Motion was made by Councilman Burry, seconded by Councilman l!art~n, ~d unanimously carried to waive the reading and approve the minutes of the August 19. 1964 meeting, as written. SARATOGA FIPZ DISTPaCT PROPOSED ~]!~_TIO~ Saratoga Hayor Glennon expla{ned that the area Droposed to be annexed to the Fire Saratoga Fire District is an area in the northwestern portion of the District City which has until recently been relatively uninhabited and has Annexation been served by the Saratoga Fire District on a contractual basis at a cost of $1.00 per year. The P~ayor further explained that for some time the proposed annexation preceedtngs have been delayed by technicalities which the Fire District has detemined that the City ~uld best handle ~d the District has therefore requested the City to initiate the annexation proceedings and prepare the necessary data to complete the annexation in retum for which the Fire District has. a~reed to Day up to $1.000. for e~enses in connecti6n with this matter. The City Attorney indicated that this would ordinarily be the function of the County Counsel's office and confimed with the council that as the procedure is too technical for the fire district, the City ~7ill proceed under the name of the Saratoga Fire District and bill them for the e~enses involved. It was moved by Councilman ilartman, seconded by Councilman Dr~ce and unaniPnusly adopted to authorize the City Staff to proceed ~,yith the annexation proceedings in accordance ~.~ith the above procedure. B. ~QUEST FOR AU~ORIZATION TO GO TO ~ID ON CIVIC CEN~R PAVI~IC ~e Director of Public !.~orks presented the final site plan for the Bids - Civic Center pavin~ ~d indicated that it ~unts to apDroximate!y Civic $10.000 worth of paved area and ~ill provide 129 parking sp,~ces. Center After discussion, it was moved by Councilman Drake, seconded by Paving Councilman llartman, ~d ~nanimeusly adopted to authorize the City Staff to advertise for bids on the asphalt and concrete work for the Civic Center site development plan. SD-430 LE ROY H!ATT Iliatt Mayor Glennon read a letter from ~. Le Roy Hiatt dated 8/24/64, Request requesting that the conditions of tantative map approval be modified for to substitute rolled curbs in place of concrete curbs and gutters. n~dification The Planning Director ex~.lained that concrete curbs and gutters are of cond. standard engineering conditions and preferred by the City for reasons of maintenance but that the Plannin~ Commission, in some instances, had no objection to the rolled curbs. SDR-368 - ST.~tDARDOIL CO~A~ SDR-368 The Director of Public Works stated that he concurred with the County Standard Engineer's recommendation that the improvements constructed in con- Oil Co. nection with building site approval for Standard Oil Company be accept. accepted for construction. After discussion, during which Council- Const. man Hartman questioned x.~ether or not the City has been too regarding architecture and landscaping of service.stations as he feels this station is aesthetically undesirable, it ~as moved by Councilman Hartman, seconded by Councilman Tyler, and unanimously approved to accept the construction Of the improvements as recommended. The Planning Director indicated that although it is hoped that no more service stations will be constructed, the Planning Commission ~i11, in the future, place more er~hasis on landscapin~ in commercial zones, particularly regarding any contemplated remodeling of service stations. C. SDR-517 - C. VIGEN SDR-517 Vigen ~. Ualker explained that all conditions of tentative buildin~ site approval have been met by a former o~,mer under SDR-207 and that I~. ViXen had applied for building site approval as the previous approval had expired. It was moved by Councilman Tyler, seconded by Councilman 11artman, and unanimously approved to adopt P~solution No. SDR-517-1, grantin~ building site approval for one lot on Wardell Road. V OLD BUSINESS A. C-70 - O. R. ~-~AGGIOP£ C-70 I-~yor Glennon read a letter from Edward R. LaCroix, attorney for M egglore Mr. Magg!ore, requesting withdrawal of the rezoning application l!o. C-70 and refund of the filin~ fee. ~7ith no objection, Mayor Glennon referred the matter to the !Yenagement Committee for rec- commendation at the next meeting. VI ADMINISTP~TIVE ~TTEP~ A. MAYOR I.C.C. Hayor Glennon announced that the Inter-City Council ~ill meet Mtg. Thursday, September 3 in Hilpitas and that anyone wishin~ to attend notify ~. IJalher for reservations. B. FIN~qCE (1) It was moved by Councilman Drake, seconded by Councilman Bills Hartman and unanimously adopted to approve the disbursements on the list dated September 2, 1964 for a total amount of $40,428.93 and authorize that ~mrrants be drawn in payment. Treasurer's (2) The Treasurer's report for the month of July, 1964 was reviewed Report and accepted. -2- C. DRIVE Stop Signs The Council studied reports from the Chief of Police and from Regan Lane the Santa Clara County Sheriff's office reco~_endin?. the & Blauer installation of stop slp, ns at the intersection of Re,an Lane and Blauer Drive. After discussion, the ~ayor~ with no ob.~ections instructed the staff to prepare a resolution for the next meetln~, formally authorizing the installation of the recormmended stop signs. (3) BIDS FOR SEATII;G - COUNCIL Council Mr. ~Jalker presented the seating plan for the council chambers and Chambers reported that three companies had submitted informal bids: Seating Irwin Company @ $28.00 per seat; i!aywood-Uakefield at $32.50 ~nids per seat and American Seating Company ~ $32.28 per seat. lie stated that the ~{anagement Committee's reconm~endation is to m~ard the bid to the American Seatin~ Campany because of the compact design which affords morn front and back room and because of a more durable quality of material. Mr. Ualker further stated that the price of $32.28 per seat includes the sales tax and installation. It was moved by Councilman Tyler, seconded by Councilman Drake, and unsniraously adopted to authorize the ;<ayor to sign the contract with American Seattn~ Company, subject to the approval of the City Attorney. Cox Ave. (2) Council studied the plans for the Cox Avenue brid~e as approved Bridge by the State and it x..,as moved by Councilman Drake, seconded bY Bids Councilman Hartman, and unanir~ously app~oyed to authorize the staff to advertise for bids for the construction of the Cox Avenue brfd~e as soon as the plans and snectficatfons are completed. View Dr,- requesting the City to take legal action a%ainst either the Sullivan developer or the bonding company to bring Sullivan IITay and Canyon Vle~ Drive up to city Standards, The Director of Public 'Jay and the City Atton~ey indicated that the City has tried unsuccess- Street Deficiencies fully for e very long time to get the developer to correct the deficiencies and that attempts to get the bonding company to cooperate have been ineffective. ~Ir, Johnston e~lained that the situation is legally complicated because the bonds posted ~ith the County prior to incorporation of the City and that the County bonds ~.~ere ambiguous as compared to the City's bond forms, After extended discussion, durin~ ~rhich ~fr, Emin~er, 21141 Canyon Vie~,~ _Drive and Mr, L, Saylot, 21081 Canyon Viex.~ Drive, advised the Council that the deficiencies in the Saratoga Ilei~hts water Company line contribute to the bad condition of the roads, ~ayor Glennon directed the City Attorney and Director of Public Uorks to thoroughly investigate the matter and make a full report to the council at the next ~eettn~. ~r. Emin~er and ~fr. Pe~. requested the council to correct the street deficiencies no~l~ and then pursue the recovex7 of the expenses involved and ~ere informed by the !~ayor that this factor ~.~ill be considered by the Council at the next .meetiu~ when the full report is available. (2) The Council discussed a request from ~¥.
