I. ROUTINE ORGANIZATION
A. ROLL CALL
Present: Commissioners Belanger, Lively, Marshall, Martin, Matteoni,
Metcalf, and Smith.
B. MINUTES
Commissioner Smith moved, seconded by Commissioner Marshall, that the
reading of the minutes of the March 12, 1973 meeting be waived and
that they be approved as distribu[ed to the Commission; motion carried
unanimously.
PUBLIC HEARINGS
A. V-391 - O. H. George, June Way and Jerries Drive - Request for Variance to
Allow Reduction in Side Yard Setback Requirements - Continued from
March 12~ 1973
Chairman Lively reopened the hearing relative to V-391 at 7:36 P.M.
The Secretary read the Staff Report recommending that the Variance
request in connection with V-391 be granted.
Commissioner Smith stated that he.questioned whether there is sufficient
hardship involved in this to warrant a Variance.
Commissioner Marshall stated that'if the pool Were located in another
area of the yard the power lines would have to be relocated. The pro-
posed pool located is the one ]~urthest"'n away from any other residence;
therefore, it is the most logical place for said pool.
Commissioner Matteoni stated that:the new fence alignment would not
impede the view of any vehicles. Placing the pool in another location
on the property would be somewhat of a hardship due to the relocation
of the utilities; whereas, other:home-owners in t~e area were not r~quir~'d
to do this to accommodate a ppol on their lot. "'
Commissioner Metcalf stated he agreed with Commissioner Smith that the
proposed Variance'did not really involve a hardship situation.

Commissioner Marshall moved, seconded by Commissioner Mar.tin, that
the public hearing in connection with V-391 be closed at 7:45 P.M.;
motion carried unanimously.
Commissioner Martin moved, seconded by Commissioner Matteoni, that
the Staff Report dated March 26, 1973 be adopted, as amended, and that
the subject request for Variance'..be approved on the basis the findings
required by Section 17.6 of Ordinance NS-3 can be made subject to the

II. B. C-166 George W. Day, Fruitvale Avenue - Request for Change of
Zoning from "A" (Agricultural) to "R-1-40,O00 P-C" (Single-
Family Residential - Planned-Community) - Continued from
March 12, 1973
Chairman Lively reopened the hearing relative to C-166 at 7:47 P.M.
He then noted that the revised exhibits showing the changed setback
were submitted.
Mr. Trinidad, Assistant Directorlof Public Works, explained that there
will be meandering pathways throdghout this development and directly
behind the curb and gutter there.will be an area provided to serve as
.an emergency pull-over.'
The Secretary, in answer to an ipquiry from Commissioner Belanger, stated
that considering the road alignment.there seemed to be enough variety in
front-yard setbacks for these lots -.lots 11 and 14 are pretty similar in
setback dimension but do have different exposure. He then read the Staff
Report recommending that the subject application for Change of Zoning be
approved.
The Staff Report was amended by ~dding the following condition 5):
"5) Setbacks' shall not be 'less than as shown
on Exhibit "A-I". '2'
Commissioner Smith moved, seconded by Commissioner Marshall, that the
public hearing relative to C-166=be closed at 8:04 P.M.; motion carried
unanimously.
Commissioner Smith moved, seconded by Commissioner Marshall, that the
Staff Report relative to C-166 dated March 26, 1973 be adopted, as
amended, and forwarded to the City'Council as the recommendation of
the Planning Commission and that.the subject Change of Zoning (C-166)
be approved on the basis the findings required in Section 18.6 and 18.11
of the City of Saratoga Zoning O~dinance NS-3 can be made for the reasons
stated in said report and subject to the'conditions set forth therein;
motion carried unanimously.
C. .C-167 - Allen De Grange, Cox Avenue - Request for Change of Zoning from
"P-A" (Professional-Administrative) to "R-M-3,000" (Multi-Family
Residential)
Chairman Lively opened the hearing relative to C-167 at 8:06 P.M.
The Secretary stated the Notice of Hearing was mailed and published.
He then read a Statement of Reason filed By the applicant and explained
that if the Change of Zoning were to be granted a Variance application
would be necessary.
Chairman Lively noted that the existing right-of-way problem involved
with this property has not yet been resolved.
The Secretary stated that the applicant did intend to use the Westhope
Presbyterian Church parking lot for access and parking for his develop-
ment; however, the Church has now decided against this arrangement.
Chairman Lively stated that the Planning Commission i~._not~ eager to
entertain the idea of any additional "R-M-3,000" (Multi-Family Residential)
developments in the City.'
Mr. DeGrange,~..the.applicant, stated that~l) it is his intent to provide
retirement housing for the City of Saratoga 2) he did realize he was
asking for a higher density, but.because of the great need for this type
housing he would request the Planning Commission to consider the subject
application 3) the site is well'located for retirement housing since it
is near shopping, recreation, and medical facilities 4) he would own the
housing development and maintainlit properly 5) the development is oriented
to upper-income people and 6) the Church did turn down his original proposal
--bu't-h-e-does-h~ve--a--revi~'d plan.and 7) he intends to follow the outline of
/ the retirement-housing-standards set by the City.

