ROUTINE ORGANIZATION The meeting was called to order by Vice-Chairman Johnson. A. ROLL CALL Present: Con~nissioners Crisp, Johnson, Kraus, Lively, Metcalf, .and' Smith. Absent: Connnissioner Norton. B. MiNL~ES Con~issioner Smith moved, seconded by Commissioner Crisp, that the reading of the minutes of the 23 September 1968 meeting be ~ived and that they be 'approved as distributed to the Commission; motion carried unanimously. II. PUBLIC HEARINGS A. C-1!8 - B. T. Galeb and Milan Popovich, Zorka Avenue and Ted Avenue - Request for Change of Zoning from "R-l-10,000" (Single-Family Residential) to "R-M-3,000" (Multi-Family Residential) - Continued from 23 September 1968 The Chairman re-opened the hearing at 7:35 P.M. The Secretary stated that 1) a communication received from the applicant requested that C-118 be postponed for thirty days and 2) additional communications opposing C-118 have been received. Chairman Johnson directed that i) C-!18~."be continued to the meeting of 12 November 1968 and 2) the additional communications that were filed not be read until that meeting. Mrs. Ilia Sheets of 12444 Ted Avenue stated she had. heard rumors that if the subject Cihange of Zoning for apartment units is denied the property would be utilized for a mobile home park. Chair~-n johnson advised (in answer to Mrs. Sheet' s statement) that no plans for such a proposal have been presented to the City. '~ 7:40 P.M. Chairman Johnson' closed the hearing for the evening and referred C-1!8 to the Subdivision Committee..~ B. , C-I°19 - Allan G. ~nd Jean R. Boyce, Verde Vista and Boyce lane - Request for Chan~e of Zoning from ':R-I-40,000" (Single-Family Residential) to "R-.1-12~500" (Sin%!e-Familv Residential) The' Ch ' ~ opened the hearing relative to C-119 at 7:42 P.M. The S'ecretary airman stated that the Notices of Hearing had been m~iled and published. Walter H. and Unetta Ubsdell, 20810 Boyce Lane; 3) two petitions with a total of twenty-six signatures oppo-' ..... sing the subject Change of Zoning; and 4)a letter opposing C-119 filed by Walter and Marianne Kerl, 20830 Boyce Lane. No one in the audience wished to conunent relative to C-I19. Commissioner Smith moved (7:49 P.M.), seconded by Commissioner Metcalf, to close the hearing for the evening; motion carried unanimously. Chairman johnson referred C-119 to the Subdivision Con~nittee for review and directed same continued to the meeting· of 28 October '1968. C. UP-156 - jeanne M. Christiansen, Pierce Road and Saratoga-Sunnyvale Road - Request for Use Permit to Allow a Day Care Nursery - Continued from 23 September 1968 '! The Secretary stated that the applicant submitted a letter requesting the withdra~,ml of UP-156. Chairman johnson, in view of the foregoing, did not open the hearing but advised that the Subdivision Con~mittee had prepared a report (prior to receiving the request for withdrawal) which reconm~ended denial for UP-156. Comn-nissioner Smith moved, seconded by Comm~issioner Crisp, that the request for withdrawal be approved; motion carried unanimously. D. At 7:54 P.Mo CommisSioner Smith moved, seconded by Cormnissioner Crisp, to close the hearing relative to UP-i57; motion carried unanimously. The Secretary read the Staff Report dated 14 October 1968 recommending that the subject application be denied. He then stated that in paragraph 2. line 4. .R-!-14,000. .should be changed to read. .R-l-10,000. · .and in paragraph 4. .line 3. .pay. .should be changed to read. paying. BUiLDiNG SITES AND SUBDIVISIONS A. SD-759 - Pete Rajkovich, Prospect Road - Subdivision Approval - 112 Lots - Continued from'23 September !968 Commissioner Smith recommended that this ~tter be continued since the applicant has not submitted further information required in order for the Subdivision Committee to 'recommend approval of the tentative ~p. The Secretar~ stated that the applicant submitted a letter granting a thirty day extension. In view of the foregoing Chairman Johnson directed SD-759 continued. B.