that nothing new had been added t.o the file. '
The applicant was present and stalled that the existing "P-A" (Professional-
Administrative) zoning does not seem suitable for the subject proper~y~ '],
therefore, he hoped the requested .change of zoning would be approved.

Chairman Norton opened the hearing relative to C-123 at 7:46 P.M.
The Secretary ·stated that the Notices of Hearing were mailed and

The applicant was present and stated that 1) the property in this
area of the City i~ too valuable not to be utilized 2) a one acre
parcel is a little too large for a single building' Sit _e~ in'thi~ -:= ..
!area and 3) he felt the City. would benefit in taxes if ehe s'ubJeC~'
property were re-zoned. ..
Chairman Norton pointed out that no residential property pays for itself
in..'taxes, especially in Sara[oga, because the tax rate is very low.

The hearing relative to V-325 was resumed at 7:50 P.M, The Secretary
reviewed the letter dated 20 'March 1969 submitted by Mr. Nick Roden,
explaining the intention of the State Highway Department to construct
· ' .. ·additional bridges in the subject area by 1971 .... The.Secretary further stated.
· . "that. 1) he discussed this matZter~ via telephone, with Mr. R. L.
State Highway Department 2) Mr. Cashion advised that monies have been
funded for the purpose of constructing two (not three as indicated by -.~.
"" P T & T) bridges in the subje'ct area by mid 1971 and that it was an
· administrative ruling by the State Highway engineers to prohibit such
attachments to the bridges an~ 3) a letter will be submitted by the
State' Highway Department to confirm the statements made by Mr, Cashion,

Cor~nissioner Crisp stated that the Variance Committee is aware
of the explanation offered in the letter submitted by Mr. Roden;
howeve~ they still feel that; a temporary connection to the existing
bridges should be arranged.
Chairman Norton suggested that the State Highway Department can disapprove
such a proposal and simply say "no" and the City is not in a position to
request them to do otherwise'..

'II.'. E. V-327 - Ditz-Crane, Cox Avende - Request for Variance in Connection with a KV Transmission Line and Poles
Chairman Norton opened the h~aring relative to V-327 at 8:06 P.M.
The Secretary s~atedthat th& Notices of Hearing were mailed and
then briefly reviewed the.subject.application.
Chairman Norton inquired if i) it would be possible to develop this
subdivision if the subject V~riance is not granted and 2) is th~S.Var~n~._J
something that is wanted or heeded by Ditz-Crane or is this just a line
that is being. put across their property.
Mr. Robert Crane, present to.represent the applicant, stated that
1) 'the line has been in existence for quite some time 2) the City of
Saratoga'Subdivision OrdinanCe require~ that when poles are re-located
the utilities must go underground 3)'there is no connection with the
Ditz-Crane subdivision and the.subject poles except that the poles are
located on the applicant's property and 4) the applicant requests that
· he not be put through the expense of installing underground utilities
when there are existing pOle~ on the property and since it does not seem
to serve any practical purpose.
Chairman Norton advised thati the purpose'of the new Emergency Underground
Ordinance is to get at situations like this and to force the installation
of underground utilities. ~
No one in the audience wished to comment.
The Secretary stated thatMr. Frank Riddle informed him, via t~lephone,'
that he was opposed to the s~bject Variance and w~Uld _..submitLa .I:etter

Commissioner Crisp, on behalf of the Variance Committee, arranged for
an on-site inspection with Mr. Crane for 9:00 A.M., Saturday, 19 April
1969.
Chairman Norton (8:14 P.M.) closed the hearing for the evening, referred
V-327 to 'the Variance Committee and directed same continued to the next
regular meeting. .:
F. ORDINANCE TO AMEND ZONING ORDINANCE NS-3 -'Amendment to Rest~.ict Uses in

The hearing was opened at 8:;15 P.M. The Secretary read the proposed
amendments to the Zoning Ordinance realrive to 1). clarification of the
permitted. and conditional usZes in the "C-N" and "C-C" Zoning Districts
and 2) a'reasonable standar~ size sign for multiple.family dwelling
complex, hotel, motel or lodging house.

