The City Atto~ey advised that he had ~rafted the proposed amendant to the Access Subdivision Ordinance to provide for pro-rating of minimm access road 'Road re~burseent agreements on the basis of the n~ber of available buildin~ ~re~ents sites and that he ~d the Director of Public I~!orks, after reivew, had concluded that th~s method would be better than allowing for the alterna- tives of applying either this method or the current one of basing the re~bursement on the front footage of the property borderin~ each side of the road. After discussion of ~he two alternatives, the ~Iayor directed the record to show that Ordinance NS-5.6 was introduced and referred, with council approval, to the Manag~ent C~ittee for study and rec~endation. C.- SETTING P~LIC HEARING ON ADOPTION OF ~! CODE OF ~E CI~ OF S~T~A Public - Hearing- It was moved by Councilman Brazil, seconded by Councilman Tyler, and City Code unanimously carried to authorize and direct the City Clerk to publish notice that a public hearing will be held at 8:00 o'clock P. ~I. on !.Yed- nesday, April 1, 1964, on the adoption of the Code of the City of Saratoga. D. ORDINanCE NO. 38 Ord. 38 T~ City A~fnistrator read the title of Ordinance I~!o. 38, a proposed Adoptfn~ ordinance adopting a c~pilation and codification of the ordinances of the City Code City of Saratoga, and it was moved b~, Councilman Drake, seconded by CouncI~an Har~an and unanimously approved to waive the readin~ of Ordi- nance 38 and direct the record to indicate that the ordinance ~.yas introduced. The.City Attorney noted .that under the fire zone district ordinance this type of steel building,is prohibited in this zone but that the applicant had been Srantedtentative buildina site approval and architectural approval prior to theeffective date'of the fire zone district ordinance.. After brief discussion, the Mayor referredto the Planning Committee the question of,whether or not .the 'City desires to exclude this type building from the Cu~aercial ServiCe-zone asia now the effect of the. fire zone district ordinance and the City BuildinS Code. . VII ADMINISTRATIVE ~L~TTERS In view of the number of people present who were concerned with the issue the Mayor asked the City Administrator if he had a report from the Chief of Police on the request for stop signs in the area'of the Argonuat School. Mr. Hanley reported that Chief Rosasco had reviewed the request for stop signs at Glen Brae and Beaumont, Hannons and Thelma (both intersections), Saratoga Stop Glen Court and Beaumont (both intersections), Beaumoat and Glasgow, and Shadow S~gns ~lountain Drive and Glasgow, all submitted in a letter dated ~ebruary 4, 1964 Argo- and signed by Mrs. R. Gaddis and Phillip ~I. l~ard, Principal of Argonaut School. naut As a result of this study and consultation with the Sheriff's Department Chief School Rosasco had concluded that stop signs were justified only at the intersection Area of Thelma and Hammons because of bad visibility for traffic approachin~ Thelma from both directions on llammons. Chief Rosasco had reported further that it was his observation that a substantial share of the p~oblem was caused by the children conmiting walking or bicycle violations throughout the course of their travel to school and that stop signs at a few intersections would not serve to protect them' against the danger that resulted from poor pedestrian behaviour. It was his further reconnendation, as reported by the City Administrator, that selective enforcement would be the proper answer, rather than stop signs, if excessive speed was the chief cause of parental concern. At the conclusion of the report of the Chief's reconmqendations, the ~!ayor asked.for comments from those present and ~lrs. ~[axine McGinnis, Mr. James Wright, Mr. Gerry Briney, Mr. Sam Gruever, i~[r. Irving Burke, Hrs. R. Gaddis, Mr. Smith, Mrs. Sally Leylor, Mr. Baker ~cGinnis and Hrs. Woodward all spol~e in favor of installing the stop signs as required in the hopes that their installation would make some contribution to improving the safety of the streets for the school children as they walked to and from Argonaut School After extended discussion by the Council, Councilman Drake suggested that the stop signs be tried as an interim measure if they would not be actually detrimental to safety. Councilman Brazil pointed out that this was one exemple of ~ problem that existed at various elementary sites throughout the city and suggested that the matter t~erefore be studied on an overall basis by a consulting traffic engineering firm as a basis for council determina- tion of an effective overall solution. He indicated that he believed there was a need for accurate pedestrian and traffic count and other technical data as a basis for rational analysis of the problem. There bein~ no objection, the bXayor referred this matter to the City Administra- tor to consult with the Chief of Police as to a possible interim solution and to investigate the cost of engaging a traffic engineering consultant to conduct an overall study. A. b~AYOR Council (1) Mayor Glennon announced that he had met this afternoon with all the Candidates City Council candidates, with the exception of Councilman Drake, to familiarize them with the problems of the city as he sees them and to invite them to