Composit.ion of Consent Calendar At the request of Acting Chairman Zambetti, Comnissioner ~rshall moved, seconded by Conmissioner Lustig, that the Planning Commission-approve the Composition of the July 27, 1977 Consent Calenjar with the deletion of Item 2a - SDR-11SS (Dwayne Richards). The motion was carried unanimously. B. Items of Consent Calendar Conmissioner ~rshall moved, seconded by Conmissioner Lustig, that the Planning Conmission approve the following applications: 1. Final Building. Site Approvals a. SDR-1312 - Board of Realtors - Blauer Drive, Final Building Site Approval - 1 Lot, Commercial b. SDR-1318 - B. T. Galeb, Zorka 6 Ted Avenue, Final Building Site Approval - 2 Lots 2. Final Design Review a. A-S63 - Jim Day, Chester Avenue, Final Design Review Approval - Lot #4 of Tract No. S923 b. A-S69 - Eldred Kunkel, Chester Avenue, Final Design Review Approval - Lot #17 of Tract No. S922 c. A-S8S - S. E. Hilton, 14S31 Big Basin Way, Final Design Review Approval - 2 Identification Signs The motion was carried unanimously. III. TENTATIVE SUBDIVISIONS A. SD-1316 - Hagan Construction Company, Regan Lane, Tentative Subdivision Approval - 17 Lots; Continued from July .1..3, '1977 At the request of the Staff, Acting Chairman Zambetti directed that consideration of SD-1316 be continued to the Planning Conmission meeting of August 10, 1977. B. SDR-11SS - .D}vayne Richards, Palomino Way, Final Building Site Approval - 1 Lot At_ the Staff's request, Acting Chairman Zambetti directed that the Planning Com- mission consider Item IV. A. (A-583 I~ayne Richards)out of order before rendering a decision on Staff's suggestion that a conditional final building site approval be granted on application SDR-1155~ inasmuch as the building site approval will expire prior to the next Planning Convnission meeting. IV. DESIGN REVIE~V A. A-S83 - r~ayne Richards, Palomino ~Tay, Final Design Review Approval - 1 Lot; Continued from July 13, 1977 " Staff prese~i'~ed the revised plans for the Planning Conmission's review. Commis- sioner Lustig expressed his displeasure about the type ~f'h~se ~h~d the amount of cut and fill proposed for this property. He urged' that this matter be referred back to the Committee-of-the-~ole for further consideration. After lengthy dis- cussion concerning configurations of the plans and geological and soils reviews on the property, the Secretary suggested that because of the time constraint involved, the Planning Conmission consider granting a conditional final building site approv- al with the condition that final design review approval must be granted before approval of the actual final building site,or issuance of building permits for the subject property. It was the consensus of the Planning Commission that this matter not to the Committee-of-the-~ole and Acting Chairman Zambetti directed that'. ='~' the Design Review Conmi~tee visit the site on Monday, August 1, 1977 at 4:00 p.m. and report back to the Commission. SDR-11SS.- ~!ayne Richards, Palomino l~'ay, F.ina.1 Bp. ild.ipg Site Approyal - 1 Lot Commissioner ~'[~rshall moved, seconded by Conmissioner Laden that the Staff Report°- dated January 8, 197S in the matter of SDR-11SS be adopted and that approval of the tentative map, Exhibit A, filed November 2S, 1974, subject to the conditions of said Report to include approval of Resolution llSS-1, be granted. The motion was carried unanimously. V. MISCELLAN]BOUS A. SDR-1299 - George Barry, Mt. Eden Ct., Tentative Building Site Approval - 1 Lot. Appeal of conditions regarding ~'ater System Improvements for Fire Protection .It was noted that this matter was reviewed at the last Committee-of-the-l~hole meet- ing. Staff explained that this is a single building site and recommended approval of the request for a modification of the coDjition concerning water system require- ments for fire protection. Commissioner ~iarshall moved, seconded by Commissioner Laden, that the Planning Com- mission grant approval to application SD-1299 per Staff Report dated July 21, 1977, regarding fire protection as outlined in Items 1, 2 and 3 of said Report. The motion ~s carried unanimously. B. SDR-1321 - Barret-Hibbard & Co., Saratoga Avenue & t~orden lVay, Tentative Building Site Approval - 4 Lots. Request for Exemption from Subdivision Ordi- nance (No. 60) Provisions, Classifying this Project as a Hillside Subdivision Conmissioner Marshall moved, seconded by Conmissioner Lustig, that the Planning Con~nission adopt the Staff Report dated July 22, 1977, in the matter of SDR-1321 (Barret-Hibbard & Co.) and grant 'th~ exemption from Subdivision Ordinance (No. 60) which classified said project as a hillside subdivision. The motion ~s carried unanimously. C. 1. SDR-1274 - Daniel Antovich, Sperry Lane, Tentative Building Site Approval - 2 Lots. Request for Modification of Conditions Regarding the Timing of Design Review Approval It was noted that this matter involves a lot split which provides for two building sites. Staff recommended that the Planning Commission approve the modification of Condition VII. A of the Staff Report, relative to the second lot (Parcel B) and that a note be placed on the map, for the benefit of potential buyers; specifying that Design Review remains an outstanding condi- tion on this lot. Commissioner Marshall moved, seconded by Commissioner Lustig, that the Planning Commission grant the requested modification to the tentative map conditions on SDR-12?4 relative to design review requirements on Parcel B, ~th the appro- priate notation on the map that design review approval is required and that - 2- V. Request for Modification of Conditions Regarding the Timing of Desi.gn Review Approval (Cont'd.) the intent shall be to provide a house designed to minimize grading and to blend with the topography. The motion was carried unanimously. 