I. ROUTINE ORGANIZATION
The meeting x~s called to order by Vice-Chairn~n johnson.

Com=~issioner Smith moved, seconded by Commissioner Crisp, that the reading
of the minutes of the 14 October 1968 meeting be ~ived and that they be
approved as distributed to the Co~ission; motion carried unanimously.
II. P~LIC H~INGS
Chair~n johnson, in view of the fact that the applicant's representative was
scheduled to board a plane, directed that the public. hearing for b~-158 (item C
on the Agenda) be the first item for discussion.
C. P-158 - Seminaries and institutes of Religion - Church of Jesus Christ of
~tter Day Saints, Allendale Avenue - Request for Use Permit to
Allow a ColleSe of Religious instruction and Worship
The hearing relative to ~-158 ~s opened at 7:31 P.M. The Secretary stated
the Notices of Hearing were mailed and then read a statement of reason filed
by the applicant's representative, ~. Elwon ~nce.
~. Elwon ~nce wasz. present and stated that 1) he would briefly review
this proposal 2) this building will contain 6,000-souare feet 3) the
building will house classrooms, a !ounge~ kitchen, office space~ and the
other nor~l facilities associat=~d with ~ school of this type 4) the
institute will endeavor to serve the s~zudents at the West Valley Jr. College
5) the institute will offer fifzy-four courses dealing in church history
6) it is necessary to round-out the religious e~uca~' ~n of ,'~oun~ college
students 7) there are one-hundred Mormon students r~:~_istered at the West
Valley jr. College 8) counseling is provided to help _~-.,~se y'o'cng people

II. C. UP-158 - Continued
Mr.' L~nce explained that 1) the Church of latter Day Saints has been
involved in the religious school l~rogram since 1927 and they have found
that it is best not to locate the religious schools or co!lege's directly
in associa[ion with the church because:
a) the program of the school is a general program
and has nothing to do with the services provided
by the church;
b) the college program, unlike the Church, is completely
financed by Salt Lake City, Utah;
c) the local church is not designed to meet the needs
of college people;
d) the church on Allend'ale Avenue is the center of the
Stake (or Diocese) and is the Stake headquarters and.
is serving at its highest capacity now; and
e) the local church and the institute of religion are
different and serve different needs;
and 2) it is not possible to go into the campus classrooms and teach the
courses offered at the institute.
Commissioner Crisp inquired about the three-and-one-half (3]~) acres not
being used at the present ~tter Day Saints church site. on Allendale Avenue.
l~.. ~nce explained that this property is proposed for development of a
baseball diamond and recreation area 'co serve the entire Stake (or Diocese).
~.~. ~nc% in an inquiry,from Coma~issioner Metcalf, stated that they did
not now o~ the property since they wanted to be 'sure they could obtain
approval to utilize the property prior to purchasing same.
Co~issioner Smith stated thai the m2p showed provisions for e>~pansion
and inquired about the ulti~te total the institute planned to serve.
~. ~nce answered that the religious intitute would eventually serve
approximately two-hundred students.
Con~issioner Smith explained that the institute would have to provide
additional parking to serve these students.
~ Shi~z~~ Athos Place, stated !) he lived direct~ behind the proDosed
school 2) he had no. objection to the services provided by the school, but
did o'?~ect to them l~ca'eing in a residential area and 3) he felt that if
one school of this nature is permitted it will set a precedent for others'
t.D try to come into this area.
!~','-~. ~nce stated 'that 1) .the statement made by ~[~. Shibel is true 2) this
should be considered a~'pOsitive attitude rather than a negativcz one and
3) .these institutes cost a lot of money and the Church of L.?.tter Day Saints
does ~en their doors to permit other churches to n~zke use of their building
a~cozt to them.
Pir. ~onie T. Kerwin, 13616 Fruitvale Avenue, stated he would like Eo know
!) where they are going to put the parking for two-hundred students on
this property and 2) are they planning to use the West Valley jr. College
parking.