Commissioner Belanger inquired about the amount of rent that would be
charged for these units.
Mr. De Grange explained that the rent would be $250 per unit per month.
About 3/4 of the units would be on the ground floor and would be quite
large in size with a lot of storage area. There will not be a recreation
building since the tenants would be approximately 55-years of age and would
not be allowed to have any children under 18-years of age living with them
in the units. ~
Chairman Lively stated that 21-unit% as-~proposed by the applican~ far
exceeds any amount he wo~ld consider for the subject property 2) the
possibility of obtaining approval:for a "R-M-3,000" development is
slight since the Planning Commission has been trying to hold to,.,!'R~M'4,000"
and 3) if the applicant were t'O'.'cha~ge his request to ask for "R-M-4,000"
zoning, perhaps, the matter could be given further consideration and/or
referred to the General Plan Review currently under way.
Commissioner Marshall recommended'that the proposal for an "R-M-3,000"
development be rejected or the applicant be asked to resubmit his appli-
cation and ask for "R-M-4,000".
Mr. De Grange explained that under an "R-M-4,000" proposal the density
would be brought down to approximately 12-units per acre and that would be
economically unfeasible for any developer.
Commissioner Metcalf stated that the application c~uld,'.be withdrawn or the
Planning Commission could denyf-C-167 without prejudice.
Mr. De Grange requested that the application for C-167 be withdrawn..
Commissioner Smith moved, seconded by Commissioner Marshall, that the public
hearing in connection with C-167 be closed at 8:25 P.M.; motion carried unani-
mously. ;
Commissioner Smith moved, seconded by Commissioner Marshall, to approve the
request for withdrawal made in connection with C-167 subject to receipt of a
written request for said withdrawal; motion carried unanimously.
D. Informal Hearing - Cannestra Encroachment Permit~ Brandywine Court
The informal hearing Was opened. The Chairman. explained that this Encroach-
ment Permit had been denied; however, the residents of the area requested that
the matter be reopened.
The Secretary explained thatOne peighbor, Mr. Sarenceno, has submitted a
letter stating he is still opposed to the requested Encroachment Permit.
Mr. Cannestra explained that 1) the children in'the neighborhood 'do'not
have a place to play in the neighborhood and the'basketball hoop and back-
board provide an excellent facility for this2) this basketball hoop has
been in existence for quite some time 3) nb park is located in the area
and the nearest school is one-half mile awayS~ 4) this cul-de-sac is a
natural place for the children tozplay and the children will play here
whether the hoop is there or not 5) Brandywine is a dead-end street so
there is very little traffic and ~) there is really only one individual
in the neighborhood that opposes this facility.

