Mrs. R~kth Owen stated that she believed that an ordinance, such as the one p~o~osed. would be difficult to enforce. Conm~issioner Kasner e~:pla.ined th~jt' if"a' nuisance does develop and a complaint is registered the ordinance will give the City the 'authority to abate same. Captain McKenzie stated that he felt that requiring people to confine their animals might force .them to construct unsightly fences. "R-M-3,000" (Mu!ti-Fami~y Residential) Chair~an Johnson opened the public hearing relative to C-112 at 8:11 P.M. The Secretary stated the iq'otices of 'Hearing were nmi!ed and published. He then read co~mnications received from !) Fred W. DeKlotz, jr., applicants attorney, e:<p!aining.how the property will be utilized 2) !~s. Carl Lervils, 12490 Radoyka Drive, listing her objections to the proposed application and seating that the ez<hibits submitted by the applicant gave the appearance of army barracks and 3) Frank L. and Gleneva L. Bachm~n, 12480 Radoyka Drive, stating their opposition to the proposed change of zoning. %'.~. Dell Hathaway, 12511 Saratoga Avenue, stated 1) he lived two doors from the 'proposed development 2) Saratoga Avenue has become a freeway because of construction and if this development goes. in. the traffic will increase even more 3) the cars will be parking on Saratoga Avenue and this wii! add to the congestion and 4) the increased traffic will cause numerous accidents. ~.'~. Rod '~a~an President Saratoga Park. Woods Homeo~mers Association. stated the residents in the area feel that the proposed development is neither necessary nor desirable and are strongly opposed to same. ~ ~,~. Lee Lenhart, 12638 Radoyka Drive, stated that 1) the apartment units would be in his 'back yard 9~ he is in the Rea~ Estate business and recently sold some property in that area ~or S/'q 500 3) his owe home has been appraised ~o~ ~45 0~'~0 but if the subject deve!o~ment is ~ermitted the value of his home will decrease 4) the West Valley junior College will produce additional traffic on Saratoga Avenue 5) a retirement facility should not be placed in an area where there is a lot of noisy traffic. and 6) "if the proposed units were not co~np!eteiy occupied by older people then arrangements will have to be made to rent to tenants other than the one preferred. ~?'x. Frank Raymond, 12508 Radoyka Drive, stated that traffic will be bad since cars will have to cut over two ianas of traff-id.-in order to enter the proposed development. -3- P!annin~ Corn_mission Minutes - 13 May 1968 - Continued ii. Gray, 12562 Radoyka Drive, stated 1) he was opposed to the proposed development and 2) he did not received a Notice of Hearing relatiQe to C-1!2 and his home is located directly behind the subject property. Mr. Cliff Harris, 12600 Radoyka Drive, stated that he moved to Saratoga because of the rural atmosphere 2) now he can see this country community growing into a high density area and 3) the residents of this area do not want apartment houses right in their back yards. ~-. ~= Albert Wilson, 12500 Jolene Court, stated he was opposed to the change of zoning.--.~ ~.~s. David J. Spoon, 12637 Radoyka Drive, stated that she and her husband were opposed to the subject proposal since they do not feel that apartments would be an attractive addition for this area. }~. Jones, Radoyka Drive, stat~ he agreed with all the objections raised relative to the apartment development. ~. David Young~ 18987 Mellon Drive, stated that 1) most retirement communities require walkways to shoDDinS centers and since there are no pathways in this area the··tenants.i would create additional traffic by using their cars and 2) a retirement community required recreational areas and even though the plan submitted calls for a putting green there are no parks. ~. Ray A. Heuman, 18925 Mellon Drive, expressed concern about the high volume of traffic on Saratoga Avenue and the increase hazard created by such a high density development. Mr. Paulsen applicant stated that 1) he constructed (in illinois)·apartments similar to the one proposed 2) this is a retirement facility for partially retired people 3) the facility would accomodate couples no longer in need of their large homes 4) Saratoga residents have indicated they would be interested in such a development 5) the plans submitted can be changed if necessary 6) Warren Heid (architect consulted by ~. Paulsen) suggested that fewer units be proposed ~·! to allow for more open space. -~. H. K. Schokal, 12470 Radoyka Drive, stated that·l) he and his wife were opposed to the subject application and 2) his biggest concern is that if this is approved by the Planning Commission it