ROUTINE ORGANIZATION A. ROLL CALL Present: Commissioners Belanger, Callon, Lustig, Marshall, Martin and Woodward Absent: Commissioner Zambetti B. MINUTES · Conmissioner Belanger moved, secodded by Commissioner Martin, that the reading of tee Planning Commissi0n'm~eting'minutes of SeptemBer 24, 1975 be waived, and that they be approved subject to the following corrections: (1) Item 3 on page 3: the Hillside District is comprised of 1,200 acres, not 12,000 acres; (2) misspel- ling of words "unsightly" on page 5 and "promulgate" on page 6; (3) the word "hydrant" in reference to fire hydrant was mistakenly omitted in the first sentence of the fourth paragraph on page 9; and (4) Item VI-4 on page 11: reference is made to the County of Santa Clara, not the City of Santa Clara. The motion was carried; Commissioner Lustig abstained. II. FINAL BUILDING SITES/TENTATIVE SUBDIVISIONS · Prior to granting final buildipg site approval to application SDR-1189 (Charles Bilek), the Commission addressed Design Review ~pplicationAT507 for M~_B~lek% Note was made that the Design Review Committee had reviewed this application, and that a Staff Report had been prepared recommending approval. Commissioner Woodward moved, seconded by Commissioner Lustig, that the Planning Commission grant final design review approval to application A-507 per Exhibit "A" and the Staff Report dated October 1, 1975. The motion was carried unanimously. Note was made that all conditions of tentative map approvals had been met on the follow- ing applications, and Staff recormnended same be granted final building site approval: Conmissioner Belanger moved, seconded by Commissioner Lustig, that the Planning Commission grant final .b'~fdi'~g~site approval to the following applications': A. As the Commission felt they should await action on this application until a decision had been reached by the City Council, Chairman Marshall directed SD-1202 be continued to the Planning Commission meeting of October 22, 1975, and referred this matter to the Subdivision Committee and Staff for further review and report. / III. PUBLIC HEARINGS A. UP-288 - American Indian Council of Santa Clara Valley, Inc., (Mr. George Woodard, President), Intersection of Prospect and Stelling Roads, Request for Use Permit to Allow a Temporary. Use of a 13-Acre Portion of the Fremont High School District Land for a 'Bicentennial Indian Encampment from April 24, 1976 to }~y 7~ 1976 (Ordinance NS-3~ Section 3.3a) The Secretary noted that regarding this application, there were problems relative to traffic and sanitation which had not yet been resolved; and consequently, it ~ was recommended that this item be continued. Introduced into the record was a letter' /~dated October 8, 1975 from the City of Cupertino stating its support of this project. _- Chairman ~rshall directed ~his letter be made part of the file on UP-288. He also directed UP-288 be continued to the Planning Commission meeting of October 22, 1975,! and referred same to~vthe Subdivision Committee and Staff for further review and report. B. GF-303 - William Dorsey, Request to Amend the ~eneral Plan Designation from Commer- cial to Multi-Family Residential on the Three (3) Parcels Comprising Approximately 2.0 Acres, Located on the North Side of Big Basin Way, West of Sixth Street (APN 503-25-16 and 29)~ Continued from September 24~ 1975 Staff noted that this itemneeded additional review by the Santa Clara Valley Water District, and the recommendation was made that this matter be continued. Chairman }~rshall directed GF-303 be continued to the Planning Commission meeting of November 12, 1975, and referred this matter to the Subdivision Committee and Staff for further review and report. IV. DESIGN REVIEW A. A-472 - Saratoga Foothills Development Corporation, Douglass Lane, Final Design Review Approval - 1 Lot (Lot ~7~ Tract #5583) Staff noted that the Design Review Committee had reviewed this matter, and that a Staff Report had been prepared recommending approval. Commissioner Woodward moved, seconded by Commissioner Martin, that the Planning Commission grant final design review approval to application A-472, Lot #7 of Tract #5583 per Exhibit "F" and the Staff Report dated October 1, 1975. The motion was carried unanimously. B. A-483 - James Skinner, Pierce Road, Final Design Review Approval - 1 Lot; Continued from September 24, 1975 Staff noted that additional review by the Design Review Committee was needed on this matter, and a recommendation