The Secretary read the Staff Report dated 14 April 1969 recommending that
the subject amendments. to the Zoning Ordinance be approved and recommended..
to the City Council for adoption.

Con~nissioner Smith moved, seconded by Commissioner Bacon that the
Staff Report dated 14 April 1969 be adopted and the ordinance amend-
ments relative to restricting uses in the "C-N" (Neighborhood-Commercial)
and "C-C" (Community-Commercial) Zoning Districts and changing Identification.

The Secretary stated that the applicant has reviewed the proposed conditions
of approval and has expressed satisfaction of same.
.: Commissioner Metcalf recommended that SDR-806 be continued on the basis
that the slope of the subject lots seem to be sufficient to validate
enforcement of the slope density ordinance under consideration.

The Secretary stated that 1) Lot 2 6f this property is probably the
one with the most slope and .that is only 25% and 2) in reality the
slope density ordinance has been, applied to this property.
... Commissioner Bacon, in answer tO'an inquiry from Chairman
stated that Los Altos Hills did not exempt any portion of their City
from their slope density regulations and he did not feel Saratoga
should either.
.. Chairman Norton brought up the question of whether the slope density
ordinance could be applied b~fore it is formally adopted.
Commissioner Bacon stated that 1) he thought that trying to enforce
.. the slope density ordinance before it is adopted would be a highly
":' controversial matter 2) it will be .a long time before the matter is
· ' settled and 3) he was in favor of going ahead with the existing
ordinance until the new s!op~ density ordinance is passed.
.. Commissioner Crisp stated that he .agreed with Commissioner Bacon since .i' :i'
he did not thin~.the Planning. Commissioner could apply an ordinance that
has not even been approved.
Chairman Norton asked the Commissioners if in their judgement SDR-806
'and other pending applications should be reviewed on.the basis of the proposed
.slope density ordinance regulations?
'Commissioner Smith stated that he did not feel'the Planning Commission
could act on something that has not been passed.
Commissioner Bacon a~ded that the possibility does exist that the sl'ope -'
density ordinance may not be: passed at all. .

III. B. SDR-806 - Continued
Chairman Norton stated that the Commission 'm~y decide to'.either"r~fe~
:imatter to the City Attorney for study or goahead and enforce the
slope density ordinance prior to its approval.
· ·Commissioner Smith Stated Chat 1) there have been building sites that·
have been approved that had steeper slopes than the ones proposed in
connection with SDR-806 and 2) in his opinion the·lots for ·SDR-806
do n~come in the same category as hillside lots.
Commissioner Crisp advised !that the subject lots were in conformance ...
... with the proposed slope density ordinance.
The Secretary explained that the applicant was asked to and did
provide a site ·development :plan for the three lots.
Co~Tanissioners Metcalf and Kraus recommended that the whole matter
be given'veryc..careful consideration and that a ruItng from the City
Attorney be obtained.
Chairman Norton so directed.
Commissioner Metcalf moved,' seconded by Commissioner Kraus,·that SDR-806
· be continued and further consideration be postponed until it is determined
· what the lot sizes are and where the proposed slope density ordinance
would apply; motion carried unanimously.
C. SD-808 -.C.L. Longson, Michaels Drive - Subdivision Approval - 10 Lots· - Continued from 24 March 1969
The Secretary stated the applicant had reviewed the.p~o~osed cond'~tions'
of approval and had expressed satisfaction of same.
Commissioner Smith stated that in view of the action taken on the
preceding application the C~mmission should continue SD-808 as well
since the·slope density ordinance would apply more to this application
than it does to the preViou~ one (SDR-806).
In view of the foregoing Chairman Norton directed SD-808 continued to
the next regular meeting. ~
D. SDR-809 - Darrell Dukes, Peach Hill ~oad - Building Site Approval - 1 Lot - Continued from 24 March '1969
The applicant was present and stated he had reviewed the proposed conditions
of approval and expressed satisfaction of same.
The Secretary explained tha~ there is no possibility of getting anything
else on this property since it is a single site in a developed area.
Chairman Norton inquired if.this application should be postponed or/
approved since.it would be a legal non-conforming lot anyway. /
Commissioner Crisp stated that it would be i·nconsistent to approve
this application in view of:the fact that the two previous applications
were continued for further Study in connection with the slope density
or d inanc e.
Commissioner Smith moVed, seconded by Commissioner Bacon, that the
Building Site Committee Report dated 14 April 1969 be adopted and that
the tentative map (Exhibit "A-l",·filed 7 April 1969) be approved subject
to the conditions set forth· in said report; motion.carried unanimously.