will open the door.for other projects of this nature. At 8:39 PoM. Chairman Johnson closed the hearing relative to C-!12 for the evening, referred same to the Subdivision Committee for study and directed the n~tter continued to the next regular meeting. Cox~issioner Crisp advised the applicant that the Subdivision Con~nittee will meet at 3:00 PoM. on Monday, 20 May 1968, ~t which time they will discuss this application and any further information the applicant may wish to submit. He further stated that anyone else interested in attending the meeting could do so. E. V-317 - Dr. john Oliver, Saratoga-Sunnyvale Road - Request for Variance in Connection With Side Yard Setback Requirements The Chairman opened the hearing relative to V-317 at 8:40 P.M. The Secretary stated the Notices of Hearing were mailed and then read communications received from 1) ~. Rona!d K. Lindsay, Calson Properties and 2).·~. Roy M. Welch, 20432 Seagull I~y, both filed in opposition to the proposed Variance. -4- Planning Commission Minutes - !3 ~y 1968'- Continued II. E. V-317 - Continued M~. Gordon Night, Green Meadow Lane, stated that he was Opposed to the subject application. . ..Mr. Allen De Grange, architect, stat'ed that 1) only 1,000 square feet of the 6,000 square feet' available would be used to keep anim~ts 2) this property is adjacent to a railroad and it is difficult to utilize any property 'next to a railroad track 3) the applicants objective is to put in parking and attractive landscaping 4) with this .'.. utilization of the land the applicant (Dr. Oliver) can put more money into the building and in that ~y produce a better looking development. Co~m~issioner Crisp, on behalf of the Variance Committee,-arranged an appointment with Mr.' De Grange (architect) for an on-site inspection for 9:00 A.M., Saturday, 18 M~y 1968. After discussion, C'hairman Johnson (8:50 P.M.) closed the hearing for the 'evening','.'. referred V-317 to the Variance Committee and directed same continued to theznext regular meeting. F..L~-!49 - James Day, Saratoga Avenue - Request for Use Permit to Allow a Model Home Sales Office '.. The hearing relative to UP-149 was opened at 8:51 P.M. The Secretary stated that the Notices of Hearing were mailed and briefly reviewed \ this file. No one in the audience wished to comment. The Secretary read the Staff Report dated 13 May recommending that the requested :Use Permit be granted. At 8:53 P.M., Commissioner Crisp moved, seconded by Commissioner Lively, to close the hearing for UP-149; motion carried unanimously. it ~s moved by Comnissioner Crisp, seconded by Commissioner Lively, that the Staff Report of 13 ~y 1968, relative to UP-149, be'adopted and the Use Permit be ,gf~'[~g-"in accordance with said ~eport and subject to the conditions state~' therein; motion carried unanimously. III. BUILDING SITES AND SUBDIVISIONS ~. SDR-732 - Franklin Homes Company, Fourth Street and Saratoga Creek - Buildin~ Site Approval - 1 Lot - Continued from 22 April 1968 ConLn~issioner Crisp explained that the applicant has submitted a letter granting the Planning Commission a further extension of time and therefore it is recommended that SDR-732 be continued to the next regular meeting. Chair~n Johnson so directed. B. SDR-740 - So L. Tyler and G. S. Kocher, Fourth Street - Building Site Approval - 1 Lot - Continued from 22 April 1968 Commissioner Crisp recommend.ed that SDR-740 be continued since the appli- cant is still working out problems relative to this site with the Flood Control Department. Stepovich, Sobey Road - Subdivision Approval - 211,ots - Continued from 22 April 1968 Corcm~issioner Crisp reconunended, at the request of the applicant, that SDR-744 and SD-746 be continued to the next regular meeting to await a report from the engineer on location of trees and related road improve- ments. He then stated that a letter of extension was submitted by the applicant for SD-746 and it is necessary for Mr. Kirkham (applicant for SDR-744) to, also, submit a letter of extension. Comnissioner Johnson directed SDR-744 and SD-746 continued with the continuance for SDR-744 subject to receipt of a letter of extension from the applicant. E. SDR-747 - George W. Day. Via Monte Drive - Building Site Approval - ! Lot The Secretary stated the applicant had reviewed the proposed conditions " of approval and had expressed satisfaction of same. Commissioner Crisp moved, seconded by Commissioner Lively, that the Building Site Committee Report of 13 ~y 1968 relative to SDR-747 be adopted·-·~n'd---that the tentative map (Exhibit "A", filed 29 April 1968) be~'~Droved subject to the conditions ·set forth in said 