~ SDR-767 - M.V.S. Company, Saratoga Avenue - Building Site Approval - 1 Lot - Continued from 23 September 1968 Con~missioner Smith reco~ended that SDR-767 be continued to the next regular meeting in order to resolve problems relative to access. Chairman johnson so directed. The Secretary stated that a letter of extension was received from the app I icant. C. $DR-773 .- Don Orlando, Verde Vista and Boyce ~ne - Building Site Approval - 3 Lots - Continued from 23 September 1968 The applicant and his attorney, M~. Bruce Oneto, were presemt and ~. Oneto stated a letter had been file~ stating their objections to the prqposed condi- tions of approval. The Secretary read the lett.er received from the applicant 'and dated 4 October 1968 in filed SDR-773. Commissioner Smith stated that 1) the letter' was based on conversations and not a formal objection. to the conditions but is an infor~l objection to '.what 'will' be Condition iI-B 2) this'i=s'a m~tter ~nich .~ill have to be settled between 'the Boyce's and the Orland.o's..3).. the Planning Co~ission will either have to deny' the request f~ 'Building"Site ApproVal-or approve it and the applicant can request reconsideration ..of Condition II-B and 4) because of the proposed Boyce Change of Zoning a full City street will be required in this area. Mr. Oneto stated that condition tt-G will require the applicant to give up 5,000 square feet of the property he planned to utilize for construction of . his house. The Secretary explained that the dimensions of the lot will have to be. revised in order for the applicant to construct his house. Commissioner Smith explained that the applicant has gone ahead with house p~ans before applying for .Building Site ApproVal; therefore, there are ,. complications. ~. ~aui Frechette, 'present to represent the applicant, stated that 1) the Or!ando's purchased their property with a 20-foot strip right-of-~y 2) now Boyce ~ne has to be widened and ~. and ~-s. Boyce wish to sub- divide their property 3) there is a question about the centerline of this 20-foot strip 4) the Boyce's have moved' the centerline to fall between the Orlando property and the 20-foot strip of right-of-way o~ed by "Boyce' '5) the Boyce's want to build On their five lots and feel the >~. Orlando can afford to give away more property and they feel that they cannot give away any of theirs 7) he recommends that Boyce ~ne be split equally do~n~ the middle and 8) if this is not achieved it will mean complete scrubbing of one of the plans proposed for ~. SDR-773 Continued The Secretary stated that if the ].and is subdivided the Boyce's will have to dedicate and improve 20-feet and the Orlando's will be required to dedicate and 'improve an additional 20-feet making a total of 40-feet= of right -of -way. M~. Oneto stated that 1) when the Orlando's purchased their property they paid $125 for the 20-.foo~-' strip of right-of-way and this became part of tb. eir deed 2) the Orlando' s have a right to use this 20-foot strip which ought to be the centerli~:e of the proposed improvements and 3) the Orlando's will build only one house on Boyce and the proposed Boyce sub- division will have three houses on Boyce Lane; so., it seems unfair to Dena!ize ~= Orlando s by requiring them to dedicate and improve the additional property. Comn~issioner SmiEh s-~'ated that 1) if Condition !I-B is dropped from the proposed conditions of app~:oval dated 14 October 1968 and it is la~er realized a full City street is needed it will be difficult to acquire same and 2) he reco~.~nends that the Planning Connnission adopt the Building Site Con~ittee Report~ as is, and if there is a legal protest it be referred to the City Attorney. Commissioner Lively s~ated tha'~- 1) it seemed that this matter is all tangled and if the report is approved it will result in further confu- sion and 2) h~ recom~ended that SDR-773 be continued in order to allow the y s and Orlando's more time to work things out between there. Bo ce ~ The Secretary stated that 1) it will be necessary for the applicant to submit a letter granting an extension if SDR-773 is to be continued and 2) he will disduss this matter with the City Attorney in order to