ROUTINE ORGANIZATION Chairman Marshall called the meeting to o~der at 7:37 p.m. A. ROLL CALL Present:' Commissioners Marshall, Martin, Matteoni, Smith and Woodward Absent: Commissioner Belanger B. MINUTES Commissioner Smith moved, seconded by 'Commissioner Martin, that the--reading of the minutes of March 27, 1974 be waived, and that they be approved as distribu- ted to the Commission subject to the following correction cited by Commissioner Woodward: page 5, second paragraph, s:econd sentence should read "Architectural Review Committee" not Stoneson Development Corporation. The motion was carried unanimou'Sly. C. CITY COUNCIL REPORT Commissioner Smith presented. an oral ~eport of the City Council meeting of April 3, 1974. A copy of the minutes !of this meeting is on file at the City's Administration Office. D. GENERAL PLAN REVIEW Chairman Marshall reported that he att. ended the City Council public hearing on the General Plan/on April 9, and stated that it had been continued to the meeting of April 17, 1974. He added that a join[ meeting between the City Council, Planning Commission, Planning Staff and the General Plan Consultants was being considered to discuss various definitions of ter~s used within the General Plan text. II. PUBLIC HEARINGS A. UP-241 - Rotary Club Art Show, Big Basin Way~ May 5~ 1974 Chairman Marshall opened the public he~ring on UP-241 at 7:37 p.m. It was noted this had been duly noticed. The Secretary explained that the Rotary Club, a non-profit organization, had re- quested a one-'day, once-a-year Use Permit to allow the Rotary Club Art Show to be held at 14440 Big Basin Way in the Saratoga/Shopping Center on Sunday, May 5, 1974. He stated that Section 7.3(6) of Ordinance NS-3 allowed such a use in a Community commercial District if .the provisions of Article 16 of the zoning ordinance were met. He added that a Staff Report dated April 10, 1974 had been prepared which recommended approval of~ this matter subject to annual review. Commissioner Smith stated that a SubdiVision Committee meeting had been held with Mr. Laughran, representative of the applicant, on April 4 and that Mr. Laughran was aware of the conditions of the Sta:ff Report. He pointed out that if any of the conditions of the report were violatedi, the Use Permit would be automatically rescinded. Mr. Laughran was present and acknowledged acceptance of the Staff Report. He stated that the Rotary Club would adhere to all such conditions. There were no further comments. -1- A. UP-241 - Rotary Club Art Show - Continued Cormnissioner Smith moved, seconded by .Commissioner Martin, that the public hearing on UP-241 be closed. The motion was carried unanimously. Chairman Marshall closed the public hearing at 7:40 p.m. Commissioner Smith moved, seconded by ~Commissioner Woodward, that the Staff Re- port dated April 10, 1974 relative toiUP-241 be approved, and the request for a Use Permit to allow an outdoor, one day, once-a-year art show be granted subject to Conditions (1) through (8) of the report. The motion was carried unanimously. III. BUILDING SITES AND SUBDIVISIONS A. SDR-1093 - David N. Grant, Canyon View Drive, Building Site Approval - 1 Lot.; Continued from March 27~ 1974 The Secretary stated that the applica~t's engineer had not submitted revised maps which.depicted access to the property as it related to the adjacent property (SDR-i090), and'recommended this matter be continUed~ He further submitted a letter from the applicant dated April 10, 1974 which granted an extension to the Planning Commission meeting of April 2~4, 1974. Chairman Marshall directed SDR-1093 b~ continued to the Planning Commission meet- ing of April 24, 1974, and referred this matter to the Subdivision Committee for further review. B. SDR-1098 - Robert Livengood, Sarahills. Drive, Building Site Approval 1 Lot; Continued from March 27~ 19.74 The Secretary stated the applicant had submitted a revised map (Exhibit A-l) which depicted an improved drive-way approach. He stated a Staff Report dated April 10 relative to SDR-1098 had been prepare~ and recommended approval of this matter.' It was noted that a grading plan would' be required relative to this, and would be reviewed by the Design Review Committee. There were no further comments made. Commissioner Smith moved, seconded by Commissioner Woodward, that Staff Report dated April 10, 1974 relative to SDR-1098 be accepted, and'that the tentative map (Exhibit A-1 filed March 20, 1974) be approved subject to General Condition I and Specific Conditions II (a) through: (j) of the report. The motion was carried unanimously. C. SDR-1099 - John Lowry, Palomino Way, B~ilding Site Approval - li'.Lot; Continued from March 27, 1974 The Secretary