'report; motion ( . car.r~e°d' unanimously. F. SDR-748 - Tomer H. Pierce, Loma Rio - BuildinS Site Approval 1 Lot The Secretary stated that the applicant has reviewed·the proposed conditions of approval and expressed satisfaction of same. Commissioner Crisp moved, seconded by' Commissioner Livei·y,·'that the Building Site Committee Report of 13 I~y 1968 relative to SDR-748 be adopted··and that the tentative map (Exhibit "A", filed 1 }~y 1968) be approved subject\··to the conditions set forth in s~id report; motion carried unanimously... ·· \ G. SDR-749 - Mission Trail Builders, Elva Avenue - Building Site Approval - 1 Lot The applicant was present and expressed satisfaction with the proposed conditions of approval. Commissioner Crisp moved, seconded by Commissioner Lively, that the Building Site Committee Report of 13 F~y 1968 relative to SDR-749 be adopted and that the tentative map (Exhibit "A", filed 3 May 1968) be approved subject to the conditions set forth in said report; motion carried unanimously. iV. DESIGN REVIEW A. A-281 - Dr. john Oliver, Saratoga-Sunnyvale Road - Preliminary Design Review - Pet Clinic Co~nissioner Kasner recommended (since this application is contingent on the Variance application (V-317)) that A-281 be continued to the next regular meeting. A-283 - Corinthian Studios, Saratoga-Los Gatos Road - Final Design Review - Remo~leling Front Facade of Commercial Buildin~ Com~.nissioner Kasner requested the Assistant Planner to read the Staff Report relative to this application. ?k-. Bonfi~qiio, Assistant Planner, read the Staff Report of 13 %~y 1968 recommending that Final Design Review be granted for A-283. Con¥~issioner Kasner moved, seconded by Con-~iissioner Metcalf, to adopt the S'caff Report of 13 May 1968 recom~mending that Final Design Approval be granted A-2S3 as show~ on E:<hibit "A" and subject to the condition stated in said reoort; motion carried unanimously. C. A-284 - Gerald Gurley, Prospect Road - Final Design Review - Identification Sign ~,.~. Bonfig!io, at the request of Commissioner Kasner i) read the Staff Report recom~,ending that Final Design Approval be granted for A-284 and 2) recon~ended that the 'following conditions be added to the subject Staff Report dated i3 lz~y 1968: Letters and numbers not to e>:ceed maximum al!o~mb!e si'ze of eighteen-inches (18") as required by Section iO.2g of Zoning Ordinance NS-3." Comanissioner l~.sner, advised that !) the applicant could not be present at this meeting 2) the sign stat'inc the price can be considered a separate .sign 3) the difference in color of the upper and lower sign is for the pur- · pose of aztracting the prospective customers attention and 4) the applicant has indicated that this is an impulse business. Commissioner Metcalf 'stated that I) these are in fact two integrated signs. 2) he finds the two (2) color combination objectionable and 3) one color for both signs would be in better taste. The Secretary, in answer to an inquiry from Commissioner Crisp, stated that Shawls Candy" and Big Tree Shopping Center have City approved signs with contrasting colors. Commissioner Crisp stated that 1) the Variance Co~ittee considered this as an integrated sign and 2) signs of ti-~ type, with two separate colors, have been approved previously. CITY COL~CIL REPORT The Secretary gave a brief summary of items reviewed by. the City Council at the meeting of ! ~y 1968. He pointed out that adoption of the General Plan by the City Council was the highlight of that meeting. Vto OLD BUSINESS A. U'P-136 - B. T. Caleb, Saratoga~Sunnyvate Road - Request for Extension for King Dodo Theater - Continued from 22 April 1968 The Secretary read the Staff Report recommending that the request for extension be granted for one (!) year subject to the same conditions stated in the Staff Report (in file UP-136) dated 27 November 1967. Commissioner Crisp moved, seconded by Commissioner Metcalf, to adopt the Staff Report of 13 ~y 1968 recom~aending that an extension of one (1) year be granted subject to the conditions stated in the Staff Report relative to UP-136 dated 27 November 1967; motion carried unanimously. B. VISITOR COI~.'