A~ue --.Request for Use Permit to Allow a Model Home Sales Office The hearing relative to UP-149 x~as opened at 8:51 P.M. The Secretary stated that the Notices of Hearing were mailed and briefly reviewed this file. No one in the audience wished to comment. The Secretary read the Staff Report dated 13 }~y recommending that the requested ~Use. Permit be granted. At 8:53 P.M., Commissioner Crisp moved, seconded by Commissioner Lively, to close the hearing for UP-t49; motion carried unanimously. It ~ms moved by Con~missioner Crisp, seconded by Commissioner Lively, that the Staff Report of 13 May 1968,'reiative to U~_-149, be adopted and the Use Permit be granted in accordance with said report and subject to the conditions stated therein; motion carried unanimously. III. BUILDING SITES AND SUBDIVISIONS A. SDR-732 - Franklin Homes Company, Fourth Street and Saratoga Creek - ..... Building Site Approval - 1 Lot - Continued from 22 April 1968 Comm~issioner Crisp explained that the .applicant has submitted a letter granting the Planning Commission a further extension of time and therefore it is recomnended that SDR-732 be continued to the next regular meeting. Chairman Johnson so directed. B. SDR-740 - So L. Tyler and G. S. Kocher, Fourth Street - Building Site Approval - 1 Lot - Continued from 22 April 1968 Co~nissioner Crisp recommended that SDR-740 be continued since the appli- cant is still working out problems relative to this site with the Flood Control Department. SD-746 - Dr. Michael L. Stepovich, Sobey Road - Subdivision Approval - 21 Lots - Continued from 22 April 1968 Com~issioner Crisp reconunended, at the request of the applicant, that SDR-744 and SD-746 be continued to the next regular meeting to await a report from the engineer on location of trees and related road improve- ments. He then stated that a letter of extension was submitted by the applicant for SD-746 and it is necessary for F~. Kirkham (applicant ~or SDR-744) to, also, submit a letter of extension. Co~nissioner Crisp moved, seconded by Commissioner Lively, that the Building Site Committee Report of 13 May 1968 relative to SDR-747 be adopted and that the tentative map (Exhibit "A", filed 29 April 1968) be approved subject to the conditions set forth in said report; motion carried unanimously. F. SDR-748 - Tomer H. Pierce~ Loma Rio - Building Site Approval t Lot The Secretary stated that the applicant has reviewed the proposed conditions of approval and expressed satisfaction of same. Commissioner Crisp moved, seconded by Commissioner Lively, that the Building Site Committee Report of 13 ~y 1968 relative to SDR-748 be adopted and that the tentative map (Exhibit "A", filed 1 May 1968) be approved subject to the conditions set forth in said report; motion carried unanimously. G. SDR-749 - Mission Trail Builders, Elva Avenue - Building Site Approval - 1 Lot The applicant was present and expressed satisfaction with the proposed conditions of approval. Commissioner Crisp moved, seconded by Commissioner Lively, that the Building Site 'Comnittee Report of 13 M~y 1968 relative to SDR-749 be adopted and that the tentative map (Exhibit "A", filed 3 May 1968) be approved subject to t'he conditions set forth in said report; motion carried unanimously. IV. DESIGN REVIEW A2281 - Dr. john Oliver Saratoga-Sunnyvale Road - Preliminary Design Review - Pet Clinic Co~n~issioner Kasner recommended (since this application is contingent on the Variance application (V-317)) that A-281 be continued to the next regular meeting. Bonfig!io, Assistant Planner, read the Staff Report of 13 ~x~y 1968 recommending that Final Design Review be granted for A-283. Con-~issioner Kasner moved, seconded by Commissioner Metcalf, to adopt the Staff Report of 13 May 1968 recom,nending that Final Design Apprgval be granted A-283 as sho'~ on Exhibit "A~' and subject to the condition· stated in said report; motion carried unanimously. C. A-284 - Gerald Guriey, Prospect Road - Final Design Review - Identification " Si:.%n i~'o Bonfig!io, at the request of Conm~issioner Kasner i) . read the Staff Report reco~aending that Final Design Approval·be grante·d for A-284 and 2) recom-,7~ended that the following conditions be added to the subject Staff Report dated 13 ~y 1968: Letters ~:nd numbers not to exceed m~ximum al!o~..,~b!e size of eighteen-inches (i8~) as required by Section i0.2g of Zoning Ordinance NS-3." Comnissioner Kasner·, advised that !) the applicant could not be present at this meeting 2) the sign stating the price can be considered a separate sign 3) the difference in color of the upper and lower sign is for· ·~!~e ·pur- pose of attracting the prospective customers attention and 4) the applicant has indicated that this is an impulse business. Co.~.~.issioner Metcalf stated tha~ 1) these are in fact two integrated signs 2) he finds the two (2) color combination objectionable and 3) one color for both signs would be in better taste. The S~:cretary, in answer to an inquiry from Conmissioner Crisp, stated that Shaxc"'s Candy· and Big Tree Shopping Center have City approved signs with contrasting colors. Comm~.issioner Crisp stated that i) the Variance Corm~ittee considered this as an integrated sign and 2) signs of tills type, with two separate colors, have been approved previously. Planninf~ Commission Minutes - 13 ~y 1968 - Continued V. CI]~~ COL~CIL REPORT The Secretary gave a brief s~n~mary of items reviewed by. the City Council at the.meeting of 1 ~y 1968. He pointed out that adoption of the General Plan by the City Council was the highlight of that meeting. V!. OLD BUSINESS ' A. UP-136 - B. T. Galeb, Saratoga-Sunnyvale Road - Request for Extension for Kin~ Dodo Theater - Continued from 22 April 1968 The Secretary read the Staff Report recormnending that the request for extension be granted for one (1) year subject to the same conditions stated in the Staff Report (in file UP-136) dated 27 November 1967. Commissioner Crisp moved, seconded by Commissioner Metcalf, to adopt the Staff Report of 13 5~y 1968 recom~ending that an extension of one (1) year be granted subject to the conditions stated in the Staff Report relative to UP-136 dated 27 November..1967; motion carried unanimously. B. VISITOR CO~.'