"P-C" (Single-Family Residential Planned C~nununity) - Continued from 10 May 1971) The Secretary recommended that C-137 be continued to the next regular meeting to ~llow time for the applicant to submit a revised map showing Department of Public Works engineering requirements. No one tn the audience wished to co~ent relative t~ this application. ~'Chairman Lively, in view of the ~oregoing, did not ~pen the hearing for C~137, directed the matter continued to the meeting of 14 June 1971 and referred same to the Subdivision Co~ittee. -.. Galeb, Ted Avenue'- Request for Change of Zoning from "R-I-IO,O00" (Single-Family Residential) to "R-M-5,000" (Multi-Family Residential) - Continued from 10 [~y 1971 The hearing was reopened at 7:41 P.M. The Secreta~ recommended that this matter be continued since there has been some question relative to a proper ~otice of hearing and the list of names submitted By the applicant requires further verification and it .may be' necessary for t~e applicant to render a new list. ~ommissioner Smith state'd that the Subdivision Co~ittee met with ~. Sheets .. of 12444 Ted Avenue and another gentlemen from the area who are present at ~his time and may want to present some points for the applicant to consider. ~. Bogden of 12471 DeSanka Avenue asked about what type of buildings that will be put on this property and how the land. wil!..be .d.~y~ded? ..................... Chairman' Lively stated that the plot plan indicates eleven (11) lots and the applicant has proposed a series of duplexes with t~o (2). lots and a total of twenty two (22) units. The plan will be available for review at the inter- mission or at the City Offices during office. hours. ~o~issioner Smith stated that the neighbors objected because they are in an -"R-i" zoning district and it would lower the 'value of the property adjacent to the subject property if duplexes Were allowed on the property. .He further stated that the applicant and his neighbors should get together and arrive a~ a c~promise that would be acceptable to both ~rties. ~. Wes Kosich, 18867 Kosich ~ive, representing the applicant stated that '1) the duplexes would not lessen the value of adjacent properties since their ~alue 'is' $60,000 for each duplex building of two (2) dwelling units and the applicant did meet with some of the neighbors and they seemed to be in accord with the proposed plan as long as the buildings remained one-story and 2) the largest parcel is 200-feet in depth and 500-feet in width facing on ~Sanka and he cannot see any reason for opposition if the property is developed as ~roposed. C-145 - Continued Mr. Jack Young, .12385 DeSanka Avenue, suggested that the traffic plan be altered to detour through the commercial area at the corner of Saratoga-Sunnyvale Road and Sea GUll Way and bordering the railroad tracks. '- " Mr. B. T. Galeb, applicant, was present and stated that 1) he is, also, interested in controlling the traffic in the area 2). the neighbors have a right to be .heard 3) the Planning Commission has a responsibility to use their ~ight to do right 4) a sub-standard development could be put 'en the property; however, this would not be marketable and he prefers high grad~ buildings that can be controlled, but he cannot have this without the cooperation of his neighbors and the Planning Commission and 5) this is a problem area that requires special consideration. ~. John B. Monney, 12385 Ted Avenue, stated that 1) he has not received (for the second time in a row) a Notice of. Hearing relative to this' appli- 'cation and 2) 'he can see no reason why DeSanka Avenue and Sea Gull Way .should not .be connected to provide ingress and egress for this develop- ment'in lieu of 'the proposed Ted Avenue-DeSanka Avenue connection. " ~. Thomas R. Pochari, o~.mer of the property at -20331 Zorka Avenue, stated that 1) he is opposed to the subject change of zoning and 2) it is his opinion that duplexes on the subject ~r'operty w0uid somewhat degrade the'entire area unless a great number of restrictions were imposed. Chairman Lively closed the hearing for the evening at 8:05 P.M., directed C-145 continued to the meeting of 14 June 1971, and referred the matter to the Subd iv is ion Com~mit tee. .... C. C-146 - Aubrey Johnston, Quito Road - Request for Change of Zoning from "R-l-10,000" (Single-Family Residential) to "C-N" (Neighborhood- C~ercial). - Continued from i0 ~y~ 1971 Chairman Lively reopened the hearing at 8:06 P.M. The Secretary recommended that this.matter be continued to allow