PARKS AND RECRF~ATiON - Element of the General Plan for 1969 - Continued from 8 September !1969 Chairman Norton re-opened the hearing at 7:38 PoM. Chairman F, orton then introduced a letter sent to the Saratoga Union School District by Mr. Higby, Assistant to the City ~Ianager, reqL.,esting their comments relative to the effect the proposed location of the central park ;,~ould have on the proposed location of an elementary school site. -1- Planning Commission Minutes - 22 September 1969 - Continued II. A o Parks - Contint:ed Mrs. Ottenberg of the League of Women Voters read a letter urging the planning Com:nission to approve the park program as outlined by the Parks and Recreation CommiSsion.. M~s. Ottenberg, in answer to an inquiry from Chairman Norton, stated that they (League of Women Voters) we,re not particularly concerned about the location of 'the central park onl~ that one is provided. [~s. Overacker· stated that she h~s been the observer for the League of Women Voters at the Park and Recreation Com~.n. ission meetings and she knows how carefully they have gone over the proposed sites. She further stated that some of the sites proposed have been subdivided while the plans were being considered and she hoped the Planning Commission would support the park program as proposed by the Park and Recreation Commission. Mr. Miles ·Rankin, realtor, stated that 1) he would like to bring up two (2) properties that have been recommended low priority park sites ·and 2) they are shown on the General Plan as'. pathw.aya and buffer zones and includes sixteen (16) acres across from Paul ~,~sson. He further stated that the property o~.mers feel that the subject land should be dropped from the General Plan since the City is not going tO purchase the property in the near future and the o~er would like to offer the property for sale for development. Chairman Norton explained that 1) the Planning Com_.~.ission cannot promise that the City will buy any prope.rty 2) finances are the City Council's problem 3) whatever is proposedz on the General Plan it is up to the City Council and the voters to provide the necessary funds and 4) there have been parks designated on the General Plan for years that have not been purchased by the City. ~h~. Rankin stated that if it is ~ho~nn as a park on the General Plan the property cannot readily be sold.'. Commissioner Smith stated that even if property is designated for parks the owner can apply for subdivision approval and the application will be studied and approved or denied on the basis of the same considerations given to any other property in the City. Commissioner Lively stated that the General Plan Committee has met several times and a report has been prepared. He read the report of the General Plan Committee dated 22 September 1969 listing all the recommendations of the General Plan Committee relative ~o .areas· in the park proposal submitted by the Park Consultant and the Park and Recreation Commission. Chairman Norton stated he is in Hisagreement with most of what is set forth · in the General Plan Committee Report relative to Area ~4. ~rs. Wilbur Worden, 14204 Squirr~! Hollow lane, stated that she would like an explanation of the proposed path~..~ys and equestrian trails. Commissioner Lively stated that 1) on the existing General Plan it is proposed that pathways and a buffer area be situated along the creeks 2) the Park and Recreation Commission has not submitted any specific plan for pathways or trailways; therefore, the General Plan Co~.m~ittee had no choice but to recommend the ones sho;.m on the General Plan Map be left unchanged and 3) at the time George D~ay s~:bdivided his land on Allendale it ~,~s pointed out t~a't"'Some equestrian trails could no longer be used as a result of the development· and this is one of the things that led to the 'pres&'nt std~y" being conducted by the Parks and Recreation Commission relative to the trails program. -2- ~Planning COmmission Minutes - 22 September 1969 - Continued II. A. Parks - Continued Chairman Norton stated that 1) the use of the parks is really the province of the Park and Recreation Comanission and it is the place of the Planning Commission to review only their proposed rec0...,-m~.endations and 2) the 1968 General Plan recommendation was that a large 6entral ~"ark ~,~s needed in Saratoga, Commissioner Lively stated that ,the park designation recon~mended in the General Plan Com_mittee Report of. 22 September 1969 actually provides- more area than designated in the 1968 General Plan, Commissioner Lively, in answer to an inquiry from ~. Rankin, stated that ' 1) "~ in any of the areas designated as path~..~ys on the General Plan it is a long-range plan use for the future and 2) if the owner of the property presented the City ~.