AGREEMENT - COX AVENUE BRIDGE & SARATOGA CREEK CHANNEL IMPROVEMENTS The Clerk presented a contract prepared'by the Flood Control District Agreemen~ Which pr0~ides the Flood COntrol DiStrict cover the cost of Sacked w/Flood concrete Zip ~ap in connection wi~ .the ~onstruction 6f the .cox Avenue Control Bridge, estimated to be 150 cubic y~rds ~t $40.00 pe~ cubic yard, a District total of $6~000. I{I ORDINANCES, PETITIONS AND FORNAL RESOLUTIONS A. ORDINANCE NO. 20-1 Ordinance No. 20-1, an ordinance approvinE the annexation of certain uninhabited territory designated "SAR 1964-1" to the City of Saratoga was presented by the City Clerk for the second reading, having been introduced at the meeting of December 2, 1964. The Council took note Ord 20-1 of a written objection by l~s, Collette Bachman, 20776 Reid Lane, to Benevento the annexation, based on the premise that the City boundaries were Annex, fixed at the time of incorporation. The Clerk stated the Notice of Hearing had been properly published and the matter appeared on the agenda at the time of the meeting, although it had inadvertently been left off of the agenda that had been mailed prior to the meeting. It was also pointed'out that the General Plan~ adopted by the Planning Commission and City Council, called for annexation of areas south and west of the City to insure proper development of the hills adjacent to the City limitse It was moved by Councilman Hartman; s~vnded by Councilman Burzy; for the adoption of Ordinance 20-1; unanimously carried and so ordered, B. RESOLUTION NO. 217 The Clerk presented Resolution No, 217~ a resolution determining to Rose 217 undertake proceedings pursuant ~o special assessment and assessment Thelma bond acts for construction of improvements on streets and easements in Ave Imp. the Thelma Avenue area° He stated that this resolution was a standard lega! procedure prepared by the bondin~ firm attorneyso Motion by Councilman Burry for the adoption of Resolution No. 217; seconded by Councilman Hartman; motion carried unanimausly. XII C. RESOLUTION NO. 218 The Clerk presented Resolution No. 218, a resolution appointing attorneys for Thelma Avenue area project. He stated that this was a standard form Reso used in such matters, involving a standard fee if project succeeds. Count 218 ellman Hartman moved for adoption of Resolution No. 218; seconded by Councilman Burry; motion carried unanimously. D. RESOLUTION NO. 219 The Clerk presented Resolution No. 219j a resolution of intention to Re,. acquire .and construct improvements in the T~elma Avenue area. It was 219 moved by Councilmen Burry to approve adoption of Resolution No. 219; seconded by Councilman Hartman; motion carried and so ordered. The clerk stated that when all plans and specifications were drawn; engin- eers selected; a call for bids made; bids opened and assessments spread; a public hearing will be held in this matter, IV SUBDIVISIONS AND BUILDING SITES A. SDR-371J H. J. Sterner, E1Quito Way The Direbtor of Public Works recommended release of the Improvement Bond SDR- posted by H, J, Sterner in the matter of SDR-371~ since all work required 371 was Completed on a minimum acd~ss road and thgre was to be no maintenance Sterner by the City, It was moved by Councilmen;Burry; seconded by C6uncilman Hartmeni to approve release of the bdnd ~or SDR-371; motion carried and so 0~deredo B. SDR-523, United Presbyterian Church, Building Site Approval Building Site Approval.was requested for a four acre lot on Saratoga- Sunnyvale Road and Herriman Avenue by the United Presbyterian Church SDR- SDP,-523. Tne Planning Director stated that parking arrangements are two 523 parking spaces for five persons and that the building planned for seating United 150 persons, eventually to accommodate three hundred. The Clerk reported Pro,by. that all conditions had been met, bonds posted and fees paid, The Plan~ Church ning Director stated that the plans are subject to design review approval by the Planning Comm~ssion as to walkways~ landscapiBg, etc. J and that surrounding builders have agreed to cooperate on the fencing problem so houses north of the church will have fencing compatible to that erected by the church, Councilman Hartmen moved for approval of ,DR-523; seconded by Councilman Burry; motion carried and so ordered. C. Tract 3596 ~ Blossom View The Director of Public Works recommended the ac6eptance of Traot 3596, I~act Blossom View~ located on Prospect Road~ east of Highway 9~ for construction 3596 and maintenance period to start, Councilman Hartman moved approval of re- commendation for acceptance for construction of Tract 3596; seconded by Councilmen Burry; carried unanimously° V PUBLIC ~HEARINCS None VI ADMINISTRATIVE ~RTTERS A. MAYOR The Mayo~ stated ha ha~ requested the City Clerk to contact Wilbur Smith to ascertain the cost for establishing traffic patterns~ volume of traffic %'~JC and cost of road improvements and signalization if the junior college Traffic locates at Allendale and Fruitvale Avenue~ He reported that Wilbur Smith survey and Associates have quoted us on the basis of times with a m~imum charge of $2s000~00. The fee is based on two conditions: Ones that the ar&hitect for the college is cooperative in turning c~er the traffic data they have and the location and distribution of student population. The second condi- tion is that the data submitted holds up and proves valid. VIA. MAYOR (Cent,) The Council agreed it was advisab~.e for the junior college to join with the City in this survey, since they h~e to know what would be required to handle tile traffic that the campus would generate, It was considered that WVJC if the outcome. of the study proved adverse and indicates that the costs of Traffic traffic control are prohibitive, the collage would reconsider locating at survey this site° I.k', Walker suggested that the cost of the survey or a part thereof could be absorbed by the 701 Program, It was the opinion of the Council and the staff that the college would cooperate fully in the pro- posed survey, Motion by Councilman Hartrm~n; seconded by Councilman BurryZ authorizing