was made to continue this item. Chairman Marshall directed A-483 be continued to the Planning Commission meeting of October 22, 1975, and referred same to the Design Review Committee and Staff for further review and report. C. A-500 - Larry Tyler, Big Basin Way, Final Design Review Approval - Parking Assess- ment District ~2 Staff pointed out that subsequent to the Planning Commission endorsement of the Parking ASsessment District #2 plans, one of the participants had dropped out of -2- ~NUTES OF SEPTEmbER 24, 1975 IV. C. A-500 - Larry Tyler~ Parking Assessment District #2 - Cont'd the District thereby reducing the number of parking spaces from 68 to 60. Additionally, Staff pointed out that also subsequent to said commission endorsement, it had become evident that there were 4 walnut trees over 12" in_diameter located near the property line adjacent to the Oak Street condominium project which warranted evaluation rele- vant to saving some or all of them on a temporary basis for screening purposes. Note was made that the Design Review Committee had reviewed this matter with representa- tives of the Parking District and the condominium project, and it had been agreed to by all parties that 3 of the 4 walnut trees would be retained for a period not to exceed 5 years, at the end of which time the District would remove the trees and install parking spaces. Staff explained that one of the 4 trees was not considered to be healthy, and that the City Parks Foreman had estimated 5 years to be the maxi- mum probable life spahnof the remaining 3 trees. C~mL~issioner Woodward moved, seconded by Commissioner Lustig, that the Planning Commission approve the amendments to the Staff Report on application A-500 pre- viously approved by the Planning Commission as outlined in the revised Staff Report dated October 8, 1975 and Exhibit "C." The motion was carriedL~Unanimously. D. A-506 - Saratoga Foothills Development Corporation, Mari6n Road, Final Design Review Approval - Lots #3 and #4 and Landscaping of Tract #5676; Continued from September 24~ 1975 Staff noted that at the last meeting, the Commission had requested that Lots #3 and ~4 be reevaluated at the Design Review Committee level with specific regards to the proximity of adjacent existing houses to the proposed houses. It was pointed out that the applicant had submitted revised plans on Lot #3 which reduced the size and shifted the location of the house, thereby increasing the-sideyard setback on the north from 10 feet to 18 feet. Note was additionally made that the Design Review Committee had reviewed these plans, and that a Staff Report had been prepared recommending approval. It was pointed out that the landscaping plans on Tract ~5676 had been-a~proved by the Conmission at its meeting of September 24, 1975. Commissioner Woodward moved, seconded by Commissioner Lu~tig, that the Planning Commission grant final design review approval to application A-506, Lots #3 and #4 of Tract #5676 per Exhibits "A-l," "B" and "E-l," and the amended Staff Report dated October 1, 1975. The motion was carried unanimously. E.A-507 - A-507 - Charles Bilek~ Sobey Road~ Final Design Review Approval - 1 Lot See Item II-A. F. A-508 - Woolworth Construction Company, Brandywine Drive~. Final Design Review Approval - 1 Lot Staff pointed out that there had been concern relative to the orientation of the rearyards of Lots #C and #D of the 4-lot subdivision approved under application SDR-1100. Staff noted that although Lot #D was undeveloped, when the structure for this site was designed, its orientation and positioning are to be such that the usable #C. rearyard would adjoin the rearyard of Lot f Note was made that the Design Review Committee had reviewed the application, and that a Staff Report had been prepared recommending approval. Commissioner Woodward moved, seconded by'Commissioner Lustig, that the Planning Commission grant final design review approval to application A-508 per Exhibit "A" and the Staff Report dated October 2, 1975. The motion was carried unanimously. V. WRITTEN CO~JNICATIONS A. Environmental Impact Reports - There were ho Negative Declarations filed. B. Other. The following written correspondence was introduced into the file: 1. Letter dated October 2, 1975 from Warren Held requesting that the General Plan designation for the parcel located on Saratoga-Sunnyvale Road and Manor Drive be changed to "Planned Development, Residential" zoning as recommended by the Planning Commission at its