PLACE: City Council Chambers, Fruitvale Avenue, Saratoga, California TYPE: Regular Meeting I. ROUTINE ORGANIZATION A. ROLL 'CALL Present: Commissioners Crisp, Kasner, Lively, MetCalf, and Norton. Absent: Commissioners Smith and Johnson. B. MINUTES Commissioner Crisp moved, seconded. by Commissioner. Lively, that the read- ing of the minutes of the 13 May 1968 meeting be waived and that they be approved as distributed to the Commission; motion carried unanimously.° SU}D~R SCHEDULE Chairman Norton suggested that any Commissioners planning to be absent due to sumn~er vacations should notify him, in adv~ance, so that arrange- ments can be' made to. assure that a quorum will be. present at the summer Planning Commission meetings. II. PUBLIC HEARINGS A. C-Ill - Wayne F. Pendergraft, Calabazas Creek and Foothill Lane - Request for Change of Zoning from "R-i-40,000" (Single Family Residential) to "'R-i-20,000" (Single Family Residential) - Continued from 13 May 1968 The hearing relative to C-ill was re-opened at 7:37 P.M. The Secretary stated nothing further had been added to the file. 'The Secretary read the Staff Report dated 27 May 1968 recommending that C-111 be denied for the reasons set forth in said report. Mr. Kenneth Forseth, attorney representing the applicant,' stated that i) he did not feel that granting the Change of Zoning for C-111 would set a precedent for spot zoning since the Planning Commission has the authority to control zoning 2) this small lot is the result of an un- intentional error on the part of the applicant 3) the property is located in an old established area and 4) if the Change of Zoning is denied this property will lie dormant and the applicant will still be obligated to pay the taxes. The Secretary, in answer to an inquiry from Chairman Norton, stated that the Ci.ty Attorney was consulted relative to this matter and it is hi's opinion that it is up to the judgement of the Planning Commission to. recon~nend approval or denial of C-111. Chairman Norton informed the applicant that this application will auto- matically be forwarded to the City Council and the applicant can appeal to them to reverse the action of the Planning Commission. At 7:46 P.M. Commissioner Crisp moved, seconded by Commissioner Kasner, that the public hearing for C-111 be closed; motion carried unanimously. B. C-112 - Peter Paulsen, Saratoga Avenue - Request for Change of Zoning from "R-I-IO,000" (Single Family Residential) to "R-M-3,000" (Multi-Family Residential) - Continued from 13 May 1968 The public hearing for C-112 was resumed at 7:48 P.M. The Secretary explained that in reviewing this application it was found that the applicant'had-v~0m~tted sixty (60) names from the list he submitted for the Notice of Hea~i~'g"mai-t.ings--pr~Qr to the 13 May 1968 meeting; there- fore, the Notice of Hearing has'b~e~"'~=~'i~{~iled including the additional names. Chairman Norton stated that some effort should be made in the future to verify these lists. The Secretary stated that the following residents submitted communications listing their objections to the proposed Change of Zoning 1).Mr. & Mrs. John Wierzbicki, 12471Radoyka Drive 2) W. B. Grens and Dora B. Grens, 12526 Radoyka Drive 3) Saratoga Park Woods Homeowners Association, R. V. Fagan, President 4) Mr. &Mrs. Aubrey K. J. Gray, 12562 Radoyka Drive 5) Mrs. Anne Mensor, 18891Ansley Place and 6) Elsie M. Much and Richard C. Much, 18830 Ansley Place. The applicant w-as present and stated 1) he rec&{ved communications favoring this project and 2) he is willing to build this project in any way that would be favorable to the City of Saratoga. Mr. Gray, 12562 Radoyka Drive, filed a petition (200 signatures) from the residents in the area of the proposed project urging the Planning Commission to deny C-112. Mr. Walter Windus, 12681 Saratoga Creek Drive.and officerof the Saratoga ........ Park Woods Homeowners Association, read 'the petition (filedT~by~Mr.?Gray)=:..