~RC~kL - Set Hearing for Proposed Ordinance Commissioner Crisp.stated that 1)~ the Subdivision Committee discussed the proposed Ordinance 2) the Ordinance, as now propoSed~ will"be avail- able for Planning Commission considerati6n by the meeting of 27 t.~y 1968 and 3) it will not be possible tO hold a public hearing prior to 10 june 1968 since there will not be sufficient time to publish a Notice of Hearing. After discussion, commissioner Johnson directed the matter continued to the next regular meeting and referred same to the Subdivision Co-mmittee for further study. C. SD-607 - Douglas P. Hines, Pierce Road '- Expiration of Time'Limi[ f0'r., Plannin~ Commission Action The Secretary explained that i) this matter was continued to allow time for the applicant to resolve sanitation problems due to septic tanks and percolation tests 2) he has not been able to resolve these oroblems; therefore, he has submitted a letter granting the Planning Commission a si~ (6) month extension and 3) the Planning Cormnission can either accept the e:<tension or take'some other form of action. Co..~anissioner Crisp explained that 1) the property is such that sliding can occur 2) the Health Department has been hesitent to grant approval for septic tanks 3) the City Public Works Department has not received sufficient assurance that this is a safe and stable site; therefore they have not approved the site since the City could be Subject to suit if anything happened and 4) the Subdivision Committee recommends that SD-607 be denied without prejudice. Commissioner Crisp moved, seconded by ConLmissioner Lively, to deny, without prejudice, the Building Site for Douglas P'~ Hines, SD-607; motion carried unanimously. VII. NEW BUSINESS SDR-662 - Guist and Beam~ Belnap W~y - Request for Extension The Secretary advised that the applicant submitted a letter requesting a one (1) year extension. Commissioner Crisp moved, seconded by Con~issioner Lively, to grant an extension of (1) year from the present. expiration date in connection with SDR-662; motion carried unanimously. -8- Planning Con~niss~on Minutes - 13 MaX 1968' Continued VII. OLD BA~'K OF .z~MERiCA BUILDING Conm~issioner Crisp stated that t) in the window of the old Bank of America Building there is a Notice of application for Alcoholic Beverage License 2) l the parking is not adequate for a restaurant at this location. 3) a restaurant does not seem like an appropriate use for this building since it could not accommodate more than twenty-five (25) people at the most and 4) a letter should be sent to Alcoholic Beverage Co~ission informing them taat this building is not suitable for this use. The Secretary, in answer to an inquiry from Com~issioner Lively, advised that a restaurant is a permitted use at this location. Commissioner Metcalf stated that all the facts relative to parking should be obtained and considered before any decision is made'. Commissioner Crisp recomnended that'a letter be submitted to the Alcoholic Beverage Con~ission urging them to hold up the liquor license until this matter can be studied further. The S~cretary, in answer to an inquiry from Co~issioner Johnson, stated that the number of parking spaces that would be allotted to the subject establish- ment could be ascertained at the time the plans for Design Review are submitted· to the City for consideration. Commissioner Kasner pointed out that the Design Review C0~ittee would thoroughly check the plans for sufficient parking. Commissioner Kasner, in answer to an inquiry from Co~issioner Crisp, stated that a restaurant could be located in this building since the proposed use is permitted by the City Zoning Ordinance in C-C (Community Co~erciai) areas. Co~issioner Metcalf stated that the City ·should express an opinion relative to this matter or request a delay from the Alcoholic Beverage/COmmisSion in issuing their liquor license. The Secretary advised that the Alcoholic Beverage Co~ission called·· the , Planning Department Staff to inquire if this is a permitted use at the subject location. Co~issioner Johnson advised that, he felt, the City Council should forward a letter Eo the Alcoholic Beverage Commission rather than the Planning Co~ission. He then directed the' Secretary to bring this ~tter to the aEtention of the City Council at their meeting of 15 ~y 1968. VIII. CO~'R.'!D~!CATiONS A. ~iTTEN B. T. GALEB -AP~R~S The Secretary read a letter received from M~. Cole Bridges, President of the Saratoga Chamber 'of ConLn~erce, supporting the proposal made by ~. B. T. ~ieb for garden apartments for his property located along the railroad tracks directly behind the 'Azule Mall Shops. B. O~.L VISITOR CO~RC~.L ~. Clarence Neale inquired how the Visitor Commercial Ordinance will be enacted and if those who have already paid a fee will be required to pay another·? The Secretary e>zp!ained that the applicant is responsible for submitting a complete and accurate list of names due to receive notices. Ottenberg, League of Women Voters, stated that i) when the Planning Coma~ission granted sign approval for the Cable Car Burger Pit it ~.,:as specified that all the banners and flags were to be removed and 2) they have not been removed and are .still in front of the building. The Secretary explained that the Cable Car is in violation of the Zoning Ordinance and! the Planning Department is taking the proper steps to eliminate this violation. Com2nissioner Kasner stated that !) the people in that area do not seem too concerned with 'the City Zoning Ordinance 2) it should be made clear to them that the City fully intends to enforce the Ordinance and 3) ,%he o~,mer of the property (~.