~.k. I~nce, stated that 1) there will be ample parkin:E provided
2) not all of the students will have cars '3)' the ~ter Day
Saints Church has facilities of this type all over the state and
are able tD provide ample parking in all of them and 4) all of the
students will not be in class at the same time.
Chairman Johnson explained that no Building Permit will be issu~d unless
sufficient parking is provided. ,
~.. De Beular, Athos Place, stated that 1) he ox.~:ed a home behind the
proposed building 2) he and his neighbors were familiar with the good
works of 'the Btter Day Saints Church 3) the Church anticipates spend-
.. ing $259,000· to put this building into operation 4) he and a number
of his neighbors have spent $50,000. to $75,000. for their homes 5) they
paid this much for their homes because of the quiet atmosphere and gra'cious
living provided for by the one-half acre lots 6) he was assured this area
would remain residential 7) he did not wish to quarrel with the Church, but
is 'opposed to this school and .8) he felt it would be far better for them to
enlarge on their presently ox.med property (3~iacres) not now being used by
the Church.
Dr. Pride, Athos Place, stated that !) he did not find fault with the
Church, but is opposed to the proposed location for this facility 2) he
felt that the present Church location would adequately serve the students
at West Valley Jr. College 3). he was on the Christian Church Board and if
they had the facilities the Church of ~tter Day Saints have they would
consider themselves very fortunate and 4) his Church found no problems
in having their schools included as part of their Church.

Planning Con~nission to rake' every attempt to keep Saratoga a rural cor;~unity
2) Saratogans have graciously accepted the West Valley jr. College even
though they were opposed to the original idea and 3) he cannot see ~./ny
the Church cannot use the 3~-acres available to them.
!.~s. Le!and Fry, former 0x.a~er of the property, stated that i) she resided
ne:<t door to the subject property 2) her Mother sold this property to
George F~y with the understanding that it would be used for Single-Family
Residential homes 3) with the. W'est Valley Jr. College already in the area
they did .not x.rant another school nearby 4) they have a beautiful home and
yard and do not want additional traffic and noise in the area and 5) they
stron[~!y object to the proposed Use ?ermit.
I~?s. ?.radner Heisy, stated 1) she x.~as relatively new to this neighborhood
2) she agreed with her neighbors that this area shc~dld be' kept strictly
residential 3) she .felt. that the school would be more appropriately located
on the 3~-acres they' already o~ed'rather than saving it for development of
recreational facilities and 4) the Church budget would probably not provide.

for' it 5) he wa~ concerned about yo'c~ng people and felt that everybody
'should be concerned and 6) it would benefit everyone if wa showed more
interest in our young people and less interest in m~tcrial thing and the
dollar.

~k'. Lance, applicant's representative, stated that 1) anyone who has
ever viewed a Mormon Church will find them all well-groomed 2) the
Mormon ChUrch has never had any probl?n~. raising money for landscaping
a'nd maintenance of their properties and 3) they have never had any
trouble with their neighbors before and they want to cooperate with
them now.
Chairman Johnson closed the hearing for the evening at 8:16 PoM.'. directed
UP-!58 continued to the next· regular meeting and referred same to the Sub-
division Comm~ittee for study.

to "R-1-12,500" (Single-Family Residential) - Continued from

The hearing relative to C-119 ~,ms re-opened at 8:17 PoM. The Secrer_ary
stated that two' communications had been filed in support of this appli-
cation by M~rs. Mildred Russell and 1,~. jerome Lohr, President Saratoga
Foothills Development.

Chairman johnson closed the hearing relative to C-1!9 at 8:20 P.M.
The Secretary read the ·Staff Report .recom_mending that U~R-I~15·,000 zoning
be granted foi- C-119.
The Secretary,· in answer. to an inquiry from Commissioner }Lraus stated that
the problem in connection with C-i19 and ~r. Orlando had been resolved for
the time being.
Com~-nissioner Smith moved, seconded by Connnissioner Metcalf, that the Staff
Report dated 28 October 1968~ recom2nending that C-119 be approved be adopted'
and that the subject rezoning (R-i-40,000 to R-t-15,000) be recom~nended for
approval to the City Council on the basis that the request meets the object-
ives of the City of Saratoga Zoning Ordinance NS-3, Section 1.1 and subject
to the·recommendations stated in said Staff Report; motion carried unanimously.
B. C-120 - Clarence W. Neale, Saratoga-Sunnyvale Road - Request for Change of
Zoning from "Conditional-Cormnunity-Commercial" (C-C) to "Visitor
Commercial" (C-V)
The hearing relative to C-120 was opened at 8:24 P.M. The Secretary stated
that the Notices of,Hearing were m~ii!ed and read a communication filed in
opposition to the p~oposed change of zoning by ~',/. John Bastianelli.
The Secretary, in answer to an inquiry from Com2nission Crisp, stated that
all of the requirements mentioned in the letter are necessary for new develop-
ments, but not for an existing development. He further explained that a
'formal or automatic variance would be necessary.
Co.~m~issioner Smith pointed out that the parking would have to checked very
closely.
~.'~'. Steve Brooks, resident-manager of the Brookside Glen Apartments, stated
that !) he was speaking on behalf of 'the tenants in the apart:nent building
2) the driveway into the apartments is hazardous because of the traffic at
Neale's Hollow 3) several tenants have had near accidents 4) parking at
· Neale:s Hollow is a problem 4) there are so many cars there and one car
can obstruct the entire flow of traffic 5) 'heavy traffic causes cars to
stop out on the highway and 6) the sign at Neale's l-!ollow is aesthetically
unpleasing and should be removed.