~ opposingfthe proposed Change of Zoning. Mr. Paul Karl stated he.was in agreement with the subject petition and was opposed to the subject application (C-112). Commissioner Crisp stated that the Subdivision Committee met with the applicant to discuss this matter. He further stated that two other residents of the area artended the meeting and stated their objections to this project. The Secretary read the Staff Report dated 27 May 1968 recommending that C-112 be denied on the basis of the reasons stated in said report. At 8:00 P.M., Commissioner Crisp moved, seconded by Commissioner Lively, to close the public hearing relative to C-112; motion carried unanimously. Connnissioner Crisp moved, seconded by Commissioner Lively, that the Staff Report of 27 May 1968 be adopted and C-112 be denied since it does not m~et the objectives of Section 1.1 of Ordinance NS-3 and for the additional reasons stated in said report and the recommendation for denial be forwarded to the City~Council as the action of the Planning Commission; motion carried unani- '..'. mously. C. C-113 - E. F. Gouveia, Ashley Way - Request for Change of Zoning from "R-I-40,000" (Single Family Residential) to "R-~-12,500"'(Single Family Residential) The hearing relative.to C-113 was. opened at 8:02 P.M. The Secretary stated the Notices of Hearing were mailed and published and briefly reviewed this application. Elanning Commission Minutes - 27 May 1968 .- Continued II. C. C-113 - Continued The Secretary then read,l) a petition (20 signatures) submitted by some residents of Pierce'Road and Foothill Lane stating they opposed this application for Change of Zoning 2) a petition (51 signatures) signed by residents of Pierce.Road, Paramount Drive, and Ashley Way (submitted by appli- cant) stating. they did not object to the subject application 3) a letter received from Anthony L. Lillo and Jeanette B. Lillo stating they were in favor of the proposed plan and 4) a statement of reason filed by the applicant, Edward F. Gouveia, stating reasons why the proposed application would be in the public interest. The applicant was present and stated that 1) he contacted the people on Ashley .Way and seven (7) of the ten (10) residents are in favor of the Change of Zoning and the other residents did not sign the petition but they were not opposed.,and 2) he wished to develop two (2) lots at the end of Ashley Way. Mr. Clarence Roessl, 12850 Foothill Lane, stated 1) he owned a one-acre lot adjacent to the subject property 2) he did not favor the idea of cutting. down on the lot size 3) the applicant is planning to develop only a small portion of a larger parcel 4) ifthis Change of.Zoning is approved then all the residents should be notified in sufficient. time to sell their property 5) Mr. Howard Haldeman, 12841 Foothill Lane, owns the land on the other side of the applicant and 6) he hoped the Planning Commission would den~ this request. A resident of Foothill Lane stated he agreed with Mr. Roessl and Was opposed to the proposed Change of Zoning. Chairman. Norton at 8:14 P.M., closed the hearing for the evening,' referred C-113 to the Subdivision Committee for study and directed the matter continued to the next regular meeting. D. C-114 - George W. Day, Farwell and Fruitvale Avenues - Request for Change of Zoning from "R" (Agricultural) to "R-i-40,000" (Single Family Resi- dential) Chairman Norton opened the hearing relative to C-114 at 8:15 P.M. The Secretary stated the Notices of Hearing were mailed and published. He then briefly reviewed this application and read a communication with eight.(8) signatures from residents in the area advocating that the applicant be required 'to provide riding trails (if this application is approved) since the develop- ment would utilize"'~ome-O.f.~.he remaining open-space. Mr. John 'Hindeii'~' engineer from George Nolte Firm, w-as present to represent the applicant and stated this zoning would be in accordance with the General Plan and the surrounding lots are zoned R-i-40,000. . The Secretary, in answer to an inquiry from Chairman Norton, stated that 1) this property is in the area discussed for possible use as a golf course and.2) the developer is required to provide a specifed sum of money for the purpose of developing parks. Mr. Robert Plane, 14452 Nutwood I~ne, stated 1) he developed the property to the rear of the proposed development 2) he would like to request that the.three P G & E power poles and wires be removed along Wild Oak Way and across from the George Day Subdivision before the utilities for the subject subdivision are permitted to be installed. Mr. Akron stated he was in agreement with the request made by Mr. Plane. Plannin~ Con~nission'Minutes - 27 May 1968 - Continued II. D. C-114 - Continued Mr. Fryer, Fruitvale Avenue, inquired if the plans provided for sufficient storm drains and' sanitary sewers to take care of