ROLL CALL Present: Commissioners Fagan, Kraus, Lively, Marshall, }~rtin and Smith Absent: Commissioner Metcalf. B. MINUTE S Commissioner Smith moved, seconded by Commissioner Marshall, that the reading of the minutes of 26 April 1971 meeting be waived, and that they be approved as distributed, with the following changes: ," page 8...under B. A-355, line 6, insert word "not" between "would and "block"; page 10...paragraph 1, "NS-3.22" should rear "NS-3.7"; motion carried unanimously. II. PUBLIC ~ARINGS " Ao C-137 - Alfred F. Dumas, Inc., ProSpect' Road - Request for Change of Zoning from "R-i-10,O00" (Single°Family Residential) to "R-lo]..0,000" "P-C" (Single'Family Residential Planned Community) - Continued from 26 April 1971) The hearing was reopened at 7:35 P°M. Mr. Art Grafe, 12121 Saraglen Drive questioned the acreage as given by McKay and Somps and by the man who owned the land. He questioned whether the Flood Control easement and the pads had been taken into consideration as they cut down the acreage. He said that the Tax Assessor's records don't show the pad on Prospect, and Flood Control doesn't know the acreage in their easement. And then there is the matter of good Oak trees that are to be removed. He said he understood. that the Fire District had approved the map and asked about road width. Chairman Lively told him this was on a sliding scale, from 26 feet to 40 feet, based on the acreage.. Mr. Walker said 40 feet was needed regardless of layout of the subdivision. Chairman Lively .requested the Planning Director. to push Flood Control for answers to the questions sent to .them. Mr. Walker said he would get them before the next meeting. Commissioner Martin asked just what the easement could be used for and Chairman Lively said that no permanent structures could be placed upon it, nor anything which would impede the flow of water. Mr. Grafe asked if he could meet with the Subdivision Committee and he was told when' the Committee meets and that he could make an appointment to meet with them. Galeb, Ted Avenue.- Request for Change of Zoning from "R-l-10,000" (Single-Family Residential) to "R-M-5.,000" ~.{ulti- ~amily Residential The hearing was opened at 7:51 P.M. The Planning Director said that Notice of Public Hearing was mailed and published on this but that many of the residents said they did not receive them in time to arrange to attend. Chairman Lively asked if the notices are returned to this office by recipient and Mr. Walker said that was not required, but .that the notices are to mailed 5 days:in advance, and that is what is done.. Chairman Lively stressed that itjis the wish of the Commission that every- one ~oncerned should have a chan~e to be heard, either here or before the Subdivision Committee. Mr. Richard Foust, Architect for Mr..Galeb, spent considerable time explain- ing the unusual location of this property and what is planned for it, saying it·fronted on the r~ilroad and that there would be a 45 foot road, and a · driveway back into a court, a relatiyely private area between the two units. He said it would be kept in character with the subdivision that he could sell these units off. Commissioner Martin asked about the setbacks and Mr. Foust said the side yards would be 10 feet and front and rear Would be 25 feet, but that it could be varied and the buildings could be all single-story dwellings. He said there are two lots with four dwelling 'nnits each. Commissioner Smith wanted to know if they were going to be for rental purposes, or to sell. Mr. Foust said they would like to leave that open. Commissioner Smith mentioned that maintenance of a nice area would go to pot if the units were owned individually. Mr. Foust assured him these are large--not small-- units and are much more expensive t'han most of the units in the area, and much larger than the existing duplexes in·the area, and that an 'owner of that price unit is not going to let it run down. Commissioner Fagan asked about the lots on the east side of Ted Avenue and. Mr.:Foust said they are scheduled for development. Said there would be a total of 22 on Ted and Zorka; those, he said, are already divided into lots and were previously zoned for duplexes. They aren't zoned for duplexes now because of being brought into Saratoga, but it is all still a part of the whole piece of property. Chairman Lively called for comments from the floor, and Mrs. Reed wanted