stated that a Staff Report dated March 27, 1974 relative to SDR-1099 had been prepared which recommended approval of this matter subject to review by the Design Review Committee~ He added that the Design Review Committee had re- viewed this matter, as required, on April 9, 1974. Mr. Lowry, applicant, was present and ~cknowledged acceptance of the Staff Report. There were no further comments made. Commissioner Smith moved, seconded by Commissioner Martin, that the Staff Report dated March 27, 1974 relative to SDR-1099 be accepted, and the tentative map (Exhibit A-1 filed February 28, 1974) be approved subject to General Condition I and Specific Conditions II (a) throughZ (o) of the report. The motion was carried unanimously. D. SDR-1100 - A.R. Woolworth, Brandywine Drive, Building Site Approval -'4 Lots; Continued from March 27, 1974 The Secretary stated this 4-lot subdivision was adjacent to a public street and that plans~'submitted in connection with this had not been acceptable to the Director of Public Works. Mr. Rowe suggested a meeting between Public Works and the applicant be held, and recommended' this matter be continued. Chairman Marshall directed SDR-1100 bezcontinued to the Planning Commission meet- ing of April 24, 1974, and referred this matter to the Subdivision Committe for further review. Minutes of April 10, E. SD-1101 - Avco Development Corporation, Cox Avenue, Subdivision Approval - 18 Lots; Continued from March 27~ 1974 The Secretary stated the applicant had refiled for an 18-lot subdivision in the freeway. right-of-way off of Cox Avenue. He explained the State Department of Transportation had not been notified ~f this application in a timely fashion, and recommended this matter be continued to the next meeting of the Planning Commission. He added that the applicant's engineer had been notified of this, and had been agreeable to a continuance to the April 24, 1974 meeting. Chairman Marshall gave the Commission%a brief history of the application, and stated that the basic problem involved was that the right-of-way to the Scully connection had not been provided as part of the earlier development by Avco Development Corporation. He stated there were three possible alternatives to this problem: (1) to provide a private emergency access from the new street to Solano Drive; (2) to provide a public streetlto Scully Avenue; and (3) to provide a public street,to Solano Drive. He conClUdedZthat the Subdivision Committee was in favor of a thru-publi6 street on an 18-lot Subdivision rather than an emergency access on private grounds, and requested Mr. Trinidad make an assessment of the most acceptable alternative. " Commissioner Smith explained that the applicant had spent much time in consider- ing alternatives to this problem, and had felt the emergency access would be the only economical solution. He indicated that this emergency access would be inconsistent with the zoning ordinance on this size of subdivision; he added that the Subdivision Committee had requested the applicant to provide a turn-around on this street and that the emergency access be barricaded. Chairman Marshall' further.requested Mr. Trinidad to determine what alternative lot configuration?n ~oe~'~18 should be depicted on the applicant's plan. He also noted that the pla~'.~ndicated that a corner of Lot 43, Tract 5233 would be dedicated to the ~ity of Saratoga. He asked Mr. Trinidad to have the map corrected to clearly .state that. this dedicationzwould be made by the developer. commissioner Woodwa[d staked that vehicular traffic, i~cluding motor~ycles,'h'~d~b~ presently traversing,'~he property. In order to prevent'inappropriate use of this area, she felt a landscaped barricade should be incorporated in the project. Commissioner Martin questioned what action would be taken regarding the dirt mounds behind 19714 Solano Drive, and.stated he felt these mounds were a result of the adjacent subdivision's construction. The Secretary explained that he had field inspected this area, and that the applicant had indicated that the individual homeowners were responsible for these mounds as a barricade between themselves and the freeway. Mr.'Trinidad was requested to look into the tract's filed grading plans. There were no further comments. Chairman Marshall directed SD-1101 beZcontinued to the Planning Commission meet- ing of April 24, 1974, and referred this matter to the Department of Public Works and the Subdivision Committee for further review. F. SDR-1102 - Mike PUrcell, Big Basin Way, Building Site Approval - 1Lot;~Commercial; Continued from March 27~ 1974 The Secretary stated that a Staff Repgrt relative to this had been prepared; how- ever, the Staff recommended