V-326 - Maurice Kerner, Ione Court - Request for Variance in Connection with Rear Yard Setback Requirements Chairman Norton opened the'hearing relative to V-326 at 7:52 P.M. The Secretary stated the Noticesiof Hearing had been mailed and then " briefly reviewed this file. Mr. Kerner, the applicant, was p~esent and explained that 1). a variance .. is needed in order to add anothe~ family room 2) what was previously ... a family room has been converted 'into a formal dining room in 'order to " entertain friends.and business adsociates 3) it is difficult to add a · "., room to 'this lot (without a variance) since it is located on a cul-de-sac " 3) he did have a statement of approval signed by his neighbors and 4) his' neighbors did not'feel the proposed variance would hinder them or their property. .' ... Chairman Norton explained to Mr. 'Kerner that 1) the Planning Commission does not grant variances freely 2) the Variance Committee will visit.the property prior to reaching a decision and 3) the applicant should be considering an alternate plan since the Committee may not be able to make the findings necessary to grant a variance in this case.' Mr. Kerner stated that he'.iSj,ai=.designer and has tried'to devise another .. plan but has not been able to comeup with one. .... Chairman Norton closed the hearing at 7:57 P.M. for the evening, referred .... V-326 to the Variance Committee for study and directed same continued to. the next regular meeting. · Commissioner Crisp, on behalf of khe Variance Committee, asked Mr. Kerner. · when he would be available for an: on-site inspection of the property~ Mr. Kerner stated that he.'.-and his{ family planned to be .out of town the next two weekends; therefore, he would~ call Mr. Walker, Planning Commission Secretary, in order to arrange an! appointment with the Variance Committee. .- E. AMENDMENT TO ORDINANCE NS-3 '-= Infbrmal Hearing to Amend City of Saratoga · m~ Zoning Ordinance NS-3 by Adding Plumbing Shop .and ... Sheet Metal Shop, and Electrical Contractor and Repair to the List of Conditional Uses in the ~., "C-C" (Community-Commercial) Zoning. District ~ · Chairman Norton opened the discussion by explaining that 1) there are in the "... "C-C" (Commhnity-Commercial) Zoning District some long established shops which .'~ are not included in the list.of p~rmitted or conditional uses 'in the "C-C" Zone ". and 2) since a need for these uses is apparent they should be made legal.by · . ..' .. '. adding them to the list of conditional uses in the "C-C" (Community-Commercial)' ". Zoning District. i ' ' ! . .' No one in the audience wished to &onnnent. ' CommiSsioner Crisp recommended that the. uses, if added, read as fol'lows: " "Plumbing and Sheet Metal Shop" · 'E" "Electrical i Contractor "'and Repair" : Commissioner Lively stated that he was concerned with the fact that there is a certain flavor to the downtown ~rea and the suggested uses may not be able .-. to conform aesthetically. " Commissioner Crisp explained that ~the uses would be conditional and would not have to be allowed if they could not conform. Norton, read the proposed ordinance emphasizing .the changes proposed by the .'. utilities companies (PT&T and PG&E). .. ," Chairman Norton stated that the City has had numerous problems getting the · . .... .. utility lines underground and the proposed ordinance, if adopted, will be a ." .. i.. sweeping attack on the same problem.· ' = '.... Mr. Cowan, manager of the PG&E office in Los Gatos, stated that 1) the PG&E '-' ".. legal department has requested that the following sentence.. .of the pars-. :.
