Glennon, Drake, LanEwill, Herman Absent: None B.. ~iINUTES Councilman Hartman moved, seconded by Councilmen Glennon to Waive the reading of the April 5 minutes and approve them a s mailed to the individual councilmen. Carried unanimously. II RESOLUTIONS AND ORDINANCES A'.' ORDINANCE 28 ORD~ 28 Clerk gave the second reading to Ordinance 28, being an ordinance EncroaCh- ment requiring permits for encroachment on public=streets in Saratoga. Permits ' Councilman Lan~will moved, seconded by Councilman Glennon to adopt Ordinance No. 28. Motion carried unanimously° B. ORDINANCE 30 Councilman Glennon moved to adopt Ordinance 30 as given its Ord. 30 SERe second reading by the Clerk. ~his ordinance authorizes the ~ayor to exeeufe a Contract for State Re~irement System for Sar~t0ga City employees. Councilman Drake seconded the motion; carried unanimously. C. RESOLUTION NO. 95 The Clerk presented Resolution Noo 95~ endorsinE Assembly Bill 2048 Re,'. 95 relative to County Righways within cities end announced that the AB.2048 County County Trafficways Committee has reconunended its adoption. The HiEhways Mayor directed, without objections that the matter be held over to_ the next maetin~ and in the interims copies of the proposed AB 20~8 be distributed to the council for s~udy. ~II PUBLIC HEARINGS A. C-31 BROWNAND KAUFMAN C-31 The Clerk announced that the pub!ic hearing was continued from the Brown & Kaufman last meeting for rezogln[ application of Brown and Kaufman. Motion carried unanimously~ The. Clerk read Ordi~ance No. 3A-ZC-17~ this being the second reading of the ordinance changing zone of B~own and Kaufman from RE:B~ tO Ri:B2. Conncilman Glennon moved~ seconded by Councilman Langwill to adopt Ordinance 3A-ZC~17. Motion carried unanimously~ B. C-32 FRANK SHEPARD Public hearing opened at 8:ll P. M. on the application of Prank Shepard to fezone property located South' of Prospect near-Scully from RE:B~ to RI:B2. llle Clerk announced that the Planning Connniss~on has C-32 approved the. tentative map for the area and that the average lot size Shepard is approximately llsS00 square feet. He reported that no communications had been received and that .notice of public hearing had been publatshed .according to law. Mro Splitstones representing the applicant spoke in favor of the rezoning and no one present spoke in opposition. Councilman Langwill moved~ seconded by Councilman Har~man to Closethe public hearing. MOtion carried unanimously. The Clerk introduced Ordinance 3A-ZC-18 and ~he matter was held over to the next meeting for second reading a~d debate of the ordinance. IV OLD BUSINESS None v NE~ BUSINESS A. SDR-265 SAN JOSE gATERWORKS The Clerk announced that this is an applicat~on for building site SDR-265 approval for a water storage tank on the Peninsula Recreation~Inc~ San Jose ~ater ~orks property near Rolling Hills Road and that all conditions had been met. No one representing San Jose Vater. ~orks was present and Council- man Drake moved to hold the matter over to the next meeting for discussion of landscaping and structural plans. Councilman Hartman seconded themot!onl carried unanimouslyo Recess and Reconvened, B. D. SD-144 S. S. WILLIAMS _BrandJn~ine Acres The Clerk displayed the final map of Shelley S, Williams for a lot subdivision Zocated approximateZy across from Argonaut Shopping Center on Highway ~9 and announced that all conditions of the Planning SD-144 Brandy- Commission had been met. Mr. Willtams spoke about landscapin~ and wine Acres asked that his request for the Council to waive the fencing condition be grauted. After discussions Councilman Drake moveds seconded by Councilman Hartman to adopt ResoZution SD-14~-I, approving final map of Tract 2577, Motion carried unanimously, The Council indicated that the Developer may ask for relief from the flood control requirement for fencin~ at a Zater date as they cannot grant it at this times there being no evidence in the file that FZood Control District wouZd approve waivin~ this condition. VI ADMINISTRATIVE MATTERS A. MAYOR (1) The Mayor announced that Dr. Wilbur Kellum has agreed to accept Defense appointme~t as Deputy Civil Defense director. CounciZman appointment moved~ seconded by Councilman Hartman to approve the appointment of Dr, KeZ~um as proposed by the Mayor. Motion carried unauimously, (2) The Mayor announced the appointment of the following persons to the Library Saratoga Library Coa;nission: Charles F. Earlays Chairman; Manny Com~Lsston Gomez; John ~, Campbell; Mrs, Phil Olsen; and Mrs, Theodore Palltricks Jr. (3) The following Civil Defense positions were announced by the Mayor= Director - Mayor Burton R, Brazil Assistant Dl=ector - WiZbur ~, KelZum Civil Deputy Director and Chief of Publicity and Information - Dorothy Parker Defense Deputy Director and Chie~ of AdauLnistration - Gordon Officers Chiefs Communications - William E. Zappelli (4) The Mayor announced tha: the Inter-City Council Mayor~s Committee I.C.C~ Mayors ~ill meet with Senator John Thompson and Assemblemen Allen and Bradley on April 27 in Sacramento, -3- (5) Councilman Glennon moved, seconded by Councilman Ha=tman to Leave of Absence grant the request of CoUncilman Langwill to be absent from the council meetings of May 17 and June 7. Motion carried. B. FINANCE (i) Councilman Drake moved to authorize payment of the bills listed Finance · tn the amount ~of $7~695~46. ,Motion seconded by Councilman Glennon and carried unanimously. (2) The City Clerk's Financial report for the month .of March was distributed.', (3) The thud quarter budget report was distribpted for council study. C. C01~ITTEES The Clerk dietributed copies of a report fromMro Nat Kendall and PatriCk Creegan, .who wore appointed to study the matter of the Herriman Avenue Bridge and submit their recommendations. After discussion, Her~iman Avonuo Councilman Langwill movod that the report of the advisory corm~tttee be Bridge adopted end that the City Administrator be .authorized t? .proceed with negotiations f~r the construction of the improvements to the existing bridge as recommended by the advisory committee. Marion ea~ried unanimously.' ~ha Director ~f Public Works will report at the next meeting whether the present design engineer w~ll proceed on this basis. D.CITY ATTORNEY No reports DIRECTOR OF PUBLIC WORKS The Director of Public Works reported that Mr. Enochs~ the County Diredtor of Public Works had informed him the County has no figures R[W cost ltwy #9 yet on the cost of right-~f-way for widening ~ghway #9 north of the railroad tracks and estimate it will be three or four weeks before they will have prelim~nary figures. He reported that.M~. Enochs 'Indicated he felt the moving of utilities would be covered by franchise except at the bridge. F. (3) The Council approved a recommendation-by the Mayor that one delegate S.C. Water. serve as representative of the four west valley cities on the Santa Commission Clara County Water Commission. VII PETITIONS AND GRIEVANCES A. ~RITTEN COMMUNICATIONS A letter from Milan M. PopovichsPresident-of the Azule Improvement Street Patterns- Association relative to street p~tterns in the Azule area was referred Azule to the Planning Co~ittee of the council.