to know if De Sanka would be opened up and was told it would, that the entire area would be opened later. Walter Bamber, 12384.De Sanka asked if there were 11 lots and 22 living units in all and was answered affirmatively. Mrs. Lorraine Boyd, 12500 De Sa~{a, complained that the right-of-way along the railroad was a veritable freeway and said to open it up would be terrible - that is is already being used for motor bikes and horses but to open it to traffic would be terrible. Chairman'Lively said that the connection to De Sanka would be through the commercial area, through to the west. He said since this is the first hearing-, this would doubtless be brought up again. Mr. Townsend, 20381Zorka, wanted to know what would keep them from going back to the original, and what about upkeep? And would the new ones look like the old ones? Chairman Lively explained that neither the Planning Commission nor the·City had much to do with upkeep--except where it concerns health and things of that nature. -2- Planning ConEnission 10 May 1971 - Continued II. B. C-145 - Continued Mr. Galeb said this is not new; that it has been a problem area before city incorporation and even before any of the homes were built and developed, and that if it isn't upgraded this area will become a slums, but he feels that this would definitely improve the whole area and would be a credit to Saratoga. Chairman Lively continued the hearing until the next regular meeting, and invited those who wished to make an appointment to meet with the .Subdivi- sion next Thursday. The hearing closed at 8:16 for the evening. C. C-146 - Aubrey Johnston~ Quito Road - Request for Change of Zoning from '~-1-10,000" (Single-Family Residential) to "C-N" "Neighborhood- ~ .Corm~,~rci~l) Chairman Lively opened the hearing at 8:17 P.Mo Planning Director Walker read three communications received on this matter --2 from other parties and one from the applicant. Applicant Johnston related how he had tried and tried to sell his p~operty but with the State Highway Department continually moving the date of their construction forward on the freeway,'the latest date projected to'be at least 10 years away, it is impossible to sell with the present zoning. He said he had chances to sell--one for.a medical-dental building--but they lose interest as soon as they find out about the .freeway. Chairman Lively continued the hearing until the next regular' meeting, referred the matter to the Subdivision Co~maittee and closed the hearing at 8:24 P.M. for the evening. D. C-147 - Clifford C. Beck, Saratoga. Avenue and Cox Avenue - Request for Change of Zoning from "R-i-iO,O00" (Single-Family Residential) to '~-A" (Pro~essional-Ad.minist. rative) The hearing was opened at 8:25 P.M. The Planning Director stated that'this concerns the property at the corner of Saratoga Avenue and Cox Avenue containing 2.'99 acres. He read two written communications objecting to this rezoning, one from Fred Styles and one from Floyd A. Sternberg. Mr. Gene Fink, representing Mr. Beck'contended that professional offices in this location would not add appreciably to the traffic and would keep a residential atmosphere. He predicted that by 1990 on Cox Avenue, the traffic count would be 500 cars per hour and that would be particularly bad if there were homes here, and that the Southwest corner and the Southeast corner are already zoned for P-A and the church across the street would not interfere trafficwise with the proposed zoning .here. He said most of the buildings would be 70 to 100 feet away from the residential buildings in the area. He stressed the drawing is preliminary and that all Codes would be complied with concerning setbacks, etc. Mr. S~yles, 18990 Saratoga Glen Place voiced further objections, then mention- ed regarding notices, 5 days is not enough; should be 10. Mrs. }~rgaret Arnet, of. 12810 Saraglen Court, whose lot backs up to this development wanted to know about access roads and noxious fumes.. C-147 - Continued Floyd Steinberg, 19020 Saratoga Glen'Place, asked if the old proposal sub- mitted when Andy. Johnson was on the Commission was still on file. It called for 12 lots on this corner and was a real good plan. He proposed tha~ an impartial coranittee study it to see if it could be used. Chairman Lively'said that was really up to the developers and Design Review Committee and there was no need for any special committee. Commissioner Smith said we ought to keep this as a residential area. The hearing was closed for the evening at 8:54 P.M.