The following consensus was reached on the two items. 1. Bed and Breakfast Regulations Staff gave a brief background on the status of existing b~b regulations in the zoning code; i.e,, they are permitted as a conditional use in the P-A, C-C, C-V, and C-N districts, but theta are no specific operational or site development standerOs. The Commissions discussed possible b&b standarCs for the City of Saratoga and directed StafP to begin preparing an ordinance that includes the following regulations: a) The property shall be a designated Heritage Resource. b) A use per. it shall be required. A new use permit would be required if the property changed owners, Ths use permit could be revoked if the b&b is not operating according to code and conditions. c) The b&b shall be located either in the Village commercial area or within 500 ft. <this distance may be changed pending measurements to specific properties interested in becoming b&b's> of its boundaries. d) Off-street parking shall be provided at the ratio of one space per bedroom plus one space for the owner or resident manager. e) No more than 8 rooms may be rented. f) The maximum length of stay shall be 2 weeks. g> No structure1 changes shall be permitted to the outside of the structure, h) The size and type o~ signs shall be limited. Outdoor lighting shall b~ kept mt a minimum. i) Individual rOOM size shall be a MiniMum of 188 sq. ft. j> Cooking shall not be permitted in bedrooms, k> The b~b operation shall be subject to all City building, fire, and licensing regulations. 1> The b&b operation shall be subject to a bed or roo~ tax. m) The b&b establishment shall be owner-occupied or owner-operated with a resident manegat, n) Only one Meal (breakfast) shall be served. o) No ancillary uses such as receptions, parties, etc. shall be allowed. There was also consensus that since b&b's would be restricted to the Village area, a policy nta%e~ent regarding this issue should be added to the Village Plan. 2. Relief from stricf application of ~ite development stand~rd~ ?or de~igna%ed historic structures. The Heritage Commission expressed concern that the strict application of site development standards (such as setbacks, parking, height, etc.) may compromise the architectural integrity and character of historic structure~. The Planning Conmission concurred and Staff was directed to develop a new ~.lndioo which would enable the Planning Commission to grant variances ?ro~ development standards if a structure was a Designated Heritage Resource.