Commissioner Smith recommended that SDR-811 be. continued to allow
time for further study.

Approval - 6 Lots'
The Secretary stated'that there is one 'lot that.is not quite 10%.
in slope in this subdivision.
'Commissioner Smith advised~that slope density did. not enter into
this application at all.
Mr. Paul Nowack,. Sandis and Associates, stated that 1) he and the
applicant reviewed the proposed conditions of approval 2) it will be
impossible to meet ConditiOn 8 of the Subdivision Committee Report
dated 14 April 1969 without acquiring land from the adjacent property'
owner.
The Secretary explained that Condition 8 is a requirement of the Public
Works Department and "as a~proved by the Director of Public Works"
could be added to the subj~c~ condition.
CommissiOner Smith stated that'the Public Works Department did go out
and look at this because o2 the traffic situation and then recommended
that Condition 8 be imposed; therefore., it should not be changed .....
The Secretary explained that the applicant could'request'excapt. ion
from this condition if he finds they cannot accomp%i~h the requirement.'
Mr. N0~mck stated that 1) ;there is also a question relative to Condition 7
2) this requirement is physically impossible 3) if the required pipe.
were installed a sump would be left between two.subdivisions and this
would not add to the natural environment and 4) it would be better
leave the ditch.as it presently exists.
· .' .' Chairman Norton informed Mr. Nowack that SD-812 could be continued to
allow time to work these c6nd'itions out with the Director of. Public
Works or the proposed condition can .be accepted at this ti~ and
reconsideration of same can be ~eq~ested at a later time.
Commissioner Smith' stated that he did not feel that any action should
be taken.at this time relative to SD-812 and recommended that the matter
be continued to the next regular meeting and that the applicant arrange
an appointment to meet with the Subdivision Committee and discuss this
matter.

Commissioner Smith recommended that SDR-813 be continued to allow time

Commissioner Metcalf stated that 1) the Design Review Committee
met with Mr. Williams of the Saratogan to discuss a common entrance
· .. for the Saratog~n and the Saratoga Foothills apartment complex 2) Mr.
Williams stated that the twenty-foUr "es"

