MINUTES
The Commission waived the reading of the minutes for the meeting of
April 18, 1984 and approved the minutes unanimously.
I. OLD BUSINESS
A. Application for Designation - Judge Foster House
The applicant, Gene Zambetti, explained the historical significance
of the building and the application request. He indicated that
the State Historic Building Code was adopted by the City Council
in March 1981 (Resolution No. 997). However, this resolution
may not actually have adopted the code since such adoption is
usually done by ordinance.
The applicant indicated that S0% of the structure is original.
The Commission then discussed the question of whether or not the
structure was a landmark or a reproduction of the original building.
The Commission indicated it wanted to encourage rehabilitation and
restoration but if a structure is not a landmark, the Commission
questions whether it ~ould be designated.
The Commission then discussed the positive and negative aspects
of the proposed designation. On the positive side, the designation
could create positive press coverage and could encourage others to
preserve rather than destroy the City's limited historic resources.
On the negative side, the designation would establish a precedent
of creating a landmark designation with only half of the original
structure and with the question of reconstruction or restoration
unresolved. The Commission decided to continue this application
to the meeting of May 23, 1984.

B. Revisions to Ordinance No. 66
The Commission determined that the criteria section of the Heritage
Preservation Ordinance needed to be revised. Commissioner Henderson
volunteered to revise this section. Commissioner Cameron stated
that criteria for alterations and the moving of structures were
needed.
Commissioner Heid suggested that each Commissioner write down any
suggested revisions to the ordinance and bring them to the next
meeting. Commissioner Cameron indicated that he would check if
the State Historic Building Code was actually adopted by the city.
C. Historic Overlay Zone
Commissioner Cameron reported on his research on Model Historic
Preservation ordinances. The main point he made is that owner
consent for designation provision in the City's ordinance should be
revised per the recommendations in these ordinances. Nancy Shanahan,
with the National Trust for Historical Preservation in San Francisco,
is reviewing and critiquing the City's ordinance. It is hoped this
critique would aid the Commission in its revision of the ordinance.
D. Application for Designation - Central Park
This item was continued since the application preparer, Commissioner
Voester, was not present.
II. New Business
A. Plans for Town Meeting
Commissioner McArthur reported that she had contacted the State
Office of Historic Preservation regarding guest speakers for the
town meeting. She indicated that Norman Kapernik will speak on
San Jose's Henslee Historic District and she will follow up on
other speakers.
III. OTHER NEWS
A. Commissioner McArthur indicated she would have a brunch on May 20th
for the Commission.
B. The Commissioners were invited to a meeting at Commissioner Kvammer's
home on May 9 at $:$0 P.M. to plan the Historic Homes Tour.
C. The next meeting for the Commission is to be May 23, 1984.
