REPORT OF BIDS - SARATOGA, COX AVENUE INE1OVENENT The Clerk reported that bids were opened at 3:00 P. li. Jnne 23, 1965 and distributed a S,~mm~ry breakdown of the three bids received for the reconstruction of Saratoga-Cox Avenues and for the storm drain and sanitary sewers. Hr. Henley stated that the underground improvements ware included in the pl~n~ and specifications far the street improvements- and that the total bids were: (1) Leo F. Piazza - 9453,328.40, (2) A, J. Raisch - 9484,631,50 and (3) L, C, Smith - 9473,003.00. The engineerws estimate was 9523,50~.00 and Hr. Henley indicated that the net result of analysis of the bids indicates that if the underground work proposed by Sanitation District ~}4 were removed, the low bidder would be A. J. Raisch but that the net low bid o~ Leo F, Piazza Paving Company 1¢ould be most favorable an the taxpayers in Sanitation District No, 4 and the City would benefit by the Job being done simultaneously and it is also net low to the praperty owners in the combined assessment aistricts, Nr. Henley read a letter from Stephen Goodman, Nauager of Sanltatidn District ~4~ advising the Council that the Board of Directors approved award of the contract to Leo F. Piazza Paving Company and authorized the payment of 94~079.00 from the Districtss funds to the City as the District~s share of the project cost for detour and traffic control, cleanup and clearing, this _~mnunt t~ be in addition to the actual cost of sewer construction, engineering and incidentals. For these reasons, 14r~ Henley ~ontinued~ it is the Staf£ recomm~ndation that the contract be awarded to the net low bidder, Leo F. Piazza Paving Company, for the total project. l~ayor Clennon stated that this report of bids was informational at this time and will be con- sidered later on the ngenda, B. REPORT OF BIDS - LANDSCAPING SARATOGA AVENUE l~r. Hanley reported that three bids ~ere received for landscapin~ Saratoga Avenue and that the Staff and Landscape Architect George l~rtin recormm~ud that the cantract be awarded to the lew bidder, Barbaccias s Nu~.sery and landscapers £or 947,600, for Items 1 through 5 and a unit price of 94.50 per cubic yard £or Item 6. The other bids reported ware Frank Clm~sons Landscape Contractor - 951,900 and Rudolph l~atsons Incorporated - 955,171, with top soil unit prices o~ 94.00 and 95,00 respectively. This item was continned until such as the award of contrac~ for Saratoga-Cox Avenue improvements is considered under Item III-E on the agenda, C. REPORT OF BIDS - SARATOGA AND COX AVENUE STOP~I DRAIN AND SANITARY SE~E CONSTRUCTION This item was included in the report of-bids for Saratoga and Cox Avenues Improvement and x..'ill be considered under Item ZV on the agenda. III SARATOGA AND COX A~NUES IMPROVEMENT A. PUBLIC HEARING Mayor Glennon declared the public hearing re-opened at 6:00 P. M. and announced that this hearing was continued from the June 16, 1965 Council meeting. Mr, John Smith asked if the Staff had had an opportunity to explore the matter of whether or not dedications of property would result in a cost saving to the property owners. Mr. Henley reported that the appraisers, Walter Doyle and Associates contacted as property owners as they were able to reach since the last council meeting and that on the basis of these eontacts it seems teaseDably apparent that unavdm{ty of dedications will not be possible. Mr, Henley also stated that he had checked out with the assessment attorneys office the status of several property owners who are in a situation where dedication on their part may result in an advantage to them and at the same t~me result in reduction to the rest of the assessment district. The bonding attorneys indicated that although there is some legal question regarding such dedications, it is felt that the city would be protected by an agreement to cover a situation where a property owner may be relieved from his 25% share of the property acquisition cost if the net result is to reduce the assessment to the district, The Council and staff discussed this question with Mro Philip Assaf and Mr, Jack Stewart, representing the attorneys and engineers, and the i~terested property owners were informed that the Staff will contact those persons whose property dedications would result in a reductio~ of assessments and that this will be done within the next few days. Interest in dedicating property was also expressed by Dean Ecke of Westhope Presbyterian Church and Dr. Isaac Abr~n~, representing M.V.S. Company, Finally, Mr. Smith volunteered to assist the Staff in obtaining desired dedicat~ons and, there being no one else who wished to speak regarding this matter, it was moved by CoUncilman Tyler, seconded by Councilman Burry and unanimously carried to close the public hearing at 6:17 P. M. RESOLUTIONS PERTAINIiqG TO SARATOGA AND COX AVENUE IMPROVEMENT PROJECT Mr. Assaf advised the Council that the contract can be awarded at this time and a future resolution adopted if dedications are made which would result in redueing the assessment. It was therefore moved by Councilmen Burry, seconded by Councilman I~]ler and unan_~mnusly carried to adopt the following resolutions: B. RESOLUTION NO. 265 - Overruling protests on Resolution of Intention C. RESOLUTION NO. 266 - Ordering reduction of Assessment D. RESOLUTION NO. 267 - Adopting englneer's report, coafirm~ng assessment and ordering work and acquisition E. RESOLUTION NO. 268 - Awarding contract to the low bidders, Leo F. Piazza PayinS Company and Barbaccia's Nursery and Landscapere. F. RESOLFfION NO. 269 - Designating collection officer. SARATOGA AND COX AVENUES STORM DRAIN AND SANITARY SEWERAGE PROJECT A. PUBLIC HEARING Public hearing was re-opened at 6:20 P. M. and there being no one present vfno wished to add to the cormeats recorded at the June 1965 meeting, it was moved by Councilman Bun-y, seconded by Council- man Tyler and unanimously carried to close the public hearing. RESOLUTION NO. 274 - Designating Collection officer. answer to a question from the audiences Mr. Assaf advised that the assessment will become a lien as soon as it is recorded and that this will be done as soon as the question of possible reduction of assess- ments has been resolved~ but in no event later than the July 7 Council meeting. Mayor Glennon invited any interested parties who wished ~o do so to remain after adjournment to discuss possible dedication of property for the Saratoga-Cox Avenues improvement with the Staff and engineer of work.