the additional run-off? Chairman Norton explained that the drains and sanitary lines will be provided but drainage is pretty well designated by the terrain. }~s. Acker was present and stated 1) she was not aware of the letter requesting the applicant to provide riding trails and she would like to add her name to the list 2) 'she hoped it was not too late to submit such a request and 3) her children and the children of other residents in the area ride every day and must cross busy streets and take chances especially since so much of the open-space is being subdivided. Chairman Norton stated the City could.nc~require Mr. Day to p~ovide the riding trails but the suggestion will be brought to his attention.. At 8:24 P.M., Chairnmn Norton closed the public hearing for the evening directed C~114 continued to the next regular meeting and referred same to the Subdivision Committee for study. E. 'UP-150 - George W. Day, Allendale Avenue - Request for Use Permit to Allow a Model Home Sales Office The public'hearing was opened at 8:25 P.M. The Secretary stated the Notices of Hearing were mailed and then briefly reviewed this file. Mr. Charles Harris, Vice President Saratoga Properties., stated that his request should be changed to Administrative Sales Office rather than Model Home Sales Office. Commissioner Crisp pointed out that some of the Model Home Sales Offices are being used for purposes other than what is permitted in a Model Home Sales 'Office and SaratOga Properties is listed as one of the offenders. Chairman Norton explained that the Ordinance of the City of Saratoga does not allow Administrative Office or Real Estate Offices in residential areas; therefore, this matter will have to be studied by the Subdivision Committee. Mr. Harris explained that the applicant 1) needed a place for an office for the staff and the salesman 2) somewhere to bring their customers. He further stated that the Use Permit for the Model Home ~Sales Office on Cumberland Drive will expire soon and they would like to move that operation' to Allendale Avenue into the. area of the subdivision now under construction. Chairn~n Norton (8:3'2 P.M.) closed the public hearing for the evening, directed UP-150 continued to the next regular meeting and referred same to the Subdivi- sion Committee for further study. F. V-317 - Dr. John O!iVer, Saratoga-Sunnyvale Road - Request for Variance in Connection With Side Yard Setback Requirements -Contin~ed"from 13 ~y 1968 ',. ",-,. The hearing relative to V-317 was resumed at 8:33 P.M. The Secretary Sta~ed nothing new had been added to the file. Commissioner Crisp read the Variance Committee Report dated 27 May 1968, recommending that a variance of 4-feet be granted subject'to the conditions stated in said!report. -4- Planning Commission Minutes - 27 May 1968 - Continued II.· F. V-317 - Continued The applicant and his architect, ~. De Grange were present. Mr. De Grange stated that the applicant would be happy to provide a 6-foot planter strip as stipulated in the Variance Committee Report of 27 May 1968; however, he felt thatjsaid·planter strip could present a lot of problems in the future.' He then suggested that a smaller planter strip be ·considered by the Planning Commission. Commissioner Crisp,·moved~.,seconded by Commissioner Kasner, at 8:39 P.M. to close the hearing relative to V-317; motion carried unanimously. Commissioner Crisp moved, seconded by Commissioner Lively, that the Variance Committee Report of 27 May 1968 be adopted and a Variance of 4-feet be granted in connection with side yard setback relative to V-317 subject to the conditions stated in said report; motion carried unanimously. G. SMALL PET ORDINANCE - Proposed Amendment to Ordinance No. NS-3 Relating to the Keeping of Certain Birds and Small Mammals as Pets in "R" Districts - Continued from 13 May 1968 There was no one in the audience that wished to comment·relative ~o this matter; therefore, the hearing was not opened. Commissioner Kasner stated that 1) Dr. '~H~imes, Santa Clara County Health, Department, contacted him to state that he was concerned that the proposed Ordinance would conflict with the County Ordinance and it was suggested that Dr. Haimes~ contact the City Attorney to discuss this 2) he (Commissioner Kasner) read the County Ordinance and feels that the proposed Ordinance does not conflict with the County Ordinance, but is only more restrictive and 3) he has discussed the matter with the City Attorney and is now awaiting a reply from him.:'.:~,..'