~ith a proposed subdivision map the City would have to take som~ sor't of action. Chairman Norton stated that labeling a certain property as parks, pathways, or buffers on the General Plan Map may some~,~at obstruct development of the property but will not entirely prevent same. ~. Rankin stated that the area along the railroad track and PG&E right-of-way is a rather wide band and could well be used as a buffer or park site. He further stated that the subject area could be narrower and still serve the same purpose. Chairman NOrton stated that 1) the' area referred to by ~-~. Rankin will be difficult to develop no matter what the General Plan 1,~ap may designate for its usage 2) it is a 10w'pri~rit'~"pie~e but since it is a difficult p~:operty perhaps the City will purchase it some day and 3) along with the PG&E easement it would be a go~d park sit~'~' Commissioner Metcalf stated that the General Plan Committee Report is recommending exactly ~,j~at appears on the General Plan of 1968 relative to pathways and buffer zones. Comn~issioner Lively stated that at the Planning Commission meeting of .8 September 1969 a letter was received asking that the area proposed for a central park site in the General Plan Committee Report be so designated. The dispute now is that the property designated for a central park site in the Park and Recreation recommendation, also, be included in the central park site. Chairman Norton stated that the General Plan Committee Report stated that Saratoga does not need a central park and he feels it is not the function of the Planning Commission to ~nake such a descision. Commissioner Lively stated that the Park and Recreation Com:nission representative at the meeting with the General Plan Co~ittee could not specifically say where the central park should be located. Chairman Norton Stated that in any case it is not up to the Planning Commission to decide anything but the location of the central park especially since the City Council has engaged the services of a Park Consultant and a Park and Recreation Com~mission. '. ... Comn~issioner Crisp stated that h~ ~.zould like to know xL~hy the City Council referred the nntter to the Planning Con~ission if they did not recommen,jation and judger~,ent of the said Commission-. Chairman Norton stated that as private"citizens the Planning Co~,igpi~ners could make their feelings kno~.~n, 'but the City Council did refer the park proposal to the Planning Co~nission because it required a change in the , General Plan }~p of 1968. Commissioner Lively stated that, he felt, the City Council referred the park proposal to the Planning Commission for their review and if ~hat Chairman Norton indicates is accurate the only thing the Planning Corrgission has the authority t'o do is say yes or no to any. proposal. and in that case the City does not need a Planning Co'~nission. Cormnissioner Smith inquired if i~ would be helpful if the last sentence on page 2. . .as follows were deleted: "We do not feel that a major central park is necessary or wanted by the majority of Saratogans." Chairm~n Norton stated that, he felt, the Planning Commission is going beyond its s~ooe in re~:iting the report of ~b~ Park Consultant Commissioner Metcalf stated he felt the General Plan Con~ittee ~.zould be derelict in their duty if they did not make the very best reco~mnendation allowed by their experience. Chairman Norton sta~ed he, also, takes issue x.~ith the recom~nendation e~4~ made in the General Plan Con~n~ittee Report (A~:ea ~ ~ relative to the Oak .Grove; .that it would be better protected by being sho~.~ as a park on the General Plan. UP-172 - Utah Homes, Inc., DeHavlilland Drive - Request for Use Permit to Allow a Model Home Sales Office - Con~tinued froU! 8 September 1969 The hearing relative to UP-172 was re-opened at 8:38 P.M. The Secretary stated the~e ~s nothing new in '.the file. ~. Howard Thompson ,~as present to represent the applicant and stated they would like the requested sales Office to sell the rest of the propertX left in their subdivision. No one in the audi'ence wished to cogent. The Secretary read the Staff Report dated 22 September 1969 reco~n=ending that the request for the Use Permit be granted. Commissioner Smith moved, seconded by Con~nissioner Metcalf, to close the hearing relative to UP-172 at 8:42 P.M.; motion carried unanimously°. Coma~issioner Smith moved, seconded by Con'~nissioner CriSp, to adopt the Staff Report dated 22 September 1969 granting the Use Permit to allow a-model home sales office on the basis the findings required by Section 16.6 of Zoning Ordinance NS-3 can be made and subject to the conditions stated in said report; motion carried unanimously. UP-174 - Valley Christian School', Saratoga Avenue - Request for Use Permit to Allow Classroom Facilities at Westhope Presbyterian Church - Continued from 8 September 1969 _ Chairman Norton re-opened the hearing at 8:43 P.Mo The Secretary stated nothing ne~..; had been added to the file. Mr. Lather, business manager for the applicant, was present and stated he had no further cormments. No one else present wished to comnent. Commissioner Smith read the Subdivision Committee Report dated 22 September 1969 recommending that the subject Use Permit be granted. Commissioner Smi.th. moved, seconded by Commissioner Crisp, that the Subdivision Committee Report dated 22 September 1969 be adopted and the subject Use Permit (UP-174) to allo~,.