MINUTES Councilman Lan~will moved, seconded by Councilman ltartman that the minutes of the mee~in~ of July 19, 1961, be epproved as distributed and the mading thereof be waived. Motion carried unanimously. II ORDINANCES AND FO~a.L RESOLUTIONS A. RESOLUTION NO. 102 - CALLING SPECIAL ELECTION re HIGBWAY 49 Deputy Clerk rcad Resolution No. 102, which was continued from last ' meetin~ for action. The Director of Public Works read his report of a meetiv4] held July 27 at the Division of HiEhways in San FranCisco, The~eetinE Res. was attehded by State and County representatives and F~. Huff and 102 - Councilman Glennoh p~esanted to them a proposal for a compromise plan Special Election for improvement of HiShway 49. The Council discussed the report at H~y.#9 length and Hayor pro tam Clennon reported that Mro Sinclair of the State Division of Highways had advised that no £unds for improvement were available for this fiscal year reSardless of the outcome of an election, Hr. Sinclair suggested that the'City Council aEree on a plan and present it to him fOFrecommendation to the Highway Connnission in time for them to make Some decision by December 31, 1961. On .this basis, after considerable discussion, a motion was made by Councilman Drake and seconded by Councilman Lan~ill, that Resolution No, 102, calling special election for October 10, 1961, be adopted and that a Council committee consistin~ of Hayor Burton Brazil and Councilman Glennon be directed to confer on a compromise solution to be presented to the Council at the August 16 meeting, Motion carried unanimously. ORDINANCE 3A-ZC-20 Deputy Clerk read Ordinance 3A~ZC-20~ this being the second reading of Ordo 3A-ZC-20 this ordinance. Councilman Lan~ill moved, seconded by Councilman Drake to adopt Ordinance 3A-ZC~20, changing zone from '~* ~o 'RE:BTi C-36 on the application No. C-36.of Clarence tdinnerlys for approximately 12.954 acres of land located East of Argonaut School and North of Glenbrook subdivision. Motion carried unanimously. III BUILDING SI~E APPROVALS AND SUEDIVISIONS A. SDR-223 VALLEY~LE..~4ODYST CHURCH Deputy Clerk reported that all conditions for this building site SDR-223 approval have been met except that the record of survey map has not Valley Methodist yet been recorded by the County. Councilman Langwill moved, seconded Church by Councilman Har~man for a~proval of SDR~223~ subjec~ to the actual recording by the County o£ the Record of Survey as called £or in Condition ~1. ~oticn carried unanimously. Council discussed costs~ utilities involved~ and method of repayment to the County. ~he City Attorney ~ead the agreement, as revised in accordance with the County Counsel's opinion dated Ray 8, 1961~ to provide for payment to the County from the City~s allocation of County Highway bond money. Councilman Laughrill moved~ seconded by Councilman Drake, to authorize the Nayor to execute the revised agreement between the County of Santa Clara and the City of Saratoga for payment of costs of right-of- way dcquisition for State Highway Route 114. ~tion carried unanimously. B. MT. EDEN ESTATES ASSESaT DISTRICT Deputy Clerk read a letter from PL-.. Nell Dollard and 14r. A. L. Dumas. requesting revision of specifications for road improvements in l~t. Eden Estates Assessmen~ Distrlet as required by Resolution No. 99. I4ith no objections the matter -~as refGrred to the Planning Commission for recommendation. VI NI~ BUSINESS A. A-56 TII:I~'~/ATER OIL COMPANY Deputy Clerk read a letter of appeal filed by TIdewater Oil Company, from the Planning Co-,,~,!ssion denial of architectural approval for a canopy over pomp islands at their service station located at the A-56 corner of Big Basin Way and Saratooea-Los Gates Road. Mr. Howard Tidewater Oil Co. Pates Engineer for Tidewater O~.1 Company. sp~.ko in support of the Appeal appeal and Mr. Harold Teeple~ proprietor of the service station~ presented a pet.~.t~.on relative to this matter. The City Attorney advised that no new evidence could be introduced unless the Council decides to hold a hearing de nero. (2) Deputy Clexk reported that $195.3~ had been received from Sani- tatian District No. l.,. as compensation for the easement across the Civic Center Site in accordance with Courtell act!Ln of June 21s 1961. C. COUNCIL COMMITTEES (1) Councilm~ Langwill reported that, in response to Council action Argonaut Drainage of June 21~ petitions are being actively circulated in the Argon- aut area relative to an assessment district for drainage facilities, (2) Councilman Drake announced that he would be unable to attend the Drake- Absence Council meeting on September 20~ and might also be away from the from m~. meeting of September 6. (3) Councilman I{artman~ ~epresentative on the County Water Counission~ Water reported that the Cer~nissions at itss meeting held todays deferred Commission action for two weeks on =he proposed 25¢ ~ater tax and on the recemmendatinn fc= a wate~ importing agency. D. DEPAR~{~NT HEADS AND OFFICERS (1) Director of Public Works reported that the cost estimate is ready on the Herriman Avenue b~:idge and specifications will be completed a~ the end of this week for submission to the Division of Highways. (2) City At=orne~ reported that the Appellate Court upheld the con- Zicovich dam viction of Anthony Zionrich on all 64 counts and that he will be required to remove the illcad1 dam or pa~tially tear it down under a building pern~t and engineered planss or go to jail. (3) Deputy Clerk raperred that notices have been received from the Departmeht of Alcoholic Beverage Control of the following appli- cations for ABe licenses: (1) Saratoga Inn for On-sale General license for ~eneral eating place. (2) Saratoga Club - transfer of On-sale Beer and Wine license. (3) Saratoga Market - transfer of Off-Sale Beer & Wine license. IX COMMUNICATIONS A. WElTTEN (1) Deputy Clerk read a letter from Mrs. John ~cNulty of 18789 Aspesi Drives Saratogas requesting a 25 mile per hour speed limlt ~uito Rd. sidewalks on quito Road during school hours and that the Council install sidewalks along ~uito for children x~ho are scheduled to artand Marshall Lane School, This request was made in accordance with Council discussion at the meeting of July 5 when the City was asked to provide bus service for these children inasmuch a s Campbell School District did not plan to do so. At that time -4- the residents who were in a~t~.naanee were advised that, if,after appealing to the proper Jursidiction, they found they needed help in providing safe walk-ways for the children, they should return to the Conncil. After discussion, FEayo: pro temClermon ordered the m~tter referred to a subsequent meeting and directed the Director of Public Works to investigate alternate routes, grading, etc. and Councilman Drake to investiga~e the matter of rental of busses and the possibilities of utilization of the three idle busses owned by the School district. (2) A letter from Mrs. D. S. Lind, 12~70 Glen Arbor Court, relative Dirt o~ streets to dir~ ned litter on streets was read, and the Council concurred that street sweeping services cannot be provided in a minimum service ci~yo Hwy.9 (3) A letter from Mr. Fo So Jones~ 20423 Thelma Avenue, was directed to be filed in the Highway ~9 file. (4) Mayor pro tem read a letter from Mr. Donald MacKay of MacKay and 'Somp~, regarding Conditions Nos. 8 and 19 of tentative approval Tr.3034 Cond. of of Tract 3034. The Deputy Clerk repo=ted ~hat these conditions Tent. map had been set by the Planning CommissiOn at th~irmemting of June 26 and Mr. MaCKay reported to the Council that they did not object to these conditions at the Planning Comm~ssionmeeting as theF felt they were matters of policy to be decided by the Council. After discussion, the City Attorney was directed to research the matter and report back as to the Council's jurisd~ction at this stage. B.
