MINUTES Relative to the minutes of!April 27,197.2..~ the following corrections were made: page 6, under GP-77.2, the motion made by Commissioner Lustig and seconded by Commissioner /2r~r~b~F~{'f~lose the public hearing on ~P-77.2 was inserted into the minutes; page 6, Item A-S66 - Commissioner Lustig voted no in the motion to approve this item; and page 7, under UP-279, the word "assistance" was substituted by the word "acceptance." Subject to these corrections, Commissioner Zambetti moved, seconded by Commissioner F~rshall, that the reading of thei Planning CommiSsion minutes of April 27, 1977 and May 11, 1977 be waived, and that they be approved as distributed to the Commission. The motion was carried; Commissioner Lustig abstained from approval of the April 27th minutes. II. CONSENT CALS\~]AR A. Composition of Consent Calendar Commissioner ~rshall moved, seconded by Commissioner Lustig, that the ~'~y 25, 1977 composition of the Consent Calendar be approved. SD-1302 - Clayton Thomas, Allendale Avenue/Chester Avenue, Tentative Subdivision Approval S Lots; Continued from Ma}~ 11, 1977 It was ex]Dlained that the applicant had not as yet resolved the issue of lot area, and a recommendation was made that this item be continued. Chairman Belanger directed that SD-1302 be continued to the Planning Commission meeting of June 8, 1977. B. SD-1293 - Osterlund Enterprises, Allendale Avenue, 26 Lots - Minor Adjustment to Pr.evi.ously-Approved Tentative Map 'Staff noted that the applicant was requesting a minor modification to the approved_tenta- tire map adjusting the corridor sections of 2 flat lots (Lots #8 and 23). It was explained that this modification would achieve more proper site drainage and it would create less of an alley affect in the subdivision. Staff recommended approval of this request per its Staff Report. Commissioner ~rshall noted that the proposed revised map did not reflect the minimLnn access road on Lots 2S and 26, and he requested that the exhibit reflect said road. Commissioner ~rshall moved, seconded by Commissioner Zambetti, that the Planning Com- mission grant approval to the request for minor adjusments to Lots #8 and #23 relative to application SD-1293 per the Staff Report dated ~'~y 19, 1977 subject to the approved exhibit reflecting the p.roposed minimum access road on Lots 25 and 26. The motion was carried unanimously. IV. PUBLIC HFARINGS A. UP-33S - Saratoga Federated Church, 20390 Park Place, Request for Use Permit to Provide for a 22-Space Parking Lot Serving the Saratoga Federated Church Located at Southwest Corner of Saratoga Avenue and Park Place (Ordinance NS-3, Section 5.3 (e)); Continued from ~[~y 11 ~ 1977 Chairman Belanger reopened the public hearing on UP-335 at 7:42 p.m. As there were no comments] Commissioner Lustig moved, seF0]i~[d by Commissioner Marshall, that the public hearing be closed. The motion was carried unanimously, and the public hearing was closed at 7:43 p.m. Commissioner Zambetti moved, seconded by Comissioner Laden, that the Planning Commission grant approval to application UP-335 per Exhibit "A" and the Staff Report dated May 19, 1977. The motion was carried;°.~6.~mi~6~e~ Williams abstained. V. DESIGN RB;IEW A. A-575 - Security Pacific National Bank, Big Basin Way, Final Design Review Approval One .Te3n. pora.ry Constrp. ction Sign Note was made that a Staff Report had been prepared recommending approval of this temporary construction sign. It ~s pointed out that per ordinance requirements, the construction sign would only be valid for a period of 6 months from date of approval. Commissioner ~'[~rshall moved, seconded by Commissioner Callon, that the Planning Commis:~ sion grant final design review approval to application A-575 per Exhibit "A" and the Staff Report dated >L~y 19, 1977. The motion was carried unanimously. VI. C(I\~'RINICATIONS A. WRITTEN 1. Letter received B[~y 19, 1977 from George E. Clausen, 1036 E. Evelyn, Sunny~-ale, regarding the location of swimming pool equipment on property located at 14728 Bougainvillea Court. (NOTE: Action was taken on this matter under Written Commtmi- cations; however, it was again reviewed by the Commission under Oral Communications due to the late arrival of Dr. Clausen.) -2- .... I~IlTTSN CC~[INICATIONS - Cont~'.d It was explained that a building permit had been issued for the location of the swimming pool, but that a permit had not been issued for the placement of the swim- ming pool equipment which was proposed to be located within the sideyard setback of this property (in violation of Zoning Ordinance requirements, as interpreted by Staff). It was explained that the applicant was requesting a redefinition of the front yard from Bougainvillea to Tollgate in an effort to redefine the sideyard and rearyard setbacks in order to place his pool equipment closer to the southerly ._.... .....property line. .