~ classroom facilities be granted on the basis the findings requi~:ed by Section 16.6 of Zoning Ordinance NS-3 can be made and subject to the conditions set forth in said report; motion carried unanimously. III. BUILDING SITES AND SUBDiVISiONS A.. SDR-824 - John B. Wa!sh, Herriman Avenue - Building Site ApprOval - 1 Lot - Continued from 8 September 1969 Commissioner Smith. stated that a'letter of extension from the applicant is necessary in order to keep this file active until the next regular me e ting. ~. Walsh was present. and submitted a letter granting the Planning Commission a'.~thirty day ~extension from the present date of expiration-and requested that SDR-824 be continued. In view of the foregoing, Chairn~n Norton directed SDR-824 continued to the meeting of 14 October 1969. B. SDR-825 Z. Clyde Standard, Monte Vista ~ive and Via Colina - Building Si~_e. Approval - 1 Lot i Continued from 8 septemb.er 1969 Co~issioner Smith stated that t~e proposed conditions of approval were ready. The applicant ~,~s present and stated he had reviewed the proposed conditions of approval and questioned condition II~C and II-G and objected to establish- ing a berm as required in condition II-C. He further stated that he has discussed the matter with the City Engineer and the Planning Director. Con~missioner Smith stated that if the applicant would read condition II-H of the Building Site Committee Report dated 22 September 1969 he would see that the City is simply asking him to release. the City from any damage on the lot now proposed for ~]e~e~°Pment and adjoining proper~y. The applicant stated he, also, .objectsto condition II-H since 1) his lot does not contribute to any water' flow 2) the water problem comes from Panorama Drive on do~,m 3) the City is already liable for ~,ater damage in this area and 4) he engaged an ~ngineer to look at his property and it was determined that nO ~.mter erosion has occurred. Chairman Norton explained that the City does not wish to assume any further responsibility in the subject area and the City is simply requesting (by condition II-H) the applicant to.release them from any responsibility for danrage that may be caused by not' fulfilling the requirements of conditions II-C and II-G~ The appli&ant stated that he is hot agreeable to signin~ such a release and inquired what other alternatives' were available to him. Chairman Norton advised the applicant that he could accept approval of the the subject Building Site Committee Report and then submit a request for reconsideration of the said conditions; which, will be reviewed by the Planning Commission and subsequently be referred to the City Council. He · further stated that if the appliCant felt he could benefit from further discussions with the Subdivision. Committee the matter could be continued to the next regular meeting. SDR-825 - Continued Commissioner Smith stated that 1). there has been a lot of discussion relative to the flooding of this property 2) about a year ago the appli- installed some culverts to relieve the flooding of his property 3) condi- .~'~n !!TH.(p0~ti°n)'°f the subje~t"~dilding Site Committee Report simply reiterates ~,~hat the applicant told the Subdivision Committee and 4) condition II-H states that the applicant may eliminate the requirements of condition - II-C (portion) and II-G by signing a statement relieving the City of any responsibility of water damage to his property. Commissioner Metcalf stated tha~ in reference tO condition II-H it seems that the Planning Commission does not have the authority to condition a lot other than the one before them for approval. He further stated that condition II-H includes an adjacent lot. The Secretary explained that there has been a history of storm drainage problems 'on this property and that is why the additional lot is included in condition II-H.- Chairman Norton stated that if the City is going to be under-liability because the applicant will not hold the City harmless from fault then perhaps 'this property should no~ be developed. Commissioner Lively suggested tMat condition II-H be eliminated from the subject report and conditions tI-C and II-G remain as presently stated and the applicant be left to decide if he wishes to build the berm or request reconsideration of the conditions. Commissioner Smith stated that condition II-tt is parallel to one that was imposed on another application and it was accepted without any problem. Con~issioner Smith moved, seconded by Commissioner Crisp, that the Building Site Committee Report of 22 September. 1969 relative to SDR-825 be adopted and that the tentative map (Exhibit "A", filed 28 August 1969) be approved subject to the conditions set forth in said report; motion carried unanimously. C. SDR-827 - ~'. Donald Hamby, Farw~Jl Avenue - Building Site Approval - ! Lot Commissioner Smith stated ~hat the proposed conditions of approval ~,~ere ready. The applicant was present and expressed satisfaction with the proposed conditions of approval. Commissioner Smith reco~ended that condition II-D be amended to read as follows: "D. Construct 18-foot wide access road along entire length of corridor using double seal coat oil and screenings or better on 6-inch rock base, as approved by Director of Public Works.'F Commissioner Smith moved, seconded by Comanissioner Crisp, that the Building Site Committee Report of 22 September 1969 relative to SDR-827 be adopted, as amended, and that the tentative map (Exhibit "A", filed 8 September 1969) be approved subject to the conditions set forth in said report; motion carried unanimously. D. SDR-828 - Dr. John Co:~Jacks ROad - Bui!din.