! Chairman Norton. directed that the Small Pet Ordinance be continued to the next regular meeting to await a response from the .City Attorney and ~eferred the matter back to the General Plan Committee for further study. H. ELSIE PATRICK, Prospect Road - Informal Hearing - Request to Add "Auto Parts Store" to the List of Conditional Uses in the "C-N" (Neighbor- hood Commercial Zoning District) - Continued from 22 April 1968 The Secretary stated 1) nothing further had been added to'the file and 2) this matter was· con. t. inued from the 22 April 1968 meeting to allow the applicant time to find someone interested in her property. ~ '~]~-. .........=_ --_.= ...... The applicant was present and stated she did have some companies interested in her property, but no firm offers had been made. No one else present wished to comment. The Secretary read the Staff Report dated 27 May 1968 recommending, with concurrence of the Subdivision Committee, that Auto Parts Store be added to the list of Conditional Uses for the C-N Zoning District. Commissioner Crisp·, in answer to an inquiry from Commissioner Kasner, stated that_l) Auto Parts Store does include the changing and installation of tires and sale Of appliances 2) all activities will be entirely.conducted inside the store and 3) since it will be a Conditional Use the Planning Commission will be able to maintain control over same. -5- PlanninS Commission Minutes - 27 May 1968 - Continued II. ELSIE PATRICK Commissioner Crisp moved, seconded by Commission Metcalf, that the Staff Report dated 27 ~y 1968 be adopted and Auto Parts Store be added to the list of Conditional Uses for the C-N Zoning District; motion carried unani- mously. III. BUILDING SITES AN~ SUBDIVISIONS A. SDR-732 - Franklin Homes Company, Fourth Street and Saratoga Creek - Buildins Site Approval - 1 Lot - Continued from 13 May 1968 Commissioner Crisp explained that this applicant is still working out problems with the Flood Control District and recommended that SDR-732 be continued to the next regular meeting. Chairman Norton so directed. B. SDR-740 - S. L. Tyler and G. S. Kocher, Fourth Street - Building Site Approval - 1 Lot - Continued from 13 May 1968 Commissioner Crisp stated that the.applicant is still meeting with the Flood Control District to discussproblems relative to SDR-740. The Secretary stated the applicant submitted a'letter granting the Planning Commission an extension of forty-five days. In view of the foregoing, Chairman Norton directed SDR-740 continued to the next regular .meeting. C. SDR-744-- Neil Kirkham, Sobey Road - Building Site Approval - 1 Lot - COntinued from 13 May 1968 See' SD-'746. D. SD-746 - Dr. Michael L. Stepovich, Sobey Road - Subdivision Approval - 21 Lots - Continued from 13 May 1968 Commissioner Crisp stated that the Subdivision Committee met with the appli- cants for SDR-744 and SD-746 and it was decided that. further information will be needed.before the Planning Conm~ission can take action. He then recommended that SDR-744 and SD-746 be continued to the next regutar~ meeting. Chairman Norton so directed. E. SDR-750 - Olaf A.. Skaar, Palomino Way - Building Site Approval -.1 Lot Commissioner Crisp moved, seconded by Commissioner Metcalf, that the Building Site Committee R~port of 27.~y 1968, relative'to SDR-750, be adopted and that the tentative ma'p (E~hibit '~X_J'~,' filed 10 May 1968) be approved subject. to the conditions set forth in sa~d report; motion carried unanimously. F. SDR-751 - Robert W. Pulver, Austin'~y - Buildins Site Approval - 1 Lot The applicant was not present. The Secretary stated that the applicant had reviewed the proposed conditions of approval and expressed satisfaction of same. Commissioner Crisp moved, 'seconded by Commissioner Metcalf, that the Building Site Committee Report of 27 May 1968, relative to SDR-751, be adopted and that the tentative map (Exhibit "A", filed 15 May 1968) be approved subject to the conditions set forth.in said report; motion carried unanimously. -6- Flanning Commission Minutes - 27 Ma, y 1968.