time for further. study. Commissioner Smith stated that the applica~t'ha~ not submitted any information relative to use he intends to make of the property under the requested rezoning. ~. Aubrey Johnston, the applicant, ~s present and stated 1) he has requested the subject change of zoning because he ~nts to sell the property so he can retire and move from the area and. 2) he has been unable to sell the property with the current "R-i" zoning due to the fact the State High~y Department has indicated that the property will be used for a portion of the West Valley Free~my s~etime in the future. ' The Secretary stated that a letter was received fr~ ~. Gene Fink, applicant's attorney, requesting that C-147 be. continued to allow time for the applicant to appear bef~e the City Council and request that the change of land use be consider. as part of the General Plan for 1971. UP-201 - West Valley Ambulance Service, Saratoga-l~vs Gatos Road - Request for Use .Permit to Allow an Ambulance Service - Continued from 10 t'~2y 197 1 · The Chairman reopened the hearing at 8:13 P.M. .' -.~ · ·The Staff Report. dated 24 ~.~ay 1971 was read. The SeCretary reconnnended that the condition (a) of the subject report be amended to read as follows: : ~.- (a) Pave existing driveway and provide nine (9) pa~ed, off-street parking spaces as sho~m ~n Exhibit "B" · and n~arked in accord with Section 11.3 of Ordinance NS-3. · ' Commissioner Kraus moved, seconded by Com~issioner Fagan to close the hearing for UP-201 at 8:18 P,M.;'moti0n carried unanimously. Commissioner Smith moved, seconded by Commissioner Kraus, that the Staff Report dated 24 ~y 1971 relative to UP-201 be adopted, as amended, and " that the subject Use Permit be granted for a 24-hour ambulance service on the basis the findings required by Section 16.6 of Z6ning Ordinance NS-3 · ' can be made and subject to approval of the request that· "Ambulance Service''· be added to the list of conditional uses in-the' "C-C" (Community-Commercial) Zoning District; motion carried unanimously. F. V-363 - ~heldon Frost, McFarland Avenue - Request for Variance to Allow a Reduction in Rear Yard Setback Requirements - Continued from ~. 1971 The hearing was reopened at 8:21 P.Mo :A communication from Charles T. Younis of 18747 McFarland Avenue was filed in support of the .requested variance. " The Staff Report dated 24 May 1971 recom~aended denial of the subject variance. The applicant was present and stated, she felt, it would be an unfair decision '. to deny the subject variance. Chairman Lively explained if the variance is denied the applicant can, within ten (10) days, file an appeal to the City Council, Commnissioner Smith moved, seconded by Connnissioner Kraus, to close the hearing in connection with V-363 at 8:36 P°M.; motion carried unanimously Commissioner Kraus moved, seconded by Comn.~issioner };arshall, that the Staff Report dated 24 ~[2y 1971 be adopted and that the subject request' for variance to allow a reduction in rear yard setback requirements be denied since the findings required under Section 17.6 of Zoning Ordinance NS-3 cannot be n~de for the reasons stated in said report; motion carried Unanimously. V-36____j5 - Mijo Miljevich, Miljevich Drive -.Request for Variance to Allow Relocation of Non-Conforming Structure and Use - Continued from The hearing relative to V-365 was reopened at 8:~7 P.M.. The Secretary read a combination Statement of Reason and sum~ry of the facts surrounding the applicant~s property and the requested variance filed by Douglas R. Korten of the Kahle and Adams law ~ffice. ~'. Don Miller, o~.mer of adjacent property o~mer ~t 20399 Kilbride ~ive, ~tated that 1) the building that burned do~.m on the Miljevich property . last JanUary ~.ms not a barn but a d~hydrator 2) he and his family were forced to leave their home because of the fire 3} the new structure that has been moved in is a new bunk house and not a barn and it was moved in during the ~ark of night 4) the original building was much smaller t~an the three (3) story str~cture that has been brought in 5) the building is ~ public nuisance and he and his family have ~ncurred countless harrass- ments from the Miljevich children and the applicant 6) the children stand ~n top of the three (3) story building and shoot B-B guns and sling shots Into his y~rd 7) he has full knowledge of what ~s on the Miljevich side of the fence when he bought the adjacent property ~nd now there are three (3) illegal buildings there that the ~'pplicant s~ould be required to remove from the property and 8) at the Ciey Council m~e~ing'of 3 1~reh' 1971 the' Council instructed the City Attorney to t~ke action to get. rid of the three (3) story structure. ~. Korten, respresenting the applicant, stated thnt 1) it was his under-. ~tanding that the old building ~.