~ Site Approval - 1 Lot The Secretary stated that the F~re Department has looked at this site but' they have not acknowledged the fact by letter. In view of the 'foregoing, Chairman Norton directed that SDR-828 be continued to the next regular meeting. -7- f~annin~ CommisSion Minutes 22 September 969 Continued IV. DESIGN REVIEW A. SS-62 Osterlund EnterpriSes, Saratoga-Sunnyvale Road and Paramount Drive - Final Design Review - Temporary Subdivision Sign - Continued from 8 September 1969 Commissioner Metcalf stated that t'he Design Review Committee did meet with the applicant and found his plans !satisfactory. The Planning Commission read the Staff Report dated 22 September 1969 recommending that Final Design App. roval be granted for SS-62 'Commissioner Metcalf recommended that the Note at the end of the report be deleted.and that the height of the sign referred to in Condition (e) be changed to allow 10-feet. The Assistant Planner recommended zthat Condition (d) be eliminated from the subject report. CommisSioner Metcalf moved, seconded by Commissioner Kraus, that the Staff Report dated 22 September 1969 be ladopted, as amended, and that Final Design Approval be granted for SS-62 as s. hown on Exhibits "D" and "E" and subject to the conditions stated in said ~eport; motion carried unanimously. B. SS-63 - Utah Homes, Inc., Cox and!DeHavilland Avenue - Final Design Approval - Temporarl_Subdivision Sign Commissioner Metcalf stated that this sign will replace an existing illegal sign. He then introduced the Staff Report dated 22 September 1969 recommend- ing that 1) Final Design Approval be granted for SS-62 2) 'the size of the subject sign be limited to 24-square feet and 3) only.two colors be used on the sign and that there not be an arrow on said sign. Chairman Norton suggested that a time limit be set for removal of this sign since it is temporary. The Secretary stated that there iS an automatic time limit of one year. Chairman Norton inquired what two 2specific colors are designated for use on this sign and recommended that a ~ondition (e) be added to the subject Staff Report as follows: "(e) Unauthorized sign to be rem'oved i~ediately." The Assistant Planner recommended that the subject Staff Report be amended to include Condition ({) as follows: ,(f) Overall height of sign not to exceed 8-feet above grade." Commissioner Metcalf recommended that SS-63 be continued to the next regular meeting to allow time for submittal of the color sketches that will be used for this propose~ sign. Chairman Norton so directed. C. A-326 C & I Development Corporation, Kirkbrook Drive - Final Design Approval - Subdivision Approval - Continued from 8 September 1969 Commissioner Metcalf stated that ~) the subject models will be located on Kirkbrook Drive and 2) basically.the Design Review Committee has required that no blank walls be allowed. He further stated that the Staff Report dated 22 September 1969 recommends that Final Design Approval be granted for A-326. Mr. Louie Tracini was present to represent the applicant. A-326 - continued commissioner ~tcalf moved, seconded by Commissioner Kraus, that..the Staff Report dated 22 September 1969 be adopted and that Final Design Approval be granted for A-326 as shown on Exhibits "B", "C", and "D" and subject to the conditions stated in said report; ~otion carried unanimously.- D. A-327 Utah Homes, Inc., DeHavilla~d Drive Final Design Approval - Subdivision Approval Continued from 8 September 1969 Commissioner Metcalf explained that this in reality will be an ex'poSt facto approval since a building permit has been issued to a previous 'developer.. Chairman Norton requested that a system be developed to check these matters more thoroughly in the future. Commissioner Metcalf moved, seconded by Commissioner Kraus, that the Staff Report dated 22 September 1969 be adopted and that Final Design Approval be granted'for A-327 as shown on Exhibits "A" through "G" and subject to the conditions stated in said report; ~otion carried unanimously. E. A-329 - William Wyant, Big Basin way - Final Design Approval Commercial Building Commissioner Metcalf introduced the Staff Report dated 22 September 1969 reconmending that Final Design Approval be granted for A-329. Chairman Norton recommended'that a' Condition (c) be added to the subject report as follows: "(c) . Stucco area shown as white zshall be off-white or beige." Commissioner Smith recommended that the Words "and sound isolated" be added to Condition (b) of the subject Staff Report. Commissioner Metcalf moved, seconded by Commissioner Kraus, that the Staff Report dated 22 September 1969 be adop'ted, as amended, and that Final Design Approval be granted for A-329 as shown on Exhibits "A", "B", "C", and "D" and subject to the conditions stated