obtain a legal opinion. ... ~. Oneto stated that his client does consent to a continuance and will submit a letter of e:<tension. Chairman johnson directed .i) SDR-773 continued to the next regular meet- ing subject to the.receipt of a !et'~--er of eXt'ension. from;the.capplicant and 2) the Secretary to inform the applicant about t.he ·City Att0rney's opinion. D. SDR-778 - Robert P. Lewis, Sobey Road - BuildinS, Site Approval - 1. Lot The applicant was present and expressed satisfaction with the proposed conditions of approval, but did request clarification of Condition II-E. The Secretary explained that this condition required the removal of any shrubbery or portion of tree that might interfere with traffic sight distance on Sobey Road and is a Standard Condition. Co~.issioner Smith moved, seconded by Commissioner Crisp, that the Building Site Committee Report of 14 October 1968 relative to SDR-778 be adopted and that the tentative reap (Exhibit "~": filed 3 October 1968) be approved sub- jpct to the conditions set forth in said report; motion carried unanimously. SDR-779 i Grand of California.~ Prospect Road - Building Site Approval - 1 Lot Mr. Nielsen was present to represent the applicant and expressed satisfaction with the proposed conditions of approval. Commissioner Smith moved, seconded by Commissioner Crisp,' that the Building Site Co~nittee ReDor~ of 14 October 1968 relative to SDR~779 be adopted and that the tentative map (Exhibit "A", filed 4 October 1968) be approved sub- ject 'to the conditions set forth in said report; motion carried unanimously. -4- P!annin~ Conunission Min~.,tes - 14 October 1968 - Continued IiI. F. SD-780 - Western iiills Development, Mt. Eden and Pierce Road - Subdivi- sion Approval - 26 L~ts Conuniss.ioner Smith stated that this is a refile for SD-592 and since the Subdivision Committee wishes to meet further ~.:ith the applicant to dis- cuss problems. relative to this application it will be necessary to continue SD-780 to the next regular meeting. Chairman johnson so directed. G. SD-733 - john Rodriguez, Big Basin Way - Subdivision Approval for Revised Tentative i..'.~a~s - 114 Lots ?.,~. Bill Bane, ~cKay and Somps, was present to represent the applicant and inquired if all the conditions remained the same as the ones approving the original tentative map. The Secretary stated that Condition 25 and a NOTE relative to pathways had been add&d to the proposed conditions of approval. ,Y~. 'Bane !) suggested that the road be constructed in such a way that a'portion of it can be used for pathways since they are a little tight for area and 2) pointed out that the Building Site Cormnittee Report of · 1-'.'-October 1968 should indicate 114 residential lots instead of 128 lots. A-294 - Grand of California, Prospect Road - Preliminary Design Review - Automobile Su~ I p y Stor~' Cosanissioner Lively stated 1) the 'Design R'eview C0rmmittee met with the applicant and reconmended some changes' for =the front of the' building and 2) A-294 should be continued to the ne>:t regular meeting in order to allow time for the applicant to n~ake the suggested changes. B. A-295 - Saratoga Foothills Development, Saratoga Avenue - Preliminary Design Review - Apartment Complex Cor..~,,.issioner Lively stated that the Design Review Committee has reviewed .. A-296 - Franklin Homes, Fourth Street and Springer Avenue - Preliminary . Desi?.n Review - Apartment Complex Ccnmissioner ]Lively stated that the Design Review Comnittee reviewed the plans and they are far superior to the original plans that were reviewed son~e 'months ago. -5- Pla~:nin:.% Con:mission .Minutes - 14 October 1968 - Continued IV. C. A-296 - Continned The Secretary read the Staff Report of 14 October 1968 recon~n, ending that Preliminary Design Approval be granted A-296. Con~nissioner Lively moved, seconded by Commissioner Metcalf, that the Staff Report of 14 October 1968 be adopted and Preliminary Design Approval be granted for A-296 as shox.m on E:d~i'git "A" and subject to the conditions stated in said report; motion carried. unanimously. SS-59 - Franklin Horaes, Saratoga-Sunn~ale Road - Final Design Review - identification SiSn Coma~issioner Lively briefly reviewed this application and stated that the Design Reviex-~ Con~ittee recommended that the two (2) stucco side panels be eliminated from the proposed subdivision identification signs. ~.