After discussion, Chairman johnson closed the hearing (8:34 P.M.) for the
evening, directed C-!20 continue~ to the next regular meeting and referred

D.. UP-159 - Saratoga Heights Mutual Water Company,-Quickert Road - Request
for Use Permit to Allox,:, Construction of Two (2) New Water Tanks
and a Pump
The hearing relative to UP-159 was opened at 8:35 P.M. The Secretary
stated the Notices of Hearing were mailed and briefly reviewed this
application.
Mr. john H. Haufe, President Saratoga Heights Mutual W'ater Company,
a:<pla'ined that' 1) since the last tank was added an Canyon View i~ive
approximately twenty (20). families have moved into the area 2) this is
the reason the new' targ~r tank is necessary 3) -the new tank will serve
the additional needed 'water for d'omestic and fire uses and 4) the two
(2) e>:isting smaller tanks will be mo~ed from Canyon View ~.ive to Quickert
Road.
At 8:40 P.M., Chairman Johnson closed the hearing for the evening, directed

Request for Use Permit to Allow Construction of a New Water
Stora~Ie Tank
The Chairman-opened the hearing relative to b~-160 at 8:41 P }~ The Secretary
stated the Notices of Hearing ~zere m~iled and briefly reviewed this application.
Chairnan Johnson explained that 'this application (D~-160) was filed in
conjunction with ~-i59 and that the two (2) tanks from Canyon View ~ive
are the ones that will be installed on Quickert Road.
~,~. HaUfe, President Saratoga Heights Mutual Water Company, e~p!ained
that 1) the proposed tank for Canyon View Drive will have 67,000-gallon
capacity and will be 26-feet in diameter and 16-feat high and 2) the
two (2') sa!ier tanks will have B~000-gallon capacity each and are
i6-feet in diameter an~ 6-feet high.
After discussion, Chairm~n Johnson closed the hearing (8:43 P.M.) for the
~,ven'i~c, directed UP-160 continued to the ne~ct regular meeting and referred
same to the SubdiviSion Committee for study.

Con~issioner Crisp reco~nended that this ~tter be continued in order to
a!lox,z time fo~ consideration of purchase (by the City) of a free-way right-of-
way for an interim park to be used until said .land is needed for free-way
purposes.

ComMissioner Crisp recon~nended that this matter. be continued to await
the submittal of a revised site plan showing two (2) vehicular means
of access to the subject property.

Commissioner Crisp stated that the applicant has reviewed the proposed
conditions of approval and e:.~pressed satisfaction of same.
Conh~issioner Crisp moved, seconded by Commissioner Lively, that the
Building Site Com~mittee.Report of 28 October 1968 relative to SDR-773
be adopted and that the tentative ~fnap (Exhibit "A", filed 20 August 1968)
be approved subject to the conditions set forth in said report; motion
carried unanimously.

Comsnissioner Crisp explained that this application is a refile for SD-592
and that two new conditions have been added to the conditions of approval.
The Secretary stated that the applicant is aware of the added conditions
and has expressed his satisfaction of same.
Com~issioner Crisp moved, seconded by Commissioner MetCalf, that the
Subdivision Committee Report of 28 October 1968, relative to SD-780
be adopted and that the tentative xnap (Exhibit "A-I", filed 21 October
1968) be approved subject to the conditions set forth in said report;
motion carried unanimously.
E. SDR-781 - Samuel E. Pace, Montaivo Road - BuildinS Site Approval - i Lot
Comzaissioner Crisp explained that SDR-781 is a refile on an application
that has expired.
. The Secretary stated that the applicant has seen the proposed conditions
of approval and is in agreemsnt with same.
Co~issioner Crisp moved, seconded by Commissioner Metcalf, that the
Building Site Committee Report of 28 October 1968 relative to SDR-781
be adopted and'that the tentative map (Exhibit "A", filed 9 October
1968) be approved subject to the conditions set forth in said report;