~s not that much ~aller than the new one ~) the building is in reality a' two--(2) story b~lding and not a three (3) ~tory and 3) the applicant s~ates that the gas station and other buildings have been on the property for many years, but their positions may have been ~hifted because of the clean up. involved in connection with the fire. ~. Miller stated that 1) the neighbors have aIready landscaped the area that should have been done by the' applicant 2) 'the new building is a lot~ longer and higher than the one that was burned ~m and 3) due to the height of the building he has no privacy in his 5zck yard. Chair~n Lively, in answer to an. inquiry from }~. Korten, stated that if th~s variance is .denied it does not prevent this applicant from applying for another .variance regarding construction or use of a new building. ORDINANCE' ~.~NDI.~NT - ;~ending the Zoning ~dinance NS-3 by Deleting Certain Conditional Uses fr~ '~-1" Zones and Modifying Certain Off-Street Parking Requirements for Offices 'The Secretary stated that this r~tter should be continued 'to the next regular meeting since the City Attorney has been in court on a case involving the City; therefore, the Staff and Attorney have not been able to get together ;to discuss the subject ordi'nance~mendment. Chair~n Lively', in view of the foregoing, did not open the hearing at .this time, directed the subject ordinancesamendment continued to the next regular meeting and referred same to the Subdivision Committee. III. BUILDING SITES AND SUBDIVISIONS. A. SDR-899 - Edward Oliver~ Saratoga Avenue - Building-Site Approval - 1 Lot - Continued from 10 May 1971. Co~issioner Smith stated that the applicant did review the proposed '~onditions of approval and expressed satisfaction with same. CoFmissioner Smith moved, seconded by CommisSioner ~aus, that the Building Site Committee Report dated 24 May 1971 relative to SDR-899 be adopted and that the tentative map (Exhibit "A 1" filed 19 May 1971) be appr0ved subject to the conditions set forth is said 'report; motion carried unanimously. B. SDR-900 - Live Oak Realty, Inc., ·Foothill ~ne - Building'Site Approval '- I Lot .- Continued from 10 ~.~y 1971 Co~issioner Smith recommended that· SDR-900 be continued to the next regular meeting to allow time for the applicant to submit a revised map. Chairman Lively so directed. C. D. 86R-905 - Meridi~h Rosebough, Via Regina - Building Site Approval - 1 Lot The Secretary recont~ended that the following condition be added to the Building Site Committee Report d~ted 26 May 19.71 relative to SDR-905.: "L.Retain tree at corridor access and Via Regina in accordance with Fire District regulations concerning trimming and access." IV. DESIGN REVIEW ." A. A-370 - ~ames R. Davi, Sousa lane ',Final Design Review - Convalescent Hospital The Staff Report dated 24 May 1971 relative to A-370 ~s read. The applicant was present and stated he is in agreement with the subject report. V. CITY CO~,~CIL REPORT .. The Assistant Planner gave a sunmary of items reviewed and action taken at the ;= City Council meeting of 19 t,'~y 1971 ~ith emphasis on items.of particular interest to the Commission. VI. P~ING POLICY CO~,~ITTEE : C~missioner ~aus stated that 1) he did attend the 19 F~y 1971 meeting for ~h~ discusslon relative the Joint' Housing Element Stndy 2) there were approximately fifty (50) organizations present and they all spoke in favor of the Joint Housing Element Study and no one spoke against it while he ~s there and 3) a Committee . will study the comments and suggestions made at this meeting. VII. OLD BUSINESS. Mckenzie, Montalvo R~d - Request for Reconsideration of Conditions - Continued from 10 May 197~ The Secretary stated that in view of the applicamt's offer of dedication of " a portion of this property which is pending bef~e the City Council it is zecom~mended that the subject request for reconsE~eration of conditions be ~ontlnued off the agenda until the City 'Council ~akes some action. SDR-891 - Continued Chairman Lively, without objection, directed the subject request continued off the agenda until a resolution is received from the' City Council relative to the said offe.r of dedication. VIII. NEW BUSINESS A. C-139 - Mala~hy J. Moran, Saratoga Avenue - Referral by the City Council for Revision of Ap_plication 'The Secretary stated that 1) the City Council a~ '~the m~eting of 5 ~y 1971 'referred this matter back to the .Planning Cormmission on the basis of a · request from the applicant to amend his application and requesting ."R-!