- Continued III. G. SDR-752 - Richard A. Huggins, Pierce and Pike Road - Building Site Approval - 1 Lot Commissioner Crisp stated this is unusual plot and the Health Department has approved one septic tank for two lots both owned by the applicant. ~. Tom Henderson, applicant's engineer, stated it will be difficult to bring the driveway into this property and the applicant will develop these two lots as one site. Commissioner Crisp moved, seconded by Commissioner Kasner, that the Building Site Committee Report of 27 May 1968, relative to SDR-752, be .adopted and that the tentative map (Exhibit "A", filed 17 May 1968) be approved subject to the conditions set forth in said report; motion carried unanimously. H.. SDR-753 - Robert C. Frazier, Vaquero Court and Cocciordi Quarry Road - Building..Site Approval - 3 Lots Commissioner Crisp recommended that this application be continued since the proposed conditions of approval had not been reviewed by the. Planning Commission. Chairman Norton so directed. I. SD-754 - George W. Day, Farwell Avenue - Subdivision Approval - 20 Lots Commissioner Crisp recommended that this application be continued to the next regular meeting since action will depend on the approval or denial of the Change of Zoning application'C-114. Chairman Norton so directed. IV. DESIGN REVIEW A. A-197 - Church of the Ascension, Prospect Avenue - Final Design Review - Modification of Landscape Plans Commissioner Kasner briefly reviewed this application and stated that a Staff Report had been 'prepared r~lative to this request. The Assistant Planner read the Staff Report dated 27 May'1968 recommending that the subject request for Modification of Parking and Landscape Plans be approved. Commissioner Kasner 'explained that Father Werner met with the Design Review Committee and stated that since the proposed additional buildings were not scheduled for construction at any definite time in the future he was hesitant about doing any permanent landscaping. Chairman Norton stated that some type of landscaping should be provided for the vacant areas; otherwise, weeds will. grow and result in a fire hazard.. Commissioner Kasner explained that the vacant areas are cultivated and the weeds are kept under' control. Commissioner Kasner moved, seconded by Commissioner Lively, that the Staff Report of 27 May 1968 be adopted and .the request for modification of parking and landscape plans be approved (Landscape Exhibit "A-i") subject to the conditions stated in said report and this recommendation be forwarded to the City Council for release of the improvement bond for the additional parking spaces; motion carried unanimously. -7- Plannin8 Commission Minutes - 27 May 1968 - Continued IV. B. A-273 - Franklin Homes, Fo6rth Street and Saratoga Creek - Preliminary Design Review - Apartment Complex Commissioner Kasner recommended, in view of the problems in connection with SDR-732, that this matter be continued to the next regular meeting. Chairman Norton so directed. C. A-285 - B. T. Galeb (Cable Car Burger Pit), Saratoga-Sunnyvale Road - Final Design Review - Remodeling Front Facade of Commercial Building Commissioner Kasner stated that ~en the applicant applied for his sign permit it xms discovered that he had not received Design Review approval for the front of this building. He further stated that a Staff Report had been prepared in connection with A-285. The Assistant Planner read the Staff Report dated 27 May 1968 recommending, with concurrence of the Design Review Committee, that the subject applica- tion be granted 'Fine-i---Design Review. Commissioner Kasner moved, seconded by Commissioner Lively, that the Staff Report of 27 May 1968 be adopted and the subject'application be granted Final Design Review for remodeling the restaurant's exterior as shown on Exhibits "A" and "B"; motion carried unanimously. V. CiTY COUX'CIL REPORT Commissioner Crisp (in the absence of Commissioner Johnson who artended the the last meeting) gave a ·brief sun~r~ry of items reviewed by the City Council at ~he meeting of 15 May 1968. He then suggested that it might be beneficial for Councilmen attending the Planning Comm.ission meeting to report on action taken by the Planning Commission. Chairman Norton stated that he agreed with the foregoing statement; however, he felt that such a decision would have to be made by the. City Council. VI. OLD BUSINESS VISITOR CO~L~ZRCIAL - Proposed Ordinance ordinance and are now awaiting clarification from the City'Attorney. Chairman Norton, in answer to an inquiry from CommiSsioner Crisp, stated that the Com~aercial Service Zoning District should be eliminated if the Visitor Commarciai is established. Com~nissioner Kasner pointed out that. Planning Consultant, Mr. Livingston, also recommended elimination of the Commercial Service Zoning District. Th'e Secretary, in answer to an inquiry from Commissioner Crisp, stated that' the ne:,z Visitor Commercial Zoning District would include the Azu!e Crossing Area and all Commercial Service Zoning Districts, but would not include the Neighborhood C~mmercial - Blue Hills Shopping Center. Cor~issioner Cria,~ suggested that the Visitor Commercial Zoning District require 'n,uj - auare-fee'~ for the minimum site area of a conm~ercial development in lieu of nhe 40,000-square-feet now required under the Commercial Service Zoning District. -8-' Planning Commission bIinutes - 27 May 1968 - Continued VI. VISITOR CO~DIERCIAL - CONTINb~D Commissioner Kasner urged that people' who have up-graded their properties to COmmercial Service Use not be penalized as the result of requirements of the proposed Visitor Commercial Service District. Commissioner. Crisp suggested that the proposed ordinance limit food ~tores to 12,000-square-foot buildings.. Chairman Norton summarized the following points: 1) the Commercial Service District should be eliminated and replaced by a Visitor Commercial Zoning District; 2) minimum site area for Commercial Service Development should be changed from 40,000-square feet to 10,000-square-feet; -. 3)..foo~ stores be limited to 12,000-square-feet; 4) any addition g~"=~UB'~'at'.tion-.-of-uses should be stated in the proposed Visitor Commercial Ordinance; and 5) a list of good uses should be established and abided by. OLD BANK OF AMERICA BUILDING The Secretary, in answer to a question from Commissioner Kasner, stated that 1) he explained to the City Council the feeling of the Planning Commission (the feeling being that the building ~s too small for the use intended and that further study ~as necessary) relative to the application for an Alcoholic Beverage License for a restaurant and bar for the Old Bank of America Building in the Village 2) the City Council felt the City should not interfere with the proceedings of the Alcoholic Beverage Commissioner and 3) the City could study the proposed plans when they ar& submitted for Design Review Approval. VII. h~W BUSINESS : SDR-749 - Mission Trail Buildend, Elva Avenue - Request for Reconsideration of Conditions The Secretary read a communication received from the applicant requesting reconsideration of Specific Condition II-A and II-D. Commissioner Crisp explained that the Planning Director, Public Works Director, and Assistant Public Works Director visited this site and now recommend that the 13 ~y 1968 Building Site Committee Report be 1) revised to eliminate Condition II-D 2) redated to 27 May 1968 and 3) readopted as of 27 May 1968. After discussion, Commissioner Crisp moved, seconded by Commissioner Lively, to readopt the Building Site Committee Report relative to SDR-749 with a new date of 27 I~y 1968 and with deletion%of Condition II-D; motion carried unanimously. VIII. CO~D~ICATIONS A. WRITTEN UP-104 - James Davi, Souza Lane -.Request for Reinstatement of Expired Use Permit The Secretary read a letter submitted by the applicant's architect requesting thatoUP-104, which expired 13 Juned 1967, be reinstated. ~ F~. Davi was present and stated that after obtaining Final Site Approval from the City Council he assumed that the Use Permit would be valid for as long as the Building Site Approval. -9- Plannin5 Commission Minutes 27 May 1968 - Continued VIII. A. WRITTEN UP-104 - James Davi - Continued Chairman Norton explained that 1) the Zoning Ordinance does not permit the Planning Commission to grant art extension for a Use Permit after it has expired.and 2) a new Notice of Hearing for request for a Use Permit will have to be mailed and a new application filed.' A~ter discussion, Chairman Norton directed this matter continued and referred same to the Subdivision Committee for study. B. ORAL CREEKS Eugenia I~lsih' reporter .for the Los Gatos Times Observer, stated that 1) the Sant Clara County Flood Control Conservation would hold a session on 28 May 1968 to determine ira public hearing.will be necessary relative to tree removal along the Smith and Rodeo Creek~'~d 2) since Saratoga has an interest in this matter a representative of the City might be interested in attending this meeting GUESTS '.. · .. ,\ Chairman Norton acknowledged, with pleasure, the presence of CoUncilmad.