~ Dave Franklin, applicant, requested another appointment with the Design Review Conmittee to discuss the subject alteration. Chairman johnson, in view of the foregoing, directed SS-59 continued to the next regular meeting. E. A-278 - Ann Valk, Big Basin Way - Preliminary Design Review - Revised Plan for Commercial Buildin[~ Co~missioner Lively stated that the Design Review Committee would like this matter continued to allow the Co~aittee time to meet with the applicant and discuss treatment of the roof of the subject building in relation tlne surrounding buildings. The applicant was present and stated that the Design Review Comittee had visited the site . and '.. there is a problem relative to stablizing the soil; therefore, it is paramount that they build '.as soon as possible. Com~aissioner Lively stated'that since this property is the keystone the development of 'this area the Design Review Committee feel's it is imperative they study the matter furth.e'r.. .. Chairman johnson directed A-278 continued to the next.~-eguiar meeting and referred same back to the Design Review Committee for further review. F. A~289 - First ~lationa!. Bank, Cox Avenue - Final Design Review - identification S Co~issioner Lively reckmended that A-289 be continued to the next regular meeting to allow the applicant time to meet with the DeSign Review Comittee to discuss the original sign proposal. Chairman johnson so directed. V. CiTY COB~TCiL REPORT The Secretary gave a summary of items reviewed and action taken at the City Council. nmeeting of 2 October 1968, with emphasis on items of particular interest to the CommiSsion. Com~m. issioner Smith gave a summary of items reviewed and action taken at the epecia! Cit Council meeting of 30 Spetember 1968, with emphasis on the foiio~ing items: i) The Mayor's referral, to the Planning Con~mission, for study and review of the frequent requests for Use Permits for nursery schools and rest homes and simi.!ar ~roups for location in R-1 zones4 and -6- .PlanninS.~ Commission Minutes - 14 October'1968 - Continued V. CITY COUNCIL REPORT - CONTINUED 2) The .~yor's referral to the Planning Cor:~nission for study and a recommendation of tb.e possible oversight in the Gen- eral Plan for specific zoning for such services uses as plumbing and' electrical services. Commissioner Smith then advised that since the V-C Ordinance was passed no provisions existed in other areas for these uses. · Commissioner Crisp stated that according to the' Planning Consultant all services uses should be eliminated from the V-C area and any consideration to reinstate said uses should. be given very serious thought. After discussion, Chairman johnson referred these matters to the Subdivision Con~mittee for study. Vi.. OLD BUSINESS AMeN'nED · · ..... REPORT The Secretary stated that an amended report for the Foothill-Pierce Road area (C-Ill and C-1i3) had been prepared by the General Plan Con~mittee. He then pointed out the changes made in the amended report. Cormnissioner Crisp recommended that the report should be directed to the City Council rather than to the Chairman of the Saratoga Planning Commission. Con~missioner Smith recon~mended that the date of the amended report be stated as follows: Amended Report - 14. October 1968 Original Report- 26 August ].968 Comm. issioner Crisp moved, seconded by Con~missioner. Smith, that. the. amended report (dated 14 October 1968) of the original re'~ort (dated 26 AUgust 1968) be adopted, as corrected, and for~,~arded to t'he City Council as the'action of the Planning Commission; motion carried unanimously. REOUEST OF CiTY ADMINISTRATOR - Consideration of specific service uses for Commercial Zonin~ Districts Chairman Johnson stated that this matter has been referred to the Subdivision Committee for study.