~ and the matter referred to the Subdivision Committee. E. UP-201 - West' Valley Ambulance Servi~e, Saratoga-Los Gatos Road - Request for use Permit to Allow an Ambulance Service - Continued from 26 April 1971 The hearing was opened at 8:57 P.M. " The Planning Director outlined the request for an ambulance service to be located at 20465 Saratoga-Los Gatos Road in the Dr. John Cox office building, between the Federated Church and Saratoga Market. The ambulance would be housed adjacent to a small dpartment used by two (2) attendants, with not business nor administrative offices involved. He read a letter from Mr. Giegling of the Division of'Highways regarding parking along the street. Mr. Walker said that only one tree of any size. would have to be removed. Commissioner Smith asked about certain trees on the property and Chairman ~ively said that the map submitted didn't show all the items it should, such as the trees to be removed; where the parking would be eliminated, etc. He asked that this be obtained by next meeting. The hearing was continued to the next regular meeting, and was closed for the. evening at 9:01PoM. F. UP-202 - Boy Scouts of AmericA'- Troop 50~, Sobey Road - Request for Use Permit to Allow a Boy Scout'Meeting Building - Continued from 26 ~pril 1971 The hearing was reopened at 9:02 PoM.' The'Secretary read the Staff Report dated 10 Ma~ 1971 recommending that the subject Use Permit be granted. Commission Smith recommended that Condition "d" be added to the subject report as follows: (d) Maintenance of area and building used only. After .. occupancy, continuance'of the Use Permit shall be contingent upon future maintenance of the entire property in a manner which complies with the condi- tions set forth.. Commissioner Smith moved, seconded by. Commissioner Fagan, to close the hearing at 9:07 P.M°; motion carried unanimously. Commissioner Smith moved, seconded by Commissioner Fagan, to adopt, as amended~"'the Staff Report dated 10 }~y 1971 and grant the Use Permit on the basis the findings required by SeCtion 16.6 of Zoning Ordinance NS-3 can be made and subject to the conditions stated in said report; motion carried with Commission Lively abstaining. G. y-362 - Robert Minardi, b~drone Hill Road - Request for Variance to Allow a Reduction in Side Yard Setback Requirements - Continued from 26 ~pril 1971 The hearing was reopened at 9:08 As there were no questions, Commissioner Kraus moved, seconded by Commis- sioner Smith, to close the'hearing at 9:12 P.M.; motion carried unanimously. V-363 - Sheldon Frost, McFarland Avenue - Request for Variance to Allow a Reduction in Rear Yard Setback Requirements The.hearing opened at 9:14 P.M. Mr. Walker said the Variance is requested to permit applicant to build a garage. He read a letter from Mr. and Mrs. Wallace Johnson of 18677 ~rtha Avenue. After an objection f~om the audience, voiced by Mrs. Wallace Johnson, and approving remarks by Mrs. Mae Frost and Sam Silacci, who felt that the whole Quito area should be permitted to build this type of building, the hearing was closed at 9:20 P.M., and the matter referred to the Variance Co~nittee. I. V-364 - West'Valley Junior College, Fruitvale Avenue and Allendale Avenue - Request for Variance to Allow Increase in the Height of Auditorium The hearing .opened at 9:21 P.M. Mr. Walker explained that the' request for Variance is to permit a 67' high scenery loft in the auditorium, instead of a 55' loft. tte stated that due to objections by th~ City, applicant'has moved the location of subject building 50 feet to the north and downhill which reduces the building's relative height by 7 feet, from an'elevation of 424 feet to 417 feet. Mr. Walker also read a letter from Judy and James Vance0f 19363 Athos, stating their objections to the effect it wasn't right for a residential area. Gene Arnold said that. nothing had been changed from the original application except moving this building to a lower location so it would block no views, and, that the structure would blend in with the surrounding terrain. He said that additional trees are to beplanted to further complete the picture. Bill Higgins, Architect, said that by moving the building, the ground floor would be lower.. Chairman Lively said that the plans, as revised by West Valley