latest General Plan Review. Note was made that this item would be one of the matters coming before the Commission for General Plan amendment, and that Mr. Heid would be notified when such amendment hearings would be held. -3- MINUTES OF SEPTEMBER 24. ~75 V. WRITTEN CO~IL~ICATIONS - OTHER - Cont'd 2. A-430 - Almaden Development, Fourth and Oak Streets - Request for Reconsidera- tion of Condition Staff noted that the Planning Commission had stipulated at the time this appli- cation was approved that certificates of occupancy would not be issued until the 4th Street stairway had been qompleted. It was pointed out, however, that the applicant had originally r~quested reconsideration of this condition in order that one occupancy permit might be issued to allow permanent gas and/or electrical power to be connected to Unit #1 of Tract #5503 for lighting and heat- ing during the day while this unit was~being displayed as the model unit. Addi- tionally note was made that the applicant had stated that no occupancy of this unit was desired at this time. Staff recommended, based on the applicantts stated desires, that approval be given for the issuance of temporary electrical and/or gas service, in lieu of permanent power, and an occupancy permit as per the Staff Report. Commissioner Woodward expressed the opinion that she felt the applicant had sho~n good faith in trying to finish the stairway, and she felt this request for power for lighting and heating was reasonable. Note was made that the Design Review Conmittee had reviewed this matter, tha~ a revised Staff Report had been prepared~d'~at the appf{~~'d'~8~bjections to this=~po~.~j~ 'Commissione~ Belanger moved~ seconded by Commissioner Woodward, that the Plan- ning Commission deny the requested reconsideration of condition imposed on the June 25, 1975 Staff Report for application A-430 to allow for the issuance of one occupancy permit; and in lieu thereof, the Planning Commission approve the granting of a temporary gas and/or electric meter set in accordance with the Staff Report dated October 7, 1975 and the Saratoga Building Department form dated October 8, 1975. The motion was carried unanimously. VI. ORAL CO~IUNICATIONS A. City Council Report Commissioner Martin gave a detailed report of the City Council meeting of October 1, 1975. Specific questions were raised by the Commission as to some of the i~ems on the agenda, and discussion followed on same. A copy of the minutes Cit of this Council meeting is on file at the y s Administration office. B. Other 1. Commissioner Belanger pointed out the letter from the City of Cupertino men- tioned earlier had not indicated a willingness to assist Saratoga in resolving some of the traffic problems which may be encountered. The Secretary explained that the letter was merely a consensus endorsement by the City Council of Cupertino indicating their support of the project. He added that the specific problems involved with the project, however, were presently being discussed with the Cupertino Planning Department. 2. Chairman ~rshall announced that there would be a Commission Committee-of-the- Whole meeting at the Redwood School Library on Thursday, October 9, 1975 from 7:30 to 9:30 p.m. to discuss the proposed Hillside Conservation and Open Space District Ordinance. 3. The Secretary informed the Commission that the Planning Department had received a copy of the Final EIR on the West Valley College bleachers and stadium, and he suggested that a Commission Committee-of-the-Whole meeting be scheduled to review this EIR. After brief discussion, it was the consensus of the Commission not to hold a Committee-of-the-Whole meeting, but rather Staff was directed to provide a summation of the EIR for Commission review. 4. The Secretary informed the Commission that the second regular Commission meeting in November fell on Thanksgiving Eve, and the second regular Commission meeting in December fell on Christmas Eve. It was the consensus of the Commission that the second December Commission meeting be cancelled; and the second meeting in -4- -~ MINUTES OF~ ~ VI. Additional consideration of this November .meeting was suggested to be made at the first meeting of November to decide on cancellation or rescheduling. 5. ChairmanMarshall acknowledged the presence of Councilman Matteoni at the Commission meeting. VII. ADJOUR~NT Commissioner Lustig moved, seconded by Commissioner Belanger, that the Planning Commis- sion meeting of October 8, 1975 be adjourned.