check any city records or consult any city officials or staff members regarding any questions they may have regarding City administration or policy. Annual (2) The ~{ayor reported that the rough draft of the annual report will be Report · available for inspection. in the City Hall until Saturday morning if any council members wish to review it prior to its printing. B. ~INANCE Bills It was moved by Councilman Drake, seconded by Councilman Herman, and unanimously adopted to approve the disburs~ments on the list dated ~Iarch 4, 1964, for a total amount of $16,695.73, and authorize that warrants be drawn in payment. ~3- . C. COUNCIL CO~IITTEES (1) Councilman Tyler reported that the Public Welfare Committee had studied the informal bids received for the street tree maintenance Street prcgrmn and recommended that the Council authorize the execution of Tree a contract with Pied Piper, Inc. as the firm which seems to offer ~aintenance the most service to the City for the cost involved. Contract - Pied Piper It was moved by Councilman Tyler, seconded by Councilman Hartman, and unanimously approved to authorize the Mayor to execute a contract, to be drafted by the City Attorney, with Pied Piper, Inc. for the street tree maintenance work proposed at a cost not to exceed $4,000. (2) Councilman Hartman reported that the Planning Committee had reviewed the proposed Chester Avenue Improvement District in the light of the report of the Planning Commission dated February 3, 1964 and it was the Chester conclusion of the Committee that the formation of the district should Avenue be approved if the following conditions were met: Improvement District a) The Weber, Wayne and Gamper parcels to be excepted from any levy on the ground that they are existing sites with established d~-yellings that met all the required conditions at the time they were developed. b) The project be extended to include the improvement of Chester Avenue to minimum standards (18') from the creek north to Allendale Avenue with the Bellicitti and Buehner parcels tO bear their reasonable share of this minimum improvement. At such time as these parcels ultimately davelope they would be required to bring their respective frontages on Chester Avenue up to full standards. Councilman Hartman indicated that the Committee's decision was based on the Planning Corfanission's recommendation that proper circulation for this area would ultimately require standard collector streets to connect Allendale, Chester and Fruitvale Avenues and that the street pattern proposed by the district is an acceptable means of providing this circulation. During the course of Council discussion it was suggested to'Mr. ~.Iast~n of }[astin and Kingston, engineers for the proposed district, that he explore the possibility of all property ~ners except those with Allendale Avenue or Sobey Road frontage bearing the full cost of the project subject to a reimbursible agreement with the City under which they would be repaid that portion of the cost attributable to the b[agnuson, Bellicitti, and Buehner parcels at such time as these parcels developed. ~[r. Mastin indicated that he would explore this possibility but asked what the council's feelings about the project would be if this alternative proved to be impossible. The majority of the Council indicated that it ]mi~t support the recommendation of the Planming Committee as presented by Councilman Hartman if a reimbursible agreement approach proved not to be feasible. Maude_Quito(3) Councilman Hartman reported that the decislon on the Maude-Ouito Intersection intersection was deferred pending preparation of cost estimates. D. DEPAR~.~NT HEADS ~/.]D OFFICERS No rep'orts E. CITY ADMINISTRATOR Cox Ave. (1) Mr. Hanley stated that, after revie~ of two proposals for engineering Bridge services for the Cox Avenue bridge, it was his recommendation that the firm of Creegan and D'Angelo be authorized as engineers on the Engineers basis that they will have related engineerin~ work to do in connection with the Cox-Saratoga Avenue project and will be in a position to provide their services more economically. After discussions it was moved by Councilman Drake, seconded by Councilman Brazils and unani- mously approved to authorize the T.iayor to execute an a~reement ~ith Creegan and D'Angelo, in accordance with the proposal outlined by the City Administrator, at a cost not to exceed $3800. -4- Church (2) With no objection, the Mayor directed the City Administrator to Farking. write a letter to the various churches within the City calling to their attention unsafe parking practices by their parishioners and asking their support in getting the cooperation of their congregations with respect to safe parking procedures. ORAL Publit (1) Planning Commissioner Crisp announced that the Planning Commission Nearing- will hold a public hearing on the proposed Planned Community Zoning Planned District on March 9, 1964 and would appreciate any comments the council Comunity wishes to make prior to that time. Zoning (2) Mayor Glennon acknowledged, with pleasure, the presence of Planning Commissioner Crisp as the official Planning Co~ission representative for this meeting, and expressed appreciation to the representatives of the Good Government Group and the new council candidates.