in said report; motion carried unanimously. F. A-330 - Elgin Capital, Big Basin ~ay - Final Design Approval Conversion to Office Building - Continued from 8 September 1969 Commissioner Metcalf 1) stated that the Design Review Committee did meet with the applicant to review the plansZand decided they liked the solid fence better than the open effect and 2) introduced the Staff Report dated 22 September 1969 recommending that A-330 be grante~ Final Design Approval. Commissioner Lively stated that h~ preferred the open fence since it has..the same horizontal lines as the building. Mr. Henderson, present to represent the applicant stated that there will be a court yard behind the fence. Commissioner Metcalf moved, seconded by Commissioner Kraus, that the Staff Report dated 22 September 1969 be:adopted and that Final Design Approval be granted for A-330 as shown on Exhibits "A", "B", and "C" subject to the condi- tions stated in said report; motion carried unanimously. · V. CITY COUNCIL REPORT Chairman Norton gav~ a summary of item~ reviewed and'action taken at the City Council meeting of 17 September 1969 with emphasis on matters of particular interest to the Commission. Continued Commissioner Kraus recon~nended that al material and facts relative to a recom~n~endation made by the Planning Commission and subsequently forwarded to · the City Council be made available to the Council in order to clarify the reasons for decisions or recommendations made ,by the Commission. Chairman Norton-agreed and further staked that, he felt, this is particularly important in a matter ~.J~.ere the Council might propose to reverse the reco~mendation of the Planning· Con,_~nission'. VI. PLANNING POLICY COb'D~ITTEE REPORT None VII. OLD BUSINESS A. PROPOSED AbfEND~iENT TO ZONING ORDINANCE NS-3 - Re Cluster Development and Park Dedication The Secretary stated that it was proposed sometime ago that developers be all0wed- to dedicate land for co~non green areas and public park use in order to gain more free park land ~or the City and 2) the proposed amendmen~ would accomplish same. ; Chairman Norton requested that the Secretary schedule the proposed amendment for public hearing and, also, request the City Attorney to prepare a final draft of said amendment. B.' A-325 - United Presbyterian Church, Saratoga-Sunnyvale Read and Herr inert Avenue - Clarification of Staff Report dated 8 September 1969 Comanissioner Metcalf introduced the S[aff Report .dated 22 Scpten~ber 1969 and explained that it was'simply ~fitten to clarify (for the applicant) the reports dated 8 April 1968 and 8 September 1969 in file A-325 rela- tive to parking requirements. Co~nissioner Smith advised that at the last meeting Commissioner Crisp stated that the parking for the' church is not determined by attendance but by the number of seats that will be available and the applicant has not filled his parking requirements. Comissioner Metcalf stated tha't the applicant informed the Design Review Co~ittec that he had been given dispensation from meeting the parking' r e quir emen t s. Chairman Norton stated that this matter should be reviewed by the Subdivision Com=~ittee. Commissioner Smith stated that': he felt that the Subdivision Con~nittee should~ discuss ·the matter ~,.,ith' the P!anning Committee of the City Council. NEW BUSINESS A. .Policy re Overhead Utility Facilities .in Pr.oximity to New Subdivisions The Secretary explained the subject policy (a copy of which distributed to each Commissioner) re overhead utility facilities in proximity to new subdivisions that had been for~rded to the Planning Commission and Planning Staff for their information and guidance by the City Council. Co~-nnissioner Crisp explained that the subject policy simply outlines the requirements the Planning Con~ission has been enforcing all along° B. P~!~cy on Grantin.~ Use Permits for Subdivision Sales Offices Com~nissioner Smith sta~ed that· 1) the report dated 22 September 1969 relative to policy on granting Use Permits for subdivision sales offices is a follow through on a suggestion made by Chairman Norton and 2) the figures quoted in the report are arbitrarily picked and can be changed. Con~nissioner Crisp recom,~ended that the Coma~iss~on tentatively· approv~ the report and refer it to the Subdivision Connnittee for discussion with the Planning Committee of the Council. Cormnissioner Smith moved, seconde~ by C6mmissioner Crisp, that the Subdivision Committee Report dated 22 September ·1969 relative to a policy on granting Use Permitsz for subdivision sales offices be tentatively approved by the Planning Commission and referred to the Subdivision Co.toni-tree for conshltation with a committee of the City Council; motion carried unanimously. Co Landscape Maintenance Provision The Secretary read a memo from the City ~nager stating that the City Council requests the Planning Co~_mission to prepare a procedure which will assure adequate provision: for maintenance of landscaping planted in connection ~.~ith subdivision: development. He f~ther stated that the residents of Saratoga Woods have submitted a coxm~mnication in opposition~ to the proposed hospital.