action not be taken until the parking district issue was resolved. There were no further comments. Chairman Marshall directed SDR-1102 be continued to the Planning Commission meet- ing of April 24, 1974, and referred this matter to the Subdivision Committee for review. G. SDR-1103 - Fred Marburg, Saratoga-Sunnyvale Road, Commercial Expansion; Continued from March 27~ 1974 The Secretary stated that a letter from the Water District had been received on April 9 which had not allowed adequate time for review by the SRbdivision Committee. SDR-1103 - Fred Marburg - Continued Chairman Marshall directed SDR-1103 be continued to the meeting of April 24,'1974 and referred this matter to the SubdiVision Committee for further review. H. SDR-1104 - Ben Yates, E1 Camino Grand~, Building Site Approval - 3 Lots; Continued fromMarch 27~ 1974 The Secretary stated the applicant had submitted revised plans to the Planning Department on April 9, which had not allowed adequate time forvreview by the Sub- division Committee. He recommended this matter be continued to the next meeting of the Planning Commission. The applicant's representative, Mr. Lou Frankly,raised a question relative to the Fire District's letter dated March 20,. 1974 which conditioned that a driveway with an ins'ide turning radius not less tha~ 42 feet be provided. Mr. Trinidad explained that the Fire District had based thiszcondition on a previous map, and suggested Mr. Fi~k~' submit the revised map to the Central Fire District with the request that t~ey forward a new letter of conditions to the Planning Department. Chairman Marshall directed SDR-1104 be continued to the April 24, 1974 meeting of the Planning Commission, and referred.this matter to the Department of Public Works and the Subdivision Committee for furthe~ review. The Secretary stated the files on SDR-1105, SDR-1106, SDR-1107., SDR-1109, SD-1110 and SDR-1111 were not complete, and recommended these matters be continued. A-391 - George W. Day & Co., Fruitvale Avenue & Douglass Lane, Final Design Review; Single-Family Residential; 1 Lot (Tract 5327~ Lot #15) Mr. Don Burt, City Planner, read the Staff Report dated April 10, 1974 relative to this matter which reco~m~ended approval of final design subject to conditions: (a) that a statement be incorporated into the Subdivision's deed restrictions which stated that the design and location of all interior fencing and/or pools for Tract ~5327 be submitted to the Design Review Committee for review; and (b) all doors and windows be fully wrapped with wood trim. There were no further comments. Commissioner Matteoni moved, seconded.by Commissioner Woodward, that the Staff Report dated April 10, 1974 relative to A-391 be accepted, and final design be granted subject to Conditions (a) and:(b) of the report. The motion was carried unanimously. B. A-430 - Almaden Development, Oak Street - Final Design Review; Multi-Family Residential (6 units); Continued from March 27~ 1974 Mr. Burt.stated the St~ff Report.on this matter :had not been prepared., and recommended this be continued to the ~ext meeting of the Planning Commission. He pointed out that Mr. Franklin, the applicant, had met with the Design Review Committee, that revisions to the plan had been requested, ~and that the revised -4- Minutes of B. The applicant was not present, and there were no'~further comments made. Chairman Marshall directed A-430 be c~ntinued to the Planning Commission meeting of April 24, 1974, and referred this matter to the Design Review Committee for further review. C. A-425 - Osterland Enterprises, Fruitvale & Allendale Avenues, Final Design Review; Single-Family Residential (Tract 4768~ Lot #4) Mr. Burt read the Staff Report dated April 10, 1974 relative to this matter which recommended approval of final design Subject to a condition that a statement be incorporated into the Subdivision's d~ed restrictions which stated that the design and'location of all interior fencing and/or pools in Tract #4768 be sub- mitted to the Design Review Committee·for review. There were no further comments. Commissioner Woodward moved, seconded by Commissioner Matteoni, that the Staff Report dated April 10, 1974 relative to A-425 be accepted, and final design be granted subject to Condition (a) of the report. The motion was carried unanimously. D. SDR-1099 - John Lowry~ Pa~Omino Way~ Final Design Review - 1 Lot Mr. Burr read the Staff Report dated April 10, 1974 relative to this matter which recommended approval of final design Subject to conditions: (a) that all windows and doors be fully wrapped with wood ~rim; and (b) that a retaining wall in the rear yard be used to minimize cut. There were no further comments made. Commissioner