the Mayor to confer with the Wast Valley Junior College District Board of IYustees in the matter of whether or not they will participate in a survey of the Allendale-Fruitvale proposed college site area with regard to traffic needs; motion carried unanimously, The Mayor informed tile Council that he has as yet received no formal reply to his letter to the West Valley Junior College trustees inquiring about location of the college on the Black Road site, B~ FINANCE (1) CounCilman Hartman moved for approval Of payment of the disbursements Payment on the list dated December 16, 1964,'for a total amouut of $10,529o96 of claims and authorized issuance of warrants for same; seconded by Council- man Burry; motion carried and so ordered, (2) The Clerk reported that our 90-.day accounts time deposits wiil draw Time 4% aS o~ maturity date; 6-month accounts~ 4-1/8%; 12-month accounts~ Deposits 4-1/4%, and that request had already been made of the banks to mak~ the Chahgeover, C. CO~CIL COMMITTEES (1) SDR-447 - M, Snow Councilman Burry reported that the Public Welfare Conmuittee had con- aidered the appeal of M, Lo Snow, SDR-447~ for change of a 12-inch concrete llne to a 8-inch steel drain line on the grounds that an SDR-447 8-inch line would serve the purpose as well as the required 12-inch Snow line~ and would cost approximately $250°00, as against the cost of $2,000 for the 12-inch lineo The Co~n4ttee recommended that the quest be granted, Motion by Councilman Burry approving an 8-inch storm drain line for SDR-447; seconded by Councilman Hartman; motion carried unanimously, The apDlicants were present, (2) SDR-531 - George Akers Councilman Hartman reported that the Planning Committee had met to consider the request for amendment of Condition IIB~ SDR-531, by SDR~-531 George Akers for a reduction of the requirement for stree~ improve- Akers ment from 26 to 18 feet, The Committee recommended that the Council uphold the recommendation: of the Planning Commission to deny this request on the grounds that this standard has been eonslste~t].y~pligd per the requirements of the Fire Marshal, Councilman Hartman moved that ths City C~L~nail uphold the decision of the Planning Comm{sslon in denying the r~.'~st of SDR-531 for amend- ment of Condition IIB, Councilman Burly ~[~Dtained from voti~ on this issue on the grounds that the property lnvo].vad abuts his property, With Councilmen Glennon and Hartman voting aye; Councilman Burry abstained; motion carried and so ordered° (3) Councilman Hartman reported that the Board of Supervisors had recon- sidered their position of accepting the recommendation of the minority Water in the matter of water metering plans and said he had read Mayor Comm, Giennon~s letter to the Board of Supervisors regarding Saratoga~s stand in the D. DEPARTMENT HEADS AND OFFICERS (1) City Attorney advised the Council he has a 25% interest in a subdivi- SD-537 sion of 31 acres on Pierce Road which will be coming before the Council for approval~ at which time he will abstain from any partici- pation in the matter~ SD-537. There being no objections the Mayor directed that this information be made a matter of record in the minutes. (2) The Director of Public Works presented an Offer of Dedication for Offer street purposes from MVS Company, a partnership between Drs. Abrams to Ded. and Sturla for property on Cox Avenue required for the Cox Avenue l~S Co. bridge construction. Councilman Hartman moved for acceptance of the Offer of Dedication; seconded by Councilman Burry; motion carried unanimous!y.' Mr. Huff reported that the directional sign for the intersection of Montalvo and Piedmont will be installed by the end of December. The Directo= of PUblic Works pre~ented Resolution 36-B-52, 35-B-53J Res~ 36~B-54, acceptance of Streets ifi Tracts 3259s 2543 and 2544 for 36-B-52 maintenance. Councilman HartmanmoVed for adoption of Resolutions 36-B-53 Nos, 36-B-52, 36-B-53, and 36-B~54; seconded by Councilmen Burry; 36-B-54 motion carried and so ordered~ (3) Planning Director repo~tedjtO]theCodn~il that the Copies of the Zoning Ordinance w~e depleted.~nd:req~ested~appraval t6 have the :' ord~nan~e~br0ught up ~o da~e'an~ ~00 ~0pies ~rinted. The Re~rint ordinances resell for $3.00. The Mayor requested the staff to check! the cost against the revenue received for publications. Motion by Councilman Burry approving request of the staff for printing of 400 . copies of the Zoning Ordinance from Dugdale & Erich at a cost of $1035,00; seconded by Councilman Hartman; motion carried and so ordered° (4) Councilman Hartman suggested that the Council make a study of. the feasibility of a municipal golf course in Saratogas as a means of pre- servin~ some of the open areas still available, citing as an exemple the proposed acquisition of 125 acres for a college site. Council- Municipal man Burry expressed doubt that a golf course could be self-supportin~ Golf with the high cost of land unless the land cost was written off. Course Mayor Glennon suggested using the study by the League of California Proposal Cities that appeared in the Western Cities magazine sometime ago regardin~ municipal golf courses as profit making enterprises. The Plannin~ Director said the report is available at the City office, having been used in the parks and recreation study, The staff was instructed to assemble all available data and submit a report at an early date. VII COMMUNICATIONS A. WRITTEN The Clerk presented a letter from the Saratoga Federated Church requesting permission for the young people to extend the live nativity scene in front of Richards Hall on the corner of Oak Place and Saratoga-Los Catos Road from the bottom of the steps leading to Richards Hall to the'curb of the street. Councilman Hartman moved that the request be granted; seconded by Councilman Burry; motion carried unanimously. The Clerk presented communications regarding fluoridation of drinking water from James G. Truman, 20675 Verde Vista Lane, and Mrs. W. Petersen of San Jose, California, to the Council and the Mayor directed that they be filed, there being no comment from the floor.