2. SDR-1274 - Daniel Antovic.h, .Sperry .L. ane., Final Building Site Approval - 2 Lots Commissioner Marshall moved, seconded by Commissioner Callon, that the Staff Report dated ~rch 3, 1977, relative to SDR-1274 be adopted and that Final Building Site Approval be granted to SDR-1274. The motion was carried unani- mously. D. A-495 - Frank Schillace (Joseph Yonan), Upper Hill Drive, Final Design Review Approval - 1 Lot.. R. equest f.or Modificatio.ns to 'Previously Approved Plans There was no written report on this item; however, Staff explained that design review approval had been granted to Frank Schillace for a single-family dwelling on Upper Hill Drive. Subsequently, this property ~s sold to Mr. Joseph Yonan, whose new plans for the development of this property deviate significantly from those previously approved for Mr. Schillace. Both maps were displayed for the Planning Commission' s perusal. It was noted that Mr. Yonan's plans provide for a single-level house, Whereas Mr. Schillace's provided for a step-footing two- level structure. Discussions follmved concerning the feasibility of the proposed plans for this property. -, Mr. Frank Yonan stated that he was not aware of any restrictions on the property when he purchased it, but ~s agreeable to continuance of the matter to the next Conmittee-of-the-Whole meeting. Acting Chairman Zambetti directed that consideration of this item be continued to the Conmittee-of-the-Whole meeting of August 2, 1977. E. EP-10 - William C. Rose, 19782 Braemar Drive. Request for Encroachment Permit to Retain Existing Fence A letter ~s received from Mr. William C. Rose relative to the complaint filed with the City Code Enforcement Officer about an existing 6' high fence which has encroached on the City right-of-way approximately 3 to 4 feet. The Secretary stated that the City Traffic Engineer reviewed this site and determined that no hazard exists. He advised that the City does not anticipate a need for additional right-of-way; however, the City has the option to revoke the permit if it chose to proceed with any building in the future. Conmissioner Lustig moved, seconded by Commissioner Marshall, that the Planning Commission grant approval of application EP-10 per Staff Report dated July 22, 1977. The motion was carried unanimously. VI. COMMUNICATIONS A. WRITrKN 1. A letter ]From Mrs. Betty Lou Maas, ~ July 7, 1977, of 20360 Saratoga-Lbs GatQ._s. ~Rp_~M, in }!.hich she expressed her opposition to the construction of any 'stad_ium facilities in the ar~'~'~t~i~'h~0~fd' F~dse traffic congestio~'p~Sbi~:" 2. A letter from Mrs. Evelyn Shiota, dated July 13, 1977, of 14270 Old Woed Road, protesting the requirement to resubmit ana pay fees for a tennis court use permit issued to the Shiotas in the fall Of 1975 when they had applied for a grading permit. The Shi~tas now wish to build a tennis court; hmqever, the use permit has since expired and, based on the fact that the permit itself does not explicitly state the expiration date, Mrs. Shiota requested that the Planning Commission consider granting an extension of the permit. Mr. Shiota told the Planning Commission that if the expiration date had appeared on the face of the use permit, he would have renewed the permit prior to that date. The City Attorney commented that the City Ordinance does indicate that the duration of a use permit is one year. Discussion and suggestions followed -3- concerning possible means by which applicants could be informed of the ex- piration dates of use permits in the future. Acting Chairman Zambetti ad- vised Mr. Shiota that although the Planning Commission was sympathetic, it would be necessary for him to resubmit plans and pay t~e'f~e'~'fSF another use permit if he chooses to build a tennis court at this time. B. ORAL 1. City 'Council Report Acting Chairman Zambetti and the Secretary gave oral repgrts on the City Council meeting held on July 6, 1977. A copy of the n~i'~utes of this meeting is on file in the City Administration Office. 2. Mr. Richard Kier - Kier & Wright (SD-1316 - Hagan C6nStruCtion Company) Mr. Richard Kier of Kier & Wright, Civil Engineers, representing the applicant (Hagan Construction Co. ), addressed the Planning Commission relative to the disposition of Item III.A..considered earlier in the evening. He stated that although he had arrived ten minutes late, he had come prepared to discuss this item and to present alternate solutions to the problem. Acting Co~nissioner Zambetti advised him that consideration of SD-1316 (Hagan Construction Co.) was continued to the next Planning Co~nission meeting to be held on August 10, 1977. VII. ADJOUR~NT Upon motion of Commissioner Lustig, seconded by Co~nissioner Callon and unanimously approved, the Planning Commission meeting was adjourned at 9:05 p.m. / / / ft/