II. D. Informal Hearing - Continued ~
Mr. A1 Kennedy of 13960 Pontiac Avenue stated he was not aware the
basketball hoop and backboard constituted an infraction of City
right-0f~way. The majority of the residents of the neighborhood
are in accord with the location of the basketball apparatus since
it does provide an excellent place for the children to play.
Mr. R. C. Hollenbeck of 12991 Brandywine Drive stated that his
children make use of the basketball equipment many times and he is
in favor of approving the requested Encroachment Permit.
Mr. Nimb of 12931 Brandywine Court stated his children, also, use
the subject basketball hoop-and he made a'recording in order to
determine the noise level created'by the use of the basketball equip-
ment."I~ 'turned out to be very minimal..
Commissioner Marshall stated that~ perhaps, the basketball'~.-.ho~p,'.a~d
back board could be mounted on private property rather than on City
rightsof-way. ,
Mr. Cannestra inquired if a portable basketball hoDp with back board
could be used; whereby, the portable unit could be moved out of the
right-of-way area after each use.
Chairman Lively recommended that this matter be reviewed with the
City Attorney and referred to the2Variance Committee. He closed-
the hearing for the evening and directed the Cannestra Encroachment
Permit application continued to the next regular meeting.
Arrangements were made with the a~plicant for an on-site inspection
by the Variance Committee for 9:00 A.M., Saturday, March 31, 1973.
III. BUILDING SITES AND SUBDIVISIONS ~
A. SD-1020 - Donald Comer, Pierce RoAd - Subdivision Approval - 7 Lots -
Continued from March 12~ 1973
The Secretary recommended that SD-1020 be denied since an acceptable map
has not been received.
Mr. Trinidad, Assistant Director Of Public Works, .stated that he did .. '.~
meet with the applicant to discuss a revised map; however, same has not
yet been submitted.
Commissioner Smith moved, seconded by Commissioner Marshall, that SD-1020
be denied unless a letter-of-extension is received from the applicant prior
to the current. expiration date,' of the tentative map; motion carried unani-
mously.
B. SDR-1023 - Robert L. Dale, Peach Hill Road - Building Site Approval - 1 Lot
Continued from March 12, 1973
The Secretary explained that the ~esthetics of the proposed grading for this
site and its effect on surrounding property is still unsatisfactory and un-
acceptable.
Commissioner Smith moved, seconded by Commissioner Marshall, that SDR-1023
be denied unless a letter-of-extension is received from the applicant prior
to the current expiration date of the tentative map; motion carried~unani-
mously.

III. C. SDR-1025 - David J. Brown, Saratoga Hills R~ad - Building Site Approval -
2 Lots - Continued from March 12! 1973
The Secretary explained that two'(2) separa e reports have been prepared

Mr. Trinidad explained that Parcel "C" is r~corded as a legal lot as part
of a subdivision in 1946.
Commissioner Belanger suggested that one driveway only be allowed for
both Parcel "A" and "B" onto Saratoga Hills Road.
Mr. Trinidad explained that one common driveway may be satisfactory
right at the entrance to Saratoga Hills Roa~; however, the Fire Depart-
ment feels it might be better to have individual driveways to the
individual lots.
The Secretary stated that the applicant has reviewed the conditions
listed in both the Staff Reports prepared f{,r SDR-1025 and has expressed
satisfaction with same.

Ther%ecretary explained that the Staff Repo!t listing the conditions of
app val has been prepared; however, the Pa~k and Recreation Commission has
asked that the Planning CommissiSn delay a ~ n on the matter since this

property has been designated as a park-site and the Park and Recreation
Commission would like more time to review t~e matter. The Secretary
recommended that SD-1027 be continued to th~ next regular meeting.

III. F. SDR-1028 - King Homes, Inc. (Royc~ S. Kadfmann), Canyon View Drive -
Building Site Approval'- 1 Lot
The Secretary recommended that SDR-1028 be continued to the'next
regular meeting since the applicant is still in the process of
working on a revised map.
Chairman Lively so directed.
G. SDR-1029 - Kathyrn Pronger~ Lomita Avenue - Building Site Approval - 2 Lots
The Secretary explained that the Applicant did review the proposed
conditions of approval and expressed satisfaction with same..
Commissioner Smith moved, seconded by Commissioner Marshall, that the
Staff Report dated March 26, 1973 relative to SDR-1029 be adopted and
that the tentative map (Exhibit "A", filed March 14, 1973) be approved
subject to the conditions set forth in said report; motion carried unani-
mously.
H. SDR-1030 - Lee Wen~er~ Springer A~enue - Building Site Approval - 1 Lot
The Secretary explained that this.is a legal non-conforming lot that has
been this way since incorporation~of the City.
Commissioner Smith noted that theL6-foot setbacks for this lot were

created under County Zoning laws prior to the y s incorporation.
The Secretary stated that the applicant did review the proposed conditions
of approval and'expressed satisfaction with same.
Commissioner Smith moved, seconded by Commissioner Marshall, that the
Staff Report dated March 26, 1973 relative to SDR-1030 be adopted and
that the tentative map (Exhibit "A", filed March 14, 1973) be approved
subject to the conditions set forth in said report; motion carried unani-
mously.
I. SDR-1031 - Peter F. Fitchen, Allendale Avenue - Building Site Approval - 1 Lot
The Secretary advised that the applicant did review the proposed conditions
of approval and expressed satsifaction with same.
Commissioner Smith moved, seconded by Commissioner Marshall, that the
Staff Report dated March 26, 1973zrelative to SDR-1031 be adopted and
that the tentative map (Exhibit "A", filed March 16, 1973) be approved
subject to the conditions set forth in said report; motion carried unani-
mously.
J. SDR-1032 - Patrick Weisner~ Saratoga Glen Place - Building Site Approval - 1 Lot
Commissioner Smith advised that there is some question as to whether the
lot coverage, due to the size of the house, is too great.
Commissioner Marshall explained that if the owner of this lot would at
sometime in the future want a swimming pool on this lot it would create
a dilemma~in~ there would not be;sufficent lot-area left to meet the
setback requirements. It should Be clearly stated in the Staff Report
that because of the extended lot-coverage, the construction of a swimming
pool or other accessory structures could be prohibited on this lot.
The report was amended by adding the following note:

III. J. SDR-1032 - Continued
Commissioner Smith moved, seconded by Commissioner Marshall, that the
Staff Report dated March 26, 1973 relative to SDR-1032 be adopted,' as amended, and
that the tentative map (Exhibit "A", filed March 16, 1973) be approved
subject to the conditions set forth in said report; motion carried unanimously.
RECESS AND RECONVENE
IV. DESIGN REVIEW
A. A-391 - George W. Day, Douglass Lane-- Final Design Review - Lots 3 & 4,
Tract 5150
It was explained that two reports were prepared in connection with A-391
- one for Lot 3 and another for Lot 4.
The report relative to Lot 3 was l amended by adding the word "smaller"
between the words "and" and "flo6r" in paragraph 1. .line 7.
Commissioner Metcalf stated that originally it was required that the
larger lots in the development have two (2) story houses - the first
of these to be located on Lot 7; however,.when it came time to approve
Lot 7 the Planning Commission approved a ,single-story house for that
lot. Now the applicant comes in'with a ~equest to place .~'~ngle-
story house on Lot 3; which, was designated for a two-stOry ho~se.
The Staff Report relative to Lot'3 recommends a compromise; however,
his feeling is the request for a single-story house for Lot 3 should
be denied since it does not conform to the original lay-out for this
subdivision. In order to get a report that would be agreeable to all
members of the Design Review Committee a single-storyhouse i~-,recommended
,'for Lot 3 but subject to two-story or split-level homes to be ~
built on two.(2) out of lhe three (3) uncommitted Lots 12, i5, and 16.
Commissioner Metcalf further stated that the'aforementioned-problem is
illustrative of a "P-C" Developm&nt when dealing with a subdivider that
is a custom~h~me. builder. The developer in this case was required to
submit a plan in advance indicating what houses would be on which lots;
however, that plan was not adhered to very much. There are still several
hundred acres left in Saratoga that are susceptible to development and for some
of-.-. these acres the City will try to get "P-C" Developments. Experience
has prove~ that it is not enough to just require a plot-plan nor to simply
allo~ the developer to specify the house he will place on a particular lot
with a lay-out of the. building .sites. In the futur~ the developer should
be required to Submit architectural renderings of each group of houses and
these should be studied and accepted or denied and then if the developer
wishes to deviate from these plahs he should be required to again submit
architectural renderings and drawings. In this way the Planning Commission
can study the complete visual aspect of the house and how it fits in with
adjacent houses.
Commissioner Smith stated that, he felt, condition "C" of the subject
Staff Report relative to Lot 3 of Tract 5150 should be amended to required
only one (1) of the three remaining lots to have a twosstory or split-level
house on-it. He did not believe:that a two-story house was necessary to
relieve the monotony of the single-story residences - a two-story, badly
located, can destroy aesthetic qualities and/or privacy of adjacent properties.
He would like to see condition "C" deleted in its entirely from the report.
Commissioner Metcalf stated he disagreed.
Chairman Lively indicated he is in favor of having some two.,.story houses
on the remaining lots.
Commissioner Belanger stated that she did not feel that the sole desire
was to just get variety in this development, but to, also, have less lot
coverage and that is one thing that a two-story does provide.

IV. A. A-391~- Continued
Commissioner Metcalf moved, seconded by Commissioner Belanger, to approve
the Staff Report, as amended, and that Final Design Approval be granted for
A-391, Lot 3 of Tract 5150 as shown on Exhibit "P" subject to the conditions
stated in said report.
Commissioner Smith moved, seconded by Commissioner Marshall, that
condition "C" of the report be amended to read:
."c. Two-story or split-level homes to be built on
one of the three (3) remaining lots - Lots 12,
15, and/or 16."
Motion carried by the foliowing vote:

The Secretary then read the Staff Report recommending that A-391, Lot 4
of T~act 5150 be granted Final Design Approval.
Commissioner Metcalf moved, seconded by Commissioner Belanger, that the
Staff Report relative to A-391, Lot 4 of Tract 5150 dated March 26, 1973
be adopted and Final Design ApproVal. be granted for Lot 4 as shown on
Exhibit "O" subject to the conditions listed in said report; motion
carried unanimously.
B. A-406 - Cal-West Communities, Saratoga Avenue - Final Design Review - Condominium Complex
The Secretary read the Staff Report recommending that Final Design
Approval be granted for A-406, Ca!-West Communities, a Condominium
complex on Saratoga Avenue. '
Commissioner Belanger, in answer to an inquiry from Chairman Lively,
explained that there is wood trim'on almost all the sides showing
and window have been added and framed.
Commissioner Smith pointed out that there will be 25% more open-space in
this development than there was in the first unit of this development.
Commissioner Metcalf moved, seconded by Commissioner Belanger, that the
Staff Report relative to A-406 be adopted and Final Design Approval be
granted for the second phase of the condominium-apartment complex for
Cal-West Communities, Inc. on Saratoga Avenue as shown on Exhibits "F"
through "J" subject to the conditions listed in said report; motion
carried unanimously.