Commissioner Crisp moved, seconded by Commissioner Metcalf, that the
Building Site Committee Report of 28 October 1968 relative to SDR-782
be adopted and that the tentative map (Exhibit "A", filed 4 October
1968) be-approved subject to the conditions set forth in said report;
'motion carried unanimously.
G. SDR-783 - Ross. Smitb~ Oak .Street - Buildin~ Site Approval - ! Lot
ConLm. issioner Crisp briefly reviewed this application and stated that the
applicant was given a copy of the proposed conditions of approval.
.!.~. Ross Smith, the applicant, stated that he would like to request
.approval of the Building Site Con~ittee Report dated 28 October 1968,
but would like to reserve the i-ight to request reconsideration of
Condition II-B of said report.
Commissioner Crisp stated that it was the applicants prerogative to make
this request.
ComnisSioner Crisp moved, seconded by Co~Lmissioner Metcalf, that the
Building Site Co~n~ittee Report of 28 October 1968 relative to SDR-783
be adopted (with the understanding that the applicant reserves the right
to request reconsideration for condition ii-B of said report) and that
the tentative ~p (Exhibit ';A", filed !8 OctOber 1968) be approved sub-
ject to the conditions set forth in said report; motion carried unanimously.
H. SDR-784 - Georqe B. Clark, Houston Court - Buildin8 Site ADDrova! - t Lot
The applicant ~,~as present and stated that he would like to request approval
of the Building 'Site Co~ittee Report dated 28 October 1968, but would like
to reserve the right to request reconsideration of Condition II-D.
Commissioner Crisp 'instructed the applicant to submit his request in ~Eiting
to the Planning Director prior to the next regular meeting of the Planning
Com~n~i s s ion.
Co~nissioner Crisp moved, seconded by Com~missioner Metcalf, that the
Building Site Comittee Report of 28 October 1968 relative to SDR-784
be adopted (with the understanding that the applicant may request reconsid-
eration of Condition iI-D of said report) and that the tentative map
(Exhibit "A", filed 16 October 1968) be approved subject to the conditions
set forth in said report; motion carried unanimously.
I. SD'~785 - Ditz and Crane, C.ox ..Avenue - Subdiv~ign Approval - 167 Lots
Commissioner Crisp explained i) 'this was part of an old Lind say tract
2) this will be ~' Planned Development and 3) a PD permits 25% of the
lots to be the next lesser lot size than the zoning district requires
in this case of a 12,500 zoning district 25% of the lots maybe as small
as !0,000 square feet.

of approval.
The Secretary, in answer to an inquiry from Conn~issioner Crisp, reco~mn~ended
that the following. condition be added to the Subdivision Con~nittee Report