Woodward moved, seconded.by Commissioner Matteoni, that .the Staff Report dated April 10, 1974 relative [o SDR-1099 be accepted, and that design review be granted subject to Conditions (a) and (b) of the report. The motion was carried unanimously. V. MISCELLANEOUS A. SDR-1007 - Ralph Pearson~ E1 quito Way~ 1 Lot - Request for Extension The Secretary submitted a letter fromzMr. Ralph Pearson dated March 25, 1974 which requested that a one-year extension be granted on this matter. There were no further comments. Commissioner Smith moved, seconded by Commissioner Martin, that a one-year exten- sion be granted on SDR-1007. The motion was carried unanimously. B. SDR-IO08 - J.F. Zeid~ Palomino Way~ l'Lot - Request for Extension The Secretary submitted a letter from:Mr. J.F. Zeid dated April 1, 1974 which requested that a one-year extension b~ granted on this matter. There were no further comments. Commissioner Smith moved, seconded by2Commissioner Martin, that a one-year exten- sion be granted on SDR-1008. The motion was carried unanimously. C. SDR-1076 - Almaden Development~ Oak S6reet - Submittal of Revised Exhibit The Secretary stated that a revised map had been submitted by Mr. Franklin, the applicant, on Wednesday, April 10 which had not allowed adequate time for,~review by the Subdivision Committee.' He recommended this'matter be continued. Chairman Marshall directed SDR-1076 be continued to the Planning Commission meet- ing of April 24, 1974, ',~d'~fe'~d'~'is matter to the Subdivision Committee for further review. VI. VI. ENVIRONMENTAL IMPACT EVALUATIONS - Continued He further stated that ENVIROS, a consultant hired by the City to review the draft, had suggested that~oa soil report at this time would do much to add to the adequacy of the tentative draft. A meeting had been held by the City Manager, Department of Public Works and the Planning Department on same, and it had been recommended a soil report be submitted prior to acceptance of the EIR. A revised draft EIR is anticipated. "VII. COMMUNICATIONS /A. Written r ' ~ 1. Two letters relative to the City Council discussions of the General Plan: -- Dated Ap[fl'l~ 1974 from Harry L. Mayfield - Dated April 6, 1974 from Charles and Margaret Guichard 2. A letter dated April 4, 1974 from .Mr. Frank Perdichizzi, president of Prides Crossing Homeowners Association, relative to Church of Ascension SDR~1094. Chairman Marshall directed this l~tter be referred to the Design Review Committee for consideration, and requested the Secretary notify Mr. Perdichizzi of this action. 3. A letter dated March 19, 1974 from Robert and Jeanne Sheffield which sub-. mitted an environmental design study by the City of Palo Alto. A transmittal memorandum from Mr. Beyer requested that the Planning Commission ~eview this design study to determine if it was relative to the Painless Parker property. It was the consensus of the Planning Commission that the economic study was '. not entirely relative to the Painless Parker property in that: (1) the City of Palo Alto had been addressing massive parcels as opposed to Saratoga's. single parcel;~d'(2) Saratoga could ~'~I'i~ an EIR as a means of project review and a portion of that environmental study would address area wide economics of projects, including a consideration of schools. B. Oral 1. Mr. Dave Franklin, applicant on the A-430 and SDR-1076 matters, upon arriving late asked the reason why these matters had been continued. He explained that revised plans had been submitted to the Planning Department on April 10 relative to SDR-1076, and that revised plans had been...'submitted for Design Review on April 9. He contended these plans containe~' all revisions requested by the Planning Commission. The Secretary submitted the revised plan on SDR-1076 (Exhibit C) to the Commission, and stated that the plan was not acceptable. It was noted that the plan did not reflect landscaping on the property, nor aid it depict the interfacing between the drive-way' and the stairway. Chairman Marshall reiterated that' insomuch as the pl.ans had not been submitted until April 9 and 10, the matters of A-430 and SDR-1076 had been continued pending further review by the Subdivision and Design Review Committees. 2. Notice from the County Board of Supervisors that the hearing on the Stanley R.' Lee decision made by the Land Development Commission would be held 'April 24. 3. Chairman Marshall welcomed Mr. Brigham and Mr. Diridon, representatives from the City CounCil, and/Miss Mary Moss of the Good Government Group.' VIII. ADJOURNMENT Commissioner Smith moved, seconded by Commissioner Woodward, that the Planning Commis- sion meeting of April 10, 1974 be adjourned. The motion was carried unanimously.