V. CITY COUNCIL REPORT
Commissioner Smith gave a brief summary of items reviewed and action
taken at the City Council meeting of March 21, 1973.
PLANNING POLICY COMMITTEE ~
Chairman Lively advised that the new C~unty Building to be located at
First and Hedding was approved at the last meeting of the Planning Policy
Committee.' He further advised that the next meeting will be on April 26, 1973.
VI. MISCELLANEOUS ITEMS ~
A. UP-80 - Church of Ascension, Prospect Road - Traffic Circulation - Continued
from March 12, 1973
The Secretary explained that this matter was continued from the last meeting
in order to allow time for both the Church of Ascension and Congregation
Beth David to comment on the Public Works Report dealing with traffic circu-
lation,~adcess, and parking. A comment has been received from the Churches in
the form of a combined letter. :
Th.e letter containing proposed changes in the traffic flow and parking
facilities was read.
Commissioner Belanger stated she would like an explanation as~to why this
is an improvement from the neighbors standpoint.
Commissioner Smith stated that he ~ould like.to know why any change
in the entrance is necessary. !t 4oes'not appear to him that the
traffic has increased that much at this location in the past few
years.
Mr. Trinidad, the Assistant Directdr of Public Works, stated that the
revised plan prepared by the Public Works Department better satisfies
the desire of the homeowners living in the area and the Beth David
Congregation. The new plan will provide for freer access.
Mr. Muzzy, President of the Prides Crossing Homeowner's Association, stated
that his group has been actively interested in this'project. He then requested
a copy of the letter prepared by the churches in connection with the subject.
matter.
Chairman Lively referred the matter' to the Planning and Public Works Staff
and directed the matter continued to the next regular meeting in order to
allow time to study the letter submitted b~ the churches.
VII. COMMUNICATIONS
A. WRITTEN
1. SDR-918 - Monty R. Boyd (Donald Comer, Arroyo de Arguello - Request for
Reconsideration of ConditiOns
The Secretary read a communication submitted by Donald T. Comer requesting
that the Planning Commission modify Che original condition for SDR-918
regarding the flood control easement.requirement.
Chairman Lively referred the matter to the Subdivision Committee and
Staff for a report at the next regular meeting.

VII. A. 2. RESOLUTION #118
Chairman Lively read Resolution #118 prepared for Commissioner
Metcalf in'appreciation for his service to the City of Saratoga
while serving on the Planning~ Commission.
Commissioner Smith moved, seconded by Commissioner Marshall,
that the Saratoga Planning Commission approve Resolution #118
and forward same to Commissioner Metcalf; motion carried unani-
mously.
Commissioner Metcalf thanked the Planning Commission a~d stated
it had been a pleasure working with them and the City of Saratoga..
3. RESOLUTION #119
The Secretary stated that 1) a Resolution has been prepared
regarding the plans for the Azule-Blue Hills area especially
the IHamilton and Garcia Properties, 2) a new proposal has been
submitted for the Hamilton property 3) the City Attorney has
stated that an Emergency Ordii~ance would be possible for this
property but would be legally'~ impractical 4) it would be best
to adopt a permanent ordinanc,e as quickly as possible; however,
the adoption of Resolution #119 should be done on an interim
basis until a final ordinance, can be drafted and adopted.
Commissioner Smith recommende~ that Resolution #119 be amended
by adding the following to paragraph 2. ."whereas the area
has reverted to "C-V" .(Visitor-Commercial) Zoning; and".
Commissioner Marshall moved, 'seconded by Commissioner Belanger,
that the Planning commission adopt Resolution #119, as amended,
and forward same to the City Council as the recommendation of
the Planning Commission; motion carried unanimously.

Chairman Lively acknowledged, with pleasure, the presence of Councilman
and Mrs. Kraus, ~Mrs. Stark and Mr. Appl.eyard o~f the Good Government Group,
Mr. Muzzy, President of the Pride~ Crossing Homeowner's Association, and
Mr. George Hamilton, owner of the Hamilton Property. He, also, thanked
Mrs. Stark for the coffee served at recess.

Commissioner Metcalf moved, seconded by Commissioner Marshall, that the meeting
March 26, 1973 be adjourned at 10:51 P.M.; motion carried unanimously.