Subdivision Co~r~n~ittee Report of 28 October 1968 relative to 8D-785 be
adopted,. a.s amended, and that the tentztive n~ (E~chibit "A ~'~ filed
28 October 1968) be approved subject to the conditions set forth in
said report; motion carried unanimously.'
IV. DESIGN .REVIEW
A. A-278 - Ann Valk, Big Basin i,.lay - Preliminary Design Review - Revised
Plan 'for Commercial Buiidin~z,~ - Continuec] from 14 October ].968
Com~nissioner ijiveiy stated that ].) tb.e Design Review Committee met x, xith
the applicant and a. Staff Report has been prepared relative to A-278 and
2) this is a redesign of a building ~:hich was previously approved and
this is a modification of the original plan.
The Assistant Planner. read the Staff Report reconnn~ended that Preliminary
Design Review be granted for A-278 on the basis of Exhibit "A-2".
Commissioner Lively moved, seconded by Cor:~issioner Metcalf, that the
Staff. Report of 28 October 1968 be a~,opted and Preliminary Design Review
Approval be granted for A-278 as shown on Exhibit '~A" and subject to the
conditions stated in said report; motion carried unanimously. '
B. A-289 .-'First National Bank, Cox Avenue - Final Design Review - Identifi-
cation Sign - Continued from 14 'October 1968
Co~.mmissioner Lively sta~ed that 1) the Design Review Coxmmittee met with
the appiicant~s representative and discussed this sign 2) a Staff Report
has been prepared relative to A-289 and 3) it is unfortunate that the
Design Review Con~mittee has not had the opportunity to meet with someone
directly .as. SOcia~ed. with the bank.
The Secretary stated [he applicant has chosen the people from the Sign
Company to .handle the subject request for them; however M~. Conger from
the First National Bank is present.
T'he Assistant Planner read the Staff Report reco~:~ending that 'Final Design
Approval be granted on the basis of Exhibits ."A", "B'', and "C".
>~r. Conger stated that 1) the applicant is not in agreement with Condition b)
set forth in the subject Staff Report dated 28 October 1968 and 2) the bank
feels very Strongly about the colors of their sign 3) other free-standing
business signs in the City have been permitted to 'use their colors.
Comr~issioner Metcalf stated that !) the Design Review Co~nittee has
reluctantly consented to approve this sign and they agree only on the
advise of the City Attorney that there is no way the Planning Co~mission
can prevent the'applicant from constructing a pole sign 2) the sign is
most distasteful to the Design Review Committee and 3). it is felt that
the color change reconnmended in Condition b) of the subject Staff Report
will make the sign a little less objectionable.
Mr. Conger stated that the applicant is trying to remove a non-conforming
sign and replace it with a conforr,aing sign.
Com~.'~zissioner Metcalf stated th~:t the Design Review committee would like to
relate its feelings to the bank officials.
Mr. Cassidy, Federal Sign and Signal Con'~.pany, stated that the objections of
the Design Review Committee have been relayed to the bank officials and they
would like to have the sign approved as originally sho~:~.
Commissioner Lively stated that since the bank wants to persist even
though they 'ar.e a~.~re of our objections there seems to be no alternative
~ .
but to. approve the sign as stated in the Staff Report.

COm'nissioner Lively moved, seconded by Commissioner Kraus, that the
Staff Report of 28 October 1968 be adopted and Final Design Approval
be granted for A-289 (identification Sign) as showa on E;:hibits "A",
'~B"~ and "C" and subject to the conditions stated in said report;

The Assistant Planner read the Staff Report dated 28 October 1968
recommending that Final Design Approval be granted for twenty-eight (28)

Commissioner Lively moved, seconded by Commissioner Kraus, that the

City Council meeting of 16 October 1968, with emphasis on the following items:
a)The plans for the addition to City Hall were referred to
Warren Held, architect, for comp'!etion.
b) C-ll3 (E.F. Gouveia, Ashley Way) was denied by the City
Council and referred to the '°~ann-;n~ Committee' of the
City Coundil for consideration at the time of the General'
Plan revision.
Com~missioner Crisp stated i) this n'atter should have been
referred back to the Planning Comanission for consideration
prior to denial by the City Council and 2) if the City
Council intends to take care of these matter the Planning
Con~issioner should be informed' of same.

Commissioner Kraus stated that i) a 'erocedure has been recommended for naming
of streets that would provide for the County check:ing to insure a name is used
only once in the process of naming streets in the County.2) ~ the Planning Policy
Committee had in attendance at its last meeting.Mm. Ink, Assistant Secretary for Hb~
of the United States Govermnent who presented one of ten awards to the Santa
Clara Countv Planning P,~licy Con~mittee and 3) a special ax.mrd was presented to
ex-Mayor William E. Glennon for his outstanding contributions to~.mrd making the
Planning Policy Cor.~ittee a success.

Staff Report re City Council Request fo~j Study of Specific Service Uses
The 'Secretary stated that the Subdivision Co~ittee and Staff met.-to discuss
this totter and decided to recon~nend that this matter be continued to the
next regular meeting.

FLAG LOTS
Commissioner Crisp stated that a new wording.should be x.mitten for Ordinance
NS-3 relative to flag or corridor lots.
The Secretary explained that in the R-I-!0,000, R-i-!2,500, and R-!-!5,000
zones there are properties that have long narrow roads leading to homes
located on the rear portion of a property that already has a home on the
front portion of the property. He further stated that t) this situation
is causing congestion on access roads ~.j~ich were not intended for this
additional traffic and 2) som.2 con~rideration should be given to requiring
f~ac ~o~-~ to be 20,000-s'quare feet in area
Chairman johnson directed the Planning Director to prepare a report stating
his r'eco~nendatioW for discussion at the next regular meeting on 12 November
1968.