%!O, 000" zoning instead of "R-i-20,000" zoning for his property on Saratoga Avenue and 2) in light of the subject revised zoning appli~tion the applicant further requested that the General Plan be reviewed to im~lude the properties along Saratoga Creek as to their laDd use density. ~. Moran, the .applicant, stated that 1) the a~mded application is the result of many discussion with the Staff, Subdivision Con~mittee, Planning CoEission and City Council even though he feels the original request was -fair and-reasonable 2) approval of the present ap'plication is urgent because of property taxes and his personal coEittments and the cost of improving the property is going up all the time 3) the more time that elapses the worse the potential becomes for. selling the property.; ~h. erefore, he would appreciate the Planning Commission holding a public hearing on the amended request as soon a possible and 4) it is his recommendation t'hat the area along SaratOga ~eek be reviewed along with .the General Plan. Chairman Lively explained that the Planning Co~nission has already reviewed the General Plan and fon.mrded same to the City ~uncil and it would be best for 'the applicant to talk with the City Council relative to any changes in the General Plan. The Secretary stated that a notice of public he~ing could be ~ailed in time' for the next regular meeting. Chairman Lively directed the amended request, relative to C-139, 'continued to the next .regular meeting and requested the Secretary to ~il a notice of public .~earing to all residents in the area with{n 500-feet of the subject property informing them of the scheduled public he~ring. B. Miljevich Prope~y, Miljevich ~ive - Memo to C~e Enforcement Officer "- Commissioner ~rshall reco~ended that a memo be ~rafted to the Code Enforcement Officer relative to the MilJevich property as follows': .."'On 15 ~y 1971 the Variance Comittee and _~_.~e~F.'' of th'e Plan~ing Department vlsited the pr6perty of t'ha bIessrs. Miljevich o~ MilJevich ~ive to determine the potential of the non-conforming structure on the ~ite. During this visit a number of conditions t.Tere noted that should be corrected; consequently, there is a rec~mendation from the Planning Co~ission.aS follows: That a complete inspection and Clean-up of the property should be made including removal of all junk and debris, elimin~tion of non-conforming temporary or permanent buildings used for dwelling purposes, the obtain- ~ng of proper permits from the City'for buildings, and adequate sanitary conditions. Lively requested the Secretary to draft a memo in accord with' the'aforcmentioned'wording and for~mrd same to the. Code Enforcement Officer. : C. ~ST VALLEY J~!OR COLLEGE ASSESS~,DENT DISTRICT The Secretary explained that the college has had this assessment distric~ reviewed by the City Council and Planning ComJnission as to the overall plan; however, the.college does want to proceed with the. first phase along Fruitvale AVenue and the City Council on the basis of the request have asked the Planning C~mission to review the first phase and make sure it is in compliance with' the }~ster Plan for the college and the assessment district. Co~issioner ~aus reco~ended. that the matter be referred to the Design Review Committee for further study. Chairman Lively so directed.and requested the Secretary to ~ite a letter to ~WJC and ask them if they have any new designs they would like the Planning Commission to review and if there is anything ~he City can do to help them expedite their plans. IX. CO~R,~I~TIONS A. ~iTTEN btter from ~. R. K. Thompson. re Jack's R~d The Secretary read a letter received from ~. R. K. Thompson requesting the. trees and other vegetation' be left undisturbed in the area of the required road improvements on Jac~'s Road. The Secretary then stated that.this matter has been resolved by the Planning Con~ission at'a previous meeting and the natural vegetation and trees_in that area will be .left in their natural state. and ~. Thompson has been ~de aware of the action of the Planning Co~ission. B. ' O~L Tree List .. The Assistant Planner distributed copies of a new Tree List which included suggestions of Brian Gage, ~esident ef the Hortlcultu~al Foundat ion.