Junior College will be reviewed. Gary Bonfiglio read the Staff Report. The hearing was 'closed at 9:30 P.M.. C0mnissioner Kraus moved to'adopt the Staff Report and to grant Variance on the application, as amended; seconded by Conmissioner ~rshall. Chairman Lively voted no in protest to the need for this Variance and in the hope that in the future the West Valley Junior College will bring preliminary designs to the Planning Conmission for early review to prevent the type of action this Variance represents. The motion carried and Variance was granted. J. V-365 - Mijo Miljevich, Miljevich Drive - Request for Variance to Allow Relo- cation of Non-Conforming Structure and'Use The hearing opened at 9:37. · Mr. Walker explained that applicant is asking Variance to allow the permanent relocation of a non-conforming building from 20446 Miljevich to the Northeast corner of Saratoga-Sunnyvale Road. He stated it was moved illegally and the 'Code Enforcement Officer has submitted his report and is taking action on behalf of the City. M~. V-365 - Continued Mr. Doug Adams, representing Mijo Miljevich, presented sketches showing the present location of the building on. the property. He said that there had been an old barn which burned. But this building is not a barn. It is to be used for storage of fruit. He said that Mr. Mijo Miljevich had been in Saratoga since 1907, and that people who purchased nearby property realized he was operating a drying shed. He said that they are going to be storing apricots, pears and maybeZsome prunes, but mainly apricots and pears~ and that there is no other place on the grounds to store fruit. There are approximately 4 acres zoned R-l, and it doesn.'t matter which part ..... of the property it is on, Mr. Miljevich needs the building in order to continue his.livelihood. Mr. Adams said he hadn't had a chance to meet with the Planning Commission. · Chairman Lively said it is the usualiprocedure for the applicant and/or his representative to meet with the Variance Committee to inspect the prop- erty and-asked if that Committee would meet with them at the site at 9:30 A.M. on Saturday. It was agreed. Comments from the aMdience were called for by Chairman Lively. Edwin Kennedy, of 20520 Leonard Road, responded, saying he had a perfect view of the property in question. He wanted to know if the present location is where the building will rest, sin~e it is on blocks or wheels .and evi- dently will be moved to a permanent spot. He asked whether anyone had' drawings as to where it will be. Mr~ Adams. said that its present location is where it will be. Mr. Kennedy wanted to know the former use of the build- ing before it was moved, and structurally whether it conforms to the Build- ing Code. He said the building is being moved onto R-1 and doesn't conform to the Master Plano He wanted to know whether it is one-story or two- stories, and further, what assurance' there is that it would be used for the purpose given, or for something else. He said he is a person that likes to "live with his neighbors," and he. realizes Mr. Miljevich has certain rights, but that when he looks out his window and sees lights that burn all · night . . and whether there is any indication it was formerly used as living quarters? He addressed the Chairman, saying he would like to go on record as being opposed to the request of putting this barn permanently on the Miljevich property. Mr. Nick Miljevich, of 20446 Miljevich Drive, addressed the Commission in defense of the application, saying that he was born on that land 45 years ago, becoming a farmer through inheritance; that farming is all he knows, and he resents people who are retired moving in, and then in a few years leaving; that he has five boys to bring up and that costs money. He said that the building will be used for storage of fruit and equipment. There will.be no dehydrator, and no prunes. The cutting operation, he said, lasts approximately 21 days. There had been lights' at night, he said. The men who watched the dehydrator stayed there -- they had no place to go -- but they have moved out. OutSide of the people who live at the back, actually no one can see that. building, he said. V-365 - Continued His stock in trade,· he said, is his property and he suggested that the objectors go home and stay in their own backyard and leave him·alone, and to· thine it over--that he needs this building. Edward