~RC!AL - Set Hearing for Proposed Ordinance Commissioner Crisp.stated that 1) the Subdivision Committee discussed the proposed Ordinance 2) the Ordinance, as now proposed, will be avail- able for Planning Commission e0nsideration by the meeting of 27 ~y 1968 and 3) it will not be possible to hold a public hearing prior to 10 june 1968 since there will not be sufficient time to publish a Notice of Hearing. After discussion, C'om~issioner Johnson directed the matter continued to the next regular meeting and referred same to the Subdivision Committee for further study. C. SD-607 - Douglas P. Hines, Pierce Road - Expiration of Time Limit for Plannin~ Commission Action The Secretary explained that.l) this ,.matter x~s continued to allow time for the applicant to resolve sanitation problems due to septic tanks and percolation tests 2) he has not been able to resolve these problems; therefore, he has submitted a letter granting the Planning Coma~ission a six (6) month extension and 3) the Planning Commission can either accept the extension or take some other form of action. Commissioner Crisp explained that 1) the property is such that sliding can occur 2) the Health Department has been hesitent to grant approval for septic tanks 3.) the City Public Works Department has not received sufficient assurance that this is a safe and stable site; therefore they have not approved the site since the City could be Subject to suit if anything happened and 4) the Subdivision Committee recomraends that SD-607 be denied without prejudice. Co~m~issioner Crisp moved, seconded by Commissioner Lively, to deny, without prejudice, the Building Site for Douglas P'~ Hines, SD-607; motion carried unanimously. VII. NEW Bi~SINESS SDR-662 - Guist and Beam. Belnap Way - Request for Extension The Secretary advised that the applicant submitted a letter requesting a one (i) year extension. Commissioner Crisp moved, seconded by Comm~issioner Lively, to grant an eztension of (I) year from the present expiration date in connection with SDR-662; motion carried unanimously. -8- Planning Con~ission Minutes - 13 May 1968 - Continued , '... VII. OLD BAk]< OF ~ERICA BUILDING Commissioner Crisp stated that I) in the window of the old Bank of Araerica Building there is a Notice of application for Alcoholic BeveraKe License 2) 'the parking is not adequate for a restaurant at this location. 3) a restaurant does not seem like an appropriate use for this building sinne could not accommodate more than twenty-five (25) people at the most afnd .4) a letter should be sent to Alcoholic Beverage Commission informing them that this building is not suitable for this use. The Secretary, in answer to an inquiry from Con~missioner Lively, advised that a restaurant is a permitted use at this location. Commissioner Metcalf stated that all the facts relative to parking should be obtained and considered before any decision is made'. Commissioner Crisp recommended that a letter be submitted to the Alcoholic Beverage Commission urging them to hold up the liquor license until this matter can be studied further. The Secretary, in answer to an inquiry from Contmissioner johnson, stated that the number of parking spaces that would be allotted to the subject establish- ment could be ascertained at the time the plans for Design Review are submitted to the City for consideration. Com.missioner Kasner pointed out that the Design Review Committee would thoroughly check the plans for sufficient parking. Com~missioner Kasner, in answer to an inquiry from Coramissioner Crisp, stated that a restaurant could be located in this building since the proposed use is permitted by the City Zoning Ordinance in C-C (Community. Commercial) areas. Com.missioner Metcalf stated that the City should express an opinion relative to this matter or request a delay from the Alcoholic Beverage Con~aission in issuing their liquor license. The Secretary advised that the Alcoholic Beverage Commission called the Planning Department Staff to inquire if this is a permitted use at the subject location. Commissioner johnson advised that, he felt, the City Council should. forward a letter to the Alcoholic Beverage Commission rather than the Planning Commission. He then directed the Secretary to bring this nmtter to the attention of the City Council'at their meeting of 15 ~y 1968. VIII. CO?D~/NICAT!ONS A. WRITTEN B. T. GALEB ~ APARTF~NTS The Secre[ary read a letter received fromMr. Cole Bridges, President of the Saratoga Chamber'of Commerce, supporting the proposal made by Mr. B. T. Ga!eb for garden apartments for.his property located along the railroad tracks directly behind the 'Azule Mall Shops. B. OblL VISITOR CO}~fERC[iL Mr. Clarence Neale inquired how the Visitor Commercial Ordinance will be enacted and if those who have already paid a fee will be required to pay another? The Secretary explained that the applicant is responsible for submitting a complete and accurate list of names due to receive notices. The Secretary explained that the Cable Car is in violation of the Zoning Ordinance and the Planning Department is taking the proper steps Eo eliminate this violation.