~ S~ explained that irregardless of whether the front yard was redefined, the sfd~- ~j ~i: yard setbacks would not change; and consequently, the site for the proposed pool ..... e~ipment Would fall within the required sideyard setback. Staff pointed out 'that '~=~': ';~ the only way for the equipment to remain where it was proposed would be to receive a variance, but it was noted that there were alternative locations on site for said equipment which ~Duld not require a variance. At this point, Commissioner Laden moved, seconded by Commissioner Lustig, that the Planning Commission confirm the present yard requirements on this lot. The motion was carried unanimously'... Staff was directed to notify Dr. Clausen of this action, and to explain rthat___th~Fe were alternative locations for this equipment. Under Oral Communications, Dr. Clausen requested and received an explanation of the action taken on this item. Dr. Clausen stated that per his interpretation ~' the Zoning Ordinance, he felt redefinition of the front yard would change the definition of the sideyard setbacks, thus allowing for the placement of the equipment as proposed. He explained that the equipment was of a solar heating nature, and he contended that the proposed site was the most appropriate for this type of equip- ment. Additionally, he pointed out that the proposed site was the least obnoxious location on his property for such equipment. Commissioner Marshall explained that Section 13.7 of the Zoning Ordinance specified that on a corner lo% a rear yard equal to the required minimum side yard would be permitted provided that a yard space equal to 25% of the area of the site could be provided adjoining the rear property line. He pointed out that Dr. Clausen had improperly interpreted the ordinance, and again noted that redefining the front or rear yard on this site would not alter the 20-foot sideyard setback where the swim- ming pool equipment was proposed to be located. It was suggested that a variance could be applied for if Dr. Clausen desired the pool equipment to be located as proposed. It was noted, however, that there were alternative locations on site for said equipment which would not require a variance, and Dr. Clausen was requested to first pursue these alternative locations. 2. "~a~di Cuenca of the Chamber of Commerce requested a status report on Long'S' Dru~'L'' store proposed for the Argonaut Shopping Center. Chairman Belanger explained that -design review approval would be required for this 'commercial activity, and she noted that such application would be reviewed by the Commission' at its next meeting. '3.'- The Secretary explained that a request had been made for the Planning CommisSiOn to review application SD-1296, Gerald Butler, for a 7-lot Subdivision on Montalvo Road at an adjourned Commission meeting. He suggested that this Commission meeting be adjourned to 4:30 p.m. on Tuesday, ~y 31, 1977' at the CriS/2_ Conference Room to discuss this matter. He noted that this meeting would be ]{~l'd prior to the regularly-scheduled Committee-of-the-~ole meeting agendized for ~y 31st. B. ORAL 1. City Council Report - Commissioner ~rshall gave an oral report of the City CounCil meeting' ~eld ~'~"1'8, 1977. A copy of the minutes of this meeting is on file at the City Administration Office. 2. Commissioner Laden _g~a~-e _a bri_ef status report of the Village Task Force study. She explained that the TasR Force'had divided into smaller work sessions on Village district zoning, traffic and parking, beautification, taxation and funding, and commercial ideas. ADJOU~N~F Commissioner Marst~ll moved, seconded by Commissioner Lustig, that the Planning Commission meeting of May 25, 1977 be adjourned to a special Commission adjourned meeting on May 31, 1977 at 4:30 p.m. in the Crisp Conference Room.