common entrance were not realized 3) a new plan'line has been established
for Saratoga. Avenue; therefore, it will be necessary for the Public Works
Department and the Saratoga~Foothills people to work out a suitable
entrance for the subject development.
i The Secretary, in answer to an inquiry from Chairman Norton, stated
that the final plan will be, presented to the Planning Commission
~ review.
V. CITY COUNCIL' REPORT
Commissioner Crisp gave a summary of items reviewed and action taken at
the City Council meeting of 2 April 1969, with emphasis on items of
particular interest to the Commission.
VI. OLD BUSINESS
A. FULTON GLASS - Big Basin Wa~ - Request to Permit A Glass Shop - Continued
from 24 March 1969
The SeCretary' stated that the applicant has submitted a letter requesting
that this matter be'continued since he is still working out details for
the new location on Highway 85. The Secretary further stated that another
similar request for glass and screen shop has been submitted ~y Mr. Richard
L. Stevenson. -' ½ ..~
Chairman Norton directed the Secretary to publish a'Notice of informal
Hearing in connection with the subject requests.
B. SDR-788 - Lawrence E. Pohle,z Glenmont Drive - Request for Reconsideration
of Condition - Continued from 24 March 1969
The Secretary briefly reviewed this request and recommended that the subject
request for reconsideration .of the condition requiring underground utilities
be recommended to the City Couhcil for denial on the basis that the cost
for said requirement is not substantial'in' this case and gripring of said'
.request would set an undesirable'preCedent for other proper. ty owners in the
area.
Commissioner Smith moved, seconded by Commissioner Crisp, that the
· . original conditioh requiring underground utilities be imposed and the
request for reconsideration zbe recommended to the City Council for denial;
motion carried unanimously.;
C. SDR-798 -.Dr. Marvin H. Quickerr, Quickerr Road - Request for
'Reconsideration of' Condition - Continued from 24 ~rch 1969
The Secretary briefly reviewed this application and read the letter
submitted by Dr. Quickerr reZquesting reconsideration of Condition II~C
of the Building Site Committee Report dated 24 February 1969 requiring'
· repair of excess water damag~ to Kittredge Road. The Secretary further
stated that it' is the opinion of the Subdivision Committee and Staff that
this'matter should be referred to the City Council since it does'concer~
liability and maintenance of. private roads.
Commissioner Smith moved, seconded by Commissioner Bacon, that the
Planning Commission recommend to the City Council that 1) the subject
condition II.-C of the Building Site Committee Report dated 24 February
'1969 be re-affirmed as origiDa!ly stipulated and 2) the subject request
for.reconsideration of these:conditions be denied; motion carried uani-
mously. .'

VI. D. CONGRESS SPRINGS ANNEXATION
· ·· The Secretary stated that 1) the City Council, via the City Administrator,
requested the Planning Commission to prepare a recommendation relative to
the proposed annexation of the 1200 acres located in the area of Congress ·
Springs and· Sanborn Roads 2)~ this matter was originally referred to the
· General Plan Committee and 3~ the Staff has prepared a report recommend-
ing to the City Council that:the subject area be annexed to the City of
Saratoga.
Commissioner Lively stated that the General Plan adopted in 1968
recommends that the Cqunty and the City of Saratoga should get together
zto work out a protective plan for this area.
The Secretary agreed that this feeling did ·exist at one time but it is
now felt that the City cannod d~pend on the County for control of this
area and the City Council is!now looking for a general endorsement from
the Planning Commission as t6 whether the subject area is appropriate
for annexation.
· Commissioner Metcalf stated that 1) since ·the Planning Commission has
been·asked to go on record relative to their feelings in connection with
the proposed annexation - paragraph (2) of the subject Staff Report dated
14 April 1969 stating:

Chairman Norton explained that the cost is not a Planning Commission
matter but has been considereZd by the·City Council and they have the
necessary figures need to determine the feasibility of the proposed
annexation·'
Comm. issioner Lively moved, se!conded by Commissioner Metcalf, that the
Staff Report dated 14 April 1'969 relative to the Congress Springs
annexation be adopted, as amended, and that the subject area be
· recommended to ·the City Council for annexation based on the reasons
stated in said report; motion carried unanimously.
VII. NEW BUSINESS.'
A. SDR-807 - John D. Johnson, Three Oaks Way - Request for Exception of
Conditions :
The Seg~et.a~y'read a letter ~eceived from ~.'Johnson requesting exception
of·the condition to improve the existing driveway. The Secretary then
reCOmmended that the matter be referred to ~he Subdivision Committee and be
continued to the next regular meeting.

In view of the foregoing, Chairman Norton directed SDR-807 continued
to the meeting of 28 April :1969.

Chairman Norton acknowledged;, with pleasure, the presence of
Councilman Robbins, Mrs. Owehs and Dr. 'Sitney of the Good Government
Group, Mrs.· Ottenberg of the League of women voters, and Mr. Norman·
· Martin of the Prides Crossing Homeowners Association. 'He, also, thanked
Mrs.· Owens for the coffee she served·~at recess.