F. Metzger, 20398 Kilbride CoUrt, said he was in full accord with the idea that people-who built this area back in the '10s and '20s deserved consideration; that he bought his home with this agricultural area behind it; that it is worth $20,000 for the lot alone, but if he had to sell it now, this situation would reduce it by $5,000 to $10,000. And he felt, in view of the moving violation, that the variance should be denied. A1 Cadella, 20380 Kilbride Court, felt there was more than the moving of the building involved, at least as far as he is concerned. The rubble that was left along the fence-line when the other structure burned down-- he asked them to remove it and they Said they would, but never have. He voiced serious objection to granting·this request. Dick Levine, 20666 Kilbride Court objected, saying that when they first bought there one could barely see the structure, but in its present loca- tion it is very visible. Chairman Lively closed the hearing at 10:20 P.M. and referred the matter to 'the Variance Committee and reminded applicant that'the Variance Committee would be out··to inspect ~he place on Saturday, ~y 15,·at 9:30 AoM. He then directed that this matter be continued to the next regular meeting, 24May 1971. III. BUILDING SITES AID SUBDIVISIONS A. SDR-888 - Thomas Dashiell, Bohlman Road - Building Site Approval - 3 Lots - Continued from 26 April 1971 Commissioner Smith moved that this be denied unless the requested continuance is received before ~y 17th; seconded by Commission Kraus;'motion carried unanimously. B. SDR-895 - S. B. Walton, Saratoga Hills Road - Building Site ~pproval- 2 Lots - Continued from 26 April 197i Commissioner Smith moved, seconded by Commissioner Kraus, that this be ap- proved subject to the Building Site Committee Report of 10 May 1971, and that the map be approved; motion carried unanimously. C. SDR-899 - Edward Oliver,. Saratoga Avenue - Buildin~ Site Approval - 1 Lot Chairman Lively said there is some concern about the 3-car garage, and said the Ordinance required a rear setback of 25-feet. · Mr. Oliver said he only put it there because "you people told me to." Said it didn't have to be that big, that he only added the other door because he was told he was allowed to. He said it is actually only a 2-car garage. Chairman Lively felt the matter should be continued two more weeks and that a plot plan should be brought in showing the garage, cabana and pool. He so directed. D. SDR-900 - Lively Oak Realty, Inc., Foothill Lane - Building Site Approval - 1 Lot Chairman Lively directed that this matter be continued until the next regular meeting, 24 ~y 1971. E. 'SDR-901 - William P..Goeppner, Vaqqero Court - Building Site Approval - 1 Lot Chairman Lively said approval should be subject to the condition that no existing trees be removed without approval of the Planning Department. Commissioner Smith moved,'seconded by Commission Kraus, subject to the above condition and that Exhibit '~" be approved. P~CESS AND RECONVENE IV. DESIGN REVI~ A.' A-355 - Tire Service Company, Prospect Road - Final Design Review - Landscape Plan - Continued from ·26 April 1971 Commissioner Marshall moved, seconded by Commissioner Martin, that the Staff Report dated 10 May 1971 be adopted and that Final Design Approval be granted for the landscape plans subject to the conditions stated in said report; motion carried unanimously. B. A-369 - Sisters of Notre Dame, Bohlman Road - Final Design Review - Remodel- .in~ of Novitiate Buildin~ The Assistant Planner read the Staff Report dated 10 ~y 1971 recommending that Final Design Approval be granted for A-369. Commissioner Marshall recommended that the subject report be amended to · include the following condition (d): (d) ~rivate interior access road to be utilized for ingress and egress; other entrances to be used for emergency purposes. Commissioner Marshall nDved, seconded by Co~missione~·l,~rtin, that the· · Staff Report dated 10 May 1971 be adopted, as amended, and that Final· Design Approval be granted for the remodeling of the novitiate building subject to the conditions stated in said report; motion carried unanimously. A-373 - Alfred Dumas, Inc., Prospect Road - Preliminary DeSign Review - Planned Community Development - Continued from 26 April 1971 Chairman Lively directed that this be continued, at the·request of appli- cant, to the next meeting, 24·May 1971. D. A-374 - West Valley Junior College,·Fruitvale Avenue and Allendale Avenue - Final DesigR Review - Humanities and Fine Arts BUilding Commissioner ~rshall moved, seconded by Commissioner Martin, that the Staff Report be adopted in accordance with Exhibit "A" and the Conditions (a), (b) and (c). Motion carried unanimously. · V. CITY COUNCIL REPORT Commissioner l.~rtin gave a summary of items reviewed and action taken at the City CoUncil meeting of 5 ~y 1971, with emphasis on items of particular interest to the Commission. VI. PLAN}IING-POLICY CO~IITTEE REPORT Commissioner Kraus reported the entire matter of the Joint Housing Study will come up·before the Planning-Policy Committee on 19 }~y 1971, but didn't believe any action would be taken--only receipt of the reaction ef the various cities and counties to this important document. He discussed the proposed housing element and concluded that further review of this matter would be'taken up at the Special Joint City Council Meeting set by the Mayor for 12 May 1971. -8- .Plan~ing Con~mission Minu~ 10 r~¥ i~7i - Continued VII. OLD BUSINESS A. West Valley Junior College Assessment District - Continued from 26 April 1971 Mr. Walker read the Staff Report. Commissioner Smith moved that .the last paragraph of the report be stricken and that the report be fon~arded to the Council as the recommendation of the. Planning Conmaittee. Seconded by Commissioner Kraus; motion carried unanimously. B. I'~ST VALLEY CHAPEL - Request to Add >unbulance Service tO the List of Con- ditional Uses in the "C-C" (Community-Commercial) Zoning District - Continued from 26 April 1971 Chairman Lively directed this matter be'continued to the next regular meeting, 24 }~y 1971. D. SDR'891 - George H. McKenzie, Montalvo Road - Request for Reconsideration of Conditions - Continued from 26 April 1971 The Secretary reported that this is awaiting word from the Council on McKenzie's Offer to Dedicate to the City. Commissioner Smith suggested that we should comnunicate with Mr. McKenzie on this, and Chairman Lively so directed. E. ~-140 - Prince of Peace Lutheran Church, Saratoga and Cox Avenues - Request to Reinstate Zoning Application The. Secretary said this was carried off the agenda to enable the Council to complete revision of the General Plan. Chairman Lively directed it continued off agenda until the Council completes the General Plan. VIII. NEW BUSINESS .. A. Secretary Walker presented a new tree-list, composed by Brian Gage, listing different species of trees for subdivisions. Chairman Lively directed that it be referred to Design Review Committee for report to the Commission. -B. The Secretary brought up the matter of aesthetic grading standards that have been talked about for many years but never came fo fruition. Commissioner Kraus inquired as to the status of elimination of conditional uses in R-1 zoning districts and the. Secretary said this matter would come up for public hearing at the next meeting and the City Attorney would be requested to make appropriate revisions in the proposed ordinance. Chairnmn Lively directed that the matter be referred to the Subdivision Com- mittee 'and then to t]~e Design Review Committee, for report. IX. COM}FONICATIONS A. WRITTEN - None B. ORAL Councilman Cole Bridge~ complimented·the Conmission on its good work. -9- Commissioner }~rtin said he 'felt the subdividers should have to put in trees prior to occupancy of the homes. The Secretary said the trees are conded for the subdivision. An effort is being made to ·change this and to have the trees put in at the same time as the roads are finished and ap- proved, ·so something is done prior to completion of the homes, even prior to construction. Chairman Lively asked if it would be feasible to get out a letter to the subdividers concerning the requirements of the Subdivision Ordinance as to the number of trees, the species, planting procedures--something to insure the installation of trees before the homes are completed. The Secretary said that in some instances, like Oak Knoll, the subdivider is bonded for trees, but waits until the homeowner has done the landscaping then takes credit for it by counting. their trees which they have planted in their yards. One section of Brown and Kauffmann doesn't have·one tree and almost every house is occupied, he said. _.~'~ ..... "' Chairman Lively asked